The Athletic’s Nicole Auerbach gets commentary from Big Sky Commissioner Tom Wistrcill - who is also the chair of the National Letter of Intent Subcommittee of the Collegiate Commissioners Association (CCA) - on moving football Signing Day to earlier in December: “The biggest reason we’re doing this is to clear up the football recruiting calendar so the signing period and the transfer portal don’t overlap. The feedback we’ve received from all coaches is that December is a mess. Especially with the expansion of the CFP coming next year, that just creates more chaos in December. This should help.” Also from Auerbach: “One other option the group is discussing is the possibility of a summer signing period (either in June or August) for college football. It would begin and end before athletes’ senior season, much like college basketball’s early signing period. If that were approved, high school senior athletes would have three opportunities to sign NLIs: The summer, early December and February. There would be no change to the traditional February signing period.” More. (link)

The Committee on Infractions began exploring legislation adopted last month that directly penalizes non-coaching staff members who are at the center of NCAA enforcement action, including university presidents, athletic directors, compliance officers and other school officials Yahoo’s Ross Dellenger reports. The COI agreed to examine the matter on a “case by case” basis, according to Offices of the Committees on Infractions Managing Director Matt Mikrut, who notes the committee will determine penalties based on the person’s activity and involvement in violations and their role within the university. The committee also decided to use the identities of those at the center of investigations in public infractions reports, and Dellenger notes that COI members set parameters on naming school athletic directors and presidents in a report. “The NCAA enforcement staff, which is independent from the Committee on Infractions, must have found a school guilty of ‘lack of institutional control’ for a president’s name to be revealed. A school must have been found guilty of a ‘failure to monitor’ for an athletic director’s name to emerge in a report.” Mirkut tells Dellenger suspending non-coaching members is complicated: “Our jurisdiction and legislation only extends to athletically related duties. What would be the scope of their [non-coach] suspension?” (link)

SEC Commissioner Greg Sankey covers several topics with bestselling author Andy Andrews. On the current landscape, Sankey notes that “for all the criticism heaped on college sports, it’s pretty remarkable the number of young people who just want to stay around. I read somebody being granted a ninth year of eligibility. Well, if it was such a not positive experience, nobody's asking to do it for a ninth year.” Also from Sankey: “Higher education is notoriously slow for adaptation, so now we're caught in this cycle where a lot is changing around us, and the enterprise itself is having to change in real time. What's happening is a very transparent, very open process of change. Change is hard. Change is stressful. Change causes frustration, it creates opportunities. … Our student-athletes in the name image and likeness space deserve better than a patchwork of 30+ state laws.” More. (link)

Puck’s John Ourand reports NFL executives were “not happy about [the College Football Playoff’s] chutzpah in scheduling” opening round games on Saturday, December 21, this year, a day on which the NFL has historically scheduled games. “NFL executives are aggrieved because CFP officials met with them as they worked through the schedule, and simply did not take heed of the league’s desire to schedule games on that Saturday. The move leaves the NFL with two options: cede that Saturday for the college football games or counterprogram the newly expanded CFP with regular season games of its own. … Executives who have done business with the NFL fully expect the league to dig in and schedule its own games on that Saturday. The NFL doesn’t take a back seat to anyone—not TV networks, not Big Tech, not sponsors, and certainly not a CFP that appears to be rudderless.” Ourand goes on to note the “date everyone should circle is 2026,” the first year of the new CFP contract. “The CFP faces a myriad of questions before then, not the least of which is whether the SEC’s Greg Sankey and the Big Ten’s Tony Petitti will remain committed to the playoffs or if they will forge ahead on their own. Amid these existential questions, the CFP could soon find out that it’s better to have the NFL in their corner, especially over a topic as seemingly mundane as scheduling.” (link)

Former Louisville men’s basketball signee Brian Bowen is petitioning the U.S. Supreme Court to hear a case focused on the business interests of athletes to play college sports and develop as pro prospects. Sportico’s Michael McCann: “Bowen v. Adidas, which accuses Adidas of racketeering, provides an opportunity for the nation’s highest court to declare that college athletes have a protected interest in positioning themselves for sports drafts. This ruling would effectively expand the reach of NCAA v. Alston, which centered on education-related expenses, into the realm of athletic play.” In Bowen’s case specifically, he accuses Adidas of robbing him of his business and property interest in playing at Louisville and developing under former UofL HC Rick Pitino. McCann: “The NCAA isn’t a party to Bowen’s case but has a clear stake in its outcome. The NCAA arguably serves as a de facto minor league system for the NFL, NBA and WNBA, all of which have collectively bargained eligibility rules denying a player’s entry directly out of high school. That means access to college sports is instrumental to some prospects’ careers.” Attorneys for Bowen argue that “business or property” as defined under antitrust law is essentially defined the same as in the RICO Act; therefore, the logic that applied to Alston ought to be applicable to Bowen as well. While the odds are long SCOTUS will hear the case, McCann notes they “may be better given the legal chaos presently facing college sports.” (link)

