Florida State administrators spoke with both Sixth Street and Arctos Partners during much of the first half of 2023 about the possibility of providing private equity money to help fund the FSU athletic department, per Sportico’s Eben Novy-Williams and Daniel Libit, who explain the talks, which were internally nicknamed “Project Osceola,” focused on the creation of a “NewCo to house commercial rights from the school’s athletic department. That entity could then take on outside capital. This structure has become common for PE investments in sports, including…CVC’s financing of LaLiga.” According to documents obtained by Novy-Williams and Libit, initial discussions between JPMorgan and FSU date back to at least the summer of 2022, while Sixth Street – which is still reportedly in active discussions with FSU – joined the talks in February 2023. The heavily redacted documents also indicate Arctos – which is reportedly no longer in talks with the Seminoles – floated an initial investment amount of $75M. A financial model dated August 2023 projected significant increases in the Seminoles’ revenue in the coming years, including a conference distribution uptick from $44.3M in 2023 to $84.5M in 2027, owing to an anticipated “bump” in payouts from the College Football Playoff. The school projected those conference distribution figures reaching $187.7M by 2043. According to yet another document, FSU was “exploring various 3rd party [multimedia rights] relationships” and “running (a) bid process in September of 2023” with the expectation it would “make new partner selection mid-October [2023].” However, the school has not indicated publicly that it has or wants to make changes to its arrangement with LEARFIELD. The Mountain West announces its new five-year strategic plan: Ascend Together: Our Path to Excellence, which establishes the league’s core principles of Competitive Excellence, Academic Achievement, Integrity, Relentless Drive, and Community and Inclusion. The plan’s strategic priorities include helping institutions provide holistic support to student-athletes; positioning the league through success, innovation and brand enhancement; enhancing revenue generation; energizing and engaging MWC institutions; maximizing the effectiveness of conference operations. (link); Full plan. (link); Fox Sports’ Bryan Fischer points out the new plan also includes the following two goals: “Develop a comprehensive plan to ensure multiple Conference teams are competing for annual berths in the College Football Playoff. Embrace and evaluate all opportunities regarding membership composition in order to maintain and enhance conference competitiveness.” (link)

The Latest from Rocky Top…
+ The Tennessee-focused Spyre Sports Group’s involvement with the recruitment of Vols QB Nico Iamaleava is reportedly part, if not the focus, of the NCAA’s investigation into UT. According to the New York Times’ Michael Schmidt, David Fahrenthold and Billy Witz, the “inquiry is looking at, among other things, the group’s role in flying a [Iamaleava] to campus on a private jet while the football team was wooing him.” (link)
+ Attorney Tom Mars represents Spyre and released a statement on the group’s behalf which reads, in part: “In early 2022, independent of the University of Tennessee or anyone associated with its athletics program, Spyre Sports entered into a mutually beneficial contractual relationship with Nico Iamaleava that involved a limited assignment of his NIL rights, no matter which school he chose to attend. Such 'representation agreements' have become increasingly common. The parties agreed that their contractual rights and obligations would be governed by California law, which freely allows prospective college athletes to enter into such agreements. … The agreement required Spyre to protect the value of Nico’s NIL rights and specifically stated that ‘nothing in the agreement constitutes any form of inducement to ATHLETE to enroll at any school and/or join any athletic team. In short, the agreement was fully consistent with then existing NCAA NIL 'guidelines' and had nothing to do with recruiting Nico to the University of Tennessee or any other school.” (link)
+ The Athletic’s Joe Rexrode reports the matter is being taken “very seriously” at UT, where Chancellor Donde Plowman and AD Danny White’s multiple requests to meet with NCAA President Charlie Baker were “rejected after the first was ignored and the second was met with an offer to meet with [NCAA EVP of Regulatory Affairs] Stan Wilcox. A Dec. 21 UT response asked to ‘let us know if (Baker) changes his mind in the new year,’ and a UT spokesman confirmed the NCAA did not come back with a written response.” (link)
+ On3’s Andy Staples wonders whether the NCAA has engaged in a conflict it can’t win and submits that if the “enforcement department — which understandably must justify its own existence lest the paychecks someday stop — thinks cracking down on what has now become standard procedure will somehow turn back the clock to a time when NCAA rules went unchallenged, it is making a grave and possibly fatal mistake.” Plowman will have no shortage of “weapons at her disposal,” Staples continues, including lawmakers like Congressman Tim Burchett (R-TN) who are already chiming in. “There is no act more bipartisan as an elected official in the Volunteer state than supporting the Big Orange against the NCAA. That particular activity has an approval rate between 95 and 100%. … What makes this even more absurd is that Baker himself has suggested changing the rules in a way that allows schools to have far more latitude and control when it comes to NIL. Under his own plan, NIL would move in-house at schools.” Lots more from Staples. (link)

