NCAA President Charlie Baker sits down with AthleticDirectorU’s Jason Belzer to discuss the future of college athletics, including the development of the NCAA’s fan database, transparency issues in NIL, the impact of sports wagering on the integrity of competition and his belief in the power of the student-athlete voice. Belzer asks whether the NCAA has gotten too big in the way it is governed and structured, and Baker says: “It’s not so much about how big it is. It’s about how diverse it is. When you literally have hundreds of schools that spend less than $5M on sports and hundreds that spend less than $10M and hundreds that spend less than $20M and 70 that spend more than $150M and over $200M in some cases, your issue there is less about size and more about spread…which is why I do think the bigger challenge is to stop thinking everybody’s the same. … Let’s give the more heavily resourced schools the ability to do more and then leave it up to the schools to make decisions because the way it’s set up now, you can’t do that. Some of the schools have said to me a number of times that they would like to do more, but the way we currently organize and operate makes it hard for them to do that and they’re right.” Baker also contends that if all student-athletes became employees tomorrow, “it wouldn’t work for 90% of the schools. … If you’re spending $5M on sports and you’re making $500K on those programs and you now have to create an employment infrastructure that sits on top of it, I think you’re going to basically just say, ‘We can’t do this.’” He adds: “Many [student-athletes] worry a lot about what that employee status would mean to their ability to succeed academically if they can’t perform as an employee. … If the issue is compensation, we can solve that one and if the issue is some of the other concerns that people have about voice and influence, they sit on all of our major committees – student-athletes do – and their voice is being heard in a big way.” Lots more in the full interview on ADU, which includes a full transcript. Sportico’s Michael McCann and Daniel Libit unpack the new lawsuit filed by former Kentucky (DI) swimmer Riley Gaines and other former student-athletes concerning transgender participation in college sports. “Core to the legal argument made by Gaines and her co-plaintiffs is that since Title IX guarantees men and women equal opportunities to compete in athletics, allowing transgender female athletes to compete deprives other women athletes. The plaintiffs also claim violations of equal protection of the law, alleging they and other women are being treated unfairly. … Expect the NCAA to argue its transgender eligibility policy reflects international consensus and is consistent with the law. The NCAA will also question the application of Title IX, the applicability for which requires federal funding.” Looking ahead, McCann and Libit posit that the continued debate over trans athlete participation “threatens to further reduce what is the already unlikely chance Congress can converge on a college sports reform bill addressing NIL, athlete employee rights, and the antitrust status of the NCAA. That legislative effort, which once carried an air of across-the-aisle comity, has increasingly shown signs of splitting along partisan lines.” (link)
