Dartmouth Men’s Basketball student-athletes Romeo Myrthil & Cade Haskins say they’ve heard from peers around the nation on potential unionization efforts. Haskins: “You kind of want to keep it on the low key, especially in the beginning phases. But everyone’s really curious and kind of seeing the opportunity for real change in the future with what we’ve started doing.” Myrthil: “We want to try to expand it to an Ivy League Players Association, because that’s the one we’re most invested in. Headlining attorney Tom Mars, who is representing the Tennessee-focused Spyre Sports Group, remarks to Arkansas Business: “The NCAA has probably made itself the most vulnerable court defendant in American history. The NCAA as an institution has managed to make itself the most hated organization on the planet, maybe short of Al Qaeda. It’s no wonder people don’t like the NCAA.” Sportico’s Michael McCann agrees, noting: “That's no exaggeration. The NCAA has a lot of money, is unpopular with many groups and both conservative and liberal judges think amateurism runs afoul of federal laws.” (link, link)

The ACC spent just over $1M lobbying Congress in 2023, almost triple what the league paid out the previous year, according to Sportico’s Daniel Libit, who also reports the SEC spent $790K lobbying, more than 2x its 2022 spend. Meanwhile, the Big 12 paid $170K, up from $100K in 2022, while the Big Ten’s $220K was slightly less than it spent the year before, and the Pac-12 “was on pace to match its 2022 spending before terminating its relationship with lobbying firm Cassidy & Associates in the fall, following an exodus of conference members to the Big Ten and Big 12. The Pac-12—and its subsidiary, Pac-12 Enterprises—finished last year having expended $210K on lobbying.” In total, the P5 leagues spent over $2.39M to lobby lawmakers, while the NCAA reported spending $540K, including $360K on its outside lobbyist, Brownstein Hyatt. The rest is attributed to its in-house government relations director, Dawn Booth. The conferences used the same lobbying firms they’ve used for the last several years, as international law firm DLA Piper, which represents the ACC, reported being paid $1.01M on a four-person lobbyist team that included former U.S. Sen. Saxby Chambliss (R-NC). The other conference’s firms were Akin Gump (SEC), FGS Global, formerly the Glover Park Group (Big Ten); and Kit Bond Strategies (Big 12). Libit also reports the MAC paid $14,427 to Active Policy Solutions and the Missouri Valley Conference spent $10K with Washington Navigators. (link)

UCSD AD Earl Edwards talks with AthleticDirectorU’s Tai M. Brown at the 2023 Women Leaders Convention about his experience guiding the Tritons from DIII to DII to DI over the course of two decades. Edwards and Brown also discuss repositioning the value of athletics in order to cultivate buy-in from campus stakeholders during the various transitions, the longtail impact of the DI transition on the talent level, and the diversity and academic profile of the student-athlete population. Edwards says the increasingly diverse student body is a natural outgrowth from moving to DI because DIII has no scholarships and DII has limited scholarships. “We’re Division I now. We max out in 10 of our sports when it comes to scholarships, and that obviously provides access and opportunity to athletes that wouldn't have had that opportunity in the past. … One thing that I like to say about collegiate athletics is that it’s more than games and competition because that’s what everybody looks at, games and competition. But we're really a laboratory for personal development, so when I look at the 500 to 600 athletes that we have, we're teaching them a lot of soft skills that are going to make them better citizens as they move forward, whether it's time management, setting goals, being committed, working with a large group, how to deal with failure – all those things are things that we learn in sports and that's what I think Athletics really does for the students and for the campus.” Full interview on ADU. Washington Football HC Jedd Fisch tells The Athletic’s Ari Wasserman that while he loved Arizona, “when I made the decision to take the [UW] job, I knew how many people I could help. I knew how many people I could take (to Washington). Selfishly, I could have stayed in Arizona. I would have been compensated really well. I think my contract would have been signed somewhere between February and May of the coming year. Hopefully, with the financial situation, it all would have been taken care of. But my assistant coach pool would still have been $3.5M less than what it is now. And some of the things I could have done for all our support staff would not have been able to get done.” Fisch also addresses criticism he’s received for having a three-minute player meeting to tell the team he was leaving. “The team meeting was not my choice. The team meeting was absolutely dictated to me from administration and really from the NCAA. If you’re going to call a player meeting and let them know you’re leaving to go to another Division I program, then you can’t talk about the why. You can’t talk about really any part other than I’m going to take the University of Washington job because otherwise you’d be considered recruiting and tampering and trying to get people to jump in the portal. + Florida Baseball HC Kevin O’Sullivan has agreed to a contract extension through October 2033 that will pay him an average of $1.84M per season. If O’Sullivan is let go without cause, UF would owe him 90% of his remaining compensation. If O’Sullivan leaves without cause, he would owe the Gators $250K per contract year remaining unless his annual total compensation is not in the top five for D1 HCs, in which case the total buyout is reduced to $500K. The new deal puts him second in the league in terms of compensation, behind only Vanderbilt HC Tim Corbin ($2.447M). (link)

