USA Today’s Steve Berkowitz reports plaintiffs in the House v. NCAA case have filed a motion asking U.S. District Court Judge Claudia Wilken for a summary judgment & point to NCAA’s Project DI, which could include student-athletes receiving NIL compensation directly from their respective schools, as well as a $30K “enhanced educational trust fund,” as a “devastating admission” that competitive balance cannot be protected. Also from Berkowitz & the filing: “As for the alleged threat to non-revenue sports, the plaintiffs’ lawyers wrote that ‘the crux of’ the NCAA’s and the conferences’ position is ‘it would be too expensive for certain schools (competitors) to continue to support non-revenue sports programs and investments that purportedly benefit student athletes (such as exorbitant coaching and administrator salaries, as well as luxury facilities) to the same degree if they were permitted to make direct NIL payments.’” More. College Sports Tomorrow, a 20-person consortium of college, professional sports and other industry leaders such as Syracuse Chancellor Kent Syverud, West Virginia President Gordon Gee, TurnkeyZRG Chairman/CEO Len Perna and NFL Chief Media and Business Officer Brian Rolapp, have outlined a system for a college football “Super League” consisting of the “top 70 programs — all members of the five former major conferences, plus Notre Dame and new ACC member SMU — as permanent members and encompass all 130-plus FBS universities,” according to The Athletic’s Andrew Marchand and Stewart Mandel, who report the “perpetual members would be in seven 10-team divisions, joined by an eighth division of teams that would be promoted from the second tier. The 50-plus second-division teams would have the opportunity to compete their way into the upper division, creating a promotion system similar to the structure in European football leagues. The 70 permanent teams would never be in danger of moving down, while the second division would have the incentive of promotion and relegation. The playoffs would not require a selection committee, as the eight division winners and eight wild cards from the top tier would go to the postseason.” Additionally, universities would own a percentage of the league, although the revenue distribution would not be an even split, even within the group of 70 teams. As noted previously, CST believes there would be added value in negotiating TV deals as one entity and creating broadcast windows that make more sense. So far, however, CST is struggling to gain traction with the top 70 teams, and leagues have canceled meetings with CST officials to not upset their current media partners. Notably from Syverud: “I really think conferences in the NCAA are at a very significant likelihood of going bankrupt in the near future because of the lawsuits, both the ones that are going to trial soon and those that will follow.” Lots more. WWE President & high-profile former media dealmaker Nick Khan tells Puck’s Matthew Belloni he believes the power teams in college football should break away from the NCAA and sign their own media rights deal. “Outside of March Madness, which is still coordinated by the NCAA, what do you need that for? So you have the SEC, who I had the good fortune of doing business with in my prior profession, you have the Big Ten. You saw the Big 12 and Big Ten just decimate the Pac-12, just rip them all apart and it almost seemed like the Pac-12 was playing by rules from decades ago and everyone else was playing by the modern rules. … And, by the way, Brett Yormark, to his credit, came in at the Big 12 and did not say, ‘Oh, I want to beat the SEC and the Big Ten on day one. He basically said, ‘I want to clearly be the number three conference, and he picked apart the Pac-12, as did the Big Ten.” Belloni points out that Khan represented the SEC and asks who represented the Pac-12, to which Khan replies: “A gentleman I had never heard of.” (link)

