The Arizona Board of Regents is in negotiations with an external firm to help restructure the athletic department and streamline athletic administration “from the ground up.” UA Interim CFO John Arnold says the department needs a complete overhaul to bring it into the "modern athletics market,” adding: “We need to reset their budget and install hard budget caps.” According to the Arizona Republic’s Helen Rummel, UA overspent its athletics budget by $32M in FY23 while the university overspent about $61M on all of its academic units combined. Given the rising costs associated with collegiate sports, Arnold said there will need to be a shift in how people think about athletics funding. "It's just unrealistic to think that athletics moving forward can be a stand-alone, self-funded unit. In the modern athletics market, that's just not possible." (link)

Washington State AD Pat Chun tells KREM’s Tim Pham that “we believe as we're probably headed into, really, the most combustible time of change in the history of college athletics, that ironically, what happened to Oregon State and Washington State may position us correctly, because it gives us gives us time and some resources that we can have some certainty on what we want to look like. And then whatever the model is, we can opt into that model at whatever point that is.” On keeping the Apple Cup alive, Chun says: “When you talk to former football players that played for Washington State, I have yet to meet one that wasn't adamant that we have to play them. I tell everyone, 'Everybody's right.' I fully understand the hostility toward UW. I will put myself in that category with all the hostility toward UW. But that's one reason not to play them. There's a dozen reasons to play them. We owe it to our student-athletes.” Ticket sales appear to have been largely unaffected by realignment, as Chun explains: “Where I'm gauging everything is on past behavior, and this past year we're up in football ticket revenue, men's basketball ticket revenue, women's basketball ticket revenue, volleyball ticket revenue, baseball's tracking steadily forward. I think we're looking at this as, I know, it's different and it's going to be a change, but man Cougs love supporting Cougs and Cougs understand there's a bigger picture here going on. So I think we're cautiously optimistic just because we've had back-to-back years of increases with all of our ticket sales.” (link)

JohnCanzano.com’s eponymous publisher answers a reader question about how Washington State and Oregon State will use its Pac-12 voting leverage on the College Football Playoff Management Committee, which requires unanimity for changing the 12-team format to a 5+7 model, something the Pac-12 currently opposes. “OSU and WSU are due to receive roughly $6M a year in playoff distributions in the next two seasons. That’s what all ‘Power 5’ members get. The Group of 5 schools get about $1M each and are left to fight for at-large berths.” Washington State President Kirk Schulz, who represents the league on the committee, “reportedly wants a guarantee of voting rights and revenue distribution for the Pac-12 that would stretch beyond the 2025 season. The Pac-12 has a two-year exemption from the NCAA to get back to a minimum of eight members. I don’t blame Schulz for playing his hand.” (link)

Sportico’s Michael McCann unpacks what comes next as Dartmouth approaches a February 20 deadline to appeal the NLRB’s decision to classify men’s basketball student-athletes as employees. The school can request an extension to that deadline; however, the players will still vote on March 5 on whether to unionize. Until then, Dartmouth must refrain from conduct that unduly pressures players, such as enlisting coaches, athletic staff and faculty to make promises to players in exchange for “no” votes. McCann believes it is likely that Dartmouth will appeal and “request a measure from the NLRB to defer the vote’s impact. Not only does Dartmouth contend the players are non-employees, but as a member of the NCAA and Ivy League, the school is contractually barred from paying players. In that light, Dartmouth could seek a stay (postponement), which would table the vote taking effect until after Dartmouth’s appeal is decided. Alternatively, the school could ask the NLRB to impound (keep in private) the union vote until after the appeal is decided. In either scenario, Dartmouth wouldn’t be obligated to bargain with the players’ union for the foreseeable future. The timing of when the board would decide the appeal is unknown and could be a game changer.” Lots more, including how the general election in November could impact the case long-term. (link)