Youngstown State will begin a $2M seating renovation project at the Beeghly Center following the basketball season. The wooden bleachers on the upper tier of both sides of the court and the existing in the bottom tier will be removed and replaced with new and improved seatbacks. Penguins AD Ron Strollo says the new seats will be wider and have additional depth for increased legroom. The project will also reduce capacity from 6,300 to between 4,800 and 5,100. Strollo also notes several more upgrades are planned in the coming years, including new signage in the building, other aesthetic updates, a booster room, locker room renovations and new video display boards. “Everything’s going to be a two or three-year (project). It depends on fundraising. But the most important piece is the seating.” YSU has reportedly secured $3M in commitments from donors. (link)

Following the announcement of the ESPN-Fox-Warner Bros. Discovery super sports streamer, Puck’s John Ourand reports NFL attorneys began “scouring its contracts with ESPN and Fox to see if the media companies were within their legal rights to launch such a service. Alas, the initial review suggested that the league could not do anything to keep its games off the new streamer. (After all, it’s hard to imagine that the generously compensated business affairs teams and outside counsels at ESPN, Fox, and WBD would allow something like this to slip through the cracks.) But the NFL is still looking for potential loopholes.” Ultimately, Ourand believes “this will likely register as just a blip in [Disney-NFL] relationship. But it is significant to note that the lawyers are involved.” (link)

Elevate is nearing an acquisition of Fenway Sports Group’s brand consulting unit, according to SBJ’s Terry Lefton, who notes the “addition of brand consulting expands Elevate’s capabilities, allowing it to compete more fully with the likes of Wasserman, 160over90, Excel and other marketing agencies with broad service offerings. It also leaves FSG as a more sales and management-focused agency.” Lefton also reports the consulting unit has fewer than 10 employees and between $2-2.5M in annual consulting revenues, with around 10 clients, including Moderna, Wasabi Technologies and Santander, which used the group largely to activate against FSG-owned properties. Arena Group expects to continue publishing Sports Illustrated despite having its license revoked by SI’s owner Authentic Brands Group, according to a filing with the SEC, which states Arena “expects to enter into a letter agreement with ABG,” which will allow it to continue operating the Sports Illustrated business until or unless “ABG provides written notice of its desire to transfer the license to another party.” Sportico’s Daniel Libit, Brendan Coffey and Eben Novy-Williams report that “as part of this arrangement, Arena said it expects Authentic Brands to drop the $45M penalty that was triggered when Arena failed to make its $3.75M quarterly payment at the end of 2023. In response, ABG revoked Arena’s license and announced it would be laying off a third of its staff, putting the future of the storied sports publication in doubt. Arena now says it believes that ABG will forgo the licensing fees it would have to pay since the start of the year.” A spokesperson for ABG did not respond to a request for comment. (link)

The Arizona Board of Regents is in negotiations with an external firm to help restructure the athletic department and streamline athletic administration “from the ground up.” UA Interim CFO John Arnold says the department needs a complete overhaul to bring it into the "modern athletics market,” adding: “We need to reset their budget and install hard budget caps.” According to the Arizona Republic’s Helen Rummel, UA overspent its athletics budget by $32M in FY23 while the university overspent about $61M on all of its academic units combined. Given the rising costs associated with collegiate sports, Arnold said there will need to be a shift in how people think about athletics funding. "It's just unrealistic to think that athletics moving forward can be a stand-alone, self-funded unit. In the modern athletics market, that's just not possible." (link)

