With the Pac-12 now at 10 NCAA Men’s Basketball Tournament units worth ~$20M and counting, Commissioner Teresa Gould tells The Athletic’s Nicole Auerbach: “Those ongoing NCAA units from past years and future years stay with the conference. The most important thing during this two-year grace period is, financially, that we’re able to support these programs at a high level so they can stay nationally competitive. … As we are working on different conference affiliation scenarios for the future, we have to keep these programs competitive and relevant – and that takes resources. Conferences don’t look the way they normally look because the lion’s share of the conference distribution historically has been from a media rights deal.” Regarding what Washington State and Oregon State are looking for in their next conference affiliation, Gould explains: “What we’re trying to do to find a sustainable, viable home for those programs, and whether that’s a rebuild, whether that’s a merger, or lots of different scenarios that could pan out, it’s important that we as an entity have assets. The accumulation of units beyond the next two years, the next three, four, five, six — the more units we have, the more assets we have to bring to the table for our future strategy.” (link)

Sportico’s Eben Novy-Williams and Michael McCann break down the exit agreement between Washington State and Oregon State and the 10 outbound Pac-12 schools. All told, the outgoing members are forfeiting $65M, with $5M apiece withheld from FY24 revenue distributions and an additional $1.5M going directly from each school to the “Pac-2.” McCann and Novy-Williams explain that “legally speaking, the settlement is structured to avert potential conflicts that could re-trigger litigation. By calling for the 10 departing schools to preserve their votes on conference matters impacting the remainder of the 2023-24 academic year while clarifying that Oregon State and Washington State—and not the exiting schools—will decide conference matters that concern future revenue and decisions, the settlement ensures the departing schools still have a voice on the present but not on the future. The settlement also calls for the departing schools to not attempt to dissolve the conference. Failure to adhere to that provision could trigger potential consequences of injunctive relief issued against the departing schools and liquidated damages pegged to (among other things) unrealized future revenues for the conference.” Further details have yet to be disclosed, as the agreement contains nearly four pages of redacted details regarding the full nature of the conference’s future revenue. The ACC will reconsider its men’s basketball schedule, including the possibility of moving back from 20 games to 18. The evaluation is part of a larger overall look at the state of the sport, according to ACC Commissioner Jim Phillips, who tells The Athletic’s Nicole Auerbach: “Over the last three Selection Sundays, we’ve had 15 teams – five each year – which I just think is not reflective of the caliber of play. We’ve had three different teams in the last two Final Fours in Duke, Carolina and Miami, the most of any conference. That speaks to how worthy our teams are. I was very disappointed about Pitt and Wake Forest not getting in. I felt that they had done enough. … None of us feel as if the number of selections has reflected the level of play and how our teams have actually performed.” Phillips also believes the selection committee needs to tweak the NET and reconsider how it utilizes advanced metrics. “There is absolutely a place for metrics. But at the end of the day, you can’t forget about actually watching these teams. … We went from 18 to 20 games (in 2019-20) alongside the advent of the NET – that came in around the same time. Except for one year, all of our other seasons have trended way below where we’ve been in the past. With games 19 and 20, half your league loses twice. You end up having another 14 losses for your teams.” (link)

Outgoing Notre Dame AD Jack Swarbrick sits down with CBS’ Dennis Dodd to discuss the future of college sports and says he’s glad to see former Alabama Football HC Nick Saban leading the call for NIL reform despite his coaching career being over. “I think it's great he's doing it in such an intentional way. He's just not, you know, talking to Stephen A. Smith about how the world should be different." Swarbrick also says he wouldn’t rule out a new model in which a select number of schools operate in a semiprofessional manner while the others adhere to the traditional collegiate model: “I never cease to be amazed at how much money drives decision making. At some point, you've got to think some number of universities are going to say, ‘We have to go back to a model that recognizes the athletes' rights but is integrated into the university.’” Swarbrick goes on to tell Dodd he was surprised by the initial pushback on expanding the College Football Playoff. “Frankly, we lost a lot because of that. I just think if we'd gotten this resolved more quickly and implemented sooner, I think a number of things might be different. I'm not sure realignment would look the same. Hindsight is 20-20." What’s next on the realignment front? “My crystal ball is cloudier than it's ever been. That's saying something. I don't see a lot of momentum towards further realignment right now. There are some schools that, if they made a move, might change that. But frankly, we're probably first among that, but we're not likely to. I don't see the catalyst right now. The Big Ten and SEC have the assets they need to position themselves for their next media negotiation. I understand the ACC has disgruntled members, but I'm not sure there are better options for them. The ACC's legal position is a very strong one." Full interview. (link)