ACC Commissioner Jim Phillips believes it’s a matter of when, not if, NCAA Tournament units will be distributed to women’s basketball teams. “To me, it shows the maturation of an incredible game and the growth that we’ve all benefited from. Now, how do you execute it? Where do the dollars come from? How do you assess what the units are worth, et cetera? To be having these types of conversations, it’s reflective of the elevation of women’s sports. But this has to be the beginning of those talks, not the end. There’s a lot more to address.” An NCAA spokesperson tells the Washington Post’s Jesse Dougherty that the finance committee is workshopping models for a women’s tournament units program. Questions being considered include when it would start, what the value of each unit would be and how and when they would be distributed. Meanwhile, Atlantic 10 Commissioner Bernadette McGlade agrees with Phillips that the conversation should just be starting. She believes the men’s and women’s Final Fours should be held on separate weekends to give sponsors and fans the chance to fully invest in each. “Units are long, long overdue. Kentucky AD Mitch Barnhart tells Kentucky Today he expects that “in the next 18-24 months, there’s going to be some direction for all of college athletics about how we get this thing in line. … It may be something we have to ask for, but I don’t know how it’s going to end. I would hope in the next 18 to 24 months we get some help from some place and I don’t know what that is. Don’t ask me to define it because I couldn’t tell you.” Barnhart says UK athletics and its NIL guidelines currently “fall under one umbrella,” which he calls a “pillar approach.” Men’s and women’s basketball each have their own NIL office, while the other sports fall under the same leadership and “they’ve already got that in place. … We’ve worked through our four or five collectives and that’s been good and it’s been consistent. Every program has done it a little differently and our coaches have been successful.” Barnhart is in favor of student-athletes having choices when it comes to the transfer portal, but with limitations. “I also think that teaching young people how to work through situations teaches them how to do things later on in life. You’re not going to get to transfer from every job you don’t like.” On SEC Commissioner Greg Sankey and Big Ten AD Tony Petitti setting up a joint advisory group, Barnhart remarks: “They’re good people who have bright minds. I think what has been said is, ‘We don’t want to separate ourselves, but we want to lead.’ I think that’s really a difference there. We’re not interested in, you know, separation that doesn’t help college athletics.” (link)

Notre Dame AD Pete Bevacqua understands and shares the urgency among fans to win a national championship in football and tells InsideNDSports’ Eric Hansen: “Because of Jack, we’re really well-positioned to make a great run here over the course of the next decade and beyond. But we don’t want to wait a decade. We want to win a national championship now. I’ll say that ’til I'm blue in the face. And every year that goes by that we don’t – not to get overly dramatic – but it eats a piece of your soul.” He adds: “Not only do we want to win a national championship, we HAVE to win a national championship. I think sitting here in 2024, we’re now officially in the second week on the job, I’m inheriting a football program that’s a lot different than the one Jack inherited. … I think not only do we have to win a national championship, I think it’s imperative that we win one with Marcus Freeman as our head football coach.” (link)

ECU has raised more than $30M for its Pirates Unite campaign in less than two years. As part of the initiative, Pirates AD Jon Gilbert notes funding for the Isley Indoor Performance Center now stands at nearly $21M, just $3M short of its goal to push the project over the finish line. Additionally, funding for the Dick and Sarah Bennett Baseball Building Expansion is now at $6.1M, closing in on the project’s total cost of $7.5M to $8M. (link)

Paciolan today will officially launch Paciolan iQ, a comprehensive tool schools can use to pair data warehousing, data visualization and insights, and CPO/CTO Keith White tells SBJ’s Ethan Joyce: “There’s a huge push to really leverage data to drive revenue to increase the donor base that’s, in many cases, maturing out. They’ve got to go use data to go acquire new and younger donors to keep that lifeblood going, which is relatively unique to college.” To do so, White emphasizes how important it was to build a system that could manage schools’ data in real time to maintain accuracy. “We try to take a super proactive, alert-monitoring stance to make sure the data is good so you can trust it. Because that’s the other problem, right? If you don’t trust the data, you’re not going to use it, and that’s a hard one to come back from.” The technology also comes with an analyst who will serve three to five schools, thereby allowing the analysts to cater to each school’s unique circumstances while also determining best practices that could potentially flow throughout the iQ clientele list. A worker burned during renovations to Wisconsin’s Camp Randall Stadium in 2022 has agreed to a $22M settlement with the contracting company. Front Office Sports’ Margaret Fleming: “Jeremy Rose, employed by the subcontractor Maly Roofing, was applying a flammable liquid to the floor in a mechanical room beneath the stadium when another worker used a flame torch to dry part of the floor, according to the Associated Press. Running from the explosion, Rose spilled a bucket of the liquid on himself and was engulfed in flames, his attorney Daniel Rottier says, burning nearly three-quarters of his body.” (link)

UMBC has reached a $4.14M settlement with former student-athletes who claim they were sexually harassed and discriminated against by former Swimming & Diving HC Chad Cradock. Between 2015 and 2020, several male and female athletes accused Cradock of creating a hostile and hypersexualized environment among team members. As part of its probe, the DOJ conducted 70 interviews and reviewed over 100K documents alleging sexual misconduct within the program and found UMBC officials failed to properly investigate and address the allegations. In addition to the monetary settlement, UMBC has agreed to significantly improve its process for responding to complaints of sex discrimination; provide additional resources for Title IX compliance; and create and enforce a policy outlining expectations for coaching staff behavior, among other requirements. The Louisiana Gaming Control Board signed an order Wednesday banning sportsbooks from offering prop bets on college athletes. Chairman Ronnie Johns: “It is the intention of the Louisiana Gaming Control Board to protect the integrity of sports betting as well as the safety and integrity of college athletes. We feel that this order accomplishes that goal.” This goes into effect August 1, 2024 at 9 a.m. ET, just in time for college football season. (link)

The Virginia House and Senate have passed a law that would allow colleges and universities to directly pay student-athletes NIL compensation, effective November 15, 2024. The bill was sent to Governor Glenn Youngkin’s desk last week and has an action deadline of April 8. (link)

The AAC officially names IMG Academy President/former Rutgers AD Tim Pernetti as its next commissioner. AAC Board Executive Committee Chair/ECU Chancellor Philp Rogers: “Tim Pernetti is the ideal leader to guide the American Athletic Conference through this pivotal time in college athletics. His perspective as a successful student-athlete, a respected and progressive director of athletics, and his demonstrated leadership, innovation, competitive spirit, and business acumen across a number of professional organizations make him uniquely suited to build on the success of Mike Aresco and steer the conference to a bright future.” Current AAC Commissioner Mike Aresco adds: “I have known Tim for a long time, and he is a superb choice to lead this conference. The NCAA was scheduled to revisit its decision on whether to hold the first two rounds of the women’s hoops tournament at campus sites and to hold its second weekend games in two sites rather than four after the 2025 championships, but NCAA VP of Women’s Basketball Lynn Holzman believes they have enough data to consider the changes following this year’s tournament. "Given the trajectory of success we've experienced over the last couple years, I see no reason to wait to start that review. The governance structure has to approve [a review], but that is our ask coming out of this championship. I believe that will take place." In discussing this year’s tournament, Holzman says the issues it has faced – including mispainted three-point lines, the removal of a referee at halftime, Utah having to change hotels, and Notre Dame star Hannah Hidalgo missing several minutes after being forced to remove a nose ring she’d been wearing all season – are a series of isolated incidents rather than a result of the disparity in how the men’s and women’s tournaments are funded. The NCAA has since spent an additional $14M per year on the women's tournament since the release of the Kaplan Report, per a spokesperson. (link)

NC State’s men’s basketball Final Four run demonstrates the conference’s depth, according to the Richmond Times-Dispatch’s David Teel, who notes 10 of the league’s 15 programs have made it to at least the Elite 8 since 2016 with six advancing to the Final Four. ACC Commissioner Jim Phillips tells Teel: “To me, the most critical piece is our schools are prepared for the NCAA tournament because of the conference they play in. … The reality is, we’ve been undervalued, and we have to do something about that.” Phillips believes the selection committee should place greater emphasis on late-season play, noting that Pitt won 11 of its last 14 games this season and, in his opinion, deserved a spot in the NCAA Tournament. “Analytics and metrics have a place, but it also warrants a discussion about whether past performance, and how conferences have fared in the NCAA tournament, should be considered.” Phillips stops short of advocating for expanding March Madness but does support studies into the feasibility of growing the field. “How can you do it without undercutting what is the crown jewel of NCAA championships while still allowing access across the country?” (link)

The Knight Commission reiterates its call for the NCAA to provide “equal rewards for the success of women’s and men’s teams in the March Madness tournaments.” The commission, which first called for such a distribution as part of its proposed C.A.R.E. Model in 2021, acknowledges the NCAA recently announced it would explore awarding financial incentives for team success in the NCAA WBB Tournament with money from the $920M contract with ESPN but insists a “more urgent and far-reaching overhaul of the NCAA plan is long overdue.” Since the 2021 Kaplan Report, the commission notes the NCAA has awarded $340M to conferences and institutions for the tournament success of men’s basketball teams “over two revenue distribution cycles without any change to its discriminatory formula. The NCAA’s apparent plan to tie future financial incentives for the women’s basketball tournament success to an assigned value in its new multisport media contract falls well short of righting this longstanding inequity. As an educational non-profit, the NCAA has one revenue distribution plan for Division I institutions—not distribution plans for each sport pegged to commercial values and media contracts. With so many complex challenges facing college sports, fixing this inequity by providing equal incentives for athletics success for men’s and women’s teams should be a lay-up.” (link)