Washington State AD Pat Chun tells KREM’s Tim Pham that “we believe as we're probably headed into, really, the most combustible time of change in the history of college athletics, that ironically, what happened to Oregon State and Washington State may position us correctly, because it gives us gives us time and some resources that we can have some certainty on what we want to look like. And then whatever the model is, we can opt into that model at whatever point that is.” On keeping the Apple Cup alive, Chun says: “When you talk to former football players that played for Washington State, I have yet to meet one that wasn't adamant that we have to play them. I tell everyone, 'Everybody's right.' I fully understand the hostility toward UW. I will put myself in that category with all the hostility toward UW. But that's one reason not to play them. There's a dozen reasons to play them. We owe it to our student-athletes.” Ticket sales appear to have been largely unaffected by realignment, as Chun explains: “Where I'm gauging everything is on past behavior, and this past year we're up in football ticket revenue, men's basketball ticket revenue, women's basketball ticket revenue, volleyball ticket revenue, baseball's tracking steadily forward. I think we're looking at this as, I know, it's different and it's going to be a change, but man Cougs love supporting Cougs and Cougs understand there's a bigger picture here going on. So I think we're cautiously optimistic just because we've had back-to-back years of increases with all of our ticket sales.” (link)

JohnCanzano.com’s eponymous publisher answers a reader question about how Washington State and Oregon State will use its Pac-12 voting leverage on the College Football Playoff Management Committee, which requires unanimity for changing the 12-team format to a 5+7 model, something the Pac-12 currently opposes. “OSU and WSU are due to receive roughly $6M a year in playoff distributions in the next two seasons. That’s what all ‘Power 5’ members get. The Group of 5 schools get about $1M each and are left to fight for at-large berths.” Washington State President Kirk Schulz, who represents the league on the committee, “reportedly wants a guarantee of voting rights and revenue distribution for the Pac-12 that would stretch beyond the 2025 season. The Pac-12 has a two-year exemption from the NCAA to get back to a minimum of eight members. I don’t blame Schulz for playing his hand.” (link)

Sportico’s Michael McCann unpacks what comes next as Dartmouth approaches a February 20 deadline to appeal the NLRB’s decision to classify men’s basketball student-athletes as employees. The school can request an extension to that deadline; however, the players will still vote on March 5 on whether to unionize. Until then, Dartmouth must refrain from conduct that unduly pressures players, such as enlisting coaches, athletic staff and faculty to make promises to players in exchange for “no” votes. McCann believes it is likely that Dartmouth will appeal and “request a measure from the NLRB to defer the vote’s impact. Not only does Dartmouth contend the players are non-employees, but as a member of the NCAA and Ivy League, the school is contractually barred from paying players. In that light, Dartmouth could seek a stay (postponement), which would table the vote taking effect until after Dartmouth’s appeal is decided. Alternatively, the school could ask the NLRB to impound (keep in private) the union vote until after the appeal is decided. In either scenario, Dartmouth wouldn’t be obligated to bargain with the players’ union for the foreseeable future. The timing of when the board would decide the appeal is unknown and could be a game changer.” Lots more, including how the general election in November could impact the case long-term. (link)