Michigan finished FY23 with a $4M budget surplus on $229M in revenue and $225M in expenses. U-M's total revenue increased by $18.9M YoY, more than half of which came from an increase in ticket sales from $55.2M to $65.1M. Football ticket sales alone accounted for nearly $57M. The next largest three revenue streams for the department came from media rights contracts ($47.87M) which does include the portion from the Big Ten, contributions ($42.69M) and royalties, licensing and sponsorships ($33M). Expenses, meanwhile, jumped by $32M YoY. Support staff and administrative compensation was the most significant expense ($41.75M), followed by coaching compensation ($39.4M), and athletic student aid ($32.5M). Also notable: team travel costs increased by $5.4M to $16.5M. (link)

Stanford Women’s Basketball HC Tara VanDerveer tells the Arizona Daily Star’s Michael Lev the dissolution of the Pac-12 is “heartbreaking” and adds: “We love coming and playing (at) Arizona, Arizona State. I hope we can play them without it being a conference game — or maybe someday some smart people will get together and we'll be back in the conference together. … How did we ever get in the place we're in right now? It makes no sense. We have a great league, and it was destroyed by, I think, greed. Obviously, we know money's important to athletics because it's so expensive. But it seems like there should have been better vision and better leadership to not to get where we are.” As far as making the jump to the ACC, VanDerveer says it’s “not ideal,” but she’s excited about the competition. Travel is one component that gives her pause, and she notes the ACC will use a travel-partner system. Lev explains that “Stanford and Cal will each get a two-for-one when they go east. Stanford will strive to schedule its nonconference games on the West Coast — which could mean, for better or worse, that the Cardinal will be appearing at [Arizona’s] McKale [Memorial Center] again in the near future.” (link)

Construction on Georgia’s new outdoor track and field facility is slated to begin this summer, Bulldogs AD Josh Brooks told the UGA Athletic Association board’s facilities and development committee last week. As far as funding, Brooks noted: “We’re close but we want to refine that number before we come to the board for that funding request. I can tell you the fundraising’s already going very well for it so, as with most of our projects, we’re trying to stay ahead and fundraise well before we break ground.” Brooks also indicated the second phase of Sanford Stadium’s $68.5M renovations is on track to be completed by the 2024 season. Additionally, the new $26.7M six-court, indoor tennis facility is a few weeks from being completed, the $38.5M softball facility upgrade beyond left field will be completed as early as September, and the second phase of the $45M project at Foley Field will begin after the 2024 season. Eastern Kentucky AD Matt Roan’s contract extension, which he signed in October, is worth $215K per year. EKU will also pay Roan $4,300 each August 1, and he will earn $10K for each regular season or postseason conference championship or postseason competition across all 16 sports. Additionally, Roan will be awarded a bonus for each postseason win ($10K for men’s basketball, $5K for all others). For sports such as cross country, track and field and golf, a win is considered advancing past regionals of the national postseason. Roan is eligible for additional bonuses ranging from $5K to $20K for winning NCAA championships, as well as a $15K bonus for a department APR of 940 or higher. On top of that, Roan has the potential to receive up to a $50K bonus each fiscal year at “the sole and absolute discretion” of EKU President David McFaddin. Full breakdown from the Lexington Herald-Leader’s Cameron Drummond. (link)

Tennessee is being investigated by the NCAA in a case that involves “multiple sports and includes scrutiny of NIL benefits for athletes,” according to Sports Illustrated’s Pat Forde, who adds: “Details are scarce on what Tennessee is potentially facing in the latest case, including the number of involved sports. The school acknowledged the investigation to SI, but declined further comment, other than to say it has not received a notice of allegations from NCAA Enforcement.” The NCAA also declined to comment, telling Forde: “With rare exceptions, the NCAA does not comment on current, pending or potential investigations due to confidentiality rules put in place by member schools.” Forde also reports that a “source familiar with the inquiry tells SI that Tennessee does not believe it has committed any violations in the NIL realm. The source cited NCAA guidance in that evolving area as ‘vague and contradictory.’” (link)