According to Law360, a Colorado federal judge has ruled that “College athletes fighting for a slice of the broadcasting profits their games earn will have to wait until the Judicial Panel on Multidistrict Litigation decides whether to consolidate their case with another similar suit before they continue briefing.” More behind the paywall. A recent NCAA student-athlete health and wellness study found that men’s sports athletes were 20-30 percentage points higher than women's sports athletes on all measures of positive body image. When asked about their body image, 68% of men and 45% of women felt they have a good body, 53% of men and 35% of women were happy with their current weight, and 59% of men and 31% of women liked what they look like in pictures. Black student-athletes were more likely than other racial groups to hold positive perceptions of body image. The study also found that, “despite two-thirds of student-athletes perceiving themselves to be the right weight for their sport, a majority reported that they were actively trying to change their weight. Women's sports athletes were more likely to perceive themselves as overweight for their sport and report trying to lose weight, while men's sports athletes were more likely to report being underweight and report trying to gain weight.” Additionally, student-athletes reported using a range of supplements to enhance their diets, including protein products (44%), energy drinks (44%), multivitamins (41%), creatine (23%) and multivitamins/minerals with other additives, such as caffeine or probiotics (22%). Regarding access to healthy foods, 43% of men and 30% of women indicated that healthy food options are readily available after practice and competition. Meanwhile, 49% of men and 45% of women said they can afford to eat healthy meals each day, and 50% of men and 32% of women said they have time to eat healthy meals each day. More. (link)

Updates keep coming from Arizona, these from yesterday’s Board of Regents meeting via the Arizona Daily Star’s Bruce Pascoe: “Arizona interim CFO John Arnold gave the Regents a financial rundown of UA in which he noted that the school’s athletics department lost $32 million during the 2023 fiscal year. UA athletics has taken a total of $86 million in loans from the school since 2018. [...] Both (Men’s Basketball HC Tommy) Lloyd and (new AD Desiree) Reed-Francois have seven-figure buyouts they must pay if they decide to leave within a year, and those buyout figures decrease each year to zero in the contract’s final years of 2028-29.” (link)

Houston students are asking the UH Board of Regents to lower the amount of student fees used for athletics and reallocate that to other student services. Specifically, the Student Fee Advisory Committee wants to reduce the approximately $8.3M in student fees it sends to the athletic department by $1.5M on the grounds that the moving to the Big 12 comes with a revenue boost for the department. “In light of the revenue increases, the university’s approach to the athletics subsidy, and past commitments athletics has made to wean off student service fees, the committee has elected to put athletics on a subsidy reduction plan in line with the university’s.” About half of the student fees allocated toward athletics go toward repaying debt from the construction of a new football stadium and basketball arena, as approved by a 2012 student referendum. The other half goes toward the athletic department’s operating budget. UH President Renu Khator earlier this month rejected the Student Fee Advisory Committee’s recommendation, noting the student fees allocated to athletics has remained flat over the past 14 years despite costs going up. Both Khator and the students will make their case before regents today. (link)

The College Football Players Association issued a statement in response to EA Sports offering roughly 11K college football student-athletes $600 each for their NIL in the production of the new videogame. The CFPA statement: “The news here is that this is the first group licensing deal in sports business history to not include royalties. CFB players get a video game instead of royalties. The athletes of the second most popular sport in America are being treated like children. Video games instead of [cash].” (link)

Florida A&M has installed a new 33’ x 77’ endzone video scoreboard and LED ribbon board at the Rattlers’ Bragg Memorial Stadium and a new LED center-hung scoreboard at the Alfred Lawson Jr. Multipurpose Center courtesy of Anthony James Partners (AJP) and SNA Displays. SNA Displays also provided a 23-foot-long field-level LED video display in each of the four corners of the stadium. The center-hung scoreboard at the Alfred Lawson Jr. Multipurpose Center consists of four LED screens and a 360-degree LED ring. Each of the four main displays is 8’8″ x 12’7″, while the lower ring is 2’4″ x 53’6. (link)

