NCAA President Charlie Baker in a letter to members says he will convene the DI Board of Directors and Board of Governors “to discuss next steps” following U.S. District Court Judge Clifton Corker’s NIL ruling. Baker: “You have many questions, and we know you need to hear from us. But given the significance and sweep of this decision, it’s critical that our guidance to you and your colleagues on this ruling be accurate. The ruling affects several NCAA bylaws and policies in Division I, and the NCAA is quickly developing guidance on which rules are enjoined by the court order. … As I said at our convention, what’s at stake is too important for any of us to stand by and hope it will just get better. And if we all do our part, get involved, do the work and play the hand, we can continue to make progress on the large, complicated problems we face. In answering a question about whether we are past the point of a judicial test for student-athletes becoming employees, Sportico’s Michael McCann explains: “I think college athletes becoming employees is the most likely outcome, but there are still hurdles or uncertainties. A new general counsel at the NLRB (which would happen if former President Trump defeats President Biden this fall) could be one. The general counsel plays a crucial role at the NLRB. Odds are the topic of college athletes as employees will eventually be heard by a U.S. Court of Appeals, and there's a luck of the draw as to which judges are picked to serve on a three-judge panel. Then there's the U.S. Supreme Court. I think it's safe to say Justice Kavanaugh is a ‘yes’ for the athletes. The other eight justices? None joined Kavanaugh in his famous Alston concurring opinion, and at the end of the day, Alston was about a relatively minor issue that had nothing to do with employment. … So the justices' views on a more divisive topic like college athletes as employees are still unknown. But if I were betting, I think the end game is college athletes become employees.” (link)

New York Supreme Court Justice Kim Adair Wilson last night ruled in favor of Manhattan men’s basketball student-athlete Dejuan Clayton, granting his motion for a preliminary injunction that will reportedly keep him eligible to play for the remainder of the season. The ruling was made at 7:48 PM, allowing Clayton to enter last night’s game against Marist with less than 10 minutes left. The decision also enjoins the NCAA from assessing penalties against Clayton or Manhattan under the association’s restitution rule. Shumaker attorney Robert Boland, who represented Clayton: “Even though there are only four regular season games left, Dejuan, who has suffered an extraordinary range of injuries, hardships and circumstances far beyond his control over the last several seasons in an attempt to finish his college career, will benefit from the opportunity to have healthy, recent game tapes in his quest to move toward a professional career either domestically or internationally. It is also our hope that Dejuan, who is also a good student, can finish his master’s degree in organizational behavior at Manhattan on schedule this spring.” (link)

Robert Morris is requesting $10M in state funding to help build a $28M hockey arena on campus. The proposed 100K-square-foot facility would include two sheets of ice, at least four locker rooms, practice and training space, and have a seating capacity of 2,500. Colonials AD Chris King: “This strategic initiative represents a blending of our pursuit of competitive excellence with our ongoing commitment to serving the needs of the greater community. The new arena would serve as a vital source of revenue, crucial for the long-term sustainability of our Division I ice hockey programs, whose resurgence has been fueled by fundraising support.” RMU plans to launch an $18M campaign in capital investment, corporate naming partners and donor investment to fund the rest of the project’s cost. Iowa State will ask the Iowa Board of Regents next week to approve a $16M upgrade of the video displays and sound systems at Jack Trice Stadium and Hilton Coliseum. CollegeAD reports Daktronics will install the video boards and One Diversified will install the sound systems. The projects are expected to be completed in phases between the fall of 2024 and the fall of 2025. (link)

Alabama AD Greg Byrne weighs in on ways to mitigate fans storming the court and says fining the schools isn’t the answer. "Kids aren’t going to be in the stands saying ‘Oh, I don’t want to do this because the school is gonna get fined $200K.’ That doesn’t enter their mindset. But if they knew the game that they just had been a part of, celebrated a great win that led to that, if they knew that they were going to lose that game immediately, that would stop them. … I think the way it will stop that, will get everybody's attention and realize this is dangerous, is if it's your game and students, who are usually the instigators, right? We love our students. Then the home team forfeits the game. Now if you have two kids running out there, no. But when you have a sustained rush like what happened the other day at Wake, you lose the game. That will get people to stop." Byrne continues: “We had a student manager we thought was gonna lose an eye after a field storm in the last few years. He ended up being concussed and the doctors were able to save his eye. We had a doctor, a female doctor, get pushed down and bruised up pretty bad. And something needs to be done about it.” (link)