Tennessee Chancellor Donde Plowman accused the NCAA of being “morally wrong” for alleging UT engaged in impermissible NIL activities in an email sent to NCAA President Charlie Baker. The email, obtained by the Knoxville News Sentinel’s Adam Sparks, reads: “The implications of the NCAA enforcement staff’s approach to date goes beyond just our institution, but also could harm many more student-athletes who have done nothing wrong – all based on the administrative disputes of adults. This is morally wrong and undermines the credibility of the NCAA’s stated interest of acting in the best interest of student-athletes.” UT officials met with members of the NCAA enforcement staff on Monday to discuss allegations the NCAA intends to bring against the university, though Plowman denied that any violations occurred. “We appreciate your staff listening to our arguments and agreeing to evaluate them. The NCAA’s allegations are factually untrue and procedurally flawed. Moreover, it is intellectually dishonest for the NCAA enforcement staff to pursue infractions cases as if student-athletes have no NIL rights.” Plowman went on to cite what the NCAA called UT’s “exemplary cooperation” in previous dealings with the Vols’ most recent NCAA investigation. “We spent more than $1M on outside counsel to investigate previous problems discovered in our football program that were reported to me, personally, and self-reported the entire case to the NCAA. … It is inconceivable that our institution’s leadership would be cited as an example of exemplary leadership in July 2023, then as a cautionary example of a lack of institutional control only six months later.” More from Plowman. JohnCanzano.com’s namesake predicts how Washington State and Oregon State’s future will play out: “They’ll slow play this and wait to see what happens at Florida State and with Charlie Baker’s NCAA proposal. Also, they’ll wait to see if any of the departing 10 members have buyer’s remorse in their new conferences and want to come back. It’s possible that an ACC implosion could cause a domino effect in the market that helps OSU and WSU. I don’t think the Beavers and Cougars ideally want to accept a simple relegation to the Mountain West Conference. They say they’d like to continue to fund their programs as a ‘Power 5’ school and operate above the G5 level. If you take on too many G5’s, you become one, don’t you?” (link)

Kansas will play two football games at Children’s Mercy Park, home of Sporting Kansas City, and four games at Arrowhead Stadium next season as construction continues on the Gateway District and Booth Memorial Stadium projects. The venues, both located in the KC metro, are situated 30 minutes and 49 minutes from campus, respectively. Jayhawks AD Travis Goff: "While we are disappointed we can’t play in Lawrence, ultimately, we want to create the best possible experience for all involved, and playing two games at Children’s Mercy Park and four games at GEHA Field at Arrowhead Stadium allows us to do that. It has been a thrill to see construction begin in earnest in Lawrence on the Gateway District and David Booth Kansas Memorial Stadium, and this decision allows that construction to continue on a necessary timeline while also benefiting the overall budget of the project and the 2024 fan experience." Cincinnati’s FY23 revenue increased by 4% to $87M while the Bearcats’ operating expenses increased by 21% to $91.9M. Direct institutional support of $35.6M contributed significantly to the revenue and marked an $11M YoY increase. Absent that direct support from the university, UC athletics’ revenue declined 13% to $51.4M. (link)

More NIL Today…
+ Extra Points’ Matt Brown reviews IRS 990 documents for over 40 NIL collectives and notes that “for the first time, these financial filings provide large-scale, publicly available and, most notably, presumably verifiable fundraising totals for athlete payrolls across the country. They also reignite the questions about whether 501(c)(3) public charities – or which ones – that were created to pay college athletes comply with federal tax law.” Clemson professor Kathryn Kisska-Schulze tells Brown: “I think the critical point in all this is what are they doing with the revenue? Not so much that they’re making the revenue, but where is this revenue going? When I look back at the IRS’s memorandum, I think the IRS was also questioning where is this money going? Is it going to charitable programs or are you bringing in this money to give it right back to student-athletes? And I think that sort of draws that question of whether this is really money going for private interest rather than public interest.” As far as where the money is coming from, Brown notes the “Florida Achievement Support Trust reported that $2.5M, or almost 81%, of its $3.1M in contributions came from large donors who each contributed more than 2% of the total. $580,180 came from the so-called public support. $1.6M of the Washington collective Montlake Futures’ $2M in total support, or 80%, was from large donors. $4.4M of Friends of the University of Notre Dame’s $7.7M in revenue, or 57%, came from large donors with the other $3.2M classified as public support. The Indiana collective Hoosiers for Good reported that nearly $2.3M, or roughly 59%, of its nearly $3.9M in total support came from large donors. $1.6M, or 41%, came from public support.” Lots more. Rice will reinstate its women’s diving team as a varsity sport beginning with the 2024-25 season. Owls AD Tommy McClelland: “When we look at our swimming program, we see an excellent program competing at the highest levels in swim. But in some ways, there’s been a barrier towards championships because it didn’t have the full allotment of how the sport is counted. As we go into competition now, we’ll be able to have those diving points, which will give us the best opportunity to win championships for a program that is already a championship-caliber one.” (link)