Fox’s 16-team College Basketball Crown is officially a go, per The Athletic’s Andrew Marchand, who reports the tournament will take place in Las Vegas’ MGM Garden Arena and MGM Arena, beginning March 31, 2025, and run until April 6. AEG is a presenting sponsor, and games will air on both Fox and FS1. The field will feature schools that failed to qualify for the men’s NCAA Tournament with two squads each from the Big Ten, Big 12 and Big East receiving automatic bids. (link)

With so much at stake and the situation changing rapidly, JohnCanzano.com’s namesake believes the Pac-12 quickly “needs to formulate a plan and show the conference coaches and athletes the path.” Canzano adds: “I’m eager to see how this unfolds for Oregon State and Washington State in the next six to 12 months. The hope is that chaos in college athletics will trigger another round of realignment and give the schools better options. Is that a Pac-12 rebuild? Or is it OSU and WSU joining some other conference? There’s been optimism, but as one major conference commissioner told me in a phone call last week: ‘Hope isn’t a strategy.’ … Next season and the WCC has to be sold as a one-year thing followed by something better. And therein lies the crux of the problem – the conference itself isn’t ready to pick a path given the potential for more shifting sands.” (link)

Stephen F. Austin Interim AD/SWA Loree McCary and Senior Assoc. AD for External Affairs Wally Crittenden met with students last week to discuss a proposed fee that would support the athletic department. McCary explained the economic impact the athletic department has on the Nacogdoches community, which amounts to $146K and over 4,000 hours of volunteering. She also emphasized that the athletic fee is “something for the betterment of all SFA” and will “assist us to grow and do things in line with what the UT system does.” Crittenden focused on the economic impact SFA athletics has on campus, particularly with 348 non-scholarship student-athletes. “They may not sell tickets, but every single one of our sports has athletes who are part of those sports and are paying full tuition, fees, books, and expenses.” McCary also commented that most student-athletes stay on campus, and some even have meal plans, which helps the SFA economy. “We put revenues into our SFA economy, which then comes back to the university. Currently, across our social channels, the add value equivalency… is worth $1.2M.” A student vote on the fee is set for April 6. (link)

Renovations to Georgia Tech’s Bobby Dodd Stadium will result in a reduction in capacity from 55K to 51,913. As part of the upgrades, three sections will be permanently removed to fit the new 100K square-foot Fanning Center, which will house offices, meetings spaces and a player’s lounge for the football program, strength-and-conditioning space, a dining hall, nutrition rooms, sports-science and data-analytics areas, sports medicine and recovery rooms, a sports-science lab and more. It is expected to be completed in 2026. (link)

Colorado is installing six new Daktronics LED displays at Folsom Field. The main south end zone display will measure nearly 40 feet high by 116.5 feet wide for a total of more than 4,600 square feet of digital canvas. On the backside of the main video board, two outward-facing displays will each measure 15.5 feet high by 30 feet wide. Daktronics will also install three ribbon boards. (link)

Memphis drew an average of 6,827 fans through the turnstiles at home men’s basketball games this season, down from the 7,458 in actual attendance in 2022-23. Under the terms of the school’s FedExForum lease agreement, the Tigers would have received a maximum payment of $800K from the Grizzlies if turnstile-count attendance averaged 10K or more. Instead, the university will get a yet-to-be-determined partial payment, according to the Commercial Appeal’s Jason Munz. Memphis’ average announced attendance this season was 12,276, up from 11,444 last year. Munz also notes if average attendance is below 6,000, Memphis gets nothing from the Grizzlies. Since 2004, that has happened only once (in 2017-18, Tubby Smith's final season as coach). If the average turnstile count is below 6,000 for two consecutive seasons, the Grizzlies have the option to terminate the school’s lease. (link)