Towson AD Steve Eigenbrot argues college sports should look to baseball as an example of how college and professional sports successfully work together to each other’s benefit, writing: “MLB teams can draft athletes upon high school graduation, a reasonable standard that allows draft access to 17- and 18-year-olds. Unlike the NFL, which requires one to be three years removed from high school, or the NBA with its ‘one-and-done’ rule, MLB does it right. Congress needs to redirect its energy to change this, pushing these leagues to cease their unfair labor practices and provide unfettered draft access upon completion of high school. If this means the billionaires invest in a real minor league to stockpile their underdeveloped prospects, let it be, but the G League isn’t it. We had this nearly figured out in the past. Our history here includes blanket freshman ineligibility, as well as those like Kobe Bryant and LeBron James forgoing college altogether. Unfortunately, the NBA billionaires drafted too many busts and reinstated their free minor league.” Eigenbrot contends that “providing student-athletes earlier access to professionalize completely reframes the current conversations about this topic. We keep trying to do more to allow student athletes to share in the resources they help generate, but it hasn’t worked — and it won’t. … With over 200 minor league baseball teams, college baseball generates less attention and money than college basketball and football, but it shouldn’t matter. We need to start thinking about what is right and stop with the money grab. I know that’s easy to say and hard to do, but it’s time. It’s beyond time. MAC Senior Assoc. Commissioner for Institutional Services/SWA Kristin Williams sits down with AthleticDirectorU’s Tai M. Brown at the 2024 NCAA Convention to discuss the MAC’s efforts to include the student-athlete voice in its governance structure. Williams emphasizes the importance of establishing authentic and transparent relationships with student-athlete leaders in order to garner trust in the governance process and describes how she serves as a connecting point between the commissioner and the student-athlete. “For me and what my role has been is really getting in front of the student-athletes and being open and honest. We're not the scary administration, we are people as well who really do want to help. So, I actually start each year with the student-athletes of [saying] this is who I am, I'm going to ask you to trust me throughout the process. I'm going to give you who I am as best I can in five minutes in just a list of the different things about me that maybe they can connect with at some point in time. So it's really about growing those relationships with them.” Williams also explains that part of her problem-solving strategy involves helping student-athletes suggest solutions to problems they present before going to the league. “Those answers we can craft, and we can have one that is high-resource required and bring them back down to what is actually manageable and more realistic in the next year, two years. We can always continue to grow to that high-resource response, but how do we take what we have and manage it to help solve your problem.” Full interview on ADU. (link)

Utah Congressman Jordan Teuscher (R-South Jordan) has introduced HB202, which would establish guardrails around NIL by establishing current NCAA guidelines as state law, require student-athletes to disclose deals worth $600 or more to their schools and prohibit deals promoting adult entertainment, alcohol, tobacco and other industries. Teuscher says he “goes back and forth” over whether the deals should be made available for public records requests, adding: “I guess the bottom line for me is I’m not convinced that there’s really a public need for the public to know how much these athletes make. Like, why does it matter?” First Amendment attorney Jeff Hunt believes they should be public records because there is compelling interest for government compliance oversight. “If government is going to get into the business of reviewing NIL agreements to make sure that they comply with NCAA eligibility requirements and that they don’t run afoul of all these prohibited transactions in the bill, then there needs to be some oversight of that compliance function.” The public, he adds, currently has “oversight over all regulatory functions in the state of Utah.” (link)

Homefield Apparel is launching The Homefield NIL Partnership Program which Extra Points publisher Matt Brown reports will create collective-specific promo codes that will give first-time customers a 10% discount. Homefield will then give 10% of those sales to the collective. Then, on six specific dates, Homefield will give 20% discounts and share 20% of the revenue to the collectives. The codes that will be good for an entire year. The five collectives that will participate in the program at launch are the Boilermaker Alliance (Purdue), Hoosiers Connect (Indiana), Florida Victorious (Florida), Classic City Collective (Georgia) and Wildcat NIL (Kansas State). Brown points out that most collectives “rely heavily on a handful of major donors to fund their operations. It can be much easier and cheaper to ask two people for $100K than it is to ask 2,000 people for a hundred bucks, but there are only so many people who are capable of writing a check for a hundred grand. Eventually, those people stop writing checks.” As such, Brown believes that this program is “worth a shot” when it comes to bringing in more revenue for collectives, “especially since this strategy doesn’t cost a lot of money to attempt, and could potentially reward customers for buying something they probably wanted to buy anyway. Other affiliate partnerships, like with collective-branded beer, are going to be exclusionary to some groups of people. But everybody needs clothes, right?” (link)

Maryland Football HC Mike Locksley appeared on a local radio show and shared a story about a third-string RB asking for $100K to remain on the roster, “and you're like, ‘Where does this magic $100K number come from?’ And it just, I mean, I sat in my office and every meeting I had was basically – and we're seven wins and going to a bowl and taking the next step – but everything coming in was like, ‘I want this. I want that.’ And the greatest team sport has now become kind of individualized. And I went home and was like, ‘Man, I don't know how much I can do because I'm about ready to come join y'all full-time, man. Y’all got room for me back at the studio or what?" (link)