On the same topic, Butler AD Barry Collier gives his opinion: “There’s a difference between trying to stop court-storming and trying to prevent injury. I’d prefer we chase the latter of those two, and then I think we’d be in a better place.” Oklahoma AD Joe Castiglione adds: It’s very difficult to stop mass stampede. Some of the security experts may even tell you in some cases, it’s safer to get out of the way than to create a worse situation.” SEC Asst. Commissioner for Championships Jeremy Hammond tells The Athletic’s Brendan Marks, Dana O’Neil and Nicole Auerbach that the conference discussed the idea of making the home team forfeit games in instances of court-storming, but “I don’t think there was an appetite, at our office or amongst our membership and their leadership, to punish the student-athletes in that manner for something they weren’t involved in and have no control over. … That’s where that sort of died on the vine.” One solution Marks, et al. present involves communicating more clearly with the fans. Kansas State Men’s Basketball HC Jerome Tang, for instance, told the fans before last season that they were allowed to storm the court once. “If you want to build a championship culture and expectation, you’ve got to do the actions before the championships come. So I told them, hey, you got the one court storming — but from here on out, let’s expect to win.” Consequently, when the Wildcats upset Kansas this season, the fans listened. More opinions on court storming, here’s Big 12 Commissioner Brett Yormark: “I have a call with some of my commissioner colleagues and we are going to address it because it's not a conference issue, it's an industry issue and something that, you know, we need to address collectively. And those conversations are being had, and formally we will have one tomorrow and we'll see where it takes us.” Kansas Men’s Basketball HC Bill Self: “Let's get rid of it, totally. I don't see the positive impact from a visual standpoint. Our game has excitement and people are excited about college basketball so much. [Court storming] isn't as big of a positive as a potential negative that exists with somebody getting hurt or lawsuits. Can you imagine a kid storms the court, runs into somebody, he gets sued and his life is changed forever? It works both ways. Or, somebody runs into one of our players, our player [lifts their arms] to protect themselves and catches somebody right in the Adam's apple or hits them in the temple and they get a concussion or something? That's a lawsuit against them.” (link)

On3’s Andy Staples points out that ESPN, the SEC’s media partner, “cut a clip [of LSU fans storming the court after upsetting Kentucky in men’s hoops last week] and posted it to YouTube advertising the court storm. ESPN’s Jay Bilas correctly explained multiple times in the past two weeks that court stormings aren’t going away in part because his network wants the visual. We love that visual. The CBS blimp shot of Tennessee fans streaming onto the field at Neyland Stadium after beating Alabama in 2022 might have been the most iconic image of that season.” Staples goes on to offer two suggestions for better managing court-storming rather than trying to eliminate it: a pregame poll and an instructional video. “On gameday, ask fans on social media if this feels like a game where they might storm if the home team wins. If the numbers come anywhere close to 50 percent, make sure arena/stadium security is on high alert. For the second, think about the video you watch before you’ve gone on any rollercoaster. It explains how to buckle your seat belt and also what kind of movements might cost you a limb. This video should offer helpful tips like asking fans to count to five before storming. … With a more common-sense approach, it’s possible to keep the fun without hurting anyone. But the fans are going to have to help.” (link)

The MAC will add Massachusetts as a full-time member in all sports, including football, beginning with the 2025-26 academic year. The Athletic’s Nicole Auerbach and Chris Vannini report that “Conference USA also had conversations with UMass about joining the conference, especially after announcing around Thanksgiving it would add Delaware in all sports. CUSA hopes to invite a 12th member this spring and Missouri State remains an option there with UMass now off the table.” (link); Meanwhile, the Toledo Blade’s Kyle Rowland reports there “continues to be mutual interest between the MAC and Western Kentucky.” (link)

