Incoming Nebraska AD Troy Dannen’s six-year deal is worth $11M. Dannen will make $1.6M the first year and receive raises of $100K each subsequent year. The contract also includes a $1M signing bonus to be paid out in May, and “stay bonuses” starting at $200K in March 2027 and increasing by $50K for each year. If Dannen resigns from NU before March 31, 2025, he would owe the university more than $12M. That figure decreases to $10.6M, $8.9M, $6.9M, $4.75M and $0 each subsequent year. Dannen is eligible for an additional $300K, plus an extra $100K if the Huskers win a Big Ten football championship and another $150K if they win a national championship. (link)

The ACC has filed a 133-page countersuit that argues Clemson cannot get out of the Grant of Rights or the conference’s exit fee, making the same argument in its legal battle with Florida State. According to the lawsuit, the ACC is, “seeking a declaration that the withdrawal payment is a valid and enforceable contract term applicable to Clemson,” and a “declaration that the language of the ACC’s Grant of Rights means what it says and that Clemson’s grant of rights is exclusive and irrevocable through the term.” The ACC is also seeking a declaration that “Clemson owes fiduciary duties to the ACC as a Member Institution” and “damages for Clemson’s breach of the Grant of Rights.” On3’s Pete Nakos indicates Clemson and the ACC agreed to work together to seek a business solution rather than resorting to litigation, but “the two parties have clearly not worked together.” (link)

More from NCAA SVP for Policy and Governance Kevin Lennon’s conversation with AthleticDirectorU. When asked what he believes the NCAA will look like in five years, Lennon notes that evolution is what is occurring now, “but I do think there will always be a need for a national organization. You can't have national competitions among highly competitive people, highly competitive schools without some set of national regulations. So that will exist. It’ll simply be where our membership, where Congress, where others want us to spend our time… and that may cause some reevaluations of things that we don't need to be involved in.” (link)

The culpability for college sports’ current predicament belongs to everyone, according to Sports Illustrated’s Pat Forde, who writes: “Something akin to the psychological concept of diffusion of responsibility is killing college athletics. When nobody is accountable for antisocial behavior—such as discreetly destroying and/or destabilizing conferences—bad things go unchecked. The entire industry is crying out for help, but nobody in the crowd is willing to act. Everyone is waiting for someone else to do the first right thing, and none of them are moving a muscle.” The NCAA is “powerless” to stop the conferences, who are “self-interested warlords engaged in turf battles,” Forde continues, submitting that: “Nowhere is that more true than in the Big Ten and SEC, who could lead everyone toward a stable future but instead chose predation. They officially got their way this week in receiving unequal revenue shares of the future CFP contract. They’re going to preemptively take it instead of earning it. Because they can.” The leagues’ machinations are driven in part by the seeming inevitability of paying student-athletes, and Forde suggests one way to mitigate that “great revenue panic” is by cutting coaching and administrative costs. He cites Alabama AD Greg Byrne’s recent raise and extension and Texas A&M AD Trev Alberts’ departure, which “assuredly” came with a raise. “But instead of reining in salaries, College Sports Inc., will continue to seek out the next media revenue gusher. And then those spoils will be divided among an increasingly small pool of conferences.” (link)

Sports economist/OSKR LLC Partner Andy Schwarz pushes back on the argument that “without Cinderellas from the one-bid conferences, the excitement of the early rounds [of March Madness] will vanish, and the money will just not be there for the football powers holding a basketball tournament.” In fact, Schwarz argues: “This is actually such an easy problem for the power schools to solve that it pains me to have to be the one to explain it, but here we go. Let’s imagine the ACC, SEC, Big 12 and Big Ten were to leave the NCAA’s overlordship at the end of the current academic year and set up a four-conference football league, while also competing against each other in other sports. And let’s say they want to stage a postseason basketball tournament featuring schools like Duke and North Carolina, Kentucky and Tennessee, Houston and Kansas, and Purdue and Illinois, just to pick two highly rated teams from each of these four conferences. Do you think TV executives might drool over the possibility of having these rights?” Schwarz contends the “breakaway schools [could then] set up any format they want for their tournament,” including inviting schools it left behind. They could then, for instance, create a qualification system for 40 of its own teams and offer $10M (potentially with help from the TV partner) to “every title-winning school from the 24 Division I conferences not included in the big conference breakaway.” That is essentially what the schools receive now, and Schwarz posits the “rump DI tournament is not going to be anywhere near as valuable once the big dogs all leave, so $10M per year for the whole conference is going to look mighty good compared to whatever the NCAA is paying out once the ‘wait, you don’t have Duke anymore?’ effect kicks in.” (link)

