Arizona State President Michael Crow speaking at a student forum this week said the Sun Devils are "approaching the timeframe" to begin appointing a new AD, adding that his main priority is restructuring "the relationship between athletics and the University." Crow went on to explain that ASU would only appoint a new AD once the athletic department is an "integrated unit like all the other units within the University financial and organizational infrastructure. … We have to find a way for it to be as self-sustaining as possible, which is quite challenging financially.” (link)

U.S. District Court Judge Clifton L. Corker yesterday denied the request by the states of Tennessee and Virginia to issue a temporary restraining order against the NCAA from enforcing NIL rules. Corker ruled that the “inability of schools and collectives to facilitate NIL discussion and provide services to assist student-athletes in navigating the NIL market … also does not constitute irreparable harm.” Corker also noted, however, that “considering the evidence currently before the Court, Plaintiffs are likely to succeed on the merits of their claim under the Sherman Act.” (link, link)

NCAA VP of DI Governance Jenn Fraser sat down with Connect/MB Sports’ Matt Banker from the 2024 NCAA Convention to provide the latest information on the trending topics from the Transformation Committee, potential changes to transfer rules, ideas being discussed to incentivize reporting NIL deals, the status of football governance and lots more. On the possibility of incentivizing reporting NIL deals, Fraser says: “Even an idea like the support that institutions can give students…you know, perhaps student-athletes can't access that support if they don't comply with disclosure. It doesn't impact their eligibility to compete, but it does maybe hinder their ability to function well in the NIL environment. So, that's an idea that was floated this week. [We are] really looking for ways to allow athletes to maximize those opportunities, not impact their eligibility, but still really get a robust disclosure pool. … It's really important to note that we're not in a system of gotcha for student-athletes. That's not the point of this, not individually identifying certain student-athletes and what their NIL deals are. This is really about de-identification reporting and aggregate, really giving a sense to the landscape that people are so curious about.” Full interview on Connect. (link)

Gonzaga President Thayne McCulloh and AD Chris Standiford sent an email to students condemning the behavior of those who threw trash and towels onto the court following a controversial officiating call during Saturday’s game against Saint Mary’s. “Unfortunately – and in a major departure from the conventional experience – numerous incidents of inappropriate behavior on the part of some students on Saturday were observed by attendees and noted by sports commentators on national television. Expressions of profanity towards the opposing team and throwing of material and liquids onto the court impacted play and reflected a student community wholly atypical and unbecoming of our university. … Saturday’s inappropriate conduct was, quite simply, unacceptable. The Athletics department is currently coordinating with our colleagues in Student Affairs to address students who interfered with play and negatively affected the experience of others. Those who acted out through verbal abuse or by throwing items or substances onto the court will be held accountable.” (link, link)

U.S. Integrity CEO Matt Holt pens alongside RealResponse Founder/CEO David Chadwick with the perspective that legalized sports gambling is in the “second inning,” noting that while lessons have been learned, there is a lot more still to unfold. “Among college athletics in particular, sports betting has placed new levels of pressure on student-athletes. One recent NCAA survey found that 10% of Division I administrators were aware of student-athletes being harassed by someone with gambling interests. 30% report being extremely or moderately concerned about gambling compared to other compliance issues—up from 20% in 2019. As a result, the NCAA is advocating for states nationwide to adapt their gambling legislation to better protect student-athletes. Mandatory reporting hotlines for gambling authorities and tougher penalties for harassers are just a couple of factors they’re pushing to standardize across jurisdictions.” Holt and Chadwick go on to identify four ways organizations can mitigate the problems associated with legalized gambling. They include investing more in education, collaborating with experts, utilizing AI, and implementing equitable deterrent methodologies. “When it comes to the evolution of U.S. sports betting, there is still plenty of game to be played (and it’s changing in real time). The best practices we learned three years ago may already be irrelevant today. The only way we ‘win’—in terms of protecting players, fans and sports integrity—is by collaborating and communicating across the industry.” (link)

