The NCAA finished FY23 with $1.3B in revenue and $870M in net assets, according to Sportico’s Eben Novy-Williams and Daniel Libit, who note the record-setting figures are largely attributable to the NCAA’s investment portfolio, which returned $63M after losing $72.3M in FY22. As of August 31, 2023, the NCAA had $815.3M of financial assets available within one year of the balance sheet, based on meeting $45.8M in cash needs, $29.6M in accounts receivable and its investments. Media rights revenue increased slightly YoY to $945.1M from $940M, likely due to escalators in existing contracts. Meanwhile, the NCAA reported distributing $670M to its DI members (up from $657M in FY22) and spending $192M on its DI championships programs and NIT tournament (up from $170M in FY22). (link)

Tennessee AD Danny White today released the following statement: “The NCAA generally does not comment on infractions cases (emphasis his) because there is a rule against it; however, that has not stopped them in the past from leaking information to the media as they did this week about us. Their actions made this ill-conceived investigation public and forced us to defend ourselves. It is clear that the NCAA staff does not understand what is happening at the campus level all over the country in the NIL space. After reviewing thousands of Tennessee coach and personnel phone records, NCAA investigators didn’t find a single NIL violation, so they moved the goalpost to fit a predetermined outcome. They are stating that the nebulous, contradictory NIL guidelines (written by the NCAA, not the membership) don’t matter and applying the old booster bylaws to collectives. If that’s the case, then 100% of the major programs in college athletics have significant violations. This is obviously silly and not productive, as is blaming the membership whenever they are challenged. We need to be spending our time and energy on solutions to better organize college athletics in the NIL era – something that NCAA leadership failed to do back in 2021. Student-athletes, prospective student-athletes, coaches, and administrators across the country deserve better, and I refuse to allow the NCAA to irrationally use Tennessee as an example for their own agenda.” (link)

ACC Commissioner Jim Phillips sits down with the Richmond Times-Dispatch’s David Teel for a wide-ranging interview and says he can’t discuss specifics of the litigation between the league and Florida State or whether that relationship is salvageable: “We will have to see where this goes, as we know it’s a process that could be lengthy. With that said, I can share that we will make every effort for our Florida State student-athletes, coaches, teams, and other administrators that have nothing to do with the legal elements to have a first-class experience as a member of this incredible conference. I’ve been really adamant with my staff about that. The reality is we have this legal issue going on, and we’ll deal with that and provide the necessary resources to make sure the ACC is protected and positioned to defend what we believe is right, and then on the other side of it, those kids deserve to have a really good experience in the ACC, and we are committed to making that happen, as we do year in and year out for all our schools.” Teel notes the disparate identities of the ACC’s members means there are varying perspectives on not just the FSU legal dispute, but also on the myriad challenges facing the industry. Phillips subsequently points out that it’s a “microcosm of the world. There’s just such chaos now in society and certainly in our space in college sports. So getting frustrated about it, or woe is me, that’s just so counterproductive. You try to (tackle it) head on; you try to deal in facts; you listen to the membership, and you try to drive in the direction they believe you should go.” (link)

Arizona President Robert Robbins talks with the Arizona Daily Star’s Ellie Wolfe about the university’s financial crisis and says he regrets the way the university handled its communication efforts: “I think we should have probably tried to prospectively address the misinformation that, you know, we didn’t lose $240M. There’s no fraud, there’s no financial malfeasance. I would have probably done a better job of doing communications around that.” Robbins says he has approached the situation as he would in his capacity as a cardiothoracic surgeon, and part of his diagnosis here involves asking: “How much does the university writ large value the market value of strong athletics?” Not only does having a strong athletics program attract students who want to experience big game days and school spirit, it also helps with fundraising across the university, Robbins notes, adding: “For universities that haven’t been to a bowl game in a long time, the amount of giving to the university dramatically goes up.” That said, Robbins acknowledges the “model of college athletics is broken. The patient is in the ICU and is in critical condition.” Cutting sports, Robbins says, is still on the table, outgoing Wildcats AD Dave Heeke’s comments to the contrary notwithstanding. More. Former Alabama Baseball HC Brad Bohannon “violated NCAA wagering and ethical conduct rules when he knowingly provided insider information to an individual he knew to be engaged in betting on an Alabama baseball game,” according to a Committee on Infractions hearing panel, which adds: “After he was fired by Alabama, Bohannon failed to participate in the enforcement investigation, in further violation of NCAA rules. The school and enforcement staff agreed that the violations in this case occurred when Bohannon communicated — via an encrypted messaging app — with an individual he knew to be engaged in sports betting activities and provided insider information about the starting lineup before notifying the opposing team. Specifically, Bohannon texted, ‘(Student-athlete) is out for sure … Lemme know when I can tell (the opposing team) … Hurry.’” Penalties include a 15-year show-cause for Bohannon, and Alabama will retain EPIC Global Solutions to provide a comprehensive gambling harm and student-athlete protection education program for student-athletes, coaches and athletics administrators. Big East Deputy Commissioner/COO Vince Nicastro served as the chief hearing officer. (link)

