The DI Board of Directors has directed enforcement staff to pause and not begin new investigations into third-party participation in NIL activities, according to a memo sent by NCAA President Charlie Baker today. Baker adds: “There will be no penalty for conduct that occurs consistent with the injunction (issued by U.S. District Judge Clifton Corker) while the injunction is in place.” Baker also pointed out that three specific policies remain in effect and will be enforced: the restriction on pay-for-play, the restriction on institutional payment for NIL and the quid pro quo requirement. “I agree with this decision, while the progress toward long-term solutions is underway and while we await discussions with the attorneys general. In circumstances that are less than ideal, this at least gives the membership notice of the board’s direction related to enforcement." Full memo. (link)

NCAA President Charlie Baker tells SBJ’s Ben Portnoy in a wide-ranging interview that, amid reports the SEC and Big Ten leaders are discussing a breakaway, it’s “not the first time those conversations or issues have come up. I think it's incumbent on me to come up with a 'business model' that gives those kinds of schools and those kinds of conferences the latitude to be able to do some of the things that they would like to do. … We've got to figure out what [the future model] looks like, and that's been what the last couple of months has been about. But I'm not living in a world where everybody's saying that the [Power Four] should be treated just like everybody else, because people get the fact that from an operations point of view, a scale point of view, they're not [the same]. I think that's directionally a good thing." Baker also says his approach to antitrust has been simple: “The NCAA should be able to make rules as an organization that comply with federal law. And I'm perfectly happy to have some federal entity oversee that and maybe even a prerequisite process that the rules would have to go through and pass some tests to get there. But this idea that the membership can make rules and then if one member decides they don't like it, because it doesn't work in a very particular, specific situation for them, that they can then turn into a federal case and everybody's hiring lawyers and spending millions of dollars to fight it, I mean, this is just no way to run anything.” Baker on student-athlete employment: “I think my view is compensation and employment do not have to be linked. And given the fact that I have a whole bunch of Student Athlete Advisory Councils who agree with me, that's going to be my position, and I'm sticking with it. But you have to present a vision and approach to this that answers the question [of employment and compensation] and that's what I think ‘Project DI’ was about." (link)

NLRB Regional Director Laura Sacks has denied Dartmouth’s motion to reopen the record in order for the school to introduce new evidence and testimony. Sportico’s Michael McCann notes that “reopening the record is considered an extraordinary measure under labor law,” and Sacks found that no such extraordinary circumstances warranted it, explaining that Dartmouth sought to introduce “evidence which existed and was readily available to it prior to the hearing.” Sacks also concluded that Dartmouth’s contention that she misapplied the law would be more appropriately argued in a request for review to the agency’s board. Dartmouth is expected to file such a request by next Monday. McCann notes that the “board has not yet ruled on Dartmouth’s other motion to postpone the election or impound the ballots from next Tuesday’s vote.” (link)

The Tennessee Board of Trustees has approved the university’s plan to create a nonprofit foundation that could quickly mobilize into a fund to pay salaries to athletes if/when that time comes, according to the Knoxville News Sentinel’s Adam Sparks. Chancellor Donde Plowman: “It’s really an effort to try to be agile and be ready for the coming changes. … If that came to fruition – and I don’t know that it will – but something like it is probably likely, we need a mechanism to do that. So the foundation would be an example of how we would put revenues from the athletic department into that foundation that we could use to pay the student-athletes.” According to UT’s proposal, an “overwhelming majority” of SEC schools already have a similar foundation set up to support financial needs of the athletics department and student-athletes. UT must return to the board before the foundation becomes operational, and Plowman explained to trustees: “So I’m here today to ask your permission to take the next steps to set up such a foundation. It’s complicated. It’s going to take time. There are IRS implications. We have to get it organized carefully so that the university is in charge of that foundation (with) controlling votes.” (link)

