NCAA SVP for Policy and Governance Kevin Lennon joins AthleticDirectorU’s Jason Belzer to discuss his new role, the challenges and opportunities facing the NCAA and more, including how to build consensus, and Lennon explains: “It isn't easy and candidly, in earlier days, I think there was more homogeneity around all of our institutions, whether they be in Divisions I, II and III. The size of budgets, the way they operated and that is clearly changed and that has exacerbated a little bit of the problem. How, within this big tent, if we were just to focus on Division I where the budgets are, there’s so much disparity…how do you have them come together to do something that's for the best for the whole thing? I think part of that answer is we need to make sure that we're allowing those who have the highest resources to make decisions in ways that are appropriate for them. And the more homogeneity you can get around the decisions – and if that means consolidating some of those around different sets of high-resource institutions – I think you make better decisions moving forward with change.” Lennon also says he’s “encouraged” by the SEC and the Big Ten taking the initiative to lead by forming a joint advisory group, telling Belzer: “This is an opportunity to provide some leadership at this critical point in time within our association, so I applaud them for that. Their profile of those institutions, the platform that they have, puts them in a position of leadership, and so I'm really encouraged that they're kind of taking these issues on directly in that regard.” The board members from both conferences, Lennon adds, “supported the holistic model that, you know, raise the boats in support for all of the institutions within Division I, not just the things that they’re doing.” Full interview on ADU. Yahoo’s Ross Dellenger provides more details on the Clemson-ACC showdown with one unnamed league administrator telling Dellenger the breaking point was the new College Football Playoff deal, “Now combine that with the gap in TV revenue.” Dellenger goes on to note that, according to an industry source, it’s not Clemson or Florida State who has the most value within the ACC, “North Carolina is the lynchpin.” As for how Fox & ESPN could impact the situation: “If Fox and ESPN will foot the bill to add FSU and Clemson (to the SEC, Big 12 or Big Ten) — or any others — maybe it happens. But first, the ACC schools must wiggle free of what many believe is a binding agreement.” More. (link)

Sportico’s Michael McCann offers a legal perspective on Clemson-ACC: “In the coming weeks, the ACC will answer the complaint and raise several defenses. Expect the conference to insist that Clemson, like FSU and other members, voluntarily entered into contractual agreements that contemplated a give-and-take. [...] The ACC will further maintain it has lawfully interpreted and applied contractual agreements with member schools. Courts generally defer to membership organizations in their interpretation of rules so long as those interpretations are not arbitrary or capricious—a very deferential standard. The ACC might also maintain the lawsuit is not yet ripe. Unless and until Clemson moves to leave the conference, the ACC could argue the legal controversy is more hypothetical than actual.” (link)

Nebraska Football HC Matt Rhule weighs in on what he would like to see in the Huskers’ next AD: “I really want somebody who has unbelievable urgency. We spend a lot of time talking about the transfer portal and NIL, this is like one of the most pivotal times in college athletics. We just need doers. We need people who just figure it out and work so I love the fact in Trev that I had an athletic director that was here at 7:00, 7:30 every morning in a suit and tie. He was a worker. Pat Kraft who I worked with at Temple, now at Penn State, was a worker. They were right there with you. … They have to be really mentally strong because when you come to a place that has as big of a brand as Nebraska, that people are so passionate about and care about, when you do something, a lot of people are going to like it. And some people aren’t going to like it and if you’re listening to the outside noise, you have no chance. I’m just hoping that it’s a worker, a doer.” Rhule also asserted he remains “all in” at NU: ”I loved Ted Carter and I loved Trev and I came because of them. Deal could be more impressive. He is worth significantly more than this deal. Really surprised he doesn't earn $2.5-$3.5M in this role. Same for other high-performing ADs. $200 M budget. Immeasurable economic impact on the school. Fundraising in the $100s of M Most notably, the current state of the ‘business of college sports,’ where coaches make 20+% of the overall budget and some athletes are getting +$1m deals, I'm beginning to think the ADs are now more undervalued / appreciated resource/asset in the business. + Nebraska Men’s Basketball HC Fred Hoiberg gets an extension through the 2028-29 season. He made $3.5M this season but will earn $4.25M next season with “annual increases in each of the subsequent contract years,” per USA Today’s Steve Berkowitz, who also points out that “two years ago Hoiberg agreed to take a pay cut, forfeit a scheduled retention payment and accept a reduction in the buyout he would be owed in case of termination without cause. His pay was increased for this season when he met certain metrics that were never made public.” (link)