Arizona State is nearing an agreement with the NCAA to resolve an investigation into alleged ASU football recruiting violations. CBS’ Dennis Dodd reports the “school is expected to agree to findings of major violations in the case, which revolves around recruits being brought on campus during the COVID-19 recruiting dead period in violation of NCAA rules. A further postseason ban is not expected to be among those penalties. ASU in August self-imposed a postseason ban for 2023 in hopes of mitigating future penalties. On the table are potential show-cause penalties against former coach Herm Edwards and members of his staff, sources tell CBS Sports. That group includes current Las Vegas Raiders HC Antonio Pierce, who is considered a central figure in the investigation.” (link)

Leaders of The Collective Association, which counts Spyre Sports Group among its members, are meeting in Orlando this week to convene its inaugural summit, where Yahoo’s Ross Dellenger notes the conversation will surely include the inexorable conflagration between Tennessee and the NCAA. Oncoor President Russell White tells Dellenger the “NCAA is grasping at straws. This is just them trying to hang on to whatever they can. They’ve passed some new rules contradicting old rules. They make it real murky to operate in this space.” SANIL Founder Jason Belzer adds: “If you move the restrictions, there is no longer any reason for the schools to follow any rules. It’s going to be really bad. We know the system needs reform, but there are a lot of student-athletes going to be hurt by this. There are a lot of athletes who have poor representation. And now every kid is going to be an open-market free agent? It is absolute chaos. That’s a disaster.” Meanwhile, Walker Jones, executive director of the Ole Miss-focused Grove Collective, insists collectives aren’t anti-enforcement, but notes collectives and student-athletes are in precarious positions because of outdated policies. “Take, for instance, universities. There are inducements to regular students every day for academic performance in terms of research grants and scholarships. Why should student-athletes be any different?” More. (link)

+ West Virginia has launched the Mountaineer Exchange alongside INFLCR. (link)
+ Opendorse is partnering with Players Health, which SBJ’s Ben Portnoy reports is “set to unveil a handful of offerings and an artificial intelligence platform that could fill major needs for NIL collectives -- most notably, a policy that will help collectives cover their losses when players leave the programs they represent.” Opendorse CEO Blake Lawrence: “If you're gonna ride a motorcycle without a helmet, that’s one thing. If you’re going to ride a motorcycle without insurance, that’s another. If you think about it, getting into the NIL business is a risk-reward [proposition]. We're trying to de-risk a little bit of it.” (link)

In his decision to dismiss Ole Miss football student-athlete DeSanto Rollins’ $40M lawsuit against Rebels Football HC Lane Kiffin, U.S. District Court Judge Michael Mills found that Rollins was unable to clear sovereign immunity exceptions or prove that his alleged mistreatment by Kiffin was “motivated by gender or racially-based” discrimination. “Although Kiffin’s conduct in the meetings was certainly offensive and imprudent, it is more akin to immature insults and indignities than to behavior going ‘beyond all possible bounds of decency.’ … Both the University and Kiffin in his official capacity enjoy sovereign immunity, which they have not waived. Thus, this Court will only have jurisdiction if Congress has validly abrogated the defendant’s immunity.” Mills also found that Rollins, who maintains he was kicked off the team, “has offered no evidence that he was medically cleared to return or that he made any effort whatsoever to resume team activities after the March 21 meeting. Consequently, the evidence shows that it was up to Rollins when or if he resumed team activities—the decision was entirely his own.” Rollins plans to appeal. (link)

