NCAA President Charlie Baker tells ESPN’s Dan Murphy he is not in favor of rules or federal laws that would place new limits on student-athletes' ability to transfer: "I've had conversations with a bunch of coaches who didn't…walk out on their contracts. One of the things I hear from kids when I talk to them about this issue is, 'Coaches walk out on their contracts. What about us?'" Baker goes on to point out the rate at which student-athletes transfer is actually less than their non-athlete peers. “Kids just transfer more because they have more information, more data, and they're more impatient about a lot of things." Baker also says that regardless of the outcome of antitrust cases, the NCAA will continue to ask Congress for help. "If we don't get it done this year, [we'll] certainly have more examples about why it would be important to take on preemption and compensation and employment and some of these other issues in the next Congress.” Baker also explains he does not favor expanding March Madness at the expense of automatic bids for conference champions: "Most of the people who follow college sports think the NCAA tournament in basketball is perfect, right? So anything that's done to change it needs to be done with care and consideration.” (link)

The College Football Playoff Board of Managers unanimously approved the 5+7 format for the 2024 and 2025 seasons. Washington State President Kirk Schulz, reportedly the lone holdout, acquiesced but expressed concern regarding potential format changes in the future. “I worry about any league getting a certain number of automatic berths beyond their champion. I wouldn’t be alone in that.” According to Yahoo’s Ross Dellenger, the “SEC and Big Ten are expected to want more revenue in a new distribution model, more authority in a voting structure and, maybe most notably, more access in a new format,” and Schulz notes: “My commissioner tells me that there was an idea floated of a single league getting four [automatic qualifiers] into the playoff. You go, ‘Boy that doesn’t seem like it’s going to be well embraced by football fans around the country.’ The commissioners are fantastic but they are paid to look out for the betterment of their conference.” Schulz, who says he would like more involvement from presidents in the process, also tells Dellenger today’s meetings are likely to produce “critical ideas” for the future of the CFP. “It might be contentious moving forward. I want to make sure that the presidents are talking about these things before commissioners say, ‘Here’s what’s in front of you [for approval]. Hope you like it.’” After conceding there was “not a lot of support” for his pitch that the Pac-12 retain its revenue and Power 5 privileges, Schulz says it’s “really, can we stay in the conversation?” (link); Regarding the suggestion that a conference floated the idea of four teams receiving AQs, former Fox Sports President Bob Thompson observes: “The SEC has floated zero AQs in the past. Maybe it was [the Big Ten’s] idea? In any case, Wednesday ought to be interesting.” (link)

Arizona President Robert Robbins during yesterday’s introductory press conference for incoming AD Desireé Reed-Francois indicated that he and Reed-Francois hadn’t discussed the $87M in institutional loans taken out by the athletic department but did say he has spoken about it with Interim CFO John Arnold. Asked if the debt would be completely forgiven or if Reed-Francois would need to formulate a repayment plan, Robbins didn't say either way, but said he was confident in the direction Reed-Francois will take the department once she meets with UA financial executives to discuss the situation. “There will have to be some restructuring — and we give loans across the university all the time. So we'll have to work with Desireé and her team to figure out what that means. Usually these loans are given, like all the improvements of the football stadium, the new softball stadium, the renovations of the pool, improvements we made at Hi Corbett (for baseball). … We will have to sit down and take a holistic approach to the athletics budget as well as the university budget. We will have a plan, and I feel confident in that 18- to 36-month timeframe, we will be on good solid ground.” (link)

