Expansion of the NCAA Men’s Basketball Tournament is unlikely to go beyond 76 teams, according to The Athletic’s Dana O’Neil, who is told by one administrator briefed on the conversations: “We’re not talking about 96. There is little to no appetite for 96 teams, or really even 80.’’ O’Neil points out that expansion is on the table at all because “college basketball administrators fear that, if the tourney is left untouched, it will inspire power conference schools to at least consider their own postseason. Fox already is creating a counter to the NIT.” The administrator adds: “The NCAA has to be proactive. Expansion — modest expansion — may be the only way to keep the tournament we all know and love alive.” Meanwhile, the question of money remains, and O’Neil notes: “Some, fearing an Armageddon scenario, worry [adding more schools without CBS/Turner adding more to the pot] will lead power-conference commissioners to push for a restructuring of the automatic bid process, which is, of course, the very lifeblood of the everyman tournament.” (link)

Asked what the Atlantic 10’s next move is after losing Massachusetts to the MAC, Extra Points publisher Matt Brown says the “only A10 expansion candidate school that I'm aware of right now is the College of Charleston. The UMass departure didn't catch anybody by surprise in A10 land and I haven't heard anything to suggest their expansion plans have dramatically changed post-UMass.” (link)

The formation of a college football super league could happen “in the next few years,” according to On3’s Andy Staples, who observes the following as it relates to the Big Ten and SEC’s attempts to secure first-round College Football Playoff byes: “This would be a ploy to protect the commercial viability of the Big Ten and SEC championship games, which are cash cows but essentially become anachronisms once the 12-team CFP begins this season. By guaranteeing those games have stakes none of the other conference title games can have, the Big Ten and SEC guarantee those games remain valuable to network partners. They also cement the stacking of the deck against the other leagues, which probably is bad for business if you’re trying to pretend everyone has the same chance. If you’re going to go that far, I said [on Friday], just go ahead and get to whatever super league alignment you’re headed for and cut out the middleman. The further this goes, the more it feels that’s what might actually happen.” In fact, UAB Football HC Trent Dilfer believes the super league will happen in less than two years, and Staples notes: “It was interesting in part because Dilfer is a sitting FBS head coach and in part because he came to college football after a long stint as an ESPN NFL commentator. He knows quite well some of the people who pull these levers.” While there are still several questions to be answered – student-athlete employment chief among them – Staples adds: “Most of us have assumed these things would happen more slowly and have been proven incorrect multiple times. Perhaps we should prepare for them to happen quickly.” (link)

The Mercury News’ Jon Wilner posits that “on the surface, the [3-3-2-2-1] College Football Proposal proposal sounds bad and looks worse for the Big 12 and ACC, codifying them as lesser than their peers in the most public of fashions. But they should take the deal in a heartbeat, then go celebrate together.” Wilner points out the format “assigns the ACC and Big 12 two-thirds the value of the Big Ten and SEC. That’s a greater valuation than they would receive in any other metric central to the sport. Once all the schools switch conferences this summer, the Big 12 and ACC won’t have two-thirds as many major college football brands as the Big Ten and SEC. They won’t have two-thirds the TV ratings or two-thirds the media rights revenue. (The total will be closer to half once all the new TV deals kick in.) And they certainly won’t claim two-thirds of the CFP berths previously earned.” Meanwhile, alternative scenarios threaten to further marginalize the leagues because, according to Wilner, “in a format with no guaranteed bids, the Big Ten or SEC would gobble up at least four and possibly five spots. Both scenarios are worse for the ACC and Big 12 because of the likelihood that, in an average year, they would not generate two playoff-worthy teams.” That said, Wilner believes the ACC and Big 12 should tell the SEC and Big Ten to “pack sand” if this model comes with guaranteed top seeds for the latter two conferences. “Give on revenue. Give on governance. Give on some other aspect of the format. But take the 3-3-2-2 format, then pop the champagne.” (link)