Colorado Football HC Deion Sanders responds to a report from earlier this month which revealed he made zero off-campus contact with recruits during his first year in Boulder. “My approach is totally different than many coaches. I’m a businessman as well, so I try to save our university money every dern chance I get. For me to go – let’s say I go to Florida and I’m visiting IMG – you don’t think those coaches are going to be a little upset if I don’t come by the school down the street? You don’t think it’s going to be pandemonium, or I’m gonna get naysayed if I don’t go another 45 minutes? Then if I go to that one, why didn’t I come to that school? Now the coach is mad and he’s not gonna let the kid come because I chose that school over that school. Other coaches, they can do it, but I can’t.” Coach Prime goes on to say he’d rather show recruits around Boulder and highlight what he likes about the city. “They want to see how I live, how I get down, see what I got going on, what God has done in my life. I know when I was in college I did not want Bobby Bowden in my house because I knew after 7 o’clock, there was going to be rats and roaches on parade. … I have never heard one guy say I chose this college because this coach came by my crib. Have you? I can’t do the things other coaches can do. You know why? I’m Coach Prime. And I didn’t stutter when I said it.” (link)

Nebraska’s Shocker…
+ Nebraska taps Washington AD Troy Dannen for the same role, and ESPN’s Pete Thamel reports Dannen is expected to sign a six-year deal with the Huskers. Dannen: "Joining the Nebraska family is truly an honor. My family and I are humbled by the opportunity to be part of such a proud athletics program, institution, community and state. Growing up in Iowa, I watched a lot of Nebraska football on Saturdays with my family. I've spent a lot of time in the state and I've found that we share a similar approach to life, work and sports: Work hard, stay humble, compete and expect to win." Huskers Football HC Matt Rhule: "I'm so fired up about this hire. Interim President Chris Kabourek has found exactly the right person to lead the Huskers forward. Troy sees what we see – that Nebraska is a special place, with special people, a great vision and the courage to be unabashed about wanting to win across the board. The fact that someone of Troy's caliber wants to join Team Nebraska will light a fire across our entire department.” A source close to Dannen tells Thamel the decision was "deeply personal," as both Dannen’s and his wife's entire families are in Iowa. Parker Executive Search assisted with the search processes at both Washington & Nebraska. (link)
+ Washington has named Deputy AD/COO Erin O’Connell as Interim AD, and UW President Ana Mari Cauce says Dannen’s departure is “deeply disappointing. But as a University committed to the welfare of the entire individual, we understand the need to make choices based on what’s best for one’s family. We wish Troy well.” (link)
+ Meanwhile, the Nebraska Board of Regents has named University of Nebraska Medical Center Chancellor Jeffrey Gold as the priority candidate to be the system’s next president. (link)
+ Kabourek on Dannen: “He is a fierce competitor, he holds himself and his programs to uncommonly high standards, and he cares personally about the success of student-athletes in sports, school and life. Troy sees the vision and momentum we have here at Nebraska, from our bold investments in facilities to our record success in the classroom to our bold plan to elevate our national reputation and competitiveness, and he is excited to be a part of it. I am thrilled that we’ve found someone who is 100% aligned with our high expectations and will be all-in on Nebraska.” (link)