The NCAA aired a new PSA during the pregame for last night’s Super Bowl, utilizing commercial inventory that had previously been used to promote March Madness, per SBJ’s Ben Portnoy. This year, the association chose to tout its recent efforts, as NCAA SVP of Business Performance Brian Higgins tells Portnoy: “We thought with all the other things we were doing in the national office — to do more for our student-athletes and hopefully change some of the image of the NCAA — that it would be a better use of that 30-second spot to talk about the holistic student-athlete model and the mental health services that are going to be available for students.” (link)

Distribution of the Pac-12’s intellectual property rights continues to be a subject of talks between Washington State and Oregon State and the 10 outbound members, and one person involved in the process tells JohnCanzano.com’s namesake: “We are continuing to work through the exact language. The goal is to arrive at a place where both the conference and the departing schools are able to use the archival material.” Another notes that the “conference owns all the IP and there’s value to it.” At least two documentary film production companies, including one from Amazon Studios, are already inquiring about a project documenting the league’s downfall, and another source tells Canzano: “The idea of a documentary was briefly discussed. Somebody is going to do this, we think. You’re either involved with it or you’re not. If we want to see it done accurately, we should probably be engaged.” Other unknowns moving forward include the fate of the Sam Ramon production facility, what happens with the Pac-12 social media channels, and who owns the league’s data. “Meanwhile, Commissioner George Kliavkoff continues to represent the Pac-12 at meetings. Someone has to show up, I guess. But he’s in the way of whatever comes next and nobody I spoke with expects Kliavkoff to be on the job after June 30. The archival video footage isn’t the most important element to any of the involved parties. Nor is the operation of Pac-12.com, the data, or the conference’s Twitter account. But they’re examples of the many loose ends.” (link)

Kennyhertz Perry attorney Mit Winter points out that under federal law medical residents are classified as both employees and students and often unionize and collectively bargain. Extra Points publisher Matt Brown points out there are examples of unionization in some states but “a closer look at the realities of graduate student and medical resident unions would not make me excited about emulating anything about that for other workers. The deck is not stacked in their favor.” OSKR Founder Andy Schwarz also weighs in: “This is why I keep saying the NCAA should let athletes unionize and then take advantage of how fragile and difficult to organize that union would be.” Winter believes it wouldn't be as difficult as some people assume. “We wouldn’t be talking about every college athlete or even every DI athlete in a given sport.” Schwarz replies: “I think the very first union contract would be decent and represent a high-water mark. At the next negotiation, the ‘owners’ would lock out the athletes until they begged to return, a la when the Pac-12 athletes threatened a boycott so Larry Scott canceled the season. … Sure, both sides lose in a work stoppage. Which side has more to lose from losing a season – the guy with a four-year college or the school with 150 years and running?” (link, link)

Related, former NFLPA Executive Director DeMaurice Smith was paid $7.85M in 2023, his last full year on the job, according to Sportico’s Eben Novy-Williams and Daniel Libit, who also note the union’s net assets now stand at $781.3M. Nebraska drew a record 15,042 fans for its women’s basketball upset win over Iowa yesterday. (link); After the game, Hawkeyes HC Lisa Bluder tried to get into the media room, according to KGAN’s Owen Siebring, and was heard shouting on an external microphone: “We’ve got a flight to catch. This is bulls–t. This is not Big Ten protocol. … They play music while you shoot free throws and now this?” Siebring notes the visiting team is traditionally supposed to go to the podium first. Louisville Women’s Basketball HC Jeff Walz voiced his displeasure with the officiating in the Cardinals’ loss at Syracuse yesterday. Down by one with less than five seconds left, UL fouled to stop the clock. WDRB’s Eric Crawford: “You see it at the end of every game when a team needs to foul. Two hands extended, maybe a semi-wrap up, and a whistle. Almost every game. Except this time, when the whistle blew, the official raised both arms, crossed, to signal an intentional foul.” Walz: “It was a God-awful call. It was terrible officiating. They should be embarrassed. But you know, I'll get my fine. I'm sure I'll get a letter of reprimand. But at this point, somebody has to start holding the officials accountable. That call was the worst call I've seen in my 29 years of coaching. If we’re going to start calling that, every foul at the end of a game when a team has to foul, it’s intentional. Every foul is. We all know it is. But to call it in a one-point game with 2.5 seconds left, it’s just awful. It's atrocious. It's embarrassing. It's embarrassing for our league. But we'll never hear anything about it because it's such a sacred society that we can't ever reprimand publicly an official, God forbid. But we'll reprimand coaches and players will be called out. But there's three people out there, God forbid, if we came out and we actually said a league made a statement that it was a blown call, a bad call. We won't do that.” (link)