Kennyhertz Perry attorney Mit Winter tells SBJ’s Ben Portnoy that “based on the NLRB decision in the Dartmouth [case], I don’t see how the L.A. regional office is going to reach a different decision at least with [athletes] being employed by the school [in the USC case]. In my view, the factors that led the NLRB to say Dartmouth men’s basketball players are employees are much stronger in the USC case.” Illinois law professor Michael LeRoy agrees, adding: “Conceptually what that does is it takes all of the major programs — the Alabamas, the Georgias, specifically Southern states where there is no collective bargaining for the public sector — and taps on a magic wand and says, ‘You are private for the purposes of collective bargaining, because the work is being controlled ultimately by these private organizations called the NCAA, Big Ten, SEC, whatever. That’s why this has a more seismic impact, whereas the Dartmouth case is a little more narrow and would apply probably more likely to small private schools, the Ivy League, etc.” (link)

Missouri State President-Elect Richard Williams was asked whether he will have any involvement in personnel decisions among campus and athletic department leadership before he officially takes over and says: "That will probably depend on where the board is at and with [President Clif Smart]. I imagine that if it's going to affect the future, that they might consult me a little bit but I definitely realize that President Smart is the president to the end. … I don't want to step on any toes. But I believe from that interview when I spoke with [Smart] that he will want to include me in things that might affect the presidency. I'm really going to allow the board and President Smart to include me as they see fit." Williams also says his role as president will be "to support Kyle Moats and what he's doing with intercollegiate athletics” and that he'll use his role to determine the resources that are needed to do that and figure out "where does intercollegiate athletics want to go?" WIAC Commissioner Danielle Harris sits down with ACC Assoc. Commissioner Matt Burgemeister and MAAC Deputy Commissioner Jessica Grasso at the 2024 NCAA Convention for a conversation about creating conference-wide consensus among various stakeholder groups, engaging SAAC and including student-athletes in the governance process, and building a robust pipeline of the next generation of conference leaders. On the topic of building consensus, Grasso explains: “I think you touched on it, the meeting before the meeting, the conversations ahead of time. You have to identify the personalities of the individuals you're speaking with – your ADs, SWAs or coaches. How do they work? How do they tick? Because ultimately when you get the decision…by the time it gets to the final stamp of approval or or non-approval you’ve vetted all the questions, the inquiries. The Ole Miss-focused Grove Collective has launched the March To Victory Bracket Challenge through which it seeks to raise $10M and surpass 10K members by the end of March. The challenge involves a 16-region, bracket-style tournament that pits different areas of the country against one another to see who can raise the most money in support of Ole Miss athletics. Rebels AD Keith Carter: "We can't wait to get this new campaign underway and celebrate the spirit of March Madness in a fun and innovative way. Army West Point announces several senior leadership changes, including the promotion of Executive Assoc. AD/SWA Tricia Brandenberg to Deputy AD/Chief Leadership Officer/SWA with sport oversight responsibilities including men’s soccer, women’s basketball, wrestling, softball and football (secondary). Additionally, Senior Assoc. SBJ has compiled a list of the Best Places to Work in Sports based on a survey of over 12K employees from 200 companies. The survey, conducted in partnership with Quantum Workplace, took into consideration metrics such as compensation, benefits, confidence in co-workers, and trust in senior