The NCAA Football Rules Committee has proposed optional technology rules, effective with the 2024 competition season, including the option for FBS teams to use helmet communication. The player allowed to use the comms system would be identified by having a green dot on the back midline of the helmet. The communication from the coach to the player would be turned off with 15 seconds remaining on the play clock or when the ball is snapped, whichever comes first. For all three divisions, teams would have the option of using tablets to view in-game video only. The video could include the broadcast feed and camera angles from the coach's sideline and coach's end zone. Teams could have up to 18 active tablets for use in the coaching booth, sideline and locker room. Tablets could not be connected to other devices to project larger additional images and could not include analytics, data or data access capability or other communication access. All team personnel would be allowed to view the tablets during the game. The committee also discussed the use of wearable technologies and has invited non-FBS conferences that are interested to submit experimental proposals by June 15. Additionally, the committee proposed adding an automatic timeout when two minutes remain in the second and fourth quarters; a stronger enforcement structure for clear violations of uniform violations; allowing conferences the option of using a collaborative replay review system; and penalizing horse-collar tackles that occur within the tackle box as a 15-yard personal foul. The family of longtime Virginia benefactors David and Mary Harrison has made a $55M commitment to UVA to support the Olympic Sports Center ($25M) and to create a leading-edge translational research program dedicated to the next generation of therapies for Alzheimer’s and related diseases ($30M). The Olympic Sports Center will provide support to more than 750 student-athletes, including UVA’s field hockey, cross country, track and field, lacrosse, rowing and soccer programs. Davidson has canceled the remainder of its women’s basketball season due to a significant number of injuries suffered by the team. The Wildcats started the year 12-1 and will finish the campaign with a mark of 18-8. AD Chris Clunie: “The physical, mental and emotional toll of this unfortunate and injury-riddled season has brought us to this point. We are incredibly saddened that we cannot finish out the season strong but feel this is the best decision for our scholar-athletes.” (link)

Georgia Football HC Kirby Smart pegs the percentage of stuff head coaches can’t prepare for at 80-90% and explains: "I mean, the media, you don't prepare for that until you do it, and you can say you're going to talk to them as an assistant, but it's not the same. The decisions. The phone calls you get when someone gets in trouble. The who are you going to take? This running back or this running back, or this receiver or this receiver? The hiring and re-hiring of coaches. The support staff hiring. … You never do it until you're a head coach. You can't practice that. You have to go through it and do it." Smart goes on to share that former Alabama HC Nick Saban offered a peek behind the curtain, but everyone understood the final decision of what to do was up to him. As far as what doesn’t change, Smart says: "The coaching part of it doesn't change. The coaching offense, defense, and special teams. That didn't change, but the rest of it did." (link)

Fanatics CEO Michael Rubin talks about MLB’s Nike uniforms, which were manufactured by Fanatics, and says: “A difficult position for us – we're doing everything as we’ve been told and we’re getting the sh*t kicked out of us. So that’s not fun. Time will tell but I believe Nike will be proved right. Moody’s Investors Service has downgraded Rider’s issuer and revenue bond ratings from B3 to Caa1, marking the university’s fourth downgrade since 2020. The agency did upgrade the school’s credit outlook from negative to stable, citing its reduced scope and steady enrollment. (link)

Louisiana Tech yesterday officially introduced incoming AD Ryan Ivey, who talked about his experience operating at athletic departments without the resources some bigger and wealthier universities enjoy. “Just throwing money at a problem has not been a luxury I have had and I know it won’t be one I have here either. I have learned to work in and with margins and have had success along the way. It doesn't mean we always got it right, but we took calculated risks that led to broad-based success. I recognize that this is a unique and challenging time in college athletics, especially for institutions like ours. We’re constantly striving to maintain and enhance our position within the college athletics ecosystem. I fully come into this position with eyes wide open knowing that we have some inherent, built-in challenges. However, I will not stand by and just accept that we can’t have success. We have the ability, opportunity, and responsibility to dream big, bold dreams and we must not settle for anything less. Now is the time to raise the bar for Louisiana Tech athletics.” Ivey went on to remark that if Tech continues to wait for the “right time,” it may be too late. “Our enterprise is not perfect. We’ve got challenges and we’ve got problems. You could almost say college athletics has gotten itself drunk and high at the same time. We don’t know which way is up or down most of the time. According to one College Football Playoff model that has been “circulated to several college athletic administrators,” the SEC and Big Ten would hold exclusive rights to the two first-round byes in a 14-team format, per Yahoo’s Ross Dellenger, who reports the version “has not been finalized and is only being socialized before more exploratory work on the format.” Dellenger also reports the seeding and structure of the 14-team field is expected to operate similarly to the 12-team structure “where the CFP Selection Committee’s rankings would equate to seeds Nos. 1-14. Pairings of the six first-round games would be made in the normal method, including the No. 8 seed playing 9 and 7 vs. 10, presumably at the home field of the better seed. Notre Dame, as an independent, would be guaranteed one of the three at-large spots if it finished in the top 14 of the CFP’s rankings. However, administrators caution that the model could change.” Commissioners are expected to meet virtually to dive deeper into the format over the next week. (link)

