Transylvania AD Holly Sheilley sits down with D3.ticker/Connect's Anthony Grassi at the 2024 NCAA Convention to discuss the latest with the Pioneers, her role as chair of the DIII Management Council, potential championship changes and much more. Sheilley believes there is a time where streaming could be more commonplace across the division. “I think it's really exciting what we might be able to do. I think as a division we're leery about a paywall because it's a little philosophical for us, but I think anything to elevate our live streaming process and get our championships and who Division III and let us tell our story, we want to be able to do that.” On PairWise, Sheilley says the name will rebrand, allow committees to focus more energy on improving the student-athletes experience and will not be impacted by regionality, adding: “What happens is you have a sport committee and you have like the Northeast and you have a RAC and these Regional advisory committees they see all these criteria which are supposed to be even – win-loss is supposed to be even with strength of schedule against regionally ranked teams – nobody thinks of it like that. You might say win-loss is most important. I might say strength of schedule. This will actually allow us to have a program that makes it the same no matter if you're sitting in the northeast or you're in the west. It's going to measure those variables the same. The committee will have an option to say, ‘We're going to say that strength of schedule is 30% and with so it's like a dial and win-loss is 70 and strength of schedule's 30 and so they can make that, not every week. They have to make the decision, stick with it through the season, because anybody will be able to pull up and see where you land so it's very transparent, very accountable and I think people really want that.” As a champs committee member, she will push for those dials to be set for more than one year. Labor law expert Eddie Bonett, who spent 22 years in the Philadelphia NLRB office, joins Optimum Sports to talk about what happens next in the Dartmouth (DI) case and explains the right-to-control test used by the board “may open things to others who are controlled by universities, people like theater majors, who have to put on a show and the university controls their hours. … It may cause them to look for some other test that tightens this up a little bit. Simply using this test, you could take this down to big high school programs – big high school football and big high school basketball schools.” If the current decision is upheld, Bonett notes Dartmouth could refuse to bargain and do a test of cert. “That would go to the district courts, and maybe even up to the Supreme Court . Then, whatever the court says is going to be the guidance for the future. The Board decision would be precedential across board cases. A university would probably try to distinguish this, in terms of the control, but any similar programs are going to run into the same issues. Now, you may have a D3 school that tries it, and they won’t have the same level of control, so maybe that’s a case where the student athletes are not employees under this decision.” More from Bonett. The Philadelphia Inquirer’s Jeff Neiburg pens on the final home Men’s Basketball game for Cabrini. With the impending acquisition by Villanova (DI), over 200 of the remaining 708 undergrads that started the academic year are student-athletes. AD Kate Corcoran: “The character and the class that they have represented this university, themselves, the coaches, and the staff with them has been inspiring to watch. I’m so proud of what they’ve done and the ability to compete at a high level and be proud of wearing Cabrini across their chest one last time.” HC Ryan Van Zelst: “Something good will come out of it. I don’t know when that will be for each of us — everyone that’s going through it, not just the men’s basketball program, throughout the campus, athletic department, you name it. Something will come out of this that’s for the better. You just got to get through it and learn from it and take it day by day. […] Normally you’re the one recruiting them and trying to mentor them and help them become productive adults in society — and now I’m passing them on. It’s a little strange. At the end of the day, this is their life and this is their experience.” (link)

A bill in Oregon that would prohibit the NCAA, conferences and any other athletics governing body from punishing an athlete or school for violating NIL rules is headed to the House floor. The bill also provides liability protection for universities and their employees “for any damages to a student athlete’s ability to exercise the student athlete’s (NIL) rights due to any decision or action” by the school or any of its employees that is “routinely taken in the course of intercollegiate sports” or is “part of identifying, facilitating, enabling or supporting opportunities for the current student athlete to exercise the student athlete’s” NIL rights at the school. Representative Zach Hudson (D-Troutdale) offers a hypothetical scenario: “Let’s say a student is making money off of [an NIL] deal. Let’s say that student has some accusation against them and the college kicks them off a team — let’s say for a weapons charge or something. It turns out that that charge was false. It turns out that the college should have known it was false and didn’t do their due diligence to make sure it was a legitimate complaint. But the student has still lost tens of thousands of dollars from the actions of the college. If the student were to sue the college for what they did in that scenario, would a judge dismiss that case based on what’s in the bill?” That scenario will likely be the subject of debate on the House floor. Oregon, Oregon State, Portland and several other universities in the state have voiced support for the bill. (link)
