The NAIA Council of Presidents unanimously approved a policy to require student-athletes to compete according to their assigned gender at birth. NAIA President/CEO Jim Carr says of the measure, which passed in a 20-0 vote: "We know there are a lot of different opinions out there. For us, we believed our first responsibility was to create fairness and competition in the NAIA. ... We also think it aligns with the reasons Title IX was created. You're allowed to have separate but equal opportunities for women to compete." Carr also tells CBS’ Dennis Dodd that student-athletes who are no longer eligible for women's competition could still participate in men's sports. “It's important to know that the male sports are open to anyone.” The policy doesn't apply to team activities like practices, exhibition games and scrimmages. St. Ambrose President/Council of Presidents Chair Amy Novak: “The task force spent nearly two years reviewing research, meeting with experts to better understand potential policy challenges, and obtaining feedback from multiple membership groups. With this policy, the NAIA has made its best effort to allow for the inclusion of transgender athletes in any way which does not impact the competitive fairness of women's sports. Our priority is to protect the integrity of women's athletics and allow them equal opportunity to succeed." (link)

Tulane Sports Law Director Gabe Feldman and Altius Sports Partners CEO Casey Schwab discuss private equity’s potential foray into college sports, and Schwab explains that “when you think about the collision of outside capital coming into a distressed industry that overspends because of what I just talked about – misaligned interests – and under commercializes, then it seems to me like there's going to come a breakpoint. And I think the breakpoint is going to come if and when – and I think it's a when…there is this rush to the super conference of football. And we know the SEC is there, we know the Big Ten for the most part is there, and then there's questions around the other conferences in terms of what do the broadcasters, the TV networks, what teams do they want to see on Saturday? If there is a consolidation of 40 or 50 teams, that means there’s going to be 50+ teams vying for, call it 20 seats, and at that moment in time there’s going to be desperation in a distressed industry.” Schwab goes on to posit that schools who are “at the adult table” when it comes to football will be less inclined to engage with PE “because you’re not going to be desperate.” But for those trying to get one of those seats, Schwab notes there are large financial hurdles facing them, including stadium upgrades, conference exit fees and player costs. “Those three are just three examples of where money is going to be needed to get to the adult table if you're any of the schools in the Big 12, any of the schools in the ACC and potentially some of the lower performers in the Big Ten and the SEC. … And if they look to private equity, there’s going to come a moment of, ‘We need to be okay with changing our north star a couple degrees towards for-profit interests.’” Lots more. Sportico’s Michael McCann explains how direct NIL payments would likely be the final nail in amateurism’s coffin, noting the “fundamental risk” is the “moment one of those payments is exposed as compensation to attend, or not later transfer from, a school. Such a payment wouldn’t be NIL, but instead pay-for-play—a payment the NCAA has long insisted is an anathema to the student-athlete model and a threat to amateurism. … Should the NCAA permit colleges to make direct NIL payments, the association better take compliance and enforcement seriously. If any so-called ‘NIL’ payments turn out to be pay-for-play and the NCAA is shown to have acquiesced, a court would be inclined to conclude the NCAA permits pay-for-play.” By itself, NIL “shouldn’t trigger employment recognition if the payments are really about the right of publicity. An athlete who signs an endorsement deal with a company doesn’t automatically become an employee of that company. … A college could adopt the same approach in paying to use an athlete’s NIL. While that structure would be different from the NCAA’s past practices, it would be consistent with the right of publicity.” (link)

Extra Points’ Matt Brown examines what the IRS’ recent denials of non-profit certification for new collectives means going forward and notes that the “letter of the law and the consensus interpretation of the law appear clear to me. Fundraising to give money to athletes, even if those athletes do charitable work, is not charity. College athletes are not a charitable class. If a collective wants to operate as a non-profit, then the majority of their money needs to directly benefit charitable organizations, not athletes. But a few large NIL collectives are making the bet that they can simply run out the clock on an overworked and unstaffed IRS. Worse case scenario, one or two collectives get sued, pay a modest penalty, and reclassify…years after the athletes they paid have completed their eligibility. Nobody is going to jail or anything for this. And the IRS can’t take away a championship trophy.” (link)

On3’s Pete Nakos notes the most valuable positions in the men’s basketball transfer portal are power forwards and centers. “For high-end talent at those positions, $1M deals are commonplace. