Sportico’s Michael McCann & Daniel Libit report in follow-up to the NCAA’s memo yesterday that it will “pause and not begin investigations” connected to NIL: “(NCAA President Charlie) Baker had no real choice but to pause enforcement unless the NCAA were to appeal the ruling to the U.S. Court of Appeals for the Sixth Circuit.” Brown AVP for Athletics, Governance & Recreation/SWA & President of the National Association for Athletics Compliance Shoshanna Engle Lewis: “Much like the environment immediately following the first iteration of the interim NIL policy in 2021, campus personnel, including compliance professionals, must use the best information available to advise and assess risk, both for institutions and individual student-athletes. While we don’t have clarity on when exactly this will play out, we are able to utilize today’s information to make a more informed risk assessment.” Headlining attorney Tom Mars: “First, it seems clear the NCAA is not going to waste more money appealing a decision that has no chance of being overturned. ESPN’s Pete Thamel writes on the future of the NCAA Committee on Infractions amid a landscape of constant rule changes & legal challenges. Northern Colorado President Emerita & COI Chair Kay Norton: “Our coaches want rules, and there's going to have to be a body that enforces those rules regardless of if it's at a conference level or at the NCAA level. So I don't see that changing ever in college athletics. There'll be some set of rules. If we didn't exist they'd have to invent us.” Missouri Valley Conference Deputy Commissioner Jill Redmond: “I would say 'no' to having enough in our arsenal as an association. We don't have subpoena power, so in some circumstances we don't know the full set of facts, and then it's hard to [figure] what is the right punishment? You've got student athletes that I would say accept benefits and do things that they know are not appropriate, and they know that there are consequences, but we don't want to punish a team because the team also has innocent student athletes. You've got programs that don't follow the rules, but then they also don't want to face those consequences. But what do we do for the programs that are compliant? To me, it's nearly impossible to issue a penalty and not somehow impact somebody in a disparate way when they didn't do anything wrong.” More. (link)

"Automatic first-round byes for the Big Ten and SEC is like the NFL saying the Cowboys get a first-round bye since they have more fans than the Bengals. How preposterous is that?” That’s TCU Football HC Sonny Dykes on the current 14-team College Football Playoff model that would include the conference champions from the SEC and Big Ten getting the only two byes. ESPN’s Dave Wilson and Heather Dinich get additional feedback from coaches in the ACC and Big 12, none of whom agree with the proposed idea. NC State HC Dave Doeren: “The champions from each of those four deserve to be in, and I agree with that. ... After the four champions, then let those teams that have earned that over the course of their season with strength of schedule, their ranking, quality wins and all that be what matters.” Oklahoma State HC Mike Gundy: “We need to let the teams decide it on the field and reward those who are most deserving.” (link)

As the Tennessee-Virginia decision reverberates nationally about third-parties’ ability to communicate with prospects about NIL opportunities, other pressing NIL-related scenarios continue surfacing on campus when it comes to student-athletes and their healthcare. MB Sports Founder/CCH+A Senior Advisor Matt Banker, U.S. Council for Athletes' Health President & CEO Dr. James Borchers, M.D.; and CCH+A attorneys Connor Glass and James Nussbaum pen an article examining the intersection of NIL and healthcare. The group points out that student-athletes who have engaged in NIL opportunities promoting or endorsing a physician, a hospital system, a clinic, a medical equipment supplier, or a nutritional supplement manufacturer may find themselves seeking care, medical advice, second opinions, and/or free products or services from individuals, companies, and organizations that operate in healthcare. This is where some of the potential complexities begin to surface. The co-authors noted NIL activities invite new dynamics to a student-athlete’s medical management and how those NIL pursuits may eventually intersect with a university’s sports medicine policies, state laws, and/or other existing NCAA rules not impacted by recent court decisions such as the NCAA’s banned substance list. The co-authors noted NIL activities can lead to a student-athlete insisting on seeking a second opinion from an outside healthcare provider the student-athlete is endorsing through use of their NIL; the potential for disparities in treatment suggested by the school’s medical staff and the NIL-endorsed outside healthcare provider; and the student-athlete endorsing a supplement that may include a substance banned by the NCAA. Context from The Athletic’s Katie Strang and Brendan Quinn: “Sanderson’s exit comes after reaching a settlement with the university, two sources briefed on the agreement said. That agreement includes a non-disclosure clause, those sources said. Sanderson’s departure follows a Dec. 7 confrontation with Michigan head coach Juwan Howard that resulted in Sanderson no longer working with the men’s basketball program. Sanderson spent the last 12 weeks working out of the athletic department’s south campus complex primarily with some of the school’s Olympic sports teams.” (link)

