The Arizona Daily Star’s Michael Lev contends that outgoing Arizona AD Dave Heeke may not be the best fit for what the job currently requires. “The AD job, nowadays, requires an elite businessman. That’s what college sports has become — a big business. A cutthroat business. A kill-or-be-killed business. [...] In just the last few years, NIL and the transfer portal have transformed major college sports. Coaches’ agents — who negotiate contracts for a living — are running the show and running circles around athletic directors. It’s entirely possible — likely even — that NIL collectives will be brought in-house in the near future. When you combine that with NCAA president Charlie Baker’s proposal to create a new subdivision — and to have those richly resourced institutions place, at a minimum, $30,000 per athlete into a trust fund — you’re no longer looking for a traditional AD. You’re looking for a CFO.” More. (link)

After finishing FY23 with an $817K budget deficit, Florida A&M AD Tiffani-Dawn Sykes has presented the FAMU Board of Trustees with a five-step action plan to close the gap and potentially finish FY24 with a balanced budget or a small surplus. The Rattlers in FY23 generated $11.9M in revenue with $12.8M in expenses. FAMU’s largest expenses were operating expenses ($4.8M), salaries ($4M) and scholarships ($2.5M), while student fees ($4.2M) are the department’s biggest source of income. For FY24, Sykes says the department will focus efforts to “realize and book earned revenues” as well as implement the “BOG-allowed out-of-state Student Athlete Fee waivers. This process is expected to realize at least an additional $660K. This will reduce the anticipated scholarship expenses.” Additionally, Sykes notes FAMU has met its obligation of paying $75K for NCAA penalties and identified $900K in funds that can be used to buy down athletic scholarship expenses. Here’s a particularly notable item from the The DI Legislative Committee’s meeting earlier this month given the recent events in Knoxville: The committee “reviewed an NIL interpretative appeal remanded by the NCAA Division I Board of Directors Administrative Committee. The Legislative Committee agreed that the institution’s actions constituted a violation of the legislation, policy and guidance; however, the legislation, policy and guidance were not clear enough that the institution should be held accountable for its actions in this case. The Legislative Committee directed NCAA staff to update the existing guidance regarding institutional involvement in NIL activities to specify the additional types of institutional support that were found to be impermissible under the NIL interim policy, with an effective date tied to publication of the update. Specifically, the guidance will be updated to specify that an institution (or staff member) may not schedule or lead a meeting with student-athletes to discuss terms of a proposed NIL agreement and an institution (or staff member) may not provide proposed agreements to student-athletes or return signed agreements to an NIL entity.” (link - note this link was live yesterday but appears to no longer be active as of publication this morning)

Indiana-based real estate investor and youth baseball coach Bert Neff has been charged with destroying evidence, tampering with witnesses and providing false statements to the FBI in the case involving “suspicious wagering activity” during an Alabama–LSU baseball game last spring. Prosecutors allege Neff received a message from an individual employed by the “baseball team of a public university in Alabama” — identified as Individual-1 — informing Neff that the school’s starting pitcher was injured and unable to pitch that day. Neff then allegedly sent that information to other bettors. Those bettors, dubbed Gambler-1, Gambler-2, Gambler-3 and Gambler-4, all wagered on the April 28, 2023, game, according to court documents. Rutgers Deputy AD/SWA Kate Hickey and Stanford Deputy AD Jacquelyn Kulgevich join AthleticDirectorU’s Steph Garcia Cichosz to dive into the topics of ambition and identity for senior athletics leaders. Hickey and Kulgevich reflect on their earliest days in the industry, serving the Southern Conference and Omaha, respectively, and the subsequent journey that led them to the Deputy AD role. Kulgevich acknowledges she did not handle critical feedback well early in her career, but now “I probably annoyingly say to everyone I work with feedback is a gift. … Now I recognize that actually by getting that feedback I get to get better, and it is a gift, it's an honesty, and…when I get that feedback, [I] just say thank you that's really the extent of it. And I can take time to determine with that feedback does it align with my values.” Hickey discusses the challenge of innovating and aligning with new ADs during a long stop at a single institution and says: “I’ve had four athletic directors in my time at Rutgers, and each one of them has operated in very different ways, which helps her see “what does [current AD] Pat [Hobbs] want out of each and every one of our sports. Arizona State sports historian Victoria Jackson in a guest column for Sportico lays out how nearly every college sport except football is increasingly integrated into global sports. For example, Jackson points out that “across the 64 teams of the 2022 NCAA DI women’s soccer tournament, 236 international athletes from 35 countries participated; 52 teams had at least one international player; and seven teams had 10 or more. … Soccer and other Olympic sports have value on college campuses, monetary and otherwise, and among their greatest strengths is this global integration. The United States, after generations of sporting isolationism, is coming around to embrace global sport, namely, soccer, in the 21st century.” Meanwhile, Jackson argues that a “lack of global integration and competition has allowed college football to develop its sub-optimal, harmful practices, spurring the current debates around athlete rights and employment. I do wonder what global soccer coming to America will mean for college football labor relations in the coming years. … It is exceptionally rare that a sport has a single development pathway and a single-country player pool, and that is where our football players find themselves – without leagues forced to adopt and maintain good practices due to competition with others in the industry.” Jackson goes on to observe that “American higher education did not actively choose to run a professional football industry or the world’s best U-23 sports development system. But here we are, and we hold a responsibility to make sure each of these industries is guided by policies that place serving their respective athletes at the heart of their missions. Adidas finished 2023 with an operating profit of €268M, down from €669M in 2022; however, the company says the result outpaced its own guidance of a €100M operating loss. On an underlying basis, operating profit came in at roughly €200M in 2023, also above guidance of around €100M. ($1 = 0.9220 euros) The company also announced that, despite previously considering writing off $325M in unsold Yeezy inventory, it won’t do so and instead plans to sell the remaining shoes “at least” at the cost it paid for them. CEO Bjørn Gulden: “Our consumer, retail and trade research has shown that we can sell this remaining inventory in 2024 for at least the cost price. This is why we have only written off inventory that was either damaged or very broken in sizes.” (link)

