ESPN’s Pete Thamel examines what the goals of the SEC-Big Ten joint advisory group might include, noting that both SEC Commissioner Greg Sankey and Big Ten Commissioner Tony Petitti “have done great gymnastics to point out” it isn’t about a breakaway. “Here's what's definitive about this new linking: These leagues don't want Eastern Michigan having a say in what happens at Michigan or Florida International affecting Florida. They don't, for example, want the Dartmouth basketball team's unionization effort to impact the Auburn and Iowa football teams' futures. … So where could this SEC-Big Ten partnership show up to forge the future of college sports? The simple answers are lawsuit settlement and revenue share. Multiple sources told ESPN there's a lot of chatter that this SEC-Big Ten arm-linking could manifest itself amid the thicket of lawsuits facing the NCAA. Some of the wealthiest conferences want to find a way to settle those suits – particularly the billions in potential exposure of House v. NCAA – and use the settlement structure to create a path forward.” Temple Sports Law Director Gabe Feldman tells Thamel establishing a framework based on the settlement structure is plausible. “The realistic part is about the will of the parties. Are the parties willing and able to find a dollar amount to make these cases go away and able to find a structure that they would continue under? It's certainly plausible." Ultimately, Thamel concludes there's “nothing linear here. But the settlement as a bridge to federal help is an idea being discussed, and it's one the SEC and Big Ten appear set to dig in on once they determine which members – presidents, chancellors and athletic directors – will make up the advisory group.” (link)

The Tampa Bay Times’ Matt Baker digs into the public records of Project Osceola, and beyond what has been reported previously, Baker points out that “projections for 2026 include naming rights to Florida State’s football home, formally called Bobby Bowden Field at Doak S. Campbell Stadium. FSU’s Year 1 revenue ranges from $1.5M to $5M, depending on the document and its assumptions. Sponsorship for the basketball arena, the Donald L. Tucker Civic Center, adds another $800K-$2.6M.” The documents also list a potential $75M expense for FSU in FY27 for a new baseball stadium and projects FSU’s baseball revenue to nearly double to $2.75M. There is also mention of a new revenue source in the form of an MiLB team in Tallahassee which initially adds a combined $4.1M in tickets, sponsorship/licensing and facilities. Also from Baker: “Multiple documents cite $8M in name, image and likeness (NIL) contributions for the ’24 fiscal year. One scenario ups that figure by 2-3% each year. In another, donations spike to $11.1M in ‘25 and $13.6M by ‘32. These numbers are notable because they’re an official snapshot in a murky marketplace filled with unverifiable, third-party claims. They’re also relevant to Project Osceola; Sixth Street asked about FSU’s NIL partnerships and ‘plan moving forward’ in July.” Lots more. (link)

U.S. Senators Marsha Blackburn (R-TN) and Cory Booker (D-NJ) have reintroduced The NCAA Accountability Act, which establishes guidelines for how the NCAA handles its infractions and investigative process. Specifically, the bill seeks to “establish due process protections for student-athletes, coaches, and universities that are under investigation by the NCAA for rule violations.” The bill would also require the NCAA to complete an investigation within a one-year period of time from when the school first receives a notice of investigation. The NCAA would also be prohibited from investigating alleged violations that occurred more than two years before the actual notice was sent to the school. In addition, the legislation authorizes the DOJ, through an administrative law judge, to fine the NCAA or individuals on staff up to $15M for violating the provisions of this bill. Blackburn: “The NCAA’s history of backroom deliberations that produce unfair punishments for athletes, coaches, and universities has gone on long enough. … The NCAA Accountability Act brings much-needed consistency and transparency to the NCAA, ensuring that everyone is operating under the same set of expectations for rule violations." Former Auburn/Cincinnati/Ole Miss/Texas Tech Football HC/U.S. Senator Tommy Tuberville (R-AL) predicts in a column for OutKick that former Alabama Football HC Nick Saban will be the first of many coaches to retire if Congress doesn’t address NIL. He writes: “As a result of this new situation, college sports have turned into the Wild West, with bidding wars for football players now starting with freshmen in high school. It will soon be impossible for any coach to build a team, knowing that his best players are highly incentivized to enter the transfer portal, which they are allowed to do at least once for no reason whatsoever. It is as if every player in the pros became a free agent every single year. Frankly this sends the wrong message, telling our young people to abandon their teams or avoid committing to anything bigger than yourself. It's also going to destroy the camaraderie between our players. Right now we’ve got quarterbacks making millions of dollars being guarded by guys making zero. Those same linemen know that their quarterback might bail and enter the portal anytime someone shows up offering him another cool million.” Tuberville goes on to tout the PASS Act, which he co-sponsors with U.S. Senator Joe Manchin (D-WV) and notes: “Congress shouldn’t sabotage a bipartisan, mainstream effort because of the extreme demands of those on the sidelines.” (link)

