NCAA President Charlie Baker tells SBJ’s Ben Portnoy in a wide-ranging interview that his approach to antitrust has been simple: “The NCAA should be able to make rules as an organization that comply with federal law. And I'm perfectly happy to have some federal entity oversee that and maybe even a prerequisite process that the rules would have to go through and pass some tests to get there. But this idea that the membership can make rules and then if one member decides they don't like it, because it doesn't work in a very particular, specific situation for them, that they can then turn into a federal case and everybody's hiring lawyers and spending millions of dollars to fight it, I mean, this is just no way to run anything.” Baker on student-athlete employment: “I think my view is compensation and employment do not have to be linked. And given the fact that I have a whole bunch of Student Athlete Advisory Councils who agree with me, that's going to be my position, and I'm sticking with it. But you have to present a vision and approach to this that answers the question [of employment and compensation] and that's what I think ‘Project DI’ was about." (link)

NCAA President Charlie Baker has three separate tracks available in the face of multipronged legal attacks facing the organization, according to Sportico’s Michael McCann. First, Baker could “gamble that the losing will end. Even the coldest streaks eventually stop. Baker could surmise while the NCAA may lose on NIL, transfers and conferences sharing TV money with players, the fundamental rule that colleges can’t pay athletes for their labor is worth defending. It’s the rule at the heart of college sports.” McCann cites U.S. District Court Judge Robert Gettleman’s ruling in Bewley v. NCAA in which Gettleman wrote the NCAA rendering ineligible athletes who already turned pro promotes the association’s ‘unique product’ of ‘college sports.’ The case is on appeal to the U.S. Court of Appeals for the Seventh Circuit, so the NCAA could still lose. But maybe there are more judges like Gettleman out there who aren’t yet ready to wipe out amateurism.” Baker’s second option is to continue lobbying Congress “to pass something of a miracle bill – one that exempts the NCAA from antitrust scrutiny, declares college athletes are not employees, sets a national NIL standard and preempts any conflicting state laws.” Even if such a bill is signed into law, McCann believes it would face “Constitutional challenges on Equal Protection Clause and preemption grounds and likely toil in court for years.” The final track has two components: radically changing the player compensation structure to comply with antitrust laws and reaching settlements with thousands of player-plaintiffs. McCann: “The NCAA is on the verge of its system being obliterated in court. It needs to undertake major reforms quickly. Otherwise, it will be compelled to change rules and likely pay out billions of dollars. Where will that money come from? How many jobs at the NCAA, conferences and schools will be lost?” (link)

As a Faculty Athletics Representative at Texas Tech, Professor Brian Shannon is responsible for advocating for student-athlete welfare. While his primary teaching responsibility is contract law, he focuses his policy and research work on mental health law, an area he has been researching for a lifetime due to his family experience with mental illness.

Professor Shannon explains that mental illness patients often get caught in the criminal justice system without receiving treatment. He also emphasizes the importance of distinguishing between having a mental illness and dealing with mental health challenges. The 180 qualifiers for the Men’s Wrestling Championship have been unveiled with the competition to begin March 15 at Hartman Arena in Wichita, KS. (link)

Sportico’s Michael McCann points out that “preferential admissions was one reason cited by NLRB regional director Laura Sacks in determining Dartmouth (DI) basketball players are employees within the meaning of labor law. Colleges that do the same for their athletes should be mindful of that.” Sacks wrote in her ruling that even though Dartmouth asserts players are admitted on the strength of their academic records, “the record reveals that Dartmouth first makes contact with the players as high school students because of their basketball abilities. The coaching staff is allotted a certain number of highly coveted admission spots for players they scout based upon their basketball skills and encourages players to matriculate to Dartmouth rather than at a school which might offer them an athletic scholarship because of the lifelong benefits that accrue to an alumnus of an Ivy League institution.” The Dartmouth men’s basketball team set to hold a unionization vote tomorrow. Rockhurst AD Kristy Bayer pens for BOSCA on the transition from coaching to administration and the decision, preparation and aftermath of such a move. Bayer relays her decision came from her loss of excitement with the “rest of coaching,” outside of game day. Her preparation for a transition began early in her career, by serving in other roles, serving in committees and communicating her goals with her AD. “My strongest piece of advice is to serve on committees. […] You will expand your network, while gaining valuable knowledge about your organization. […] As I was preparing for the AD interview, I was discouraged because I didn’t have a lot of fundraising experience. I mentioned this to Tim Selgo, a DII legend and my former AD when I played at Grand Valley. He said, ‘What do you mean you don’t have fundraising experience?! You were a successful head coach for 14 years. Your recruiting is your fundraising. You have years of experience.’ You can sell. You can speak in front of groups. You can persuade people. This is an underrated skill, that is greatly transferable to external roles in athletics.” On coping with the loss of a coaching identity, Bayer: “You will need to adopt a mindset shift. As a coach, you were an advocate for your players, budget, court time, and everything necessary for your team to be successful. As an administrator, not only do you look out for the entire department, but your decisions and actions need to be in the best interests of the entire university. You don’t have a singular domain anymore. You need to contribute to the collective good of university operations. […] Your path may forever lie in coaching or you may be deciding your next step. You may have transitioned out, but in your heart, mind, and body, you will always be a coach.” (link)

Given the possible technology changes across multiple sports, the MIAA will put together a Technology Task Force, per Commissioner Mike Racy, “to put together a comprehensive report that our athletic administrators can look at in June of all of the things we may want to test or fully Implement next academic year. It's a recognition by our administrators that this is the way of the future. These are things we're going to have to embrace. We want to do it in a way where we're still a leader in innovation and strategy.” More. (link)
