Findlay announces its plans to merge with Bluffton (DIII), starting in 2025-26. From the university: “Through this merger, the universities would position themselves to provide increased educational opportunities that prepare current and future students to lead and serve in their local communities and beyond. Students and employees would benefit from access to expanded resources on both campuses located 20 miles apart in Northwest Ohio. A goal of the proposed merger is to innovate in response to the changing climate of higher education while honoring individual campus traditions.” Pending NCAA approval after the merger is complete, both institutions would continue to operate their own athletics programs. Minot State will eliminate its AD position and have athletics fall under the oversight of VP for Student Affairs Kevin Harmon, who has been serving as Interim AD since January. Harmon will now serve as VP for Student Affairs and Intercollegiate Athletics. President Steve Shirley: “Kevin has deep and long-standing ties to Minot State University going back to his days as a Beaver student-athlete, coupled with a distinguished career as a senior administrator on campus. He has guided both areas with a steady hand this winter, and I look forward to continuing to work closely with Kevin in his new role at MSU.” (link)

More from NCAA President Charlie Baker’s sitdown with AthleticDirectorU’s Jason Belzer, as Baker talks about the project to build a fan database, which he says has 6.5M fans in it now. “Hopefully, 10M by the convention in January and 25M over the next couple of years. … I really do believe that if we have 25M fans and we know where they live, what sports they are interested in, what teams they follow and what conferences they’ve chased – that sort of thing – and we’re in a position to just constantly, hopefully not overly do it, but just constantly give them information in a consumer-centric way around the teams and the sports and the stuff they’re interested in, I think they’ll respond.” Baker goes on to note he “couldn’t understand why the same athletes who participate in the Olympics and the World Games, which are basically college students representing the United States, get huge visibility in the trials and the games, whether it’s the Olympics or the World Games. They do fine on TV and they do fine on broadcast and they do fine in terms of who shows up for their events, but [the coverage of college events in those sports is] nothing like it is in the trials and the World and Olympic Games and that says to me that that’s because people can’t find them.” On separating the highly resourced DI institutions from everyone else, Baker says he wants them to have more flexibility concerning out-of-season tournaments, roster management and compensation. He reiterates that he doesn’t want student-athletes to become employees, “but you can certainly do compensation agreements without doing employment. Winston & Strawn Co-Executive Chairman and headlining antitrust attorney Jeffrey Kessler joins Pablo Torre Finds Out and talks about his role in taking on the NCAA in several lawsuits over the years, including House v. NCAA. Kessler explains there had long been a feeling among owners in professional leagues that free agency would destroy their games and lead to declining fan interest, but the opposite has occurred. “And it’s the same thing with the amateurism justification from the NCAA. Even the NCAA executives and the conference commissioners, no one even believes it anymore, and everyone now understands this is just about finding a better, just system. I mean, if you interview the president of the NCAA today, he is saying we know we've got to change. So, I said the question is how quickly and what is the change going to be? Is it going to be the right change, the fair change?” Kessler says antitrust is a particularly vulnerable area for the NCAA because “what the NCAA does is the sweet spot of what the antitrust laws hold to be unlawful. The second thing about antitrust laws is that it has very, very broad relief. You can get injunctions totally ending the restrictions, and you can get triple damages for the injuries in the past. When you're talking about years of restricting compensation in a business that's already $16B a year, those damages get pretty high pretty quickly. If the NCAA takes this to the mat, they may have very, very large checks that the conferences are going to have to write. That’s a lot of pressure to try to find a settlement, to try to find some way to resolve this. If there’s ever going to be a settlement, there are two elements of it. It would have to be fair compensation for the damages but they're also for the future would have to be a fair system agreed to.” Lots more in the full podcast. (link)

The NCAA announces the Draw the Line campaign, which prioritizes student-athlete education on the effects of sports betting while also addressing problem gambling for all who consume and participate in college sports. The campaign, which will debut during the first week of the men’s and women’s basketball tournaments, is aimed at college students and will run across social media channels. It also includes a membership toolkit for member schools and conferences to access resources that extend the campaign to their campuses. NCAA President Charlie Baker: "Sports betting is everywhere — especially on college campuses — so it's critical student-athletes get the real story about how it can impact them and their ability to play. We know some bettors are harassing student-athletes and officials, so that's why we are advocating for policy changes at the state level and launching monitoring tools around championships to refer serious threats to law enforcement. The NCAA is doing more than ever to protect the integrity of the game and arm student-athletes with the truth about sports betting." (link)

Extra Points publisher Matt Brown points out that one underreported component of a potential federal solution to NIL is the makeup of Congress itself. Democrats currently hold a small majority in the Senate while Republicans hold a slim edge in the House. With it becoming increasingly unlikely a bill will get passed by this Congress, Brown looks ahead to the bicameral makeup of the next Congress and notes it’s possible, if not probable, that the GOP will retake the majority in the Senate and slightly expand its majority in the House. In the event that former President Donald Trump wins reelection in November, Brown posits there’s still “no guarantee that a GOP sweep would lead to college athletics legislation. Democrats may still be able to filibuster, or the House majority may be too narrow to pass laws on partisan grounds alone. But I believe it will make it much more likely that the NCAA could secure an antitrust exemption, or perhaps laws to explicitly declare college athletes as non-employees.” Concerning the conversation around paying players leading to the elimination of Olympic sports, Brown contends: “The choice should not be ‘let the NCAA control all the FBS football money or women’s volleyball gets it!.’ The choice should be: We cannot continue to fund volleyball the way we have before if the business model around FBS football changes. We all agree that funding college opportunities around volleyball and the development of world-class volleyball athletes is important. What are other ways we can continue to provide this experience?’ Every congressional hearing or pow-wow that does not attempt to engage with that question in a meaningful way is another lost opportunity.” (link)