The Mercury News’ Jon Wilner contends Arizona “could not have asked for a better outcome” to its AD search than hiring Missouri AD Desiree Reed-Francois, whom he describes as the “only name in the overlapping region of the Wildcats’ complicated Venn diagram.” For Wilner, the first circle consists of experienced major-college ADs willing to accept Arizona’s offer, the second includes proven ADs with ties to Arizona itself and the third is made up of former college athletes. He notes: “Tucson isn’t exactly home. But as with [Football HC Brent] Brennan, who worked for former Arizona coach Dick Tomey, it’s familiar, meaningful terrain. She knows the culture and understands what the university means to the community. The fit, so crucial for both athletic directors and head coaches, is right.” In fact, he adds: “If the overlapping region of those circles featured a name other than Reed-Francois, we are unaware. … Because of the financial crisis, Arizona has more systemic pressures and additional strategic complications. There are precious few athletic directors with the right skill set for the daunting task ahead. The Wildcats found one.” (link)

CollegeAD reports Texas State AD Don Coryell has received an extension that could keep him in San Marcos through August of 2028. As part of the new deal, Coryell’s base increases from $300K to $330K. There are also bonus opportunities of up to $35K per year with another $15K kicker should the Bobcats win a National Championship. Buyout wise, if the university makes a move without cause, Coryell would be owed one year’s base pay. If Coryell exits for a similar role at another institution he would owe the university $115K. The Intercollegiate Coach Association Coalition (ICAC) has made a formal submission to Congress's Commission on the State of U.S. Olympic and Paralympic Sports underscoring the need to safeguard Olympic sports amid discussions surrounding protections for the NCAA. National Wrestling Coaches Association Executive Director Mike Moyer notes the letter “suggests that any aid provided to collegiate athletics [from Congress] should be contingent upon the protection of Olympic sports through antitrust exemptions or equivalent measures." Specifically, the letter points out that “of the 626 members of Team USA that competed in the 2020 Olympics, 76% of them were current or former student-athletes from 171 different colleges or universities with 82% of the medals coming from athletes that were trained in 86 unique schools.” It adds: “Almost every attempt by the NCAA to regulate in the area of revenue and competition has been met with litigation and much of it has been successful. This has caused financial strain that threatens to bankrupt the NCAA and destroy the relatively level playing field collegiate sports have enjoyed. By the same token, conversations about a ‘football super conference’ that might exist if antitrust protections are afforded are every bit as detrimental to the Olympic sports as no relief at all. … Relatively speaking, it won’t take much of the additional revenue to keep Olympic sports alive, but it will likely mean the difference between continued success on the world stage and the relative mediocrity that plagued so many of our Olympic teams only a few decades ago.” Full letter. The America East has unveiled a new logo as part of a rebrand, which ESPN’s Pete Thamel reports will roll out this week and is centered on the phrase “Where Champions Rise.” (link); America East Commissioner Brad Walker on the league’s brand refresh and new logo: “What's most important is having something that differentiates ourselves as far as putting out our message of who we are, what we're committed to. But specifically around the mark, [we wanted] something that was more distinct and bold and said our name specifically, [that] this is who we are.” The new mark and color scheme, which were unveiled yesterday, were developed in partnership with SIDEARM Sports and pay homage to the league’s membership along I-95. A soft implementation will occur on campuses through the end of this academic year, with full integration set for 2024-25. (link)

Indiana Deputy AD/COO Stephen Harper weighs in on the Hoosiers’ Adidas x Fear of God basketball jerseys, which proved to be unpopular among fans: "We're as traditional as the fans are. We like the traditional uniforms. You know, Adidas has been a good partner for us in the department, and from time to time, they do like to bring special products that they think will excite the players, excite recruits, those kinds of things. That was an example of that. Obviously, beauty is in the eye of the beholder. We heard a lot from fans that didn't necessarily love those, which we understand. We don't plan on moving away from the traditional look of Indiana basketball, which, again, means a lot to us. … I meet a lot of our recruits as they come in to tell them about the opportunities that we have in the department, and you'll see a lot of our recruits wearing that brand. So I think it's meaningful to them, even though it's not meaningful to everyone else." (link)