Siena Senior Assoc. AD/SWA Angie Jabir sits down with AthleticDirectorU’s Tai M. Brown at the 2024 NCAA Convention and shares how she balances priorities as a sport administrator, NCAA committee member and senior leader within her department. Jabir also reflects on her early transition from coach to administrator while at Dayton, when she learned the importance of sport oversight. On that topic, Jabir explains: “You have to become a subject area expert in the sports you oversee. … There’s nothing more frustrating for a coach to be sitting with their administrator and feel like either you’re not asking the right questions, you don’t have a baseline understanding of their sport.” Jabir and Brown also break down the value of an “inbox zero” approach and how organization and communication are the keys to balancing multiple responsibilities in her primary role and an NCAA committee member: “I pride myself on having a small inbox, so I try to frequently check in with the folks back home and also take advantage of this opportunity to be here with colleagues” from around the country. “I think being organized and being intentional with your time, but also making sure that you're communicating you're still accessible even when I'm in Phoenix I'm still accessible to the coaches back at Siena.” Full interview on ADU. The Wall Street Journal’s Rachel Bachman breaks down the financial components of Iowa women’s basketball star Caitlin Clark’s decision to turn pro, noting that while it may seem “from a distance” like Clark could make more by staying in college, the reality is more nuanced. For instance, while the rookie salary for a WNBA player drafted in the top four is $76K, Clark could make up to $250K per year as a marketing ambassador for the league, up to $100K for team marketing deals and other bonuses for winning league awards. Clark can also earn more from sponsorships in the WNBA. Bachman also points out that “Clark’s top sponsors—Gatorade, Hy-Vee and State Farm—told The Wall Street Journal they’ll maintain their partnerships with Clark into the pros. And she’s certain to add sponsors when she goes to the WNBA.” On top of that, Clark is likely to field bids for shoe deals worth upwards of $3M per year. The IRS will begin auditing dozens of companies over the personal use of corporate jets by executives and other wealthy travelers. According to IRS Commissioner Danny Werfel, the agency will start with three to four dozen audits of large corporations and partnerships with audits of high-income individuals likely to follow. “These aircraft audits will help ensure that high-income groups aren’t flying under the radar. What we believe is happening is there’s not enough robust record-keeping going on, and there is systemic overstating of these business deductions.” The Wall Street Journal’s Ashlea Ebeling and Theo Francis report the audits will “span multinational corporations, domestic corporations, and complex partnerships across a diverse set of industries, focusing on whether they overstated deductions. Then, once the IRS gets a better understanding of the issue, the next wave of audits would be on individuals who aren’t reporting personal trips as income.” It is unclear whether higher ed and/or athletic departments will be included in the audits. The DI Board of Directors has directed enforcement staff to pause and not begin new investigations into third-party participation in NIL activities, according to a memo sent by NCAA President Charlie Baker today. Baker adds: “There will be no penalty for conduct that occurs consistent with the injunction (issued by U.S. District Judge Clifton Corker) while the injunction is in place.” Baker also pointed out that three specific policies remain in effect and will be enforced: the restriction on pay-for-play, the restriction on institutional payment for NIL and the quid pro quo requirement. “I agree with this decision, while the progress toward long-term solutions is underway and while we await discussions with the attorneys general. In circumstances that are less than ideal, this at least gives the membership notice of the board’s direction related to enforcement." Full memo. (link)

NCAA President Charlie Baker tells SBJ’s Ben Portnoy in a wide-ranging interview that, amid reports the SEC and Big Ten leaders are discussing a breakaway, it’s “not the first time those conversations or issues have come up. I think it's incumbent on me to come up with a 'business model' that gives those kinds of schools and those kinds of conferences the latitude to be able to do some of the things that they would like to do. … We've got to figure out what [the future model] looks like, and that's been what the last couple of months has been about. But I'm not living in a world where everybody's saying that the [Power Four] should be treated just like everybody else, because people get the fact that from an operations point of view, a scale point of view, they're not [the same]. I think that's directionally a good thing." Baker also says his approach to antitrust has been simple: “The NCAA should be able to make rules as an organization that comply with federal law. And I'm perfectly happy to have some federal entity oversee that and maybe even a prerequisite process that the rules would have to go through and pass some tests to get there. But this idea that the membership can make rules and then if one member decides they don't like it, because it doesn't work in a very particular, specific situation for them, that they can then turn into a federal case and everybody's hiring lawyers and spending millions of dollars to fight it, I mean, this is just no way to run anything.” Baker on student-athlete employment: “I think my view is compensation and employment do not have to be linked. And given the fact that I have a whole bunch of Student Athlete Advisory Councils who agree with me, that's going to be my position, and I'm sticking with it. But you have to present a vision and approach to this that answers the question [of employment and compensation] and that's what I think ‘Project DI’ was about." (link)

