Former Gators AD Jeremy Foley: "Bill Carr was a wonderful man and a great Gator. I am very saddened by his passing and wish to send my condolences to his entire family. Bill's fingerprints are all over the foundation of this program.” Carr, who after his stints as an AD was a pioneer in creating the management consulting & executive search verticals in college athletics alongside former Southern Miss AD Richard Giannini, is survived by his wife Janice & five children, including FIU AD Scott Carr. On a personal note, I am so fortunate to have known Bill. His enthusiasm for others was unmatched. February will be a busy month for AD hires, according to CollegeAD, which reports Tarleton will likely be the first to wrap up after the Texans interviewed three finalists last week. A new AD is expected to be named this week. Louisiana Tech, as reported, will begin virtual interviews next week, as will San Diego, which expects to have finalists visit for on-campus interviews beginning February 19. Meanwhile, American will begin virtual interviews on February 19, with in-person interviews to follow. Also, Little Rock is expected to have its new AD in place by April. (link)

Asked whether he is committed to the College Football Playoff in 2025 and beyond, SEC Commissioner Greg Sankey tells Yahoo’s Ross Dellenger: “Yep, but we’ve got a lot to get right. The commitment is we want to see this get right.” Dellenger notes that Sankey and Big Ten Commissioner Tony Petitti “each expressed frustration over challenges and delays on the 12-team format as well as the unsettled revenue-distribution model after 2025,” with Sankey remarking: “We have the reality of meeting to deal with CFP governance with the 2026 season and beyond. That’s a highly important issue.” Petitti adds: “I’m new to [CFP] meetings. How these things develop, there have been some surprises. The focus on what this is going to look like beyond 2026 is highly important and deserves a lot of time and discussion.” (link)

North Carolina AD Bubba Cunningham sits down with Teamworks Vice President for Business Development Kevin Barefoot for the second in a series of conversations offering forward-looking solutions to the most pressing issues in today’s college athletics landscape. Cunningham and Barefoot discuss the trickle-down ramifications of high level changes, such as NIL and the transfer portal, on department resources, donor fatigue and Olympic sport programs. They also unpack the Project DI framework, particularly as it relates to schools participating in NIL and increasing educational benefits. Cunningham cautions that one consequence of expanding the educational benefits pool involves further fatiguing donors. “I feel like athletic directors and coaches and everybody's been crying wolf for 25 years that, ‘Oh my gosh, we can't do that, we can't afford to do that,’ yet the commercial activity continues to rise. Salaries continue to rise, facilities continue to get built, but I do think that we have recognized in the last couple of years, since the advent of NIL, that our donors are fatigued – the people that support intercollegiate athletics are tired. And so if we continue to add expenses or add benefits to those that participate without some restriction on costs, whether that's facility cost, salary costs, whatever it is, we have to take a look at that because…at some point this will level off and we'll have to make some decisions. We saw some of those decisions being made during COVID. You never saw anybody cutting back in football and basketball in COVID, but I did see the Olympics sports drop during COVID, and that was concerning to me.” Lots more from Cunningham on AthleticDirectorU. The NCAA has responded to the TRO request made by the AGs of Tennessee and Virginia, in which it claims that lifting pay-for-play rules “would have negative implications reaching far beyond the use of NIL negotiations in collegiate athletic recruitment.” More specifically, the NCAA warns an injunction would “expose” recruits, some of whom are minors, “to bad actors who cajole” them “into entering coercive contracts” and lead to recruits feeling “overwhelm[ed]” with solicitations. Sportico’s Michael McCann goes on to point out that the “NCAA contends the AGs…are attacking the same rules that have been scrutinized through evidence and testimony since 2020, when [House v. NCAA litigation] began. As the NCAA sees it, the AGs ‘offer no evidence or argument for why they need injunctive relief on an even faster basis, or why money damages—the traditional remedy—would fail to adequately redress the injuries they claim.’” The NCAA also argues, per McCann, that it is “hypocritical for UT to use Tennessee to demand pay-for-play rules be lifted when it is a member of a conference defending those same rules in [House v. The attorneys general from Tennessee and Virginia subsequently responded to the NCAA’s arguments, writing: “It’s not Plaintiffs’ fault that the NCAA has decided to regulate NIL and recruitment through a byzantine set of overlapping rules of guidance. To the extent there’s confusion on which rules the NCAA thinks give it the power to enforce the NIL-recruiting ban, that problem is one of the NCAA’s own creation. The NCAA cannot benefit from the fact that its rules – scattered across a 437-page manual – are often impenetrable, shifting, and vague. … The NIL-recruiting ban injures athletes, in both Virginia and Tennessee, by artificially deflating their value in the marketplace. And athletes who get even close to the line, whether that line is drawn by the NCAA now or later, could have their eligibility taken away or their school competitively sanctioned. Either would further impact their NIL opportunities for the remainder of their brief opportunity to participate in college athletics.” More from the AGs. (link); Tennessee AG Jonathan Skrmetti on Fox News yesterday: “I think federal regulation is the only answer to the federal antitrust legal problem, but what we have right now is already the wild west, but it's the wild west with arbitrary enforcement and that's really hurting these student athletes especially when they're unlucky enough to be in a school that gets in the crosshairs.” On the Title IX implications of NIL, Skrmetti notes NIL “is not something the university is giving the students, it's an inherent right that they have. It’s an intellectual property right in their name, their image, and their likeness, and the law is they retain that right whether they're playing for the school or not. So, this is a matter of a school interfering with their property rights in a way that suppressing their compensation Title IX can be kept completely separate from that because that is run through the universities.” (link)