The Men's and Women's Soccer Rules Committee proposed substitution rules changes for men's competition, effective for the 2024 season. Specifically, the committee recommended that no reentry be allowed in either half once a player leaves the game via substitution. Additionally, teams will have six moments to make substitutions in a game, and substitutions can occur during any stoppage of play. Teams would be awarded an additional moment to make substitutions in overtime. The committee also recommended stopping the clock on all substitutions in the last 15 minutes of the second half and in overtime periods. Additional recommendations include expanding video review for potential PK situations, straight red card situations, offside violations and fouls that deny obvious scoring opportunities. Also, the committee is proposing using the sudden-victory format for postseason play. (link)

Austin Peay AD Gerald Harrison has agreed to a new five-year contract to continue leading the Governors. President Mike Licari: "Gerald's leadership has been an important factor in our University's success. He has significantly impacted fundraising, athletic success, enrollment and retention efforts. His forward thinking has led to groundbreaking initiatives with Sabertooth Sports & Entertainment and the F&M Bank Arena — one of the first such partnerships in college athletics — that solidified our long-term vision to connect APSU to historic downtown Clarksville." The Arizona Daily Star’s Michael Lev contends that outgoing Arizona AD Dave Heeke may not be the best fit for what the job currently requires. “The AD job, nowadays, requires an elite businessman. That’s what college sports has become — a big business. A cutthroat business. A kill-or-be-killed business. [...] In just the last few years, NIL and the transfer portal have transformed major college sports. Coaches’ agents — who negotiate contracts for a living — are running the show and running circles around athletic directors. It’s entirely possible — likely even — that NIL collectives will be brought in-house in the near future. When you combine that with NCAA president Charlie Baker’s proposal to create a new subdivision — and to have those richly resourced institutions place, at a minimum, $30,000 per athlete into a trust fund — you’re no longer looking for a traditional AD. You’re looking for a CFO.” More. (link)

After finishing FY23 with an $817K budget deficit, Florida A&M AD Tiffani-Dawn Sykes has presented the FAMU Board of Trustees with a five-step action plan to close the gap and potentially finish FY24 with a balanced budget or a small surplus. The Rattlers in FY23 generated $11.9M in revenue with $12.8M in expenses. FAMU’s largest expenses were operating expenses ($4.8M), salaries ($4M) and scholarships ($2.5M), while student fees ($4.2M) are the department’s biggest source of income. For FY24, Sykes says the department will focus efforts to “realize and book earned revenues” as well as implement the “BOG-allowed out-of-state Student Athlete Fee waivers. This process is expected to realize at least an additional $660K. This will reduce the anticipated scholarship expenses.” Additionally, Sykes notes FAMU has met its obligation of paying $75K for NCAA penalties and identified $900K in funds that can be used to buy down athletic scholarship expenses. Here’s a particularly notable item from the The DI Legislative Committee’s meeting earlier this month given the recent events in Knoxville: The committee “reviewed an NIL interpretative appeal remanded by the NCAA Division I Board of Directors Administrative Committee. The Legislative Committee agreed that the institution’s actions constituted a violation of the legislation, policy and guidance; however, the legislation, policy and guidance were not clear enough that the institution should be held accountable for its actions in this case. The Legislative Committee directed NCAA staff to update the existing guidance regarding institutional involvement in NIL activities to specify the additional types of institutional support that were found to be impermissible under the NIL interim policy, with an effective date tied to publication of the update. Specifically, the guidance will be updated to specify that an institution (or staff member) may not schedule or lead a meeting with student-athletes to discuss terms of a proposed NIL agreement and an institution (or staff member) may not provide proposed agreements to student-athletes or return signed agreements to an NIL entity.” (link - note this link was live yesterday but appears to no longer be active as of publication this morning)

Indiana-based real estate investor and youth baseball coach Bert Neff has been charged with destroying evidence, tampering with witnesses and providing false statements to the FBI in the case involving “suspicious wagering activity” during an Alabama–LSU baseball game last spring. Prosecutors allege Neff received a message from an individual employed by the “baseball team of a public university in Alabama” — identified as Individual-1 — informing Neff that the school’s starting pitcher was injured and unable to pitch that day. Neff then allegedly sent that information to other bettors. Those bettors, dubbed Gambler-1, Gambler-2, Gambler-3 and Gambler-4, all wagered on the April 28, 2023, game, according to court documents. Neff also allegedly advised one of the gamblers to not comply with a grand jury subpoena. More from The Athletic’s Mark Puleo. (link)