Fox, ESPN and Warner Bros. Discovery are creating a joint streaming platform to share sports assets, according to the Wall Street Journal’s Joe Flint and Isabella Simonetti, who report the service will be available to ESPN+, Hulu and Max subscribers. Each company will own one-third of the product, which is expected to launch later this year. There will undoubtedly be more details about this ahead. (link)

Vivature CEO Mouzon Bass and President Lance West Wilson, along with physician Robert Brent Scott, have been indicted by a federal grand jury and charged with conspiring to commit wire fraud, conspiring to commit healthcare fraud, and conspiring to commit money laundering. Another physician, Kyle Carter, has been charged with conspiring to commit wire fraud. The indictments allege that from roughly 2014-2023, Bass and Wilson used Vivature to submit false claims to private insurance carriers purporting that physicians, like Scott and Carter, were providing medical services for injured student-athletes at universities across the country. According to the DOJ, the services were actually performed by athletic trainers employed by the universities who were specifically excluded from insurance companies’ reimbursement policies. In total, the defendants are alleged to have collectively obtained more than $70M, which they used to purchase property, including a multimillion dollar home, lakehouse, and an international residence; and bought a multimillion dollar yacht. The Big 12 has fined Baylor AD Mack Rhoades $25K for his criticism of the officiating in last weekend’s men’s basketball game against Iowa State, from which Bears HC Scott Drew was ejected. CBS’ Matt Norlander reports that lead official Jeb Hartness “sending Drew to the locker room did not come as a surprise to some in the Big 12 for one reason: In mid-January, after CBS Sports' reporting on the pattern of bad behavior nationally with coaches constantly drifting onto the court, Big 12 coordinator of officials Curtis Shaw sent a stern memo to every head coach and every official in the league regarding bench decorum from all coaches and players.” From the memo: "Bench decorum has become a pressing issue and must be addressed. Situations where head coaches are clearly on the court, head coaches are playing 'defense' on players near their sideline, assistant coaches that are standing during every play, and comments from players sitting on the bench directed toward their opponents must be addressed and penalized." The memo also emphasized that "crews who do not handle these situations will be penalized." Norlander also reports this is the first season the Big 12 is formally grading its officials. Per a source: “Now we have an 'observer' that does. It was instituted this year for the first time in an effort to get better and be more accountable — and at arm's length of our coordinator (Shaw)." Meanwhile, one coach tells Norlander: “The memo went out, everybody knows that for the next few weeks it'll be toe-the-line, ticky-tacky.” (link, link)

Renovations to Simmons Bank Liberty Stadium will likely impact Memphis’ 2025 football season, according to Tigers AD Laird Veatch, who notes the “question really now is how much of '24 will be affected and in what way." Veatch says the university has been finalizing design plans and working on fundraising since getting the final go-ahead for renovations last month. "There's just a lot of work. A whole lot of work going on behind the scenes, as well as refining the design, starting the fundraising process and those conversations. There's several working groups and a lot of activity happening, but really for the next month or two I think you're going to see us with our heads down just really working hard to get through all that." Veatch also says of contract negotiations with Football HC Ryan Silverfield: “I feel good about the process, I feel good about the conversations with his agents and working through that. I would expect something to materialize here before long." (link)

St. John’s Men’s Basketball HC Rick Pitino offers two solutions for men’s hoops moving forward: “For basketball - have the Power 5 & Big East conference commissioners get together and create a salary cap between $1.5M and $2M. All contracts delivered to the league and school offices. All other conferences establish their own salary cap. I would never exclude anyone from the NCAA tournament. Obviously football is a different sport entirely and some of their talent makes more than NFL players. … Solution 2: Do away with letters of intent, make athletes sign a two year binding contract, no different than professional athletes - which they are. With that, the collective puts together their NIL contract based on the cap. Obviously a lot has to go into this. I believe the NCAA should be taken out of the equation and the commissioners put into it as the NCAA loses more cases than the defense lawyers on Law & Order.” (link, link)