Kansas is working on solutions to get students to home football games at Children’s Mercy Park and Arrowhead Stadium next season. Jayhawks AD Travis Goff notes KU is putting together a “comprehensive plan that will include running as many buses as possible,” and Deputy AD for External Affairs and Revenue Generation Jason Booker adds the department is looking at possibly adding “discounted to free” parking and transportation options for students. For those who can’t attend the games, KU plans to host watch parties in Lawrence, per Booker, who says: “I think it’s really important that we’re listening to our community here in Lawrence, and that’s why it’s important for us to have representation in those boards.” Exactly how much the Jayhawks will pay to use Children’s Mercy Park and Arrowhead Stadium has yet to be determined. ESPN’s Outside the Lines zeroes in on the meteoric rise of sports gambling since 2018, during which time advertising spend on the industry has increased from $22.9M per year to $360M per year as the number of states to legalize sports betting has increased from four to 40. U.S. Congressman Paul Tonko (D-NY) would like to explore a prohibition on advertising aimed at more vulnerable populations, much like the limits that have been placed on the tobacco industry. “I think we need to take a closer look at this because it could be a public health crisis that grows in tremendous dimension.” American Gaming Association President/CEO Bill Miller disagrees that gambling poses a type of public health crisis. “I think that we are facing is a migration of the American sports bettor who had no legal opportunities to bet on sports into the safe regulated marketplace.” (link)

In a 60 Minutes piece on sports gambling last night, gambling addiction therapist Harry Levant says some of his patients are college students who have gambled away their federal student loan money. "I have patients who gamble in the shower. I have patients who gamble before they get out of bed in the morning. I have patients who gamble while they are driving. There are no guardrails.” Levant has partnered with Northeastern law professors Dick Daynard and Mark Gottlieb, who are preparing to take on the gambling industry in court. Daynard, one of the architects of the first major lawsuits against tobacco companies, says of the similarities between the gambling and tobacco industries: “We’re dealing with addictive products. We're dealing with an industry that will still defend itself sometimes on the basis that it's really the smoker who's making the choice. We have that exactly with a gambling industry.” The group in December filed lawsuits against DraftKings for deceptive advertising and is calling on Congress to control the way gambling products are promoted. Meadowlark Media CEO/former ESPN President John Skipper believes the Super Bowl will be streaming-only within eight years, before the league’s media rights deal concludes in 2032. “I would have thought that pay-per-view for the Super Bowl would be on the outside of that deal. I now think in the life of the deal, the Super Bowl will go pay-per-view.” Asked to explain whether he means the game will be pay-per-view or behind a streamer’s paywall, Skipper explains: “Depending on who owns the Super Bowl, it would be more or less valuable to put it behind a paywall and get subscribers. After you have the consolidation of streaming services and big broadcast companies, that’s when it will actually go pay-per-view I think. So you’re looking at three-to-four years.” (link)

