Washington State President Kirk Schulz concedes the College Football Playoff is a “mess” right now, telling the San Jose Mercury News’ Jon Wilner the internal communication among CFP leaders leaves something to be desired. “The commissioners meet to discuss the playoff on a regular basis. Every couple months, they ask the presidents to approve something. We are getting too much information second- and third-hand. If the SEC and Big Ten are considering things, it’s appropriate they communicate to us. That communication is not going on.” During last week’s meetings, in fact, a president from the Group of 5 reminded the board that playoff expansion (from four to 12 teams) had previously stalled as the commissioners squabbled, saying the “reason we got to where we are is the presidents took the lead,” according to Schulz. The other sticky wicket continues to involve revenue disparity, and Schulz tells Wilner: “The leagues have become tiered, and two of them are more resourced than everybody else. And some of the highly resourced schools have a different format in mind, which would give them more automatic qualifiers.” Meanwhile, Schulz remarks that there is “profound sense of regret about the situation we’re in. A lot of presidents have told me, ‘That could have been us’ or ‘That could be us.’ Realignment isn’t done.” (link)

As Washington State and Oregon State consider how best to utilize their $255M war chest, JohnCanzano.com’s titular publisher acknowledges the schools could use the funds to ensure they can retain coaches but adds: “I’m not convinced those things are what matter most to the coaches in [football and men’s and women’s basketball] right now. I’ve talked with a few of them and the feedback I get is that they’re concerned about the public perception of being relegated to the Mountain West and WCC. It threatens the recruiting effort and retention of the current roster. It’s why Oregon State football coach Jonathan Smith bolted for Michigan State instead of being more patient. Smith could have probably waited for Washington or UCLA to open up but had an ‘any port in a storm’ mentality. He took the first available exit. It will be essential for OSU and Washington State to draw some clear and definitive distinctions between themselves and the MWC and WCC programs they compete against next season. That will take brand awareness and intentional action. The narrative and message to coaches and players must be that this is a short-term plan and that they’re not settling.” (link)

Oklahoma State is currently in the “silent phase” of its $325M vision plan announced last year, according to Cowboys AD Chad Weiberg. The plan includes several facilities upgrades, including a new softball complex, indoor track & field facility, men’s and women’s basketball practice facilities, a human performance innovation complex and football center and a Gallagher-Iba Arena welcome plaza. Weiberg says OSU is keeping fundraising efforts quiet for now but notes architects have been contacted about most facilities. “It’s hard to believe it’s been a year already. But a year in, and I feel good about the progress that we’re making. … These are once-in-a-lifetime projects. Anytime you build anything like this, they’re gonna be there for 40, 50, 60 years or beyond. So the main thing is, it’s not so much how fast you can get it done – you got to get it right. Because you got one shot to do it.” (link)

Sportico’s Michael McCann explains that EA Sports’ NIL contracts with student-athletes for College Football 25 could hurt the NCAA in court. Simply put, EA offered a contract to student-athletes, who could either accept or reject it. Meanwhile, “longstanding NCAA legal defenses, such as the claim that amateurism rules ‘protect’ college athletes from exploitation and help distinguish the product of college sports from what pro sports offer, are being aggressively criticized by judges as unpersuasive and circular. It’s why Justice Brett Kavanaugh went so far as to write in NCAA v. Alston ‘the NCAA’s business model would be flatly illegal in almost any other industry in America.’ Expect EA’s use of simple contract law principles to negotiate with college athletes to be mentioned in court filings to argue athletes—and consumers—have unnecessarily denied games by NCAA rules.” (link)

ESPN men’s basketball analyst Jay Bilas advises the NCAA to settle the House lawsuit and asserts that if the association goes to trial and loses, then “it is done,” in part at least because appealing the decision would require posting an appeal bond for the entire amount, estimated by many to be ~$4B. Bilas: “The appeal bonds are there for a reason, so that parties that lose can’t just stretch this out and not pay for a decade. If they want to stretch it out, it’s going to cost them a lot of money.” Bilas goes on to say that in the meantime, the NCAA is spending countless amounts on legal fees “claiming victimhood,” adding: “If you want people to stop suing you for antitrust violations, stop violating antitrust law. It’s amazing how all these American businesses don’t get sued for antitrust violations. They don’t violate antitrust law. It’s not that hard. … Every doomsday scenario that the NCAA puts out – ‘If we do this, therefore we’ll have chaos and, therefore, people will turn away’ – ratings are up, there’s more interest, not less. It was all a lie. And it’s a lie that they can’t do it through employment. It’s a lie that they can’t sign the players to contracts. It’s all a lie. They just don’t want to do it. And I get it – if I didn’t have to pay the people who provide services to me, I’d be happy not to pay them.” (link)