The Big East will partner with Marquette and Invesco QQQ to celebrate National Girls and Women in Sports Day on February 7, culminating with the second annual “female forward” broadcast as the Golden Eagles host Georgetown for a women’s hoops matchup on FS1. The broadcast will feature an entirely female crew, including talent and production. Commissioner Val Ackerman: “The Big East is proud to work alongside Marquette to celebrate the many important roles women play in the sports world. We are also grateful to Invesco QQQ for choosing to partner with the Big East in our shared commitment to advancing women's sports. Dartmouth men’s basketball student-athletes are university employees and are therefore eligible to unionize under U.S. labor law, according to the NLRB Regional Director Laura Sacks, who finds: “Because Dartmouth has the right to control the work performed by the Dartmouth men’s basketball team, and because the players perform that work in exchange for compensation, the petitioned-for basketball players are employees within the meaning of the [National Labor Relations] Act. Additionally, I find that asserting jurisdiction would not create instability in labor relations. Accordingly, I shall direct an election in the petitioned-for unit. … Like the graduate student research assistants and teaching assistants in Columbia University, and like the football players in Northwestern University, the basketball players at issue here perform work which benefits Dartmouth. While there is some factual dispute as to how much revenue is generated by the men’s basketball program, and whether that program is profitable, the profitability of any given business does not affect the employee status of the individuals who perform work for that business. The basketball program clearly generates alumni engagement—and financial donations—as well as publicity which leads to student interest and applications. The Employer concedes that the players are representing Dartmouth when they wear Dartmouth-branded clothing and uniforms. While students at Dartmouth take part in many extracurricular activities, major media outlets do not pay for the right to broadcast and distribute video of the vast majority of those activities.” Full downloadable 26-page decision can be found here. In a statement to Front Office Sports’ Amanda Christovich, a Dartmouth spokesperson says the school will appeal the ruling. “Unlike other institutions where athletics generates millions of dollars in net revenue, the costs of Dartmouth’s athletics program far exceed any revenue from the program–costs that Dartmouth bears as part of our participation in the Ivy League. We also do not compensate our athletes, nor do we provide athletic scholarships; all scholarships are based on financial need.” Christovich also notes the Dartmouth team will have the opportunity to hold a union election even after an appeal is filed and adds: “The board usually consists of five people: three Democrats and two Republicans under the Biden administration. However, there’s currently a vacancy in one of the Republican seats. At least three board members would have to agree on a decision, which could take several months. The appeal process could continue beyond this board, however, to a Circuit Court and, ultimately, to the Supreme Court.” (link); An NCAA spokesperson tells Christovich: “The NCAA is in the process of reviewing the Region 1 Regional Director’s decision and its potential impact on all schools and student-athletes." Dartmouth men’s basketball student-athletes Cade Haskins and Romeo Myrthil called the ruling "a significant step forward for college athletes” before announcing plans to form the Ivy League Players Association for basketball players across the league. “We believe that other athletes will recognize the opportunities this ruling presents and will be inspired to follow suit. This association aims to foster unity, advocate for athletes' rights and well-being, and create a platform for collaborative decision-making. We look forward to working with our fellow Ivy League athletes to bring positive change to the landscape of college sports and the Ivy League." (link)

The College Football Playoff Management Committee unanimously agreed on an undisclosed distribution to the ACC for SMU, “but it's still less than the revenue the CFP typically distributes to Power 5 schools,” according to ESPN’s Heather Dinich. CFP Executive Director Bill Hancock: "I think everybody in the room felt like it was a fair accommodation. They've spent a long time talking about it -- over three meetings." Dinich explains that in the past, schools that made the leap from the Group of 5 conference to the Power 5 saw an increase in CFP revenue from roughly $1M to $6M. In 2022, the CFP voted to give full Power 5 revenue to incoming Big 12 schools UCF, Cincinnati, Houston and BYU. SMU and the ACC were under the impression they would get the same. The committee remains in a holding pattern concerning a format for the 12-team playoff, with all but the Pac-12 in favor of a 5+7 model. Hancock: “It's not done yet because the Pac-12 isn't prepared to vote on it.” The measure needs unanimous approval to pass. (link)

NCAA President Charlie Baker and Ohio Governor Mike DeWine are calling on lawmakers in the state to ban prop bets involving the performance of collegiate athletes. DeWine says in a release: “One year into sports gambling in Ohio, we have seen a marketplace develop where a number of bad actors have engaged in unacceptable behavior by making threats against student-athletes in Ohio and across the country. By amending rules to focus bets on the team and away from individual athletes, I believe we can improve the marketplace in Ohio and better protect student-athletes from unnecessary and potentially harmful threats.” Baker adds: “Sports betting without appropriate controls poses real risks to the well-being of student-athletes and to the integrity of collegiate competition – risks which are heightened by individual prop bets.” If the request is approved by the Ohio Casino Control Commission, the following would also be prohibited: “Any full team proposition bet on a sporting event governed by the NCAA that, while not based solely on an individual, would on average depend 50% or more on the statistical performance of one or two athletes on the team to determine the outcome. For example, whether Team A will gain over 200 passing yards in a football game would predominantly rely on the quarterback’s yardage, likely over 50% dependence.” (link)