The Federal Reserve held its benchmark federal-funds rate steady in a range between 5.25% and 5.5%, the highest level in more than two decades, as it awaits more convincing evidence that a sharp downturn in inflation at the end of last year will continue. Fed Chair Jerome Powell: “It’s a highly consequential decision to start the process” of lowering interest rates “and we want to get that right. We’ve made a lot of progress on inflation. We just want to make sure that we do get the job done in a sustainable way.” (link)

+ The attorneys general from Tennessee and Virginia have filed a federal antitrust lawsuit against the NCAA, alleging that the association has violated antitrust laws by denying athletes their ability to earn full compensation for their names, images and likenesses. CBS’ Dennis Dodd reports that “the plaintiffs…may, in a matter of days, seek a temporary injunction that could suspend the NCAA's NIL rules and limitations. …Considering what's at stake, this latest lawsuit could result in a possible ‘epic legal firefight with the NCAA,’ a source familiar with Tuesday's filing told CBS Sports.” (link)

+ From the complaint: “The NCAA is thumbing its nose at the law. After allowing NIL licensing to emerge nationwide, the NCAA is trying to stop that market from functioning. This month, it announced new proposals related to ‘student-athlete protections in NIL.’ These ‘protections’ allow current athletes to pursue NIL compensation. But it bans prospective college athletes (including current college athletes looking to transfer to another school who are in the “transfer portal”) from discussing potential NIL opportunities before they actually enroll. It’s like a coach looking for a new job, and freely talking to many different schools, but being unable to negotiate salary until after he’s picked one (the depressive effect on coaches’ wages in such a dysfunctional market is obvious).” Full complaint. + The NCAA has released a statement regarding its investigation into Tennessee: “While the NCAA generally does not comment on specific infractions cases, it is important to remember that NCAA member schools and conferences not only make the rules but routinely call for greater enforcement of those rules and holding violators accountable. … This legal action would exacerbate what our members themselves have frequently described as a ‘wild west’ atmosphere, further tilting competitive imbalance among schools in neighboring states, and diminishing protections for student-athletes from potential exploitation. The NCAA remains firmly committed to protecting and expanding student-athletes’ NIL rights and opportunities. However, our membership has steadfastly supported the prohibition on impermissible recruiting contacts, booster involvement in recruiting prospects and the use of NIL offers as recruiting inducements.” (link)
+ Sportico’s Michael McCann and Daniel Libit boil down the NCAA’s current predicament to its most basic form, noting the “antitrust problem for the NCAA is that its rules restricting economic opportunities for athletes are formed through NCAA member schools and conferences. Members are competing businesses, such as when they compete for students, faculty and grants. Under antitrust law, competing businesses are forbidden from conspiring in ways that, on balance, harm economic competition—including, at least in some ways, the competition for college athletes. The NCAA and members engage in a form of ‘horizontal price fixing’ by not allowing athletes, who under NCAA rules can only be paid by schools up to the grant-in-aid, from obtaining their market value.” However, in the most recent suit brought the AGs of Tennessee and Virginia, McCann and Libit note the NCAA is “armed with a bevy of legal defenses,” including this: “The NCAA might portray the plaintiffs as proxies for influential state universities—specifically the University of Tennessee—and stress the high deference courts historically accord membership organizations when a member challenges application of a rule. NCAA rules prohibiting pay-for-play are not unilaterally imposed by the NCAA—they are formed through member institutions’ proposals, discussions and voting. As a member institution, UT and other NCAA colleges in Tennessee and Virginia contractually assent to follow those rules and accept the NCAA’s enforcement of them.” More analysis. (link)