Sports Illustrated’s Pat Forde charges the Big Ten and SEC each with one count of “next-level gluttony” and one count of “next-level cowardice” for seeking to secure automatic first-round byes in the 14-team format. Forde asserts that the “two most powerful conferences in America are scared to compete” and that “the richest of the rich want the biggest tax breaks.” He then asks: “When does the appeasement game end with these two gluttons? When do they stop asking for more? When do they stop bullying the rest of college athletics into acquiescence? … At some point, the rest of the leagues—and the NCAA—may surrender to fatigue and simply wave the Big Ten and SEC out the door, on their way to set up their own AFC/NFC fiefdom. It might be what they want but are reluctant to outright declare. Don’t think those two aren’t discussing it. This was strangely tucked into the 19th paragraph of this ESPN.com story Wednesday night: ‘One high-ranking official involved in the discussions told ESPN on Wednesday that the presidents and chancellors in both the SEC and Big Ten are having conversations about whether to continue their NCAA membership.’” (link)

Washington State President Kirk Schulz during yesterday’s introduction of new Pac-12 Commissioner Teresa Gould also spoke about the situation in Pullman: “We’re not likely to have the same revenue package coming in to support Cougar Athletics over the years that we enjoyed in the heyday of larger media packages in the Pac-12. We’re going to have to make some adjustments in our budgets and what we pay and things like that. But we don’t feel like we have to do those overnight.” He also commented on the possibility of a breakaway from the NCAA: “It’s easy to throw hand grenades at the NCAA…but at the end of the day we need an organization that puts on championships and handles enforcement.” (link); Also from Schulz: "At the end of the day, what's important for Washington State and our football program is access to the (College Football) Playoff. The latest version of the NCAA Division I Women’s Basketball Committee’s top 16 has been revealed. No. 1 seeds include South Carolina, Ohio State, Stanford and UCLA. No 2 seeds are Virginia Tech, Texas, Iowa and USC. No. 3 seeds are LSU, UConn, NC State and Oregon State. No. 4 seeds are Colorado, Indiana, Gonzaga and Oklahoma. (link)

Recruiting was the biggest driver of increased spending among athletic departments in FY23, according to Sportico’s Daniel Libit and Lev Akabas, who note that “cumulative recruiting line-item growth (24%) outpaced that of total athletic department expenditures (13%) from 2021-22 to 2022-23. … At least seven public Power 5 schools reported seven-figure spikes in their recruiting budgets from 2021-22 to 2022-23, while a number of smaller Group of 5 programs reported their recruiting costs at least doubling from FY22 to FY23.” Football recruiting costs grew at an even faster rate, seeing a 32% increase YoY. The deregulation of the transfer market over the last few years is the biggest impetus for the uptick, according to athletic department officials who spoke to Sportico. LSU Assoc. AD/Chief Brand Officer Cody Worsham: “There is a lot more last-minute travel. You are doing a private charter or buying an expensive ticket, rather than (scheduling) a planned-out trip. You are not looking at price, you are looking at immediacy.” Meanwhile, Oklahoma Assoc. AD for Strategic Communications Mike Houck says the Sooners’ $900K increase in recruiting spending was due to trying to match the expenditures of soon-to-be SEC foes. “As we looked at comparative data related to SEC football program recruiting expenditures, we found that we would need to invest more to compete with the top programs in this area.” More. The Centennial Authority in Raleigh has chosen Gensler Sports and Raleigh-based LS3P as the new PNC Arena design team. Authority Chairman Philip Isley: “It sounds like we’ve made the right choice and everybody is ready to hit the ground running. From there, I think all good things are going to continue to happen in the building.” The authority, which will hold a full board meeting next week to approve the selection, also considered Perkins & Will/HH Architects and Generator Studios/City Collective. Indiana is unlikely to move on from Men’s Basketball HC Mike Woodson after this season, according to Field of 68’s Mike Miller and Jeff Goodman, who notes Woodson has the support of Hoosiers great/IU Board of Trustees Chair Quinn Buckner. Buckner “spearheaded his hire and has plenty of juice in the decision-making process.” That said, Miller and Goodman point out that a “buyout wouldn’t be a determining factor” if IU does choose to move on. “According to an amendment obtained by The Field of 68, Woodson is owed $12.6M if he’s terminated this spring. But it wouldn’t be due all at once. Indiana could pay Woodson $1M per year, all the way until 2036.” Meanwhile, the duo point out it’s worth monitoring that if “Woodson has had enough of the fan base calling for his ouster,” Woodson, who is 65, may decide he wants to enjoy retirement. It’s also worth keeping an eye on whether “there is a mass roster exodus.” (link)