More on the ESPN-Fox-Warner Bros. Discovery super sports streaming service…
+ Disney CEO Bob Iger: “The launch of this new streaming sports service is a significant moment for Disney and ESPN, a major win for sports fans and an important step forward for the media business. This means the full suite of ESPN channels will be available to consumers alongside the sports programming of other industry leaders as part of a differentiated sports-centric service. I’m grateful to Jimmy Pitaro and the team at ESPN, who are at the forefront of innovating on behalf of consumers to create new offerings with more choice and greater value.” The Athletic’s Richard Deitsch reports the “joint venture has not yet finished its research on where [the price] will land. But for some guidance, based on those briefed on the deal, the likelihood is it will be priced between where a standalone RSN might charge for its monthly offering (think $20-30 monthly depending on where you live) or what you might pay for bundled services (think $75 and up). Could that mean around $50-55? We’ll learn soon.” The Athletic’s Andrew Marchand adds that while the deal is a three-way split in ownership, the “fees that each company will receive are based on what they earn in their cable deals and with services, like YouTube TV. … This means that ESPN, which receives the highest fees, will receive a higher percentage from each subscriber to the new venture.” (link)
+ Sportico’s Anthony Crupi: “Given the demonstrable manner in which the cable bundle has managed to retain the custom of the most sports-hungry consumers, the new venture isn’t expected to cannibalize the already much-diminished pay-TV model. In the last five years, some 35 million U.S. TV households, or around 40% of all bundled subs, have cut the cord, although the majority of these defectors appear to be light or infrequent sports viewers. Despite an 18% drop-off in overall TV usage since 2022, sports ratings have increased during the same period, which if nothing else, would seem to indicate that sports is probably the only thing that’s keeping the bundle together.” (link)
+ Citi analysts estimate the streamer will encompass 55% of U.S. sports rights, and the Wall Street Journal’s Joe Flint and Isabella Simonetti report a CEO for the venture is expected to be named in the coming weeks. (link)
+ Streaming Media Blog publisher Dan Rayburn poses several questions that need to be answered before the service’s impact can be gauged, including: “Do any of these companies in the JV truly understand what the sports viewership crossover is from one sport to another? Or are they guessing a ‘sports fan’ wants to watch all sports?” He also wonders whether RSNs will eventually be included in the bundle, whose tech stack it will be built on, how user data will be shared among the companies, what type of ad formats will be offered and lots more before observing: “Multiple news outlets report that sports leagues weren’t informed of the talks to create the new sports-streaming platform. Even if you own the rights to the content, you still want the leagues backing this and making them feel like they are a part of it.” (link)

ESPN’s Pete Thamel examines what the goals of the SEC-Big Ten joint advisory group might include, noting that both SEC Commissioner Greg Sankey and Big Ten Commissioner Tony Petitti “have done great gymnastics to point out” it isn’t about a breakaway. “Here's what's definitive about this new linking: These leagues don't want Eastern Michigan having a say in what happens at Michigan or Florida International affecting Florida. They don't, for example, want the Dartmouth basketball team's unionization effort to impact the Auburn and Iowa football teams' futures. … So where could this SEC-Big Ten partnership show up to forge the future of college sports? The simple answers are lawsuit settlement and revenue share. Multiple sources told ESPN there's a lot of chatter that this SEC-Big Ten arm-linking could manifest itself amid the thicket of lawsuits facing the NCAA. Some of the wealthiest conferences want to find a way to settle those suits – particularly the billions in potential exposure of House v. NCAA – and use the settlement structure to create a path forward.” Temple Sports Law Director Gabe Feldman tells Thamel establishing a framework based on the settlement structure is plausible. “The realistic part is about the will of the parties. Are the parties willing and able to find a dollar amount to make these cases go away and able to find a structure that they would continue under? It's certainly plausible." Ultimately, Thamel concludes there's “nothing linear here. But the settlement as a bridge to federal help is an idea being discussed, and it's one the SEC and Big Ten appear set to dig in on once they determine which members – presidents, chancellors and athletic directors – will make up the advisory group.” (link)