Towson AD Steve Eigenbrot argues college sports should look to baseball as an example of how college and professional sports successfully work together to each other’s benefit, writing: “MLB teams can draft athletes upon high school graduation, a reasonable standard that allows draft access to 17- and 18-year-olds. Unlike the NFL, which requires one to be three years removed from high school, or the NBA with its ‘one-and-done’ rule, MLB does it right. Congress needs to redirect its energy to change this, pushing these leagues to cease their unfair labor practices and provide unfettered draft access upon completion of high school. If this means the billionaires invest in a real minor league to stockpile their underdeveloped prospects, let it be, but the G League isn’t it. We had this nearly figured out in the past. Our history here includes blanket freshman ineligibility, as well as those like Kobe Bryant and LeBron James forgoing college altogether. Unfortunately, the NBA billionaires drafted too many busts and reinstated their free minor league.” Eigenbrot contends that “providing student-athletes earlier access to professionalize completely reframes the current conversations about this topic. We keep trying to do more to allow student athletes to share in the resources they help generate, but it hasn’t worked — and it won’t. … With over 200 minor league baseball teams, college baseball generates less attention and money than college basketball and football, but it shouldn’t matter. We need to start thinking about what is right and stop with the money grab. I know that’s easy to say and hard to do, but it’s time. It’s beyond time. MAC Senior Assoc. Commissioner for Institutional Services/SWA Kristin Williams sits down with AthleticDirectorU’s Tai M. Brown at the 2024 NCAA Convention to discuss the MAC’s efforts to include the student-athlete voice in its governance structure. Williams emphasizes the importance of establishing authentic and transparent relationships with student-athlete leaders in order to garner trust in the governance process and describes how she serves as a connecting point between the commissioner and the student-athlete. “For me and what my role has been is really getting in front of the student-athletes and being open and honest. We're not the scary administration, we are people as well who really do want to help. So, I actually start each year with the student-athletes of [saying] this is who I am, I'm going to ask you to trust me throughout the process. I'm going to give you who I am as best I can in five minutes in just a list of the different things about me that maybe they can connect with at some point in time. So it's really about growing those relationships with them.” Williams also explains that part of her problem-solving strategy involves helping student-athletes suggest solutions to problems they present before going to the league. “Those answers we can craft, and we can have one that is high-resource required and bring them back down to what is actually manageable and more realistic in the next year, two years. Utah Congressman Jordan Teuscher (R-South Jordan) has introduced HB202, which would establish guardrails around NIL by establishing current NCAA guidelines as state law, require student-athletes to disclose deals worth $600 or more to their schools and prohibit deals promoting adult entertainment, alcohol, tobacco and other industries. Teuscher says he “goes back and forth” over whether the deals should be made available for public records requests, adding: “I guess the bottom line for me is I’m not convinced that there’s really a public need for the public to know how much these athletes make. Like, why does it matter?” First Amendment attorney Jeff Hunt believes they should be public records because there is compelling interest for government compliance oversight. “If government is going to get into the business of reviewing NIL agreements to make sure that they comply with NCAA eligibility requirements and that they don’t run afoul of all these prohibited transactions in the bill, then there needs to be some oversight of that compliance function.” The public, he adds, currently has “oversight over all regulatory functions in the state of Utah.” (link)

Homefield Apparel is launching The Homefield NIL Partnership Program which Extra Points publisher Matt Brown reports will create collective-specific promo codes that will give first-time customers a 10% discount. Homefield will then give 10% of those sales to the collective. Then, on six specific dates, Homefield will give 20% discounts and share 20% of the revenue to the collectives. The codes that will be good for an entire year. The five collectives that will participate in the program at launch are the Boilermaker Alliance (Purdue), Hoosiers Connect (Indiana), Florida Victorious (Florida), Classic City Collective (Georgia) and Wildcat NIL (Kansas State). Brown points out that most collectives “rely heavily on a handful of major donors to fund their operations. It can be much easier and cheaper to ask two people for $100K than it is to ask 2,000 people for a hundred bucks, but there are only so many people who are capable of writing a check for a hundred grand. Eventually, those people stop writing checks.” As such, Brown believes that this program is “worth a shot” when it comes to bringing in more revenue for collectives, “especially since this strategy doesn’t cost a lot of money to attempt, and could potentially reward customers for buying something they probably wanted to buy anyway. Other affiliate partnerships, like with collective-branded beer, are going to be exclusionary to some groups of people. But everybody needs clothes, right?” (link)

Maryland Football HC Mike Locksley appeared on a local radio show and shared a story about a third-string RB asking for $100K to remain on the roster, “and you're like, ‘Where does this magic $100K number come from?’ And it just, I mean, I sat in my office and every meeting I had was basically – and we're seven wins and going to a bowl and taking the next step – but everything coming in was like, ‘I want this. I want that.’ And the greatest team sport has now become kind of individualized. And I went home and was like, ‘Man, I don't know how much I can do because I'm about ready to come join y'all full-time, man. Y’all got room for me back at the studio or what?" (link)