+ On3’s Eric Prisbell observes that there are several “absurdities” regarding the NCAA’s targeting of Tennessee over NIL violations ranging from the fact that “the alleged transgressions are petty” to the fact that the “NCAA is attempting this NIL crackdown at the same time it is actively trying to fast-track legislation that would allow schools themselves to enter into NIL deals with athletes.” Perhaps most importantly, however, Prisbell submits that the NCAA is “choosing to make enemies with the very schools it most needs to placate. … College sports is on fire right now – set ablaze not because athletes can finally monetize their brands but because the current system is unsustainable, antiquated, and, increasingly in the eyes of the courts, in violation of antitrust law.” One conference commissioner tells Prisbell: “I keep saying that the next 18 months or so will determine whether the NCAA will exist as we know it moving forward.” Rather than evolve its model, Prisbell points out the NCAA is becoming increasingly reliant on Congress to toss it a lifeline that looks less and less likely to be thrown. He adds: “Keep picking fights with the Power Four schools over murky, contradictory NIL guidelines and they’ll gather their belongings and break away from the NCAA. Whispers along those lines are only getting louder.” (link)
+ This “feels like the big one,” according to On3’s Andy Staples, who observes that up to this point, “cases brought into federal court have skated around the margins of paying players in college sports.” The case brought by the AGs of Tennessee and Virginia, however, is “far more direct,” as “essentially, it asks the court to end the fantasy. NCAA leaders want a world where highly sought-after recruits, be they coming out of high school or in the transfer portal, don’t consider how much they’ll be compensated before they choose a school. That world doesn’t exist. That world has never existed. … This day was coming the moment the Supreme Court ruled 9-0 in Alston v. NCAA in 2021. Guess who was on the business end of that shutout? The majority opinion in that case made clear that any more NCAA price fixing rules that came before the court would be in extreme danger of being declared illegal.” Furthermore, Staples points out this isn’t just about the Vols. “If the NCAA can get Tennessee for Iamaleava, then it can get pretty much every school in a power conference. Why NCAA leaders assumed the schools would simply accept that possibility — even though they haven’t been given the usual opportunities to shape the rules as members of the organization — is mystifying. This wave of enforcement includes other cases that haven’t surfaced in the news yet. Every school is at risk. So of course the schools are going to act to nullify the risk as quickly as possible. They’ve chosen something close to a nuclear option.” (link)

More from Arizona President Robbins and Interim CFO John Arnold on the university’s plan to address its financial situation. Arnold noted that certain departments will be centralized by early March: business and finance, facilities management, human resources, information technology, marketing and communications, and the university advancement office. He also said that UA will seek to reduce administrative costs by reviewing positions across leadership, including “every single vice presidential position,” among others, “to see if we need those positions moving forward.” Arnold also asserted the current troubles are due to a confluence of factors, saying: “This is not an athletics problem” or “a problem in the president’s office.” Also from Arnold: “Some of the information the university put out—really from June forward—was incorrect. And it’s taken us a while to get our hands around the nature and depth of the problem. And I completely understand why the governor, the public and the on-campus community [have] been frustrated by those inaccuracies and those delays.” (link)

William & Mary has received a $2.3M gift from alumnus Rick Platt to support a total renovation of the men’s and women’s track & field and cross country locker rooms in Zable Stadium. Tribe AD Brian Mann: “His gift gave us some much-needed momentum as we neared the close of the All In campaign and it is a game-changer for our cross country and track programs. When the new locker rooms are finished, it will signal that our program has taken a huge step forward.” The project is expected to cost $3M in total. (link)

The Iowa Department of Public Safety has issued a statement indicating that it believes the evidence collected in its sports wagering investigation involving Iowa and Iowa State was “obtained in a constitutionally permissible manner,” as “Iowa Code section 99F.7A requires sports wagering licensees to ‘employ reasonable steps to prohibit coaches, athletic trainers, officials, players, or other individuals who participate in an authorized sporting event that is the subject of sports wagering, from sports wagering.’” The department also notes that “prior to using the [software] tools provided, the Department of Public Safety conferred with legal counsel to ensure lawful access to and use of the technology. Two county attorney offices also reviewed all relevant investigative information before making the ultimate decision to file charges. … Ultimately it is up to the courts to decide. We want to reassure Iowans that the Department always strives to scrupulously uphold the laws and constitutions of the United States and the State of Iowa.” (link)