The Tampa Bay Times’ Matt Baker digs into the public records of Project Osceola, and beyond what has been reported previously, Baker points out that “projections for 2026 include naming rights to Florida State’s football home, formally called Bobby Bowden Field at Doak S. Campbell Stadium. FSU’s Year 1 revenue ranges from $1.5M to $5M, depending on the document and its assumptions. Sponsorship for the basketball arena, the Donald L. Tucker Civic Center, adds another $800K-$2.6M.” The documents also list a potential $75M expense for FSU in FY27 for a new baseball stadium and projects FSU’s baseball revenue to nearly double to $2.75M. There is also mention of a new revenue source in the form of an MiLB team in Tallahassee which initially adds a combined $4.1M in tickets, sponsorship/licensing and facilities. Also from Baker: “Multiple documents cite $8M in name, image and likeness (NIL) contributions for the ’24 fiscal year. One scenario ups that figure by 2-3% each year. In another, donations spike to $11.1M in ‘25 and $13.6M by ‘32. These numbers are notable because they’re an official snapshot in a murky marketplace filled with unverifiable, third-party claims. They’re also relevant to Project Osceola; Sixth Street asked about FSU’s NIL partnerships and ‘plan moving forward’ in July.” Lots more. (link)

U.S. Senators Marsha Blackburn (R-TN) and Cory Booker (D-NJ) have reintroduced The NCAA Accountability Act, which establishes guidelines for how the NCAA handles its infractions and investigative process. Specifically, the bill seeks to “establish due process protections for student-athletes, coaches, and universities that are under investigation by the NCAA for rule violations.” The bill would also require the NCAA to complete an investigation within a one-year period of time from when the school first receives a notice of investigation. The NCAA would also be prohibited from investigating alleged violations that occurred more than two years before the actual notice was sent to the school. In addition, the legislation authorizes the DOJ, through an administrative law judge, to fine the NCAA or individuals on staff up to $15M for violating the provisions of this bill. Blackburn: “The NCAA’s history of backroom deliberations that produce unfair punishments for athletes, coaches, and universities has gone on long enough. … The NCAA Accountability Act brings much-needed consistency and transparency to the NCAA, ensuring that everyone is operating under the same set of expectations for rule violations." Former Auburn/Cincinnati/Ole Miss/Texas Tech Football HC/U.S. Senator Tommy Tuberville (R-AL) predicts in a column for OutKick that former Alabama Football HC Nick Saban will be the first of many coaches to retire if Congress doesn’t address NIL. He writes: “As a result of this new situation, college sports have turned into the Wild West, with bidding wars for football players now starting with freshmen in high school. It will soon be impossible for any coach to build a team, knowing that his best players are highly incentivized to enter the transfer portal, which they are allowed to do at least once for no reason whatsoever. It is as if every player in the pros became a free agent every single year. Frankly this sends the wrong message, telling our young people to abandon their teams or avoid committing to anything bigger than yourself. It's also going to destroy the camaraderie between our players. Right now we’ve got quarterbacks making millions of dollars being guarded by guys making zero. Those same linemen know that their quarterback might bail and enter the portal anytime someone shows up offering him another cool million.” Tuberville goes on to tout the PASS Act, which he co-sponsors with U.S. Senator Joe Manchin (D-WV) and notes: “Congress shouldn’t sabotage a bipartisan, mainstream effort because of the extreme demands of those on the sidelines.” (link)

Fox, ESPN and Warner Bros. Discovery are creating a joint streaming platform to share sports assets, according to the Wall Street Journal’s Joe Flint and Isabella Simonetti, who report the service will be available to ESPN+, Hulu and Max subscribers. Each company will own one-third of the product, which is expected to launch later this year. There will undoubtedly be more details about this ahead. (link)