Winston & Strawn Co-Executive Chairman and headlining antitrust attorney Jeffrey Kessler joins Pablo Torre Finds Out and talks about his role in taking on the NCAA in several lawsuits over the years, including House v. NCAA. Kessler explains there had long been a feeling among owners in professional leagues that free agency would destroy their games and lead to declining fan interest, but the opposite has occurred. “And it’s the same thing with the amateurism justification from the NCAA. Even the NCAA executives and the conference commissioners, no one even believes it anymore, and everyone now understands this is just about finding a better, just system. I mean, if you interview the president of the NCAA today, he is saying we know we've got to change. So, I said the question is how quickly and what is the change going to be? Is it going to be the right change, the fair change?” Kessler says antitrust is a particularly vulnerable area for the NCAA because “what the NCAA does is the sweet spot of what the antitrust laws hold to be unlawful. The second thing about antitrust laws is that it has very, very broad relief. You can get injunctions totally ending the restrictions, and you can get triple damages for the injuries in the past. When you're talking about years of restricting compensation in a business that's already $16B a year, those damages get pretty high pretty quickly. If the NCAA takes this to the mat, they may have very, very large checks that the conferences are going to have to write. That’s a lot of pressure to try to find a settlement, to try to find some way to resolve this. If there’s ever going to be a settlement, there are two elements of it. It would have to be fair compensation for the damages but they're also for the future would have to be a fair system agreed to.” Lots more in the full podcast. (link)

Oregon State AD Scott Barnes sits down with Fox Sports/Connect’s Bryan Fischer at the 2024 NCAA Convention to discuss OSU’s long-term future, Corvallis’ geographical challenges, where NIL is headed and lots more. Barnes acknowledges that OSU’s location has “always been an issue from scheduling to conference alignment. Thinking about regionality while we think about the bigger picture, you don’t have as many options. But what we do see is a proliferation of teams in the West, programs in the West that have joined the ranks of conferences that are concentrated in the Midwest or East. And so with that sort of western outpost of schools now, totally, I think, bodes well for us and our potential opportunities.” Barnes also asserts that separating football from olympic sports needs to start happening at a “much higher level…because ultimately I think that’s where we’re going.” On the topic of NIL, Barnes explains he has changed his thinking and now believes it should be handled in-house. “Because of the chaos that is in the marketplace, it has to be inside. We’ve got to bring some controls to this.” Barnes asserts the collective marketplace is not sustainable, and “we've got to have some reasonable approaches to this. … We've got to do all we can do as member institutions to vote to support guardrails, to beef up enforcement, to give clarity to the student-athlete so it's sustainable because it's not right now.” Full Q&A on Connect. Sportico’s Daniel Libit examines how Drake’s men’s and women’s basketball March Madness berths came just five days after the university announced its recommendation to discontinue eight undergraduate and graduate programs to help balance the budget. “The juxtaposition of these developments, though mostly coincidental, nonetheless captures an ongoing and age-old debate in higher ed about how athletics fits into and impacts the mission of the larger institution. This is especially acute at schools for which Division I athletic success does not come naturally.” Drake President Marty Martin, though, is a “devout believer in the collective benefits of college basketball and what it can do to improve an institution,” something he saw firsthand while at Gonzaga. He tells Libit: “It is an example of how success in athletics can raise the profile of an institution such that it elevates everything else about the institution. You go back to that initial appearance, and at that point, (Gonzaga) was very different, much, much smaller, really struggling financially. … Basketball created an opportunity for people to discover what was and remains a really great institution.” As far as how football fits in, Martin says he was concerned he was going to have to discontinue the program upon taking over “because I thought the school was still trying to compete at FBS. And when I came and discovered the FCS and the Pioneer Football League model, I thought [it was] perfect, that somebody was really smart to create that and get that going. Because it is the perfect place for us to be.” More on Drake’s historical struggle between balancing athletics and academics. (link)