+ College Sports Communicators and SIDEARM Sports have agreed to a three-year partnership extension through 2026. (link)

+ The PGA Tour has officially signed a $3B investment agreement with Strategic Sports Group, which includes Boston Red Sox/Liverpool FC owner John Henry, New York Mets owner Steve Cohen, Atlanta Falcons owner Arthur Blank, Chicago Cubs owner Tom Ricketts, RedBird Capital Partners Founder Gerry Cardinale and several other pro team owners. According to Bloomberg, the deal, which includes $1.5B upfront and values PGA Tour Enterprises at $12B. As part of the agreement, nearly 200 PGA Tour members will have the opportunity to become equity holders in the new company, with the potential for future players to be included. The PGA Tour also says talks have progressed with the Saudis and that Strategic Sports Group has consented to a future investment from Saudi Public Investment Fund. (link)
+ The Messenger is ceasing operations less than a year after it launched. The shutdown is effective immediately, and the New York Times’ Benjamin Mullin writes: “By closing less than a year after it launched, The Messenger will now be one of the biggest busts in the annals of online news. And its collapse is the most substantial blow in recent months to the news industry, which is reeling from an unrelenting series of cutbacks.” Despite a stated goal of bringing in $50M in its first year, Mullin notes that “near the end of last year, the company had generated only $3 million and had just $1.8M in cash on hand. The Messenger lost about $38M — the majority of its initial $50M funding round — and was spending more than $8M on offices in Florida, Washington, D.C., and New York.” (link)

In addition to improved locker rooms for football, women’s lacrosse, and women’s soccer, Delaware State is setting the table for several more facilities upgrades, including a football field house that will house an indoor practice facility and athletic administration offices. HBCU Sports’ Chris Stevens notes that a new grandstand for Alumni Stadium, “which has remained largely unchanged since its opening in 1957, is also on the agenda,” while other facilities could be added to the plan in the near future. President Tony Allen: “We have to have great football and basketball teams and facilities – full stop. We can’t have parents coming to our campus, coming to our locker rooms, and thinking it’s Dover High School.” Hornets AD Alecia Shields-Gadson adds: “We have to get better on the field. That takes time and commitment. We are striving to provide our student-athletes with the opportunities to be the best that they can be. We can’t do that if we don’t have the facilities to accommodate that.” So far, the school has raised $10M to support facilities upgrades. (link)

Jared Wangler, founder of Valiant Management Group, which operates the Michigan-focused Champions Circle collective, talks with On3’s Andrew Graham about the importance of retaining football upperclassmen through NIL. Last year, the group launched the One More Year Fund, which helped retain players like Blake Corum and Zak Zinter, who led the Wolverines to the national championship. This year, the goal remains the same: keep Michigan’s best players at Michigan. To do so, the collective has launched the Those Who Stay campaign, and Wangler notes: “If you look at Zak Zinter and Trevor Keegan and their production this past year, it was like having four- or five-star recruits come in, right? And out of those four or five stars, 50% of them hit and you might have spent $2M trying to go get four- or five-star offensive linemen. And in this case, it’s like, ‘No, maintain these guys. Invest in your current guys. Because not only do they have the talent, but they also understand the culture and understand the program.” So far, the campaign, along with U-M’s decision to promote OC Sherrone Moore to HC, has helped the team retain key players like RB Donovan Edwards, CB Will Johnson and DT Mason Graham. The ultimate goal is to raise $1M through the campaign. (link)

The Washington Post’s Jesse Dougherty profiles Campus Ink’s growth, and CEO Steven Farag explains the process of pitching former Dallas Mavericks owner Mark Cuban on investing. Farag explained how the company would vertically integrate, mainly with in-house shipping and printing, which would allow them to disrupt the market with their athlete-friendly revenue sharing model. Every NIL sale, Farag and co-owner Jedd Swisher noted, would include a cut for athletes, even with something like a championship shirt without a specific player’s name or number, for which Campus Ink often partners with collectives. They had shown via a partnership with Illinois that their model would work at scale. Farag: “[Cuban’s] first response was: ‘Why are you emailing me? To brag?’ I just forgot to say: ‘Do you want to invest?’” Cuban initially valued Campus Ink at almost $5M, leading him to offer $250,000 for 5% of the company. Six months later, Dougherty reports he led a group investment of another $2M, then made another investment for an undisclosed amount. While the company continues to grow (although Dougherty notes some bigger programs are wary of partnering to avoid friction with current licensing partners), there is some worry about what Congress will eventually have to say about NIL. Farag, however, insists “Things will change, but we’re built for the long haul.” Lots more. (link)