The NCAA has responded to the lawsuit filed by Attorney Generals from Tennessee & Virginia: “Allowing member institutions and associated groups or individuals to induce prospective student-athletes to attend a particular institution by offering NIL compensation would inevitably lead to a greater concentration of talent in a smaller number of member institutions. [...] For at least the last five years, the Southeastern Conference has had at least one representative on the Division 1 Council, which approves the Division I Manual. The current chair of the Division I Council — which recently passed legislation regarding NIL and introduced proposals regarding NIL, discussed further below — is an employee of the University of Florida, also in the Southeastern Conference. [...] There is no reason to upend this process, invite chaos on a moment’s notice, and transform college sports into an environment where players and schools match up based primarily on the dollars that can change hands. However, every seasoned trial lawyer in the country would agree that well-intentioned fans staging a ‘walk’ in Greenville the day of the (preliminary injunction) hearing would be a mistake that could backfire badly.” (link)

The Arizona Daily Star’s Greg Hansen writes on Arizona’s AD search, suggesting the Wildcats should not use a search firm, which he says would be “a colossal waste of $100,000 to $200,000.” Hansen gets this from an unnamed Power 5 AD: “I think it will be difficult as long as (President Robert Robbins is there). [...] You need a veteran, sitting AD who has seen it all. You need an operator, someone who in the next four or five years can get you back on your feet. But it’s going to be difficult to find that person as long as Arizona has the same leadership it has now.” Hansen goes on to provide names UA should contact: TCU AD Jeremiah Donati, but only for advice on “who not to hire,” find out if Utah AD Mark Harlan is “untouchable” (Harlan’s buyout is $2M) & “arrange to meet Baylor AD Mack Rhoades” due to his deep roots in Tucson, “Maybe he’s done all he can do at Baylor. Rhoades might be open to returning home and working on his third reconstruction project before retiring.” (link)

Speaking of Mack Rhoades, Baylor Men’s Basketball HC Scott Drew was ejected from last night’s game against Iowa State, the first dismissal of Drew’s career. Rhoades after the final buzzer: “I'm not somebody that calls the officials or calls the league after every game. In fact, I never call when it comes to officiating. It's always about, 'We need to play better, we need to execute better, we need to play tougher,' all of those things. But tonight was an embarrassment for this league. We have the best basketball league in the country and the officiating tonight did not match it. Period. End of story. [...] This league needs to get better when we think about our officiating. And we have some great, great officials. But this particular crew tonight did not match the level of this game. And that shouldn't happen in this league. I'm going to fight for our program. I'm going to fight for our school. I'm going to fight for our coaches. We're going to fight for our student-athletes. I'll be on the phone tomorrow.” (link)

The Auburn Board of Trustees has given the go-ahead for the athletic department to fund the replacement of the scoreboard in Jordan-Hare Stadium’s north end zone with a video board. While no budget has been released, the renderings have, and show that it will be 47 feet high by 154 feet wide with 7,238 square feet of LED space. The north end zone face life project is expected to break ground this summer and be completed in time for the 2025 football season. LBYD Engineers of Birmingham was the recommended engineer firm for the proposed project. (link)

Sportico’s Michael McCann says the ruling in the lawsuit filed by Ole Miss Football student-athlete DeSanto Rollins against Rebels Football HC Lane Kiffin “reaffirmed the extensive and longstanding power of college football coaches over their players. It’s the kind of ruling we could have seen in 1984 or 2004—but perhaps won’t in the coming years.” More from McCann: “The ruling comes at a time when college athletes are inching closer to recognition as employees and union membership. In a world where college football players have a union, Rollins v. Kiffin probably wouldn’t be heard in court. The union and school would have instead negotiated a dispute resolution process. College players, meanwhile, would have collectively bargained job protections while coaches who act in ‘certainly offensive and imprudent’ ways might run afoul of obligations to treat players as professionals.” (link)