leadership. In the category of Leagues/Teams/Governing Bodies with under 50 employees, the Northeast Conference was awarded the silver medal. For professional services firms, Navigate was awarded the bronze medal, and for agencies with 50 or more employees the gold, silver and bronze medalists were WME Sports, Octagon and Playfly Sports, respectively. Teamworks was awarded the gold medal for technology firms with 50 or more employees. With the Dartmouth men’s basketball team set to hold a unionization vote tomorrow, The Athletic’s Nicole Auerbach explores what happens next, and Tulane Sports Law Director Gabe Feldman explains: “With these cases that are addressing one rule at a time, it’s like pulling out one piece of that Jenga puzzle, and you don’t know how many pieces need to be pulled out before the whole thing collapses. Maybe no single one would bring down the NCAA as we know it. But if you lose multiple (cases), that might be enough to knock down the NCAA as we know it. Or you can look at the big antitrust cases — whether it’s the House case, the Carter case — and they’re just knocking the whole puzzle down. Either way, we end up with all the pieces on the ground. The question is whether it happens one piece at a time or all in one fell swoop.” If student-athletes are deemed employees, attorney Paul McDonald, the lead attorney for the plaintiffs in Johnson v. NCAA, believes the most difficult part will be including language in employment or at-will agreements regarding termination, which is something for which a union would be responsible. However, Feldman notes: “We don’t know if the bargaining will take place in the equivalent of what is league-wide at the professional level. It could be team by team, or school by school, or sport by sport. But the broader you go, the more differences there might be in what the athletes are interested in. We don’t have much of an analogue for this in the sports world. We don’t have the star quarterback as part of the same bargaining unit as the backup fullback on the soccer team. … The collective bargaining dynamics are going to be a little unpredictable.” More. NCAA President Charlie Baker has three separate tracks available in the face of multipronged legal attacks facing the organization, according to Sportico’s Michael McCann. First, Baker could “gamble that the losing will end. Even the coldest streaks eventually stop. Baker could surmise while the NCAA may lose on NIL, transfers and conferences sharing TV money with players, the fundamental rule that colleges can’t pay athletes for their labor is worth defending. It’s the rule at the heart of college sports.” McCann cites U.S. District Court Judge Robert Gettleman’s ruling in Bewley v. NCAA in which Gettleman wrote the NCAA rendering ineligible athletes who already turned pro promotes the association’s ‘unique product’ of ‘college sports.’ The case is on appeal to the U.S. Court of Appeals for the Seventh Circuit, so the NCAA could still lose. But maybe there are more judges like Gettleman out there who aren’t yet ready to wipe out amateurism.” Baker’s second option is to continue lobbying Congress “to pass something of a miracle bill – one that exempts the NCAA from antitrust scrutiny, declares college athletes are not employees, sets a national NIL standard and preempts any conflicting state laws.” Even if such a bill is signed into law, McCann believes it would face “Constitutional challenges on Equal Protection Clause and preemption grounds and likely toil in court for years.” The final track has two components: radically changing the player compensation structure to comply with antitrust laws and reaching settlements with thousands of player-plaintiffs. McCann: “The NCAA is on the verge of its system being obliterated in court. It needs to undertake major reforms quickly. Otherwise, it will be compelled to change rules and likely pay out billions of dollars. Where will that money come from? How many jobs at the NCAA, conferences and schools will be lost?” (link)