Heitner Legal Founder Darren Heitner is “increasingly finding that the more experienced, reputable agencies are considering charging a commission on NIL collective deals, albeit below the standard marketing fee collected for typical endorsement deals. For those charging, the range tends to be between 3-10%. Some agents are also considering only taking a commission on the amount of compensation they can add, in negotiations, above the original offer presented by the NIL collective to the player. Many agents are playing the long game, but are growing tired of ‘giving away’ services.” (link)

The Athletic’s Christopher Kamrani explores why there aren’t more Football HCs below the FCS level who make their way to FBS, citing LSU HC Brian Kelly, Alabama HC Kalen DeBoer, Kansas State HC Chris Klieman and Kansas HC Lance Leipold as examples of those who have successfully navigated that path. Since 2000, there have been 15 HCs hired at the Power 5 level who were once HCs at a lower level than the FCS, and their combined record since joining the P5 is 582-434 (.572). Despite that, Leipold tells Kamrani: “If an administrator has cut their teeth at the upper levels of Division I or whatever, they don’t understand what Division III and NAIA is. They view them more like high school coaches, which is really unfortunate.” Vanderbilt Chief Consultant to the HC/former New Mexico/Minnesota HC Jerry Kill adds: “There is a reassurance of sorts with three or four guys, but hey, let’s face it: If you get to a certain age, that’s not the normal trend. But really everyone is hiring the 38-year-old cute guys that have never made (expletive) $250 a month and some of them haven’t even been GAs. … And the reason they’re doing that is because they think they can relate to the players better, and that’s (expletive), too.” Kansas State AD Gene Taylor makes a similar point, albeit less colorfully: “Sometimes in this business, whether it’s an AD or someone else, we tend to typecast. We go, ‘Oh, God, they can’t coach at this level if they’ve never been at this level. They think, ‘I’ve got to have a coordinator from a P5 or a sitting head coach somewhere,’ but there’s lots of talented coaches at lower levels. Under Armour and IMG Academy have agreed to a multiyear extension. Terms were not disclosed, but SBJ’s Wes Sanderson notes the extension “will not only mirror a collegiate style apparel deal – providing IMG Academy athletes with head-to-toe gear – but also allow Under Armour and academy athletes to test products and provide customization not available to other schools. The extension comes as Under Armour has stated plans to zero in on youth sports, specifically athletes between the ages of 16 and 24.” (link)

NCAA President Charlie Baker in a letter to members says he will convene the DI Board of Directors and Board of Governors “to discuss next steps” following U.S. District Court Judge Clifton Corker’s NIL ruling. Baker: “You have many questions, and we know you need to hear from us. But given the significance and sweep of this decision, it’s critical that our guidance to you and your colleagues on this ruling be accurate. The ruling affects several NCAA bylaws and policies in Division I, and the NCAA is quickly developing guidance on which rules are enjoined by the court order. … As I said at our convention, what’s at stake is too important for any of us to stand by and hope it will just get better. And if we all do our part, get involved, do the work and play the hand, we can continue to make progress on the large, complicated problems we face. In answering a question about whether we are past the point of a judicial test for student-athletes becoming employees, Sportico’s Michael McCann explains: “I think college athletes becoming employees is the most likely outcome, but there are still hurdles or uncertainties. A new general counsel at the NLRB (which would happen if former President Trump defeats President Biden this fall) could be one. The general counsel plays a crucial role at the NLRB. Odds are the topic of college athletes as employees will eventually be heard by a U.S. Court of Appeals, and there's a luck of the draw as to which judges are picked to serve on a three-judge panel. Then there's the U.S. Supreme Court. I think it's safe to say Justice Kavanaugh is a ‘yes’ for the athletes. The other eight justices? None joined Kavanaugh in his famous Alston concurring opinion, and at the end of the day, Alston was about a relatively minor issue that had nothing to do with employment. … So the justices' views on a more divisive topic like college athletes as employees are still unknown. But if I were betting, I think the end game is college athletes become employees.” (link)

New York Supreme Court Justice Kim Adair Wilson last night ruled in favor of Manhattan men’s basketball student-athlete Dejuan Clayton, granting his motion for a preliminary injunction that will reportedly keep him eligible to play for the remainder of the season. The ruling was made at 7:48 PM, allowing Clayton to enter last night’s game against Marist with less than 10 minutes left. The decision also enjoins the NCAA from assessing penalties against Clayton or Manhattan under the association’s restitution rule. Shumaker attorney Robert Boland, who represented Clayton: “Even though there are only four regular season games left, Dejuan, who has suffered an extraordinary range of injuries, hardships and circumstances far beyond his control over the last several seasons in an attempt to finish his college career, will benefit from the opportunity to have healthy, recent game tapes in his quest to move toward a professional career either domestically or internationally. It is also our hope that Dejuan, who is also a good student, can finish his master’s degree in organizational behavior at Manhattan on schedule this spring.” (link)

