+ Nebraska taps Washington AD Troy Dannen for the same role, and ESPN’s Pete Thamel reports Dannen is expected to sign a six-year deal with the Huskers. Dannen: "Joining the Nebraska family is truly an honor. My family and I are humbled by the opportunity to be part of such a proud athletics program, institution, community and state. Growing up in Iowa, I watched a lot of Nebraska football on Saturdays with my family. Winston & Strawn Co-Executive Chairman and headlining antitrust attorney Jeffrey Kessler joins Pablo Torre Finds Out and talks about his role in taking on the NCAA in several lawsuits over the years, including House v. NCAA. Kessler explains there had long been a feeling among owners in professional leagues that free agency would destroy their games and lead to declining fan interest, but the opposite has occurred. “And it’s the same thing with the amateurism justification from the NCAA. Even the NCAA executives and the conference commissioners, no one even believes it anymore, and everyone now understands this is just about finding a better, just system. I mean, if you interview the president of the NCAA today, he is saying we know we've got to change. So, I said the question is how quickly and what is the change going to be? Is it going to be the right change, the fair change?” Kessler says antitrust is a particularly vulnerable area for the NCAA because “what the NCAA does is the sweet spot of what the antitrust laws hold to be unlawful. The second thing about antitrust laws is that it has very, very broad relief. You can get injunctions totally ending the restrictions, and you can get triple damages for the injuries in the past. When you're talking about years of restricting compensation in a business that's already $16B a year, those damages get pretty high pretty quickly. If the NCAA takes this to the mat, they may have very, very large checks that the conferences are going to have to write. That’s a lot of pressure to try to find a settlement, to try to find some way to resolve this. If there’s ever going to be a settlement, there are two elements of it. It would have to be fair compensation for the damages but they're also for the future would have to be a fair system agreed to.” Lots more in the full podcast. (link)

Oregon State AD Scott Barnes sits down with Fox Sports/Connect’s Bryan Fischer at the 2024 NCAA Convention to discuss OSU’s long-term future, Corvallis’ geographical challenges, where NIL is headed and lots more. Barnes acknowledges that OSU’s location has “always been an issue from scheduling to conference alignment. Thinking about regionality while we think about the bigger picture, you don’t have as many options. But what we do see is a proliferation of teams in the West, programs in the West that have joined the ranks of conferences that are concentrated in the Midwest or East. And so with that sort of western outpost of schools now, totally, I think, bodes well for us and our potential opportunities.” Barnes also asserts that separating football from olympic sports needs to start happening at a “much higher level…because ultimately I think that’s where we’re going.” On the topic of NIL, Barnes explains he has changed his thinking and now believes it should be handled in-house. “Because of the chaos that is in the marketplace, it has to be inside. We’ve got to bring some controls to this.” Barnes asserts the collective marketplace is not sustainable, and “we've got to have some reasonable approaches to this. … We've got to do all we can do as member institutions to vote to support guardrails, to beef up enforcement, to give clarity to the student-athlete so it's sustainable because it's not right now.” Full Q&A on Connect. UTSA has received a $1.25M commitment from The Greehey Family Foundation to establish The Greehey Family Foundation Athletics Excellence Fund, which will provide scholarships to athletes who are first-generation college students as well as academic services to ensure students are successful in the classroom. The foundation has directed $250K of the gift toward football scholarships specifically. Sportico’s Daniel Libit examines how Drake’s men’s and women’s basketball March Madness berths came just five days after the university announced its recommendation to discontinue eight undergraduate and graduate programs to help balance the budget. “The juxtaposition of these developments, though mostly coincidental, nonetheless captures an ongoing and age-old debate in higher ed about how athletics fits into and impacts the mission of the larger institution. This is especially acute at schools for which Division I athletic success does not come naturally.” Drake President Marty Martin, though, is a “devout believer in the collective benefits of college basketball and what it can do to improve an institution,” something he saw firsthand while at Gonzaga. He tells Libit: “It is an example of how success in athletics can raise the profile of an institution such that it elevates everything else about the institution. You go back to that initial appearance, and at that point, (Gonzaga) was very different, much, much smaller, really struggling financially. … Basketball created an opportunity for people to discover what was and remains a really great institution.” As far as how football fits in, Martin says he was concerned he was going to have to discontinue the program upon taking over “because I thought the school was still trying to compete at FBS. And when I came and discovered the FCS and the Pioneer Football League model, I thought [it was] perfect, that somebody was really smart to create that and get that going. Michigan State Men’s Basketball HC Tom Izzo agrees the NCAA Tournament Selection Committee needs more former players and coaches and should rely less on ADs dissecting analytics. "There definitely should be some coaches and players on that thing to bring some levity to as crazy as it's gotten. I never know what the NET means, what KenPom means, what ESPN means or the Daily News. There's so many things out there right now that do influence [the committee]." Analytics, Izzo argues, often miss the nuances of playing a long season. "I'm appreciative of being in, and I wouldn't have felt any different if I was out, but I think it would be best if people who've been in the game and have been around. [They] understand when you lose a game and something happens – you play three tough games in a row; analytics don't show injuries or they show when a guy misses a game but not when he plays hurt." Izzo also says that while he’s always been a fan of “the little guys,” it might be time to reevaluate the AQ process that awards a spot to each conference champion. "What's happening now, everybody likes the upsets on the first weekend, but I'm not sure moving on that's what's best for the game. I think it's got to be looked at seriously." (link)

The SEC is expected to remain at eight conference football games through at least the 2025 season, and 247Sports’ John Talty and Alex Scarbrough, who also report that “desiring an all-day SEC football feel, SEC Network game start times can now be pushed back 45 minutes to lead to more staggered finishes, i.e. moving from 11 a.m. to 11:45 a.m. CT. kickoff time. A typical SEC Network slate would now look like 11:45 a.m. CT, 3:15 p.m. CT and 6:45 p.m. CT while ABC and ESPN games would keep their typical start times. The SEC and ESPN will have the ability to flex ABC and ESPN afternoon and night games a limited amount of times per school.” The league is expected to unveil its 2025 schedule later today. (link)

SBJ’s Ben Portnoy takes a look at Huron’s growth in the athletics space over the past three years, and Huron Higher Education Consulting Manager Kyle Waterstone explains: “Initially, we always say we were kind of building the airplane while we were flying it. We didn't have a precedent for structure of projects, how long should they take, how many people should be staffed on the project. We were kind of figuring it out while we went. I think this next iteration is about us internally being more efficient and being able to quickly deliver on projects, know what a certain project should be priced at based on what our previous work is and what our value is to the market.” With the landscape changing so rapidly, Waterstone notes the firm’s projects are increasingly geared towards what’s next. “All those sorts of questions are being asked at the highest level. At some of the lower levels, and the mid-major type schools, their initial thought is, ‘Hey, we're not gonna be able to outspend these people, and we're not going to get more money, but how can we be more efficient with what we do have and then let's reallocate the resources that we have to be the best version of ourselves.’ … Our work still traditionally starts with a diagnostic defensive assessment of, ‘Where are you at? Where are your peers? Where are your vulnerabilities?’ And then, once we understand that, let's go on the offensive and try to close some of those gaps.” (link)

The Athletic’s Andrew Marchand sheds some light on ESPN’s long-term plans, including its DTC strategy, and explains the goal is still to sell one or two minority equity shares in the company, with the NFL and the NBA its top potential candidates. “ESPN continues its negotiations with the NFL for the league to become equity partners, executives briefed on the conversations told The Athletic. The valuation of what the league is offering in return, and the billions ESPN is worth, is one of the ongoing negotiation points of focus.” If the two sides can reach a deal, ESPN would take control of NFL Media, and Marchand notes the “volume of NFL content would be a further selling point for ESPN’s DTC product, which would mean more NFL games to go along with the 25 ESPN already owns per season. While the digital world has led to advantages shrinking, ESPN sees alignment with Google/YouTube, according to executives briefed on their thinking. ESPN and YouTube have previously worked on partnerships, and the network is already offered on its cable-lite service, YouTube TV. ESPN is also talking with Roku to offer the new DTC service as one of its tiles when viewers turn on its televisions.” Internally, ESPN is focused on “offerings that will cost much less than the $100-plus per month cable often requires” and “will take its standalone direct-to-consumer product to the market in 2025 at $25-30 per month. … Meanwhile, ESPN wants to be the solution for MLB, NBA and NHL in regional sports, hoping to offer them as part of its direct-to-consumer strategy, as add-on channels for an extra fee, so fans can watch their favorite teams.” More from Marchand. NCAA SVP for Policy and Governance Kevin Lennon joins AthleticDirectorU’s Jason Belzer to discuss his new role, the challenges and opportunities facing the NCAA and more, including how to build consensus, and Lennon explains: “It isn't easy and candidly, in earlier days, I think there was more homogeneity around all of our institutions, whether they be in Divisions I, II and III. The size of budgets, the way they operated and that is clearly changed and that has exacerbated a little bit of the problem. How, within this big tent, if we were just to focus on Division I where the budgets are, there’s so much disparity…how do you have them come together to do something that's for the best for the whole thing? I think part of that answer is we need to make sure that we're allowing those who have the highest resources to make decisions in ways that are appropriate for them. And the more homogeneity you can get around the decisions – and if that means consolidating some of those around different sets of high-resource institutions – I think you make better decisions moving forward with change.” Lennon also says he’s “encouraged” by the SEC and the Big Ten taking the initiative to lead by forming a joint advisory group, telling Belzer: “This is an opportunity to provide some leadership at this critical point in time within our association, so I applaud them for that. Their profile of those institutions, the platform that they have, puts them in a position of leadership, and so I'm really encouraged that they're kind of taking these issues on directly in that regard.” The board members from both conferences, Lennon adds, “supported the holistic model that, you know, raise the boats in support for all of the institutions within Division I, not just the things that they’re doing.” Full interview on ADU. Yahoo’s Ross Dellenger provides more details on the Clemson-ACC showdown with one unnamed league administrator telling Dellenger the breaking point was the new College Football Playoff deal, “Now combine that with the gap in TV revenue.” Dellenger goes on to note that, according to an industry source, it’s not Clemson or Florida State who has the most value within the ACC, “North Carolina is the lynchpin.” As for how Fox & ESPN could impact the situation: “If Fox and ESPN will foot the bill to add FSU and Clemson (to the SEC, Big 12 or Big Ten) — or any others — maybe it happens. But first, the ACC schools must wiggle free of what many believe is a binding agreement.” More. (link)

Sportico’s Michael McCann offers a legal perspective on Clemson-ACC: “In the coming weeks, the ACC will answer the complaint and raise several defenses. Expect the conference to insist that Clemson, like FSU and other members, voluntarily entered into contractual agreements that contemplated a give-and-take. [...] The ACC will further maintain it has lawfully interpreted and applied contractual agreements with member schools. Courts generally defer to membership organizations in their interpretation of rules so long as those interpretations are not arbitrary or capricious—a very deferential standard. The ACC might also maintain the lawsuit is not yet ripe. Unless and until Clemson moves to leave the conference, the ACC could argue the legal controversy is more hypothetical than actual.” (link)

Nebraska Football HC Matt Rhule weighs in on what he would like to see in the Huskers’ next AD: “I really want somebody who has unbelievable urgency. We spend a lot of time talking about the transfer portal and NIL, this is like one of the most pivotal times in college athletics. We just need doers. We need people who just figure it out and work so I love the fact in Trev that I had an athletic director that was here at 7:00, 7:30 every morning in a suit and tie. He was a worker. Pat Kraft who I worked with at Temple, now at Penn State, was a worker. They were right there with you. … They have to be really mentally strong because when you come to a place that has as big of a brand as Nebraska, that people are so passionate about and care about, when you do something, a lot of people are going to like it. And some people aren’t going to like it and if you’re listening to the outside noise, you have no chance. I’m just hoping that it’s a worker, a doer.” Rhule also asserted he remains “all in” at NU: ”I loved Ted Carter and I loved Trev and I came because of them. But I came to be at the University of Nebraska, and I've loved the people I've met, and we're not going anywhere unless you guys kick us out.” (link, link)

Deal could be more impressive. He is worth significantly more than this deal. Really surprised he doesn't earn $2.5-$3.5M in this role. Same for other high-performing ADs. $200 M budget. Immeasurable economic impact on the school. Fundraising in the $100s of M Most notably, the current state of the ‘business of college sports,’ where coaches make 20+% of the overall budget and some athletes are getting +$1m deals, I'm beginning to think the ADs are now more undervalued / appreciated resource/asset in the business. + Nebraska Men’s Basketball HC Fred Hoiberg gets an extension through the 2028-29 season. He made $3.5M this season but will earn $4.25M next season with “annual increases in each of the subsequent contract years,” per USA Today’s Steve Berkowitz, who also points out that “two years ago Hoiberg agreed to take a pay cut, forfeit a scheduled retention payment and accept a reduction in the buyout he would be owed in case of termination without cause. His pay was increased for this season when he met certain metrics that were never made public.” (link)

The New York Times’ Billy Witz asks what the difference is between a college football team and marching band when it comes to employment, and Minnesota law professor/former NLRB field attorney Matt Bodie tells him part of the issue facing college athletics is that it’s “hard to find a comp and that’s what the law likes to do.” Bodie also contends the USC case with the NLRB is the “more traditional case” while Dartmouth’s is “kind of surprising. The economic relationship there is a little hard to see. If the basketball players are employees, why not the orchestra? Why not the people on the squash team?” Meanwhile, there is a political component that factors into the schools’ strategies. If Donald Trump wins the 2024 presidential election, a new NLRB five-member board will be appointed along with a new general counsel, and Witz notes: “This probably explains USC stringing out its case with a lengthy witness list, which included the school’s band director, who spent more than three hours testifying in intricate detail how his program was run, describing how band members get into uniform before a game, the same as football players.” Notably, when Wilma Liebman was appointed by President Bill Clinton to the NLRB’s board, the board ruled in a case involving NYU and whether graduate students were employees. When George W. Bush became president, the board reversed that decision in a case involving Brown grad students. The Pac-12 Network will broadcast the spring football games for all 12 schools, including the 10 outbound programs. The Big Ten Network will send reporters to the games at Oregon, Washington, UCLA and USC and is “working with the schools to obtain footage for coverage on BTN.” (link)

J.P. Morgan is creating a sports investment banking group that will work with the firm’s investment banking, commercial banking and private bank divisions to offer clients advisory and investing opportunities, according to Sportico’s Asli Pelit. J.P. Morgan Global Head of Media and Communications Investment Banking Fred Turpin in a note announcing the news to his staff: “With top sports franchises in the U.S. and Europe now valued at more than $400 billion in total, sports have become an increasingly large asset class, attracting more and more institutional investors.” (link)

The son of a former college football player who died in 2018 and was later diagnosed with CTE has sued the NCAA, accusing the organization of negligence and wrongful death.
