From the Winter DII Presidents and Management Council meetings, the DII Management Council introduced NIL legislation for possible action next month that would continue to prohibit institutions from compensating student-athletes, remove restrictions on services that can be provided for student-athletes, clarifying that entities closely aligned or officially affiliated with institutions are subject to institutional standards, clearly define an NIL entity, eliminate regulations governing communication between schools and NIL entities provided the institution does not provide “direct or indirect financial support or institutional assets,” and prohibit NIL entities from contacting or engaging with prospective student-athletes, those at other institutions or their representatives. The Presidents Council sponsored a pair of legislative proposals for the 2025 NCAA Convention: eliminate 18-semester/27-quarter hour recruitment for eligibility and removing the English, math and science requirements for two-year college transfers. Also of note, for membership-sponsored legislative proposals, the DII Executive Board will now only take a position if the proposal has a significant financial impact on DII or its members. (link)

BakerHostetler Partner Todd Lebowitz highlights some of the realities associated with student-athletes becoming employees and points out the NLRA “obligates employers to bargain over a broad range of issues, including compensation, scheduling, work rules, discipline and work assignments.” He then applies those criteria to schools as employers and asks: “Can the coach set the starting lineup (work assignments) without consulting the union? Set the practice schedule? The travel schedule? The play-calling? … What happens when two starters get benched for objecting to curfew? File a charge. Disciplined for violating a team rule that you and a teammate called unfair? File a charge. Did the coach make the whole team run laps because one player was late? (Yes, in the Dartmouth case). If two players refuse and get disciplined, file a charge. An administrative law judge will decide who plays and whether the discipline stands.” Furthermore, if student-athletes are employees under the NLRA, they may be employees under other laws too. “The NLRA is just one tree in a forest of employment laws.” Additionally, Lebowitz points out the irony in which the “Dartmouth Student Athlete Handbook prohibits players from receiving compensation for employment obtained ‘because of athletic ability.’ … But that’s exactly what the regional director concluded is happening. Quite the conundrum. The regional director would likely say that her ruling applies only to the NLRA, and technically that’s correct. But other laws apply the same test. So either the regional director is right in her ruling, or she is misapplying the test. Or are we prepared to say that the players are employees under the right-to-control test and simultaneously not employees under the right-to-control test?” (link)
