Sportico’s Michael McCann explains why it will be the judicial rather than the legislative branch that decides the future of college sports: “It will be judges, who at the federal level have lifetime appointments and who usually resolve debates by applying law to specific questions presented in a case. That means judges won’t abstractly determine if states can prevent the NCAA from enforcing NIL rules. Instead, they’ll consider if the law of one state violates provisions in the state and federal constitutions. How that impacts other states and their laws could spark additional legal controversies. That’s how precedent works: taking one decision spawned by a unique set of facts and arguing the decision and accompanying legal reasoning ought to apply in a particular way to a similar set of facts. Likewise, judges won’t consider if the NCAA’s system of amateurism is illegal under antitrust law. Instead, they’ll attempt to resolve usually confined antitrust disputes, such as whether Power 5 conferences should be able to share broadcast money with players. … How those resolutions ought to impact judges in other state and federal jurisdictions and antitrust challenges to other NCAA rules is what lawyers are paid to figure out. … Law works incrementally. Decisions are subject to appeal, subject to additional appeals. The unhurried pace is even more noticeable in this era of instant news and hot takes.” (link)

The North Carolina System Board of Governors University Governance Committee has approved a policy change that will require all system schools to receive approval from the board and the system president before changing conference affiliation. Specifically, the policy change states that chancellors must give the president “advance notice prior to executing any agreement which would result in the constituent institution’s transfer, removal, or joining of an athletic conference association. The notice to the president shall include for the president’s approval or disapproval a financial plan related to the proposed action." The recommendation must still be approved by the entire 24-member board. (link)

NCAA CMO Brian Hainline led a panel discussion on student-athlete mental health that included JED Foundation CMO Laura Erickson-Schroth; Virginia State AVP for Intercollegiate Athletics Peggy Davis; and Arizona State (DI) Tran Ethnic and Minority Psychology and Experiences Lab Director Alisia (Giac-Thao) Tran. Panelists shared their thoughts on ways to create healthy environments that normalize seeking mental health care, address inclusion and belonging, and foster student-athlete experiences of personal growth, self-acceptance and positive relationships with others, and Tran pointed out that coaches tend to have particularly close relationships with their student-athletes and calls on them to leverage that to monitor for potential signs that players may need help. “I think the message for coaches is that you can be a great starting point, but you don’t have to shoulder it all. … Know that you’re not supposed to be the one-stop shop for this. You’re not supposed to take on all of this burden because mental health is something that we can all help each other with, and so helping them know they can be a starting point and feel confident to do some of the things that you're doing but then be attuned to some of those things…and then using the systems that are in place” to ensure the student-athlete receives the help they need.