The Orlando Sentinel’s Mike Bianchi takes Florida and Florida State leaders to task for what he characterizes as a refusal to “obey the law,” specifically the state’s Sunshine Law. In UF’s case, Bianchi reports the Gators are under NCAA investigation for potential violations regarding now-Arizona State QB Jaden Rashada. “As if the Gators didn’t look dumb enough for getting mixed up in the biggest fiasco since NIL became legal, they have since tried to hide that they are being investigated by the NCAA. UF initially refused public-records requests from the Tampa Bay Times and Associated Press, whose reporters asked the university to turn over the NCAA’s notification-of-allegations letter sent to school president Ben Sasse. According to Times reporter Matt Baker, UF originally claimed the NCAA letter was exempt from the Sunshine Law but finally acquiesced and turned over the letter — but only after the Times got its lawyers involved.” Meanwhile, FSU “has been trying (successfully) to circumvent the Sunshine Law by failing to comply with public-records requests from reporters at Sportico” who are seeking to learn more about the Seminoles’ communications with JPMorgan regarding the potential investment of private equity funds into the department. Sportico’s Eben Novy-Williams tells Bianchi: “They are touting all of this stuff about transparency in their lawsuit against the ACC. They are telling everyone that the ACC is withholding public records from the university and from the people of Florida. Transparency has sort of become their central theme in the lawsuit. If Florida State cares so much about transparency then what about that public records request [Politico] submitted six months ago? [FSU’s rhetoric] sounds like a bunch of doublespeak.” More. (link)

Desser Sports Media President Ed Desser and Kosner Media President John Kosner believe media rights fees are still on the upswing for the most popular properties and outline the several factors influencing rights value, including the attractiveness of a given package, time since the last reset, whether the package has been under-market, demographics, demand, audience trends, the nature of the package and whether it’s a tentpole property. Overall, they conclude that “the big are getting bigger,” and “cord-cutting and a softer advertising environment aside, we expect the NBA to book a significant increase in its rights (as the NFL did) since it checks all the above boxes (perception, nine years since the last deal, young demos, high-demand property, gambling attraction, fairly stable audiences in a declining trend marketplace, significant interest from sponsors and fans, nine months of programming; and, certainly, a tentpole during its spring playoffs). If ESPN closes its reported six-year extension, the College Football Playoff deal will also show a nice increase. Ironically, the CFP’s biggest challenge is that the NFL sucks much of the oxygen…and attractive time slots…out of the system. 23M viewers for the Peacock playoff game is just the latest example. … [College Football Playoff] and NBA scores mean a lot less money left for everyone else. That’s the new reality of sports media: Still an up market — for a few.” (link)

Sportico’s Anthony Crupi takes a look at how Nielsen’s forthcoming expanded out-of-home reporting system will impact sports TV ratings and notes “the expanded OOH scheme is expected to unearth hitherto undetected impressions captured in public venues such as bars, restaurants and gyms, which in turn should give the networks some leeway to raise their in-game advertising rates.” While the specific impact of an expanded OOH system remains to be seen, Crupi points out that “any additional lift will be welcome, as the networks look to offset the costs of the escalators that are built into their rights deals.” The expansion will include several markets not previously measured (Crupi points out the current OOH platform “effectively overlooks 35% of the population”), including several major college sports towns, such as Louisville, Birmingham (which includes Tuscaloosa), Memphis and Madison. The new methodology is expected to be in place in time for Super Bowl LIX in February 2025. (link)

In a recently unsealed transcript of a 2022 deposition taken in a lawsuit stemming from the league’s head injury lawsuit, NFL Commissioner Roger Goodell appeared to suggest it was still uncertain whether a link existed between concussions and long-term neurological damage, according to Front Office Sports’ Daniel Kaplan. According to the deposition, an insurer’s attorney asked: “As you sit here today, sir, do you know whether there is any medical consensus regarding whether concussions result in long-term damage to NFL players who sustain concussions while playing in the NFL?” Goodell responded: “I think there’s still a great deal of uncertainty about the causation issue, if that’s what you’re referring to.” Kaplan notes that Goodell “appeared to be contradicted by his own general counsel, Jeff Pash, who was asked the same question in his deposition and answered: ‘I think we’ve said that there can be long-term effects.’ The insurers’ counsel then asked Pash: ‘And are you aware that Commissioner Goodell testified that the causation has not yet been established regarding long-term effects of concussions as it related to concussions sustained by players during their playing days?’ Pash replied that he had not been briefed on Goodell’s testimony.” (link)