Fox Sports’ Bryan Fischer reports that “While CFP has been the focus of the FBS commissioners this week, there has also been more high level discussion over changes to the early signing period recently, a source said. A number of stakeholders have been surveyed for their thoughts on a two year trial of moving it up/back or eliminating it altogether. Movement on potential changes to the December date could come as soon as next week. I’m also told that discussions regarding NCAA MBB tournament expansion continue to come up as well. There’s one big obstacle however: CBS/Turner would not be on the hook for ponying up any significant amount of new money to the NCAA, complicating the issue. (link, link)

The Mercury News’ Jon Wilner talks with Washington State President Kirk Schulz about several topics, including plans for the Pac-12 Networks studio. Wilner wonders whether the facility could be used by the outbound schools, which must produce hundreds of on-campus events for their new conferences’ digital media partners, whether Apple or Amazon would have interest in leasing the production team and equipment for their sports content, and/or how WSU and Oregon State could use the networks for their own events. Schulz: “It could turn into an entity that’s a real revenue generator. We’re exploring what that looks like.” Schulz also tells Wilner the Pac-2 is “working through the last details” to finalize a settlement with the outbound Pac-12 teams and notes there is an “active dialogue” concerning liabilities moving forward. While he declined to provide details, Schulz says former Commissioner George Kliavkoff handled the separation “professionally,” adding: “I appreciate that he took the high road. He could have made this difficult for everybody.” On new Commissioner Teresa Gould, Schulz says she is leading the conference with no acting or interim tag. “She wanted to work with us on the future assets, more of the strategy issues. She’s not just running the operations of the conference. She’s going to help us map the future.” (link)

Extra Points’ Matt Brown reports EA is sending out NIL contracts to over 11K FBS football players today: “Sources familiar with the proposed contract tell Extra Points that the base contract will pay athletes $600 for usage of their digital name, image and likeness in the video game, along with a copy of EA Sports College Football 25 on a system of their choosing.” The contract offer will be sent to all “eligible” players with the aim of achieving a roster size of 85 players per team for all 134 FBS programs. EA will also offer ambassador contracts to a select number of players who will be paid to promote the game on social media. Student-athletes from the service academies, though prohibited from signing NIL deals, are expected to be depicted in the game. EA also believes international student-athletes will be able to participate. As of now, Brown does not expect FCS teams to be included when the game launches. Also, Brown notes: “EA is committing to representing 85 athletes per team. That does not necessarily mean the 85 players who are on scholarship.” And, according to EA, “opting-in does not guarantee the inclusion of an athlete’s NIL in the game.” (link, link)

ACC men’s basketball coaches are frustrated with the league’s lack of respect in this year’s NET rankings, according to the Richmond Times-Dispatch’s David Teel, who explains the Big 12 appears to be getting the benefit of the doubt due to its success last year. Specifically, Teel points out that while 11 of the 15 ACC teams had higher NET ratings at the end of non-conference play, the league overall paled in comparison to the Big 12, whose teams, per Teel, played “lousy non-conference schedules.” In fact, 10 Big 12 teams had a non-conference strength of schedule below 200, including Iowa State, which began conference play ranked seventh in the NET despite winning zero Quad 1 games. Moreover, nine of the Cyclones’ 11 out-of-conference wins were against Quad 4 foes. Yet ISU’s high ranking “paid compound interest to all in the Big 12.” In head-to-head matchups, the ACC is 9-3 against the Big 12 with four wins over teams ranked in the NET’s top 40. NC State HC Kevin Keatts: “This thing’s become a complete numbers game. Unfortunately, I think it takes away from the sportsmanship. ... You’ve got to try and beat the heck out of people just to improve your NET.” More from Teel. (link)