NLRB Regional Director Laura Sacks has denied Dartmouth’s motion to reopen the record in order for the school to introduce new evidence and testimony. Sportico’s Michael McCann notes that “reopening the record is considered an extraordinary measure under labor law,” and Sacks found that no such extraordinary circumstances warranted it, explaining that Dartmouth sought to introduce “evidence which existed and was readily available to it prior to the hearing.” Sacks also concluded that Dartmouth’s contention that she misapplied the law would be more appropriately argued in a request for review to the agency’s board. Dartmouth is expected to file such a request by next Monday. McCann notes that the “board has not yet ruled on Dartmouth’s other motion to postpone the election or impound the ballots from next Tuesday’s vote.” (link)

The Tennessee Board of Trustees has approved the university’s plan to create a nonprofit foundation that could quickly mobilize into a fund to pay salaries to athletes if/when that time comes, according to the Knoxville News Sentinel’s Adam Sparks. Chancellor Donde Plowman: “It’s really an effort to try to be agile and be ready for the coming changes. … If that came to fruition – and I don’t know that it will – but something like it is probably likely, we need a mechanism to do that. So the foundation would be an example of how we would put revenues from the athletic department into that foundation that we could use to pay the student-athletes.” According to UT’s proposal, an “overwhelming majority” of SEC schools already have a similar foundation set up to support financial needs of the athletics department and student-athletes. UT must return to the board before the foundation becomes operational, and Plowman explained to trustees: “So I’m here today to ask your permission to take the next steps to set up such a foundation. It’s complicated. It’s going to take time. There are IRS implications. We have to get it organized carefully so that the university is in charge of that foundation (with) controlling votes.” (link)

The NCAA Football Rules Committee has proposed optional technology rules, effective with the 2024 competition season, including the option for FBS teams to use helmet communication. The player allowed to use the comms system would be identified by having a green dot on the back midline of the helmet. The communication from the coach to the player would be turned off with 15 seconds remaining on the play clock or when the ball is snapped, whichever comes first. For all three divisions, teams would have the option of using tablets to view in-game video only. The video could include the broadcast feed and camera angles from the coach's sideline and coach's end zone. Teams could have up to 18 active tablets for use in the coaching booth, sideline and locker room. Tablets could not be connected to other devices to project larger additional images and could not include analytics, data or data access capability or other communication access. All team personnel would be allowed to view the tablets during the game. The committee also discussed the use of wearable technologies and has invited non-FBS conferences that are interested to submit experimental proposals by June 15. Additionally, the committee proposed adding an automatic timeout when two minutes remain in the second and fourth quarters; a stronger enforcement structure for clear violations of uniform violations; allowing conferences the option of using a collaborative replay review system; and penalizing horse-collar tackles that occur within the tackle box as a 15-yard personal foul. The Olympic Sports Center will provide support to more than 750 student-athletes, including UVA’s field hockey, cross country, track and field, lacrosse, rowing and soccer programs. Davidson has canceled the remainder of its women’s basketball season due to a significant number of injuries suffered by the team. The Wildcats started the year 12-1 and will finish the campaign with a mark of 18-8. AD Chris Clunie: “The physical, mental and emotional toll of this unfortunate and injury-riddled season has brought us to this point. We are incredibly saddened that we cannot finish out the season strong but feel this is the best decision for our scholar-athletes.” (link)

Georgia Football HC Kirby Smart pegs the percentage of stuff head coaches can’t prepare for at 80-90% and explains: "I mean, the media, you don't prepare for that until you do it, and you can say you're going to talk to them as an assistant, but it's not the same. The decisions. The phone calls you get when someone gets in trouble. The who are you going to take? This running back or this running back, or this receiver or this receiver? The hiring and re-hiring of coaches. The support staff hiring. … You never do it until you're a head coach. You can't practice that. You have to go through it and do it." Smart goes on to share that former Alabama HC Nick Saban offered a peek behind the curtain, but everyone understood the final decision of what to do was up to him. As far as what doesn’t change, Smart says: "The coaching part of it doesn't change. The coaching offense, defense, and special teams. That didn't change, but the rest of it did." (link)

Fanatics CEO Michael Rubin talks about MLB’s Nike uniforms, which were manufactured by Fanatics, and says: “A difficult position for us – we're doing everything as we’ve been told and we’re getting the sh*t kicked out of us. Moody’s Investors Service has downgraded Rider’s issuer and revenue bond ratings from B3 to Caa1, marking the university’s fourth downgrade since 2020. The agency did upgrade the school’s credit outlook from negative to stable, citing its reduced scope and steady enrollment. (link)