ESPN play-by-play announcer Dave Pasch tells The Athletic’s Richard Deitsch he’s been on the mic for two college basketball games in his three-decade career that ended in fans storming the court, including LSU’s upset over Kentucky last month. For that game specifically, Pasch says he and analyst Jay Williams asked an LSU staffer if fans would storm the court if they won. “He was like, ‘Nope, we don’t storm the court here. We’ve beaten Kentucky before.’ Well, they won on this crazy, last-second shot and, of course, they stormed the floor.” Deitsch notes that in the game’s final sequence, Williams can clearly be heard saying: “Didn’t we talk today about if LSU has the right protocol in place for a court storm?” Thinking about the issue more broadly, Deitsch wonders how broadcasts should handle court-storming and ESPN’s Dan Shulman says: “I think for the most part, people in television hope that when these do happen, it is all good fun, and no one gets hurt. There’s no question it’s a good visual on TV, which is enjoyed by a lot of viewers. But to me, the risk outweighs the reward.” As far as whether networks should show it, longtime CBS News and CBS Sports director Bob Fishman believes that “you can’t ignore it. It’s not like a streaker running across the field at a football game, which you don’t show. I think that you have to show it because it’s part of the story and especially now since players have been injured.” Fishman adds he would broadcast it via a wide shot, “then I would make sure that my cameras on the court were recording everything and that stuff was being fed into a tape machine. I would never put that on the air.” (link)

Fairleigh Dickinson details how last year’s NCAA Men’s Basketball Tournament run has impacted the university, noting that applications were up 27% over the previous year’s cycle while admits increased 35%. Additionally, the December 2023 Open House attendance was up 33% over 2022, and the October 2023 Open House attendance jumped 48% YoY. FDU athletics has also undergone its first full rebrand in nearly 20 years. That rebrand includes a change in the school’s athletic identity from Fairleigh Dickinson to FDU. The Knights also announce that 2023-24 set the single-season revenue high for MBB ticket sales in program history. On top of that, from March 2023 through October 2023, FDU’s online merchandise sales increased 327% from the same period in 2022. (link)

Puck’s Julia Alexander wonders whether a future exists for ESPN+ in its current form, noting the app “carries a handful of sports, including MLB baseball, hockey, soccer, and exclusive UFC matches—but crucially, not every Monday Night Football game.” Alexander adds that ESPN+ “wouldn’t necessarily be made obsolete by the Spulu bundle, which will presumably be four or five times more expensive. But the current version of ESPN+ will likely become a lower tier of the new ESPN stand-alone streaming app that Disney CEO Bob Iger has announced for 2025. This new, much ballyhooed service is expected to have all of the same content as the cable network, presumably at a price point somewhere in between the basic bundle and Spulu. If that sounds confusing, you’re not wrong. Consolidation is coming.” (link)

The NFL has revealed it tested optical technology to track first downs in multiple games this season, including the Super Bowl, and that the owners will be presented with information about how the tests went as the NFL considers the possibility of using the tracking instead of chains. The testing featured technology developed by Hawk-Eye, the computer vision system that assists with video replays in tennis, to precisely determine the position of the ball and players during replay reviews. According to NFL Network's Tom Pelissero, the technology is not ready to be rolled out for the 2024 season. (link, link)

Clarification… In recapping Wednesday’s conversation between Tulane Sports Law Director Gabe Feldman and Altius Sports Partners CEO Casey Schwab, we noted the two remarked that “schools can negotiate NIL with prospective student-athletes before they enroll.” In fact, Schwab said U.S. District Court Judge Clifton Corker’s ruling only allows third parties to negotiate NIL with prospective student-athletes, not schools but is “going to lead to practical outcomes on campuses and how coaches work with collectives that there’s going to be a distinction without a difference between collectives talking to recruits and making offers and coaches are now just that much closer to it and we’re getting closer to it and we’re getting really close to pay-for-NIL, if not pay-for-play.” (link)