SBJ’s Ben Portnoy chronicles Indiana’s investment in football, which was underscored by the Hoosiers spending $15.5M to buy out former HC Tom Allen’s contract and the addition of $2M to the AC pool for new HC Curt Cignetti. Portnoy: “The impetus for this philosophical shift in thinking in Bloomington is layered. The looming boogeyman, however, is the potential for a great divide in college football and the hundreds of millions of dollars at stake. … Indiana, for its efforts, isn’t waiting to find out where that line is drawn.” Hoosiers AD Scott Dolson: “The decision for us [to part ways with Allen and hire Cignetti] was really looking at, ‘What’s the trajectory of our program right now and where’s the trajectory of football in the Big Ten?’ With expansion and all that is happening in terms of football in the Big Ten, it became not ‘What is the cost of making the change?’; it was, ‘What is it going to cost us if we don’t make the change?’” Dolson also explains that during the search that landed Cignetti, the school reevaluated how it allocated resources, leading it to the aforementioned $2M bump to the FB AC pool. “The change [was] instead of just saying, ‘Hey, the old staff was $X million for everybody excluding the head coach. You just have to let us know what you want to do.’ We didn’t do it that way. We broke it down into buckets and said, ‘Here’s what we’ve got in these areas and let’s talk it through.’” IU has also more broadly coordinated NIL efforts, and Tyler Harris, executive director of the Hoosiers Connect and Hoosiers for Good collectives, says: “We’ve seen an uptick in support, whether that’s because IU is able to help push out the message now where they were limited in the past, or because people are really starting to realize, you know, this is just another way to support athletes.” More. As the USC-NLRB trial gets set to resume, Kennyhertz Perry attorney Mit Winter tells On3’s Eric Prisbell he believes it’s “almost guaranteed the judge will declare the USC athletes are employees of the school. If you look at the Dartmouth decision, the factors the regional director focused on there are stronger in the USC case.” For Prisbell, the more interesting question is whether the NLRB will determine USC student-athletes are employees of the Pac-12 and/or NCAA. “The NLRB has jurisdiction only over private employers. But if the judge rules that the Pac-12 and NCAA are joint employers, then it could open the door for athletes at public schools to also be classified as employees, which would afford them the right to unionize and collectively bargain as well. It is possible for the judge to conclude the athletes are employees of USC but not the Pac-12 or NCAA. That decision could hinge on whether the judge finds the athletes are compensated by the conference and the NCAA, and how much control each exerts over the athletes. Because of the potential that the Pac-12 and NCAA are deemed joint employers, Winter views the USC decision as ‘potentially more important and more impactful’ than the Dartmouth decision in terms of its effect on the future model of college athletics.” (link)

As college athletes’ seemingly inexorable march towards employment continues, Sportico’s Michael McCann posits schools will face three choices: embrace, resist or cut. He also points out that “the timing couldn’t be worse for colleges. The college-athlete population in the U.S. is projected to ‘shrink dramatically beginning in 2025 and lasting until 2037’ due to declining birth rates.” That said, McCann notes it’s “worth considering why colleges ‘lose’ money on athletics. Some pay high salaries to coaches and athletic directors. Others invest in modernizing athletics facilities. Paying coaches less and spending less on facilities would presumably free up some money. … Even if those schools claim to be losing money on athletics, they’d privately admit net profit/loss calculations do not capture the transformative impact athletics can have on fundraising and enrollment.” For schools who will consider cutting sports in response to student-athletes becoming employees, McCann advises: “Any moves along those lines could trigger a bevy of legal consequences, but the school would be on stronger labor law grounds by cutting all programs instead of just a few. While labor law protects workers against partial closures (like closing one store in a chain) it can’t force a business to continue operations when it seeks a full closure.” More from McCann. (link)