The New York Times’ Billy Witz asks what the difference is between a college football team and marching band when it comes to employment, and Minnesota law professor/former NLRB field attorney Matt Bodie tells him part of the issue facing college athletics is that it’s “hard to find a comp and that’s what the law likes to do.” Bodie also contends the USC case with the NLRB is the “more traditional case” while Dartmouth’s is “kind of surprising. The economic relationship there is a little hard to see. If the basketball players are employees, why not the orchestra? Why not the people on the squash team?” Meanwhile, there is a political component that factors into the schools’ strategies. If Donald Trump wins the 2024 presidential election, a new NLRB five-member board will be appointed along with a new general counsel, and Witz notes: “This probably explains USC stringing out its case with a lengthy witness list, which included the school’s band director, who spent more than three hours testifying in intricate detail how his program was run, describing how band members get into uniform before a game, the same as football players.” Notably, when Wilma Liebman was appointed by President Bill Clinton to the NLRB’s board, the board ruled in a case involving NYU and whether graduate students were employees. When George W. Bush became president, the board reversed that decision in a case involving Brown grad students. The Pac-12 Network will broadcast the spring football games for all 12 schools, including the 10 outbound programs. The Big Ten Network will send reporters to the games at Oregon, Washington, UCLA and USC and is “working with the schools to obtain footage for coverage on BTN.” (link)

J.P. Morgan is creating a sports investment banking group that will work with the firm’s investment banking, commercial banking and private bank divisions to offer clients advisory and investing opportunities, according to Sportico’s Asli Pelit. J.P. Morgan Global Head of Media and Communications Investment Banking Fred Turpin in a note announcing the news to his staff: “With top sports franchises in the U.S. and Europe now valued at more than $400 billion in total, sports have become an increasingly large asset class, attracting more and more institutional investors.” (link)

The son of a former college football player who died in 2018 and was later diagnosed with CTE has sued the NCAA, accusing the organization of negligence and wrongful death. Clemson has filed a lawsuit against the ACC asserting the league’s withdrawal penalty is "unconscionable" and "unenforceable." The suit argues that the ACC’s GOR should only apply to members while they’re in the conference and that the league’s withdrawal fee should not be enforceable. “Each of these erroneous assertions separately hinders Clemson’s ability to meaningfully explore its options regarding conference membership, to negotiate alternative revenue-sharing proposals among ACC members, and to obtain full value for its future media rights.” Clemson is calling for a declaration that the ACC would not own the rights to Clemson's games "after Clemson ceases to be a member of the ACC." The Tigers also want the ACC’s exit fee, which is estimated to be around $140M, to be deemed as "an unenforceable penalty in violation of public policy." Also from the suit: "The ACC's actions interfere with Clemson's free exercise of its rights and are fatally detrimental to Clemson's efforts to ensure that its athletic programs can continue to compete at the highest level which is critically important to Clemson even beyond athletics. … Properly understood, ‘the contractual obligations of the Conference’ did not include providing media rights to games played by a school after that school exits the Conference. The media rights to games played while Clemson is a member of the ACC are the only rights necessary for the ACC to perform the Conference’s obligations under the ACC’s media agreements with ESPN. The media rights to games played at a time when Clemson is not a member of the ACC were never a part of any grant of rights." Additionally, Clemson says in a statement: “The ACC’s position regarding the Grant of Rights, the exit penalty, and obligations owed by members to the conference, as detailed in its public statements and other court filings, leaves Clemson with no choice but to move forward with this lawsuit. Virginia President/ACC Board of Directors Chair Jim Ryan and ACC Commissioner Jim Phillips have released the following statement concerning Clemson’s lawsuit: “The ACC remains confident that its agreements will be affirmed by the courts. Clemson, along with all ACC members, voluntarily signed and resigned the 2013 and 2016 Grant of Rights, which is binding through 2036. In addition, Clemson agreed to the process and procedures for withdrawal. The Conference’s legal counsel will vigorously enforce the agreement and bylaws in the best interests of the ACC’s current and incoming members.” (link)

The College Football Playoff and ESPN have officially finalized their media rights agreement. The six-year deal runs through 2031 and will pay out an average of $1.3B annually. As reported previously, the revenue breakdown is as follows: 58% for the SEC/Big Ten; 32% for the ACC/Big 12; 9% for the Group of 5; and 1% for Notre Dame. There is no finalized model yet, but there are protections for AQs for Power 4 champions, the highest-ranked G5 program and ND “via ranking,” according to Yahoo’s Ross Dellenger, also reports the “SEC/B1G [have] heavy authority over format.” The agreement also includes a look-in provision in 2028. The format for the next two seasons will include five AQs from the five highest-ranked conference champions and seven at-large bids. ESPN SVP for College Sports Programming & Acquisitions Nick Dawson: “There is a right and flexibility to do early-round games on direct-to-consumer streaming services, but as of now, no decision has been made on our side to even activate that right.” Dawson also says the new TV deal specifically addresses 12- and 14-team models, but includes "a mechanism to address if they expand beyond 14 teams. … I do think at some point you start to really impact the regular season and the conference championship games. I feel like they've done a great job so far of designing the 12-team model, and potentially even the 14-team model, although we'd still need to understand exactly what it looks like. ... I do worry that the larger you get beyond that, I think it becomes almost impossible to avoid some damage being done there." (link, link)

Missouri submitted its authorization form to TurnkeyZRG with two notable selections left blank: the target salary and target hire date, which “suggests that, at least formally, the university is willing to take a patient approach with its hire and pay its chosen athletics director the salary it thinks is necessary to secure their services,” according to the St. Louis Post-Dispatch’s Eli Hoff. It’s now been a month since former Tigers AD Desiree Reed-Francois left for Arizona, and Hoff points out that Texas A&M’s AD search, which was also assisted by TurnkeyZRG, took roughly two months to complete. “A lingering question over MU’s search is whether there are reputational red flags surrounding the job, which has seen considerable turnover over the last decade. Heightened oversight from the UM System Board of Curators, the power of football coach Eli Drinkwitz and the downward career move of Reed-Francois to Arizona all factor into those questions.” Hoff adds that “Turnkey’s position description also expects the next Missouri AD to ‘provide regular reporting to President, Board and Board Committees on all topics related to athletics, as requested by those parties and in addition to regular scheduled periodic reporting in order to develop and execute on strategic priorities of MU Athletics.’” (link)

The NCAA announces the Draw the Line campaign, which prioritizes student-athlete education on the effects of sports betting while also addressing problem gambling for all who consume and participate in college sports. The campaign, which will debut during the first week of the men’s and women’s basketball tournaments, is aimed at college students and will run across social media channels. It also includes a membership toolkit for member schools and conferences to access resources that extend the campaign to their campuses. NCAA President Charlie Baker: "Sports betting is everywhere — especially on college campuses — so it's critical student-athletes get the real story about how it can impact them and their ability to play. We know some bettors are harassing student-athletes and officials, so that's why we are advocating for policy changes at the state level and launching monitoring tools around championships to refer serious threats to law enforcement. The NCAA is doing more than ever to protect the integrity of the game and arm student-athletes with the truth about sports betting." (link)

Sunday’s NCAA men’s basketball tournament selection show averaged a 3.1 rating and 5.91M viewers on CBS, marking the largest audience for the annual program since 2019 (6.2M) and second-largest in a decade, per Sports Media Watch’s Jon Lewis, who notes the women’s tournament selection show on ESPN averaged a 1.0 and 1.94M viewers, “the highest for the event in 20 years. Viewership for the respective shows increased 16% and 52% from last year (5.08M and 1.27M). The U.S. Department of Justice has found that former UMBC Swimming & Diving HC Chad Cradock, who passed away in 2021, sexually and verbally abused members of the team for roughly five years. According to the letter sent from the DOJ to the school, Cradock would kiss male team members on their necks, hug them from behind, and trace his fingers down their bare stomachs “from their belly buttons toward their genitals.” Cradock would entertain students in his home and allegedly engaged in sexually inappropriate behavior there. The DOJ also found that under Cradock’s tenure from 2016 to 2020, members of the women’s team were harassed, stalked and subjected to “dating violence” by their male teammates. Instead of immediately reporting the harassment to the school’s Title IX Office, the DOJ says Cradock chose to “retain control over the situation and the students involved for as long as possible.” Additionally, the DOJ concluded that some senior UMBC administrators and members of the athletic department knew about Cradock’s behavior but did nothing about it. UMBC President Valerie Sheares Ashby says the investigation “revealed not only despicable actions by one individual, but profound failures in the university’s response during [2015 to 2020]. As the DOJ said in its report, these students deserved better. Let me be very clear: we take full responsibility for what happened, and I am committed to addressing their failures through our words and through actions.” (link)