Michigan State Men’s Basketball HC Tom Izzo agrees the NCAA Tournament Selection Committee needs more former players and coaches and should rely less on ADs dissecting analytics. "There definitely should be some coaches and players on that thing to bring some levity to as crazy as it's gotten. I never know what the NET means, what KenPom means, what ESPN means or the Daily News. There's so many things out there right now that do influence [the committee]." Analytics, Izzo argues, often miss the nuances of playing a long season. "I'm appreciative of being in, and I wouldn't have felt any different if I was out, but I think it would be best if people who've been in the game and have been around. [They] understand when you lose a game and something happens – you play three tough games in a row; analytics don't show injuries or they show when a guy misses a game but not when he plays hurt." Izzo also says that while he’s always been a fan of “the little guys,” it might be time to reevaluate the AQ process that awards a spot to each conference champion. "What's happening now, everybody likes the upsets on the first weekend, but I'm not sure moving on that's what's best for the game. I think it's got to be looked at seriously." (link)

The SEC is expected to remain at eight conference football games through at least the 2025 season, and 247Sports’ John Talty and Alex Scarbrough, who also report that “desiring an all-day SEC football feel, SEC Network game start times can now be pushed back 45 minutes to lead to more staggered finishes, i.e. moving from 11 a.m. to 11:45 a.m. CT. kickoff time. A typical SEC Network slate would now look like 11:45 a.m. CT, 3:15 p.m. CT and 6:45 p.m. CT while ABC and ESPN games would keep their typical start times. The SEC and ESPN will have the ability to flex ABC and ESPN afternoon and night games a limited amount of times per school.” The league is expected to unveil its 2025 schedule later today. (link)

SBJ’s Ben Portnoy takes a look at Huron’s growth in the athletics space over the past three years, and Huron Higher Education Consulting Manager Kyle Waterstone explains: “Initially, we always say we were kind of building the airplane while we were flying it. We didn't have a precedent for structure of projects, how long should they take, how many people should be staffed on the project. We were kind of figuring it out while we went. I think this next iteration is about us internally being more efficient and being able to quickly deliver on projects, know what a certain project should be priced at based on what our previous work is and what our value is to the market.” With the landscape changing so rapidly, Waterstone notes the firm’s projects are increasingly geared towards what’s next. “All those sorts of questions are being asked at the highest level. At some of the lower levels, and the mid-major type schools, their initial thought is, ‘Hey, we're not gonna be able to outspend these people, and we're not going to get more money, but how can we be more efficient with what we do have and then let's reallocate the resources that we have to be the best version of ourselves.’ … Our work still traditionally starts with a diagnostic defensive assessment of, ‘Where are you at? Where are your peers? Where are your vulnerabilities?’ And then, once we understand that, let's go on the offensive and try to close some of those gaps.” (link)

The Athletic’s Andrew Marchand sheds some light on ESPN’s long-term plans, including its DTC strategy, and explains the goal is still to sell one or two minority equity shares in the company, with the NFL and the NBA its top potential candidates. “ESPN continues its negotiations with the NFL for the league to become equity partners, executives briefed on the conversations told The Athletic. The valuation of what the league is offering in return, and the billions ESPN is worth, is one of the ongoing negotiation points of focus.” If the two sides can reach a deal, ESPN would take control of NFL Media, and Marchand notes the “volume of NFL content would be a further selling point for ESPN’s DTC product, which would mean more NFL games to go along with the 25 ESPN already owns per season. While the digital world has led to advantages shrinking, ESPN sees alignment with Google/YouTube, according to executives briefed on their thinking. ESPN and YouTube have previously worked on partnerships, and the network is already offered on its cable-lite service, YouTube TV. ESPN is also talking with Roku to offer the new DTC service as one of its tiles when viewers turn on its televisions.” Internally, ESPN is focused on “offerings that will cost much less than the $100-plus per month cable often requires” and “will take its standalone direct-to-consumer product to the market in 2025 at $25-30 per month. … Meanwhile, ESPN wants to be the solution for MLB, NBA and NHL in regional sports, hoping to offer them as part of its direct-to-consumer strategy, as add-on channels for an extra fee, so fans can watch their favorite teams.” More from Marchand.
