The DIII Football semifinals and semifinals and championship for Men’s and Women’s Basketball and Women’s Volleyball will be broadcast on ESPN+ as part of the NCAA’s new ESPN media deal, with the FB championship to remain on ESPNU. The new deal will bring an estimated $1.2M per year to the division, with the DIII Presidents and Management Councils approving annual production costs between $270K and $495K to broadcast these events. Sportico’s Michael McCann explains why it will be the judicial rather than the legislative branch that decides the future of college sports: “It will be judges, who at the federal level have lifetime appointments and who usually resolve debates by applying law to specific questions presented in a case. That means judges won’t abstractly determine if states can prevent the NCAA from enforcing NIL rules. Instead, they’ll consider if the law of one state violates provisions in the state and federal constitutions. How that impacts other states and their laws could spark additional legal controversies. That’s how precedent works: taking one decision spawned by a unique set of facts and arguing the decision and accompanying legal reasoning ought to apply in a particular way to a similar set of facts. Likewise, judges won’t consider if the NCAA’s system of amateurism is illegal under antitrust law. Instead, they’ll attempt to resolve usually confined antitrust disputes, such as whether Power 5 conferences should be able to share broadcast money with players. … How those resolutions ought to impact judges in other state and federal jurisdictions and antitrust challenges to other NCAA rules is what lawyers are paid to figure out. … Law works incrementally. Decisions are subject to appeal, subject to additional appeals. The unhurried pace is even more noticeable in this era of instant news and hot takes.” (link)

During the NCAA Convention, NCAA Managing Director of Enterprise Risk Management Clint Hangebrauck moderated a session on sports gambling that featured Teresa Fiore, vice president of partnerships at EPIC Global Solutions, which the NCAA partnered with to provide member schools a free sports gambling harm prevention program; Dr. Timothy W. Fong, professor of psychiatry at UCLA (DI) and co-director of the UCLA Gambling Studies Program; Jonathan Hirshler, co-founder and chief executive officer of Signify Group; and Mark Hicks, managing director of enforcement at the NCAA. During the conversation, Hicks explained that over the past two years “our violation numbers have doubled. And I’ll caution you, it’s not a huge number relevant to other bylaws like recruiting and things like that, but it has doubled. … One little stat here is that every undergraduate student has come to age during a time of legalized sports betting, which is completely different than any of us.” Hicks observes there’s “this great divide between people who have grown up coming to age at a time where sports betting is generally legal and the rest of us where it was sports betting that was going through a bookie. In addition to regulatory bodies, integrity services and on-campus compliance observation, Hicks believes the “number one change is the sports books or the operators themselves are policing the space. … We're actually getting – because they're obligated in their state law – reports to us about activities that involve student athletes and staff athletic staff members.” Full session. According to a meta-analysis conducted by researchers from Buffalo (DI), one in 10 college students is a pathological gambler, far higher than the 2-5% of the U.S. general population estimated to have a gambling problem, according to Time’s Oliver Staley, who adds: “Other studies place the number of student gambling addicts lower, but still higher than the overall population of pathological gamblers.” Staley points out the behavior on college campuses isn’t limited to sports betting and also includes ETF trading, cryptocurrency trading and other forms of gambling. The common denominator among all these behaviors are mobile phones. Psychiatrist James Sherer: “You don’t have to go to a casino, you don’t have to go to a bank, you don’t need to carve time out of your schedule, you can do it at work, you can do it in the middle of the night.” Meanwhile, TV ad spends for gambling sites have increased from $197M for all of 2021 to $305M through November of this 2023 and Sherer notes: “Because of the way advertising works these days, even if you are trying to avoid it, you are going to be served up more options and opportunities to re-engage in that behavior than if you were someone who never engaged in that behavior in the first place.” (link)