Robert Morris is requesting $10M in state funding to help build a $28M hockey arena on campus. The proposed 100K-square-foot facility would include two sheets of ice, at least four locker rooms, practice and training space, and have a seating capacity of 2,500. Colonials AD Chris King: “This strategic initiative represents a blending of our pursuit of competitive excellence with our ongoing commitment to serving the needs of the greater community. The new arena would serve as a vital source of revenue, crucial for the long-term sustainability of our Division I ice hockey programs, whose resurgence has been fueled by fundraising support.” RMU plans to launch an $18M campaign in capital investment, corporate naming partners and donor investment to fund the rest of the project’s cost. Iowa State will ask the Iowa Board of Regents next week to approve a $16M upgrade of the video displays and sound systems at Jack Trice Stadium and Hilton Coliseum. CollegeAD reports Daktronics will install the video boards and One Diversified will install the sound systems. The projects are expected to be completed in phases between the fall of 2024 and the fall of 2025. (link)

Alabama AD Greg Byrne weighs in on ways to mitigate fans storming the court and says fining the schools isn’t the answer. "Kids aren’t going to be in the stands saying ‘Oh, I don’t want to do this because the school is gonna get fined $200K.’ That doesn’t enter their mindset. But if they knew the game that they just had been a part of, celebrated a great win that led to that, if they knew that they were going to lose that game immediately, that would stop them. … I think the way it will stop that, will get everybody's attention and realize this is dangerous, is if it's your game and students, who are usually the instigators, right? We love our students. Then the home team forfeits the game. Now if you have two kids running out there, no. But when you have a sustained rush like what happened the other day at Wake, you lose the game. That will get people to stop." Byrne continues: “We had a student manager we thought was gonna lose an eye after a field storm in the last few years. He ended up being concussed and the doctors were able to save his eye. We had a doctor, a female doctor, get pushed down and bruised up pretty bad. And something needs to be done about it.” (link)

On the same topic, Butler AD Barry Collier gives his opinion: “There’s a difference between trying to stop court-storming and trying to prevent injury. I’d prefer we chase the latter of those two, and then I think we’d be in a better place.” Oklahoma AD Joe Castiglione adds: It’s very difficult to stop mass stampede. Some of the security experts may even tell you in some cases, it’s safer to get out of the way than to create a worse situation.” SEC Asst. Commissioner for Championships Jeremy Hammond tells The Athletic’s Brendan Marks, Dana O’Neil and Nicole Auerbach that the conference discussed the idea of making the home team forfeit games in instances of court-storming, but “I don’t think there was an appetite, at our office or amongst our membership and their leadership, to punish the student-athletes in that manner for something they weren’t involved in and have no control over. … That’s where that sort of died on the vine.” One solution Marks, et al. present involves communicating more clearly with the fans. Kansas State Men’s Basketball HC Jerome Tang, for instance, told the fans before last season that they were allowed to storm the court once. “If you want to build a championship culture and expectation, you’ve got to do the actions before the championships come. So I told them, hey, you got the one court storming — but from here on out, let’s expect to win.” Consequently, when the Wildcats upset Kansas this season, the fans listened. More opinions on court storming, here’s Big 12 Commissioner Brett Yormark: “I have a call with some of my commissioner colleagues and we are going to address it because it's not a conference issue, it's an industry issue and something that, you know, we need to address collectively. And those conversations are being had, and formally we will have one tomorrow and we'll see where it takes us.” Kansas Men’s Basketball HC Bill Self: “Let's get rid of it, totally. I don't see the positive impact from a visual standpoint. Our game has excitement and people are excited about college basketball so much. [Court storming] isn't as big of a positive as a potential negative that exists with somebody getting hurt or lawsuits. Can you imagine a kid storms the court, runs into somebody, he gets sued and his life is changed forever? It works both ways. Or, somebody runs into one of our players, our player [lifts their arms] to protect themselves and catches somebody right in the Adam's apple or hits them in the temple and they get a concussion or something? That's a lawsuit against them.” (link)

On3’s Andy Staples points out that ESPN, the SEC’s media partner, “cut a clip [of LSU fans storming the court after upsetting Kentucky in men’s hoops last week] and posted it to YouTube advertising the court storm. ESPN’s Jay Bilas correctly explained multiple times in the past two weeks that court stormings aren’t going away in part because his network wants the visual. We love that visual. The CBS blimp shot of Tennessee fans streaming onto the field at Neyland Stadium after beating Alabama in 2022 might have been the most iconic image of that season.” Staples goes on to offer two suggestions for better managing court-storming rather than trying to eliminate it: a pregame poll and an instructional video. “On gameday, ask fans on social media if this feels like a game where they might storm if the home team wins. If the numbers come anywhere close to 50 percent, make sure arena/stadium security is on high alert. For the second, think about the video you watch before you’ve gone on any rollercoaster. It explains how to buckle your seat belt and also what kind of movements might cost you a limb. This video should offer helpful tips like asking fans to count to five before storming. … With a more common-sense approach, it’s possible to keep the fun without hurting anyone. But the fans are going to have to help.” (link)