Of the Mountain West’s 10 men’s basketball members, San Diego State “regularly rank[s] in the bottom three when it comes to charter flights per season.” The San Diego Union-Tribune’s Mark Zeigler notes that most years the Aztecs “get four legs, or the equivalent of two round trips. This season, they’ve played 10 games away from Viejas Arena. Two were within driving distance. The other eight required plane trips, and the Aztecs flew commercial on all eight. That included close to a 10-hour trip home following a Saturday afternoon game at Boise State, arriving after midnight, when their flights through Portland were delayed by winter weather. In New Mexico, the day’s only nonstop to San Diego left 45 minutes after the game ended. The Aztecs instead flew through Phoenix in what became an eight-hour odyssey of delays and missed connections.” Aztecs AD John David Wicker: “Obviously, we want to charter more. There are a lot of needs as you look at running a top-tier Division I basketball program. I’d like a lot more money to do a lot of different things. We just have to take the investment that we have and use it most efficiently. It’s balancing the needs across the board. We’re never going to be Texas. We’re never going to be Ohio State. But we’ll continue to try to build our budget and address the needs of our student-athletes.” Zeigler notes a typical Mountain West road trip costs SDSU $20-25K while a round-trip charter is usually about $50K. NCAA coaches could vote on changing a rule prohibiting Canadian Hockey League players from later playing in the U.S. college ranks after this season concludes, according to Sportsnet’s Elliotte Friedman, who adds: “Even if coaches go for it, there’s the question of how quickly will the NCAA allow it to happen. So there’s that, but we are headed toward a future of where CHL players are going to be able to play NCAA hockey. The question is when.” Friedman notes the advent of NIL has changed the thinking among many coaches about the CHL’s policies. (link)

The San Francisco 49ers are unhappy with the practice field at UNLV, where the team was assigned to prepare for the leadup to Sunday’s Super Bowl. According to CBS’ Jonathan Jones, a “49ers advance group that includes members of the equipment staff and grounds team traveled to Las Vegas last week to check out the facilities. They feel the grass is too soft for the team to practice on, and the team has considered alternatives. … Sources say this is not a health-and-safety issue as much as it's simply a preference issue. Sources say the current surface at UNLV meets all NFL, NFL Players Association and independent standards. Among the tools the league uses to make sure a field is up to code is the ‘Clegg’ test, which measures a field's firmness. NFL fields have to be at or below 100g (units of gravity) to pass. According to a source, the natural grass at UNLV measures around 50g, whereas the 49ers have a preference around 70g.” The NFL designates one team as the home team and the other as the away team on a rotating basis between the AFC and NFC each year. As the home team this year, the Chiefs get to use the local NFL team’s facilities. (link)

Business of Fashion's Daniel Yaw-Miller chronicles the challenges facing Nike, many of which are “self-inflicted,” and notes: “After decades of rapid, almost uninterrupted growth, there’s an emerging consensus among analysts, industry insiders, loyal customers, athletes and employees past and present that Nike is fast becoming just another sneaker brand. … It’s hard to pin Nike’s problems on any one cause. But sneaker industry insiders trace many of the brand’s shortcomings to decisions made early in the tenure of John Donahoe, who was named chief executive in January 2020. His arrival came amid an exodus of veteran designers, marketing gurus and executives. … The company invested ever-more design and marketing resources into its booming retro sneaker business, capitalizing on seemingly bottomless demand for iterations on vintage Jordans and Air Force 1s.” While that proved successful in the short term, Nike was losing ground in a category it once dominated: performance products. Whether correlative or causal, the result has been a deterioration of Nike’s cultural impact. As an upstart, Nike invited competition with other companies, and Yaw-Miller notes the Swoosh’s rivals are now using that playbook against Nike. The Kicks You Wear publisher Mike Sykes: “It’s what so many brands seem afraid of doing these days. They go out of their way to not mention the competition as if it just doesn’t exist. No, fam. It’s there. Acknowledge it. Tell us why your thing is better than their thing. That’s the name of the game here.” (link)