Opendorse CEO Blake Lawrence joins the Front Office Sports Today podcast and argues that collective bargaining will benefit schools and conferences far more than student-athletes. “Right now, student-athletes are benefiting from a capitalistic environment where they can earn their value…and anything related to collective bargaining is really going to be put in place by schools or conferences to limit and restrict trade. So, athletes will not be able to move from one school to the next or into the transfer portal, which is a chaotic environment for coaches and recruiting and different media relationships, but for athletes it’s all-empowering. If an athlete could enter the free agency market in the professional ranks every year, most of them would. They would test those markets and get their market value. So, in a strange way, the movement to collective bargaining is not necessarily to benefit athletes.” Lawrence believes if student-athletes can participate in the revenue pool without having to unionize, then they will “earn a much larger share of the pool of dollars that are available to them. … I think collective bargaining will exist. I think it will be brought on by conferences and schools who say, ‘Okay, we'll let you share in this revenue, but we are going to restrict where you can go. Up until that point athletes are able to go wherever they want, and the first conference to figure out they can share revenue with athletes through NIL or other additional setups will have an advantage in the recruiting environment, and that'll mostly be what triggers the entire whirlwind of collective bargaining to be put on the table by the schools and colleges themselves.” On NIL writ large, Lawrence notes there’s “lunch money and living money,” with the latter coming mostly via collectives, which he says account for 80% of all NIL dollars. Idaho State will begin a $500K renovation of the Jared Allen Strength and Conditioning Center in May. With the help of an anonymous donor, the project will include the installation of PLAE Achieve flooring. Bengals AD Pauline Thiros: “The strength center is a place where student-athletes commit themselves to doing the work no one sees. … This improvement is a message to our student-athletes that we care about them, and we support them. In total, there are 296 players in their fourth, fifth or sixth seasons in this year’s NCAA Men’s Basketball Tournament. According to Stats Perform, that is the highest since it began tracking such data in 2008. (link)

NFL owners unanimously voted to institute a 15-yard penalty for what’s known as a “hip-drop tackle,” which occurs when a defender grabs or wraps his arms around a runner and “unweights himself by swiveling and dropping his hips and/or lower body” while landing on and trapping a runner’s leg at or below the knee. In addition to being penalized, players will also be subject to a potential fine for doing it. Despite it being a player safety issue, the NFLPA opposes the new penalty, explaining in a statement that it “cannot support a rule change that causes confusion for us as players, for coaches, for officials and especially, for fans.” Atlanta Falcons CEO/NFL Competition Committee Chair Rich McKay insists that “we have an obligation from a health and safety standpoint to protect players when there’s unreasonable risk of injury. There’s pure data: it’s an unreasonable risk of injury.” (link)

The settlement between Washington State and Oregon State and the outgoing Pac-12 schools is now final and states that “no departing member shall have any claim to distribution of any amount of conference revenues earned, due to be paid or, [with exceptions], actually received” in FY25, FY26 or any subsequent year. Revenue received by the conference at the end of FY24 that “was due to be paid or expected to be received by the conference” in FY24 or a prior fiscal year is a “refund payable to the conference” for FY24 or a prior fiscal year. Delayed revenue is not future revenue; therefore, 1/12 will be distributed to each departing member on the last day of the quarter in which it is received. The settlement also includes the following on withholding revenue: “Notwithstanding the distributions described above, the conference shall withhold $5M from the [FY24] financial distributions to each of the departing members for a total of $50M.” The revenue will be withheld in the following amounts per school: $1M in the first FY24 distribution, $2M in the FY24 April distribution and $2M in the FY24 June distribution. Additionally, the conference will be entitled to a $1.5M payment from each departing member. (link, link); The Mercury News’ Jon Wilner points out that the revenue WSU and OSU are earning via NCAA Tournament units this season is contingent on the Pac-12 surviving as a league. “If the conference dissolves or becomes a different legal entity, a source said, the revenue earned this month would revert to the 12 current schools, regardless of future conference affiliations. Also, any additional members of the Pac-12 — if we assume WSU and OSU pursue expansion in some form — might attempt to negotiate access to a portion of the NCAA units. And it’s unclear how the CFP would handle revenue distributions if a Pac-8 or Pac-10 were to emerge in a few years, with schools from the Mountain West or other conferences.” (link)