On3’s Eric Prisbell posits that “one way schools can diminish the likelihood that their athletes will also be classified as school employees” is by “relinquish[ing] the amount of control schools exercise over athletes.” Boise State law professor Sam Ehrlich explains this is the “path forward for a lot of these schools that don’t have the ability to compensate athletes and pay athletes wages – they have to find a way to avoid the employment classification. I don’t think that’s impossible at all. Control is always going to be the biggest factor.” Akerman LLP Collegiate Athletic Practice Chair LaKeisha Marsh agrees, noting that the reality is not all DI schools operate the same way. “We’re not dealing with one shoe fits all. I think you would need multiple models. There is change on the horizon, for sure. We just have to see if it is going to be voluntary or if it will be forced.” (link)

The first hearing for Florida State’s complaint against the ACC in Leon County (FL) has been scheduled for April 9, according to the Tampa Bay Times’ Matt Baker. During the hearing, Leon County Judge John C. Cooper will hear the ACC’s motion to dismiss or stay FSU’s suit. The North Carolina case (filed by the ACC) has a hearing scheduled for March 22. (link)

Texas Tech AD Kirby Hocutt discusses how the Red Raiders are preparing for the myriad changes that could be in store for the industry and says: "I think about that all day and every day. Obviously, we're going to have to continue to grow revenue. We're going to have to be creative and find new revenue streams. We have been and are very fortunate that we continue to benefit from the generosity of so many donors and supporters and season-ticket holders. … I think there's a new model that is coming forward that is going to lead to some type of revenue share with our student-athletes, which will obviously impact and alter all of the broad investments that we're making and others are making within their athletics program today.” Hocutt also notes that “as we complete the south end zone and the Womble Football Center, I think you will start to see a new narrative and a redirection of our fundraising efforts that will move away from capital projects and move toward this new model and annual support in whatever direction this turns on us." On Project DI, Hocutt says: "Right now, that model is being vetted out by the Division I Council, and the Division I Council is made up of all Division I conferences. Well, if this is really going to be at the highest levels, that discussion group should be made up of four conferences, not 32 Division I conferences that make up the Division I Council." As far as the actual implementation of Project DI, Hocutt remarks: "Do I think the minimum-sport requirement will be put on the table for further discussion as this new model evolves? Yes, I do. Do I want to be in a position where we have to reduce sport sponsorships? No, I don't. I went through that earlier in my career at Ohio University, and it's not something you want to do.” (link)

Over 10K football student-athletes have opted into EA Sports’ College Football 25, according to ESPN’s Adam Rittenberg, who notes the 10K figure is 87% of EA’s overall goal. An EA spokesman says more than 100 of college football's most recognizable players have opted in during the past week, including Colorado two-way star Travis Hunter, Texas QB Quinn Ewers, Georgia QB Carson Beck, Alabama QB Jalen Milroe and Oregon QB Dillon Gabriel. St. John’s President Brian Shanley has revealed plans for a new men’s and women’s basketball practice facility and campus recreation center. While details are set to be released later this week, Shanley’s communique hinted at the “renovation and conversion” of Taffner Field House, the current home of the university's basketball practice facilities and intramural sports. The project is expected to be completed during the 2027 spring semester. (link)

The Big 12’s Basketball All-Access Pass, which the league announced last week, “arose after Legends surveyed 12,000 Big 12 basketball fans in 2023 regarding ticketing, seating and fan experience. That research found a staunch demand for more premium options,” SBJ’s Ben Portnoy reports, and Legends College President Mike Behan says: “When Brett [Yormark] got on board [as commissioner] the theme that he’s been communicating has been around the value of basketball and the position the Big 12 has with really establishing marquee brands across the basketball landscape. Going from 10 schools now to 16 member schools, demand has always been at a high level, but it just amplifies that demand further.” Portnoy cites a source who says the “Big 12’s latest ticketing endeavor could bring the league $30M in revenue as it accounts for roughly 12% of T-Mobile Arena in Kansas City, Mo. That projection comes on the heels of the Big 12 raising ticket prices to last year’s men’s basketball championship for the first time in a decade using a roughly 20% blended average. This year’s tournament, too, is slotted for another significant increase in ticket pricing because of two new sessions to accommodate four new teams.” Yormark believes the league could adopt a similar program for football and tells Portnoy: “I think this is game-changing. Candidly, I think others are going to figure out ways that they might do this.” (link)

Fox Corp. CEO Lachlan Murdoch projects the ESPN-Fox-Warner Bros. Discovery sports streaming bundle will hit 5M subscribers within the first five years, remarking during the Morgan Stanley Technology, Media & Telecom Conference: “This a pro-consumer package.” He adds that the TV industry historically has “made life for our audiences…incredibly hard. What this bundle does is put a majority of sports into one bundle. It’s an easy place for sports fans to come to.” Murdoch also reiterates the total addressable market for the venture includes 60M cord-nevers. “That’s a huge market. That’s half of the television households in this country. And we know that sports is the No. 1 driver…[of] viewership and subscriptions.” (link)