With the NCAA Rules Committee expected to propose helmet comms legislation this week, NCAA Coordinator of Officials Steve Shaw, who serves as the committee’s secretary-editor, tells CBS’ Dennis Dodd: "Especially at the FBS level there is a really big desire to really see if we can push this forward. We had all the FBS football administrators in, and we really talked through technology. There seems to be at least -- at those 10 FBS conferences – [that] desire to make this thing work. It's kind of maybe unprecedented." Big Ten VP of Football Operations AJ Edds adds: "We want this to be a single unified solution start to finish. Schools can determine, conferences can determine, if this is a priority. The feedback we had was extremely positive.” Shaw notes the “biggest issue of all with this is scope and scale. If we open this up, then are there going to be 130 [FBS] teams that want to do it. Do we have enough product that can get 130 teams covered?" Also from Shaw: "People think this was all generated because of current events. It clearly was not. It's been on the docket for years. … I don't know in Year 1 if we're going to eliminate signaling over time, [but] with cooperation from the conferences, this becomes potentially more doable." The FCS Oversight Committee heard an update from the Football Recruiting Subgroup, which will continue to review the impact of the early National Letter of Intent (NLI) signing period on the recruiting calendar. The committee expressed support for the subgroup’s collaboration with the FBS Oversight Committee to “establish a calendar that coincides with potential changes to the early NLI signing period to alleviate the pressures that occur in the month of December. The subgroup will monitor the Collegiate Commissioners Association NLI Policy and Review Committee review of early football NLI signing dates. The subgroup will develop a recruiting calendar recommendation based on the Collegiate Commissioners Association’s decision about the timing of football’s early NLI signing period.” The committee also reaffirmed its support for increasing the preseason participant limit from 110 to 120 student-athletes for the 2023-24 academic year. Also, the committee “unanimously supported a narrow legislative change to the requirements for eligibility for single-sport conference voting to align the legislation with current practice. The current legislation requires a conference to conduct a full round-robin schedule to be eligible for voting rights. The FCSOC supported permitting a conference to satisfy the requirement with a schedule that includes a minimum of eight conference games for all institutions, while maintaining the option for full round-robin for smaller conferences. The FCSOC did not support the elimination of single-sport conference football voting rights at the DI Council level.” (link)

The Competition Oversight Committee discussed updates to the size of squad and travel party sizes and agreed the “current process and principles for squad and travel party sizes remain generally relevant. The committee agreed to conduct the review every four years moving forward and noted that sport committees could propose changes in a non-review year if there are significant changes in the sport, the championship or the sport’s playing rules. Per the committee’s request, staff provided a brief history of squad size development to help inform discussion, including a summary of the average number of roster members who participate in competition. COC members noted this to be a valuable metric, which should be used as a reference when determining appropriate squad size. The committee also confirmed that squad size positions should be matched with corresponding funded travel party positions.” The COC also approved the Women’s Bowling Committee’s request to host the 2025 championship at the Suncoast Bowling Center in Las Vegas, approved 11 conferences for AQs in women’s rowing and approved a waiver for the Pac-12 to retain its AQ in wrestling with four members for the 2024-25 championships. Arkansas State reported operating revenue of $32.84M in FY23, including $13.4M in institutional support, $7.21M in student fees and $3.61M in contributions. The Red Wolves’ football program finished with $9.92M in revenue with expenses of $13.27M for a $3.35M loss. The program’s revenue was down 12% from $11.28M in FY22. A-State’s overall expenses were also $32.84M. (link)

Plans to construct a new $50M arena at Mohawk Harbor have been finalized, paving the way for Union’s men’s and women’s hockey teams to have a new home venue. The project features a 2,200-seat hockey rink with capacity expanding to 3,600 for other sporting events, trade shows, special events and conventions. Union will contribute $20 million over 25 years to host the men's and women's hockey programs. Construction is slated to begin this spring and be completed in time for the 2025-26 season. (link)

+ The Big 12 announces the launch of the Basketball All-Access Pass, a new membership program for fans at the Big 12 Men’s Basketball Championship. The pass, which includes Premium and Priority options, will provide fans the opportunity to purchase the same seat location for the championship each year through 2031. It will debut in 2025.