HBCU Sports’ Chris Stevens contends the tumultuous football coaching searches at Texas Southern and Florida A&M demonstrate how much undue influence outside forces have at several HBCUs. “While HBCU alumni, booster groups and fans have always had an opinion on sports, the recent shenanigans at Texas Southern and FAMU set a dangerous precedent regarding undermining the authority of people entrusted to make decisions of a college institution’s athletic program. … As Bethune-Cookman athletic director and men’s hoops coach Reggie Theus told HBCU Sports senior editor Kendrick Marshall weeks ago, the hiring and firing decisions are the AD’s weight to bear alone. No one else faces any questions or second-guessing about bringing in a coach who might be a poor fit or letting go of a coach who shines elsewhere. Playing armchair administrator is easy when you don’t have to make any decisions other than how much hell you’ll raise if you don’t get your way. If Black College sports are to continue trending upward, then trusting in the people hired to oversee athletic programs and departments is a must. The more people you chase off, the more unstable these programs become, and you’re back to square one.” (link)

Illinois State has closed its investigation into whether a fan or fans directed racial slurs toward Norfolk State men’s basketball student-athlete Jamarii Thomas last month. The investigation included a review of all available video and audio recordings, along with the lead official’s game report, game operations plan, and seating diagrams; the identification of more than 50 individuals in the general vicinity of the alleged incident or associated with game operations, including: game officials, media, Norfolk State student-athletes, ISU student-athletes, ISU staff and spectators; and statements from over 47 individuals, with only Norfolk State declining to participate. From Illinois State: “While the investigation did not verify the use of a racial slur, Illinois State remains committed to promoting an open and inclusive campus community where all people feel welcomed, valued, and respected. It is our goal as a university to move forward with a renewed effort to promote and encourage practices on our campus that help us demonstrate that commitment, including those outlined in Illinois State’s Event Code of Conduct, the Athletics Code of Sportsmanship, and the Missouri Valley Conference Sportsmanship Standards of Conduct." Norfolk State officials also released a statement, which reads, in part: “Norfolk State University stands firmly against racism and discrimination in any form. We are fully committed to fostering an environment where all individuals, regardless of their background, feel valued, respected, and included. The external investigation into this matter was very important, and we are appreciative of the efforts made by Illinois State University.” (link)

The Big Ten Men’s and Women’s Basketball Tournament fields will officially expand from 14 teams to 15 beginning next season, a “format that maintains the five-day schedule of the event, provides access to all teams in contention for postseason invitations, and will maintain a double bye for each of the top four seeds while seeds 5-9 will receive a single bye.” Meanwhile, the men’s and women’s conference schedules will remain at 20 and 18 contests, respectively, allowing for “non-conference scheduling flexibility, is consistent with peer schedule formats and maximizes opportunities for NCAA postseason berths.” (link)

+ UNC Wilmington will refurbish the playing surface, dugouts and outfield wall at Brooks Field, home of the Seahawks’ baseball team. The upgrades will take place after the 2024 season and be completed in time for the start of the 2025 campaign. Designs were done by CHA Consulting. (link)
+ Maine has inflated the new Mahaney Dome nearly a year after the facility’s bubble collapsed under the weight of snow and ice. More work needs to be done before teams can begin utilizing the facility, on which Black Bears AD Jude Killy says the department will spend up to $3M. He adds: “They are doing a lot of the interior stuff now. Everything is new. They are working on the lighting, the heating, the insulation. All those things are new. It’s all modern technology. And they have to paint the field.” (link)