Colorado’s new contract with LEARFIELD calls for the company to pay CU a total of at least $46.8M,” and possibly a lot more under shared revenue, for the next ten years through 2035,” according to Sportico’s Eben Novy-Williams, Daniel Libit and Michael McCann, who add, though, that the arrangement includes “extensive and detailed clauses addressing so-called ‘diminishing events,’ situations that could trigger revisions to the stated terms. Examples of diminishing events as stated in the contract include contagions, conference realignment, scheduling changes, potential athlete labor disruptions, NCAA bylaw revisions and the knock-on effects of NIL. Novy-Williams, et al.: “The new exhibit goes on to offer a non-exclusive laundry list of things that could trigger an offset to the deal: unwanted public attention or scandal in the form of TV, Internet, print media and other reporting; Colorado allowing athletes to use its marks protected by trademark law in NIL deals, without Learfield’s prior approval; disciplinary sanctions—of any type—for the football or men’s basketball teams; elimination or a substantial curtailment of the football or men’s basketball teams; the playing of fewer than six home football games or 16 home men’s basketball games.” The contract also includes a force majeure clause which allows the deal to be adjusted in the case of occurrences like pandemics, acts of terrorism, and natural disaster, among others. The Wichita Eagle’s Kellis Robinett breaks down Kansas State’s new contract with Nike and reports that starting in July, Nike will pay K-State a 14% royalty on net sales for any Nike products “bearing K-State marks” except for footwear. For any shoe or sandal connected with K-State, Nike will pay a royalty of 5% of net sales. Additionally, Nike can no longer license any of its K-State rights to other athletic apparel companies. The contract also includes performance bonuses, including $100K for a national championship in football, $25K for reaching the Final Four, $20K for winning the Big 12 football title and $10K for winning the outdoor track & field national title. In previous contracts with Nike, the company provided K-State with a ~$2M allotment of apparel each year. In the new contract, the Wildcats will receive a 66.6% discount on all the gear it orders from Nike up to $4.2M in any given year. (link)

Vitamin Water Founder and St. John’s alumnus Mike Repole has made a seven-figure commitment to support the Red Storm student-athletes’ NIL endeavors and tells the New York Post’s Zach Braziller: “I’m going to commit whatever it takes. I don’t think there’s going to be any alumni from any other Big East school that’s going to give to their alma mater more than I can. If there is, I would like to meet him. I just want to make sure everybody knows that.” Repole also says he found Men’s Basketball HC Rick Pitino’s recent remarks about this season being the “most unenjoyable experience of my life” to be refreshing. “Rick’s rant the other day was probably no different from my rant five years ago. I loved it. How amazing was it that St. John’s has a coach that wants to win so badly? He’s a Hall of Fame coach. He knows how to motivate. He knows what he’s doing.” (link)

Former Texas A&M QB Johnny Manziel went on the Club Shay Shay podcast and relayed the following to NFL Hall of Famer Shannon Sharpe: “I’m leaving to go to the draft. I’ll paint a picture for you. It’s the spring of 2014, December 2013, right in there about December/January, I’m getting ready to make this decision on if I’m going to the NFL Draft or if I’m going to stay. And I found this out five years later from my dad. But my dad went and had a meeting with Kevin Sumlin. And pretty much went to him man to man and was like, ‘We’ll take $3M and we’ll stay for the next two years.’ And my dad says this is as true today as he did when he told me.” Manziel goes on to say that such occurrences were relatively commonplace at the time and adds: “Just keep it in cash, throw it somewhere. We’ll get it later. We don’t need it right now. But for my security if something happens for two years down the road. And my dad did this without me knowing. And I ain’t mad at him about it or nothing. It’s the way the business worked back then. There was a bag man. There was a bag man at LSU. There was a bag man at ‘Bama. There was a bag man at every school around the country if you were competing for a national title. It is what it was, and it was always that way until we’re into the NIL portion of everything now, the way it should be.” Manziel obviously wound up leaving for the draft, and says Sumlin “had this ego about him that what we built, ‘we,’ was all him.” (link)

UCF has received a $5.5M donation from alumnus Taylor A. Gerring to support construction of a new football administration and coaches building as part of the Hagle Football Gateway project. In recognition of the gift, UCF has approved the naming of the Taylor A. Gerring Football Center. Gerring has also pledged $1M to the Knights-focused collective, The Kingdom. (link)

All-conference selections from the Group of 5 are more than twice as likely to transfer as their Power 5 counterparts, according to 247Sports’ Chris Hummer, who reports there were 241 G5 players selected as a first- or second-team all-conference player this year. Only 134 of those had remaining eligibility or opted to return to college football in 2024. Of those, 44 (32.8%) hit the transfer portal during the winter window. With the same criteria applied to the Power 5, just 15.7% entered the portal. Hummer also notes that “of the players returning to CFB in 2024, 39.3% of G5 first team all-conference selections transferred during the winter window. That number was just 10.5% in the Power 5.” (link, link)

Sportico’s Daniel Libit and the Wisconsin Transparency Project have filed a lawsuit against Wisconsin and the UW Foundation alleging they illegally denied his request for copies of UW’s agreement with Altius Sports Partners. Wisconsin claims it has no copies of the agreement because the agreement was made with the UW Foundation. Libit: “Public university foundations must not be used as instruments to obscure the public’s business. If UW-Madison is keen to play this game with an athletic department NIL consultant, imagine how much other public business is being concealed in this manner.” The suit seeks to force the defendants to turn over the contract, as well as an award of reasonable attorney fees, costs, and damages.