Coaches Corner…
+ Boston College Football HC Jeff Hafley is leaving Chestnut Hill to take over as the Green Bay Packers’ new DC. A source tells ESPN’s Pete Thamel: "He wants to go coach football again in a league that is all about football. College coaching has become fundraising, NIL and recruiting your own team and transfers. There's no time to coach football anymore. A lot of things that he went back to college for have disappeared." Rutgers Deputy AD/SWA Kate Hickey and Stanford Deputy AD Jacquelyn Kulgevich join AthleticDirectorU’s Steph Garcia Cichosz to dive into the topics of ambition and identity for senior athletics leaders. Hickey and Kulgevich reflect on their earliest days in the industry, serving the Southern Conference and Omaha, respectively, and the subsequent journey that led them to the Deputy AD role. Kulgevich acknowledges she did not handle critical feedback well early in her career, but now “I probably annoyingly say to everyone I work with feedback is a gift. … Now I recognize that actually by getting that feedback I get to get better, and it is a gift, it's an honesty, and…when I get that feedback, [I] just say thank you that's really the extent of it. And I can take time to determine with that feedback does it align with my values.” Hickey discusses the challenge of innovating and aligning with new ADs during a long stop at a single institution and says: “I’ve had four athletic directors in my time at Rutgers, and each one of them has operated in very different ways, which helps her see “what does [current AD] Pat [Hobbs] want out of each and every one of our sports. How does he want us all to function together? And then taking what we've done previously but molding it into how he wants us to move forward as a department.” Full interview on ADU. (link)

Arizona State sports historian Victoria Jackson in a guest column for Sportico lays out how nearly every college sport except football is increasingly integrated into global sports. For example, Jackson points out that “across the 64 teams of the 2022 NCAA DI women’s soccer tournament, 236 international athletes from 35 countries participated; 52 teams had at least one international player; and seven teams had 10 or more. … Soccer and other Olympic sports have value on college campuses, monetary and otherwise, and among their greatest strengths is this global integration. The United States, after generations of sporting isolationism, is coming around to embrace global sport, namely, soccer, in the 21st century.” Meanwhile, Jackson argues that a “lack of global integration and competition has allowed college football to develop its sub-optimal, harmful practices, spurring the current debates around athlete rights and employment. I do wonder what global soccer coming to America will mean for college football labor relations in the coming years. … It is exceptionally rare that a sport has a single development pathway and a single-country player pool, and that is where our football players find themselves – without leagues forced to adopt and maintain good practices due to competition with others in the industry.” Jackson goes on to observe that “American higher education did not actively choose to run a professional football industry or the world’s best U-23 sports development system. But here we are, and we hold a responsibility to make sure each of these industries is guided by policies that place serving their respective athletes at the heart of their missions. Sometimes we get it right, but too often by accident.” Full op-ed. (link)

Adidas finished 2023 with an operating profit of €268M, down from €669M in 2022; however, the company says the result outpaced its own guidance of a €100M operating loss. On an underlying basis, operating profit came in at roughly €200M in 2023, also above guidance of around €100M. ($1 = 0.9220 euros) The company also announced that, despite previously considering writing off $325M in unsold Yeezy inventory, it won’t do so and instead plans to sell the remaining shoes “at least” at the cost it paid for them. CEO Bjørn Gulden: “Our consumer, retail and trade research has shown that we can sell this remaining inventory in 2024 for at least the cost price. This is why we have only written off inventory that was either damaged or very broken in sizes.” (link)

The Federal Reserve held its benchmark federal-funds rate steady in a range between 5.25% and 5.5%, the highest level in more than two decades, as it awaits more convincing evidence that a sharp downturn in inflation at the end of last year will continue. Fed Chair Jerome Powell: “It’s a highly consequential decision to start the process” of lowering interest rates “and we want to get that right. We’ve made a lot of progress on inflation. We just want to make sure that we do get the job done in a sustainable way.” (link)