Vivature CEO Mouzon Bass and President Lance West Wilson, along with physician Robert Brent Scott, have been indicted by a federal grand jury and charged with conspiring to commit wire fraud, conspiring to commit healthcare fraud, and conspiring to commit money laundering. Another physician, Kyle Carter, has been charged with conspiring to commit wire fraud. The indictments allege that from roughly 2014-2023, Bass and Wilson used Vivature to submit false claims to private insurance carriers purporting that physicians, like Scott and Carter, were providing medical services for injured student-athletes at universities across the country. According to the DOJ, the services were actually performed by athletic trainers employed by the universities who were specifically excluded from insurance companies’ reimbursement policies. In total, the defendants are alleged to have collectively obtained more than $70M, which they used to purchase property, including a multimillion dollar home, lakehouse, and an international residence; and bought a multimillion dollar yacht. The Big 12 has fined Baylor AD Mack Rhoades $25K for his criticism of the officiating in last weekend’s men’s basketball game against Iowa State, from which Bears HC Scott Drew was ejected. CBS’ Matt Norlander reports that lead official Jeb Hartness “sending Drew to the locker room did not come as a surprise to some in the Big 12 for one reason: In mid-January, after CBS Sports' reporting on the pattern of bad behavior nationally with coaches constantly drifting onto the court, Big 12 coordinator of officials Curtis Shaw sent a stern memo to every head coach and every official in the league regarding bench decorum from all coaches and players.” From the memo: "Bench decorum has become a pressing issue and must be addressed. Situations where head coaches are clearly on the court, head coaches are playing 'defense' on players near their sideline, assistant coaches that are standing during every play, and comments from players sitting on the bench directed toward their opponents must be addressed and penalized." The memo also emphasized that "crews who do not handle these situations will be penalized." Norlander also reports this is the first season the Big 12 is formally grading its officials. Per a source: “Now we have an 'observer' that does. It was instituted this year for the first time in an effort to get better and be more accountable — and at arm's length of our coordinator (Shaw)." Meanwhile, one coach tells Norlander: “The memo went out, everybody knows that for the next few weeks it'll be toe-the-line, ticky-tacky.” (link, link)

Renovations to Simmons Bank Liberty Stadium will likely impact Memphis’ 2025 football season, according to Tigers AD Laird Veatch, who notes the “question really now is how much of '24 will be affected and in what way." Veatch says the university has been finalizing design plans and working on fundraising since getting the final go-ahead for renovations last month. "There's just a lot of work. A whole lot of work going on behind the scenes, as well as refining the design, starting the fundraising process and those conversations. There's several working groups and a lot of activity happening, but really for the next month or two I think you're going to see us with our heads down just really working hard to get through all that." Veatch also says of contract negotiations with Football HC Ryan Silverfield: “I feel good about the process, I feel good about the conversations with his agents and working through that. I would expect something to materialize here before long." (link)

St. John’s Men’s Basketball HC Rick Pitino offers two solutions for men’s hoops moving forward: “For basketball - have the Power 5 & Big East conference commissioners get together and create a salary cap between $1.5M and $2M. All contracts delivered to the league and school offices. All other conferences establish their own salary cap. I would never exclude anyone from the NCAA tournament. Obviously football is a different sport entirely and some of their talent makes more than NFL players. … Solution 2: Do away with letters of intent, make athletes sign a two year binding contract, no different than professional athletes - which they are. With that, the collective puts together their NIL contract based on the cap. Obviously a lot has to go into this. I believe the NCAA should be taken out of the equation and the commissioners put into it as the NCAA loses more cases than the defense lawyers on Law & Order.” (link, link)

On3 CEO Shannon Terry points out that the “projected spend for Roster Management for Collectives/Schools over the next 12 months for P5 College Football (only) is around $325M. ‘Roster Value’ remains around ~90% of the total NIL Market and Valuation for CFB players.” On3’s Andy Staples adds: “To put this in perspective, each NFL team in 2023 spent $224.8M on salary.