Boise State Softball HC Justin Shults sat down with D1.ticker’s Matt Roberts at the 2023 NFCA Convention to discuss the growth of the sport and how to sustain success overall while maintaining parity in the changing landscape. Shults points out the transfer portal is a double-edged sword, through which people are “getting approached probably unethically, But I think at the same time I've been able to build a culture and to create a product that we're proud of, and part of it's the people who didn't buy into that blue-collar way. It was actually faster for us to allow them to go find a new home, so I think the portal is good. … The rich are going to get richer, but for us it’s how do you find the right recruits whether it's portal or high school kids, and then your job is to keep them. I think as a mid-major or whatever we're going to call ourselves, our job is to create an environment that they want to stay.” Shults notes that while there are NIL opportunities for softball student-athletes, that’s not the focal point of his recruiting pitch. “The focal point is coming in with that chip on your shoulder…and do you want to be a part of something that's different because right now it's easy to hit the portal, go join a super team and play. + Michigan is expected to hire Chicago Bears Chief of Staff Sean Magee as a Senior Assoc. AD/GM for football, according to 247Sports’ Matt Zenitz. Magee served as Assoc. AD for Football for the Wolverines from 2017-21 and “helped build the Wolverines from a roster, staff and culture standpoint,” Zenitz notes, adding that an SEC school had also been targeting Magee for a Deputy AD role. The shortened two-year bidding window for NCAA championships led to the Greater Raleigh Sports Alliance to present bids largely for sports it has hosted in the past, namely men’s basketball, College Cups, golf, gymnastics and the DII College World Series. The News & Observer’s Luke DeCock notes there have been talks about the GRSA presenting bids to host other events, including wrestling, a volleyball regional and the Frozen Four. GRSA Executive Director Scott Dupree: “I’m pretty confident we would sell out (wrestling) and make it a successful event. I just think it creates potential complications. We decided to focus on men’s basketball. I know we’ll look at wrestling again next time. … I can’t say it for certain, but I can say it with a good deal of confidence, a lot of these decisions would have been made differently in a four-year window. That would have given us, in a big-picture kind of way, a lot more flexibility, a lot more options. In a four-year window, our final bid package would look different. I couldn’t tell you exactly how, but different.” (link)

Puck’s John Ourand and Matt Belloni unpack the ESPN-Fox-Warner Bros. Discovery sports bundle and Ourand notes that “at least one league is looking into whether the networks even have the rights to carry their games on this new platform. It’s clear that they aren’t taking this lying down. … What has particularly struck me during my time in Vegas this week is how little anyone actually knows about this plan—even from the companies involved. We don’t have a name. We don’t have a price point. We don’t know who’s going to run it. We don’t have an official launch date. All we have is a lot of angst from leagues and distributors who were kept in the dark about all of this.” They also discuss Endeavor’s planned divestments as majority owner Silver Lake continues raising money to take it private. While WME, the agency, isn’t likely to be going anywhere, Belloni says On Location “seems the most likely to go, according to people I’ve talked to.” (link)

The Wall Street Journal’s Joe Flint, Isabella Simonetti, Jessica Toonkel and David Marcelis take a comprehensive look at the ESPN-Fox-Warner Bros. Discovery sports bundle and observe that “with the streaming venture, Disney, Warner and Fox have decided to leap into a new business even if it accelerates cable’s collapse—with the real risk that what they are building won’t be anywhere near as lucrative. As one rival executive put it, they are tearing down the house to put a shed in the backyard.” Former ESPN Chairman Steven Bornstein agrees: “It just further decays the bundle, which is the lifeblood of these companies. I would be concerned if I was sitting at Disney and Fox and Warner Bros. about being part of something like this.” Crakes Media Principal Patrick Crakes, however, contends: “We’re doing what should have happened slowly over 20 years all at once now. This is not going to save anybody, but it’s a start.” Flint, et al. go on to report that “a number of private-equity firms, including TPG, have expressed interest in possibly investing in the new company,” though it remains unclear whether Disney, Fox and WBD want financial partners. Before the new streamer can become fully realized it will have to pass muster with federal regulators, which is not a given, according to former FTC Chair/General Counsel William Kovacic, who asks: “How do you assure that you get collaborators who have a common interest to schizophrenically step aside and go after each other’s throats” when competing for content rights?