Fairleigh Dickinson’s ill-fated elevator ride at LIU had a silver lining, as the school reports it garnered over 140.2M impressions across, TV, social media, radio and online publications. All told, the incident netted the Knights over $12M in publicity value. Oak View Group will acquire Invited’s Stadium Club unit, a “move that will accelerate OVG’s push into college football hospitality,” per Sportico’s Eben Novy-Williams, who notes OVG will take over ownership and operations of football stadium club properties at Baylor, North Carolina, Arizona, Utah, Texas Tech and Virginia Tech. OVG360 President Chris Granger: “This reinforces our commitment to elevating the premium space. Now you add this to the mix, where we’re thinking about membership on a year-long basis, and not just on an event-by-event basis.” (link)

The American sports betting industry recorded $10.92B in revenue for 2023 with a total handle of $119.84B, according to the American Gaming Association's annual report. The record revenue figure represents a 44.5% YoY increase, while the handle, also a record high, is 27.8% higher than 2022. AGA SVP of Government Relations Chris Cylke is tempering expectations for 2024: "I think we're in some ways victims of our own success over the past five years in that we now have 38 states plus DC that have already taken the step of legalizing and regulating sports betting, so there's a lot fewer states left on the board. Some of them have pretty significant political challenges in terms of getting sports betting itself enacted. When we look at the map, there could be potentially two or three states that have some activity and get it across the finish line this year. There could be zero, which would be disappointing, but that's where we are right now with the progress that we've made over the past almost six years." (link)

Incoming Arizona AD Desiree Reed-Francois today explained her decision to depart Columbia for Tucson was an “opportunity to come home,” adding: “I got a little bit emotional at the podium because this is a heart move. This is a move that I know what the University of Arizona can be. I know there are challenges. … My skillset meets what I believe the University of Arizona needs at this time, this very important time.” Reed-Francois, who earned her law degree at Arizona, also commented on the Wildcats’ financial situation: “I haven’t met very many athletic departments that say, ‘Hey, we’ve got so much money we don’t know what to do with it. This is not a problem that’s incredibly unique, but what we have to do is just be very diligent in our approach and very thoughtful. Let’s listen and let’s learn and let’s analyze, put together the best plan and move forward.” (link)

The Athletic’s Andrew Marchand, Nicole Auerbach, Stewart Mandel and Chris Vannini report the “terms agreement negotiated between ESPN and the firm CAA Evolution, which represents the [College Football Playoff], has been in place for months, but CFP leaders still need to vote on the deal for it to take effect. Those leaders’ inability to reach consensus on topics they were hoping to settle before signing has been described by some executives involved as a ‘mess.’” As such, ESPN executives “are growing impatient and, as Puck business writer John Ourand first mentioned, will consider pulling the offer if the CFP fails to get its act together soon.” While ESPN has yet to set a deadline, one source says the company isn’t going to “wait forever.” With that as the backdrop, Marchand, et al. note those attending this week’s CFP Board of Managers meetings “are preparing for a battle that could become cutthroat and contentious.” As one attendee notes: “The corporate, bottom-line world does not have the same expectations of collegiality from colleagues as higher education.” Also from Marchand, et al.: “Some commissioners in the room acknowledge that the mighty Big Ten and SEC have the leverage to chart a course forward, but have yet to throw it around. Those commissioners also say they don’t know what, exactly, the Big Ten and SEC want out of the remaining debates. The hope is more clarity at the meetings Tuesday and Wednesday.” (link)

As Washington State and Oregon State continue to shop football games to networks for next season, JohnCanzano.com’s namesake notes the negotiations have intensified in recent weeks. WSU President Kirk Schulz tells him that “we’re in conversations with several potential partners and have to ensure we are weighing program exposure with money for specific games. Kickoff times also will play a role as we make a decision moving forward.” An OSU source adds: “We’re advancing the ball down the field and have received strong interest from multiple groups.” Former Fox Sports President Bob Thompson believes the schools should prioritize exposure over revenue, noting there is extra interest in what happens to the programs next season. One Pac-2 HC in a non-revenue sport tells Canzano: “We’ve got to do everything we can to seize that platform.” Canzano goes on to point out that “it’s possible the schools could sell a couple of their football games (See: Oregon at OSU and Texas Tech at WSU) to a carrier that would give them some wide exposure. Selling the games à la carte is a strong possibility given that 13 games between two Pacific Northwest schools may be too much for a single entity to digest.” (link)