Vaqueros AD Chasse Conque: "The Southland Conference is positioned in a tight footprint between Texas and Louisiana. This will allow our student-athletes to spend less time traveling cross-country and more time at home training, recovering, and preparing for competition and will significantly reduce missed class time. With significantly reduced travel, there will be cost savings that allow our department to reinvest in the student-athlete experience in ways we haven't been able to before." Stanford AD Bernard Muir, in his last quarterly meeting with C-House, an organization with representatives from all 36 sports who meet with administration, was asked to start thinking about what student-athlete employment models may look like, according to the San Francisco Chronicle’s Marisa Ingemi who notes some Cardinal student-athletes are skeptical the athletic department will keep up with the changing times. Stanford law professor William Gould, who served as an NLRB chairman in the ‘90s, tells Ingemi: “You’d like to think that the leadership here at Stanford would take the initiative in recognizing that the employment relationship exists, and that they are not opposed to athlete initiatives to reap the benefits of the employment relationship. I will hope for that but I don’t know that the past record holds much promise on that.” At the same time, women’s soccer student-athlete Elise Evans: “Some of us are also concerned because we’re still such a diverse community how this affects international students as employees, and things like that. And so I think there’s concern from both sides, but it also excites some people in terms of how they’re going to start making more money. So yeah, I think it kind of varies.” Schools around the country have warned that putting student-athletes on the payroll would result in the loss of sports, and Gould says that “scare tactic could be real because Stanford itself has tried to eliminate a bunch of sports. So I think that it’s quite possible that some universities may say they will cut back or discontinue so as to put the fear of God into the athletes.” (link)

Sportico’s Michael McCann sits down with Jake Krupski, the labor attorney representing the Dartmouth men’s basketball team, who says he was approached by SEIU Local 560 to see if he’d help the players form a union. Krupski believes college-age workers increasingly view unions as crucial to ensuring their voices are heard. “There is a move for younger generations to want more say. They’re not willing to work for $7.25 an hour. They demand higher wages. They demand insurance. They demand time off.” Krupski says more Americans, especially younger ones, are recognizing that life shouldn’t be about working all day every day. “That shouldn’t be necessary to be a middle class American. You shouldn’t have to work 100 hours a week to make a decent living.” Krupski also understands how terrifying presidents and ADs find the prospect of student-athletes unionizing. “People are often comfortable with the status quo, particularly if they’ve excelled under it.” The NCAA’s nomenclature and messaging over the years, Krupski continues, are the reasons people are shocked to see them viewed as employees: “The question that matters” is whether the players “provide services under the direction and control of another in exchange for consideration. The NCAA announces that seven of the eight NCAA Men’s Basketball Tournament sites sold between 95% and 100% of their tickets for the opening rounds on Thursday and Friday. Second-round games Saturday and Sunday also drew well, with 131,073 fans buying between 97% and 100% of the available tickets at seven of the eight sites. Meanwhile, tournament scoring is up compared to last year, with five teams topping 100 points, another eight scoring at least 90, and 21 others putting up 80 or more. For perspective, teams scored 100 or more points just six times in the past 10 tournaments, and there were only five 90-point games in last year's tournament. Through Sunday's games, teams are averaging 73.1 points per game, up from 69.5 in last year's tournament. (link)

ESPN starting this week will be integrating links to video feeds from regional sports networks into its main app and website. The rollout will start with NESN with Washington, D.C.’s Monumental Sports Network set to follow this spring and Pittsburgh’s SportsNet Pittsburgh expected to be added down the line. The links will be geotargeted and only available to subscribers of the RSNs. VP for ESPN Strategy Tim Bayus: “This is about improving discoverability of people’s favorite teams and who’s carrying their games.” Bayus also notes that internal research has indicated that avid sports viewers are confused and frustrated by the difficulty in finding games: “What we’re trying to do is solve those consumer pain points. This is a first step in trying to figure that out. We know it’s a meaty one to tackle.” (link)