Colleges might be wise to “skip ahead” and declare student-athletes as employees, according to Sportico’s MIchael McCann, who acknowledges the “idea may sound absurd. Colleges are contractually bound by NCAA and conference rules forbidding members from pay-for-play. State NIL laws also present a hurdle. They prohibit payments to college athletes in exchange for playing a sport.” But, considering the alternatives – as well as the NCAA’s recent track record in the courtroom – McCann suggests skipping ahead could be a viable strategy for a university president to say “enough is enough.” McCann: “Some would praise this president for taking a forward-looking and labor-friendly approach. The president would also garner tremendous media attention—and perhaps boost their school’s admissions and alumni fundraising efforts. Polling data suggests most of the public would be supportive: A joint survey by Sportico and The Harris Poll last year found 79% of Democrats and 59% of Republicans supported direct compensation of athletes by their colleges. At the very least, history would remember this president.” On the other hand, the “NCAA and the college’s conference could suspend or expel the school, declare all the teams and players ineligible and even sue the school for breach of contract.” But, McCann wonders whether the NCAA is up for another legal battle and posits that “a case built around punishing a college for providing minimum wage to young people also doesn’t sound like a public relations winner.” More from McCann. Classifying college athletes as employees comes with a raft of under-discussed consequences, according to JohnWallStreet, who talks with one Power 6 AD about the economics of it. First, the AD notes that granting student-athletes protection under the FLSA “can’t just be applied to select athletes at several dozen schools. It would be for all [athletes at every] school.” The AD points out that the plaintiffs in the Johnson case are “basically [a collective of] FCS athletes that do not generate any kind of media rights revenue,” but if they are deemed employees, they would be entitled to at least minimum wage, all of which would be taxable. At $15 per hour and 20 hours per week, each athlete would earn $15,600 annually, and the AD notes:. “Then there’s the benefits cost, social security, taxes, and FICA. It will end up costing the university [an extra] $20,000 a year [per student-athlete].” A school with 450 student-athletes would then have an additional $9M expenses to cover. Furthermore, the AD explains the incidentals, such as covering travel expenses for players during breaks, would likely become income in the eyes of the IRS, and JWS observes: “Depending on the value of a school’s scholarship, the bulk of a minimum wage income may end up just serving to pay off the student athlete’s tax bill.” Ultimately, the AD concludes, “it’s [going to result in] a loss of opportunities.” (link)

California Senator Nancy Skinner (D-9) has submitted SB 906, a new NIL bill that would require collectives and others to disclose specific compensation amounts and the athlete’s team and gender. Names would not have to be disclosed. Skinner, who introduced the first statewide NIL bill in 2019: “SB 206 sparked a revolution in the multibillion-dollar industry of college sports. Today, student athletes in every state are finally receiving some compensation for their talent and hard work. That’s great news. But with the growth of collectives and other strategies employed by college sports boosters, these efforts may be primarily benefiting men and once again shortchanging women athletes. SB 906 will shine a light on NIL and give us a better understanding of whether NIL is contributing to gender inequity in college sports.” (link)

North Dakota State is looking into providing Alston payments to student-athletes, but “nothing is set in stone at this point,” according to Bison AD Matt Larsen. Inforum’s Mike McFeely adds: “The Tip Sheet checked with Larsen because multiple sources have told us the athletic department is moving toward securing Alston payments for athletes and is actively working with big-money donors to come up with the needed cash. The info to this point is little more than rumor, however.” (link)

Furman will begin a $40M renovation to Timmons Arena this April that includes a reimagining of the entrance and lobby, upgrades to seating options, the addition of premium and luxury box seating, improved audio and visual components, enhanced box office support, a children's play area, new visiting team locker room and new administrative offices. The renovation is expected to be complete by the fall of 2025. While construction is underway, the men's basketball team will play the majority of its home games at Bon Secours Wellness Arena in downtown Greenville, while the women's team will play the majority of its home games at North Greenville (DII). Mercer will add a baseball performance center, new tailgating areas within Five Star Stadium and a joint tennis and golf facility. The tailgating space will have two levels with the bottom tier being dedicated for tailgate tents. The second level will be a patio area where spectators can purchase concessions and watch the game from right behind the endzone. Baseball’s new performance center will feature a patio overlooking the field, a meeting room for donors and recruits as well as offices for the team’s coaches. On the ground level of the facility, there will be batting cages and a pitching lab. Bears Deputy AD/Mercer Athletic Foundation Executive Director Brian Gerrity: “This is all donor-funded and these projects all fall in line with the larger athletics facility plan. It’s not sort of ‘poof,’ out of nowhere, it’s these projects that are part of a larger plan to take the next step forward.” As of now, there is no timeline for the projects to be completed. (link)

Iowa women’s basketball star Caitlin Clark has yet to receive any compensation from the Hawkeyes-focused Swarm Collective, and it remains to be seen whether doing so will have any impact on her decision to stay one more year in Iowa City. Swarm CEO Brad Heinrichs tells the Wall Street Journal’s Rachel Bachman: “She hasn’t taken a dime from us yet, so I don’t know why she would next year. Could she change course? Of course. I mean, we’d love to have her. We’d love to compensate her and do things through the Swarm for her. But she has her own thing, which is totally fine. That’s her prerogative. … Not to be self-deprecating, but I think the Swarm NIL collective might be small potatoes for what she’s doing.” As for whether Clark will come back for one more year, Heinrichs says he used to think she should due to her earning potential. “But now I’m starting to believe that she can transcend the sport and not only will she continue to make as much money as she does now, she can make a lot more as she continues to move forward. And she might make a lot more for everybody else in the league as well—just like Tiger made all this extra money for everybody on the PGA Tour. Everybody wants to watch.” (link)

Opendorse has launched the Opendorse Payments feature that will allow partner universities to “manage NIL contracts, send NIL deals by scheduling recurring payouts, track completed activities and offer consolidated reporting to the NCAA once rules allow,” according to On3’s Eric Prisbell. Opendorse CEO Blake Lawrence: “Charlie Baker’s proposal has had an impact on accelerating allowing institutions to start to think about how they will participate more in NIL. There’s also been a movement of schools who are starting to always think about how they can be more involved with NIL. And so giving the school themselves the same tools that are used by brands and collectives and their athletes already used to receive payments is just natural.” (link)

+ Law360 indicates Rutgers Men’s Basketball student-athlete Jeremiah Williams has settled his suit with the NCAA. From behind the paywall: “The NCAA has settled a lawsuit brought by a Rutgers University basketball player who sued the organization earlier this month over claims it was trying to make him live out a punishment for sports betting violations that he had already served while a student-athlete at Iowa State.” (link)
+ Law360 also reports that an Indiana magistrate judge ruled last week that “Former University of San Francisco baseball players cannot hold their social media messages ‘hostage’ in a lawsuit that accuses the NCAA of enabling the sexual harassment they allegedly endured at the hands of two coaches.” (link)
+ FuboTV has filed a lawsuit seeking to block Spulu (imagine saying that sentence in 1985). The complaint was filed under seal, but Puck Founding Partner Eriq Gardner reports Kellogg Hanson, the law firm which has represented Facebook and other big clients, is representing Fubo. Gardner adds: “Fubo seeking injunction to stop venture or imposition of terms that would mean licensing parity for competitors like itself. (And damages, of course.). (link)
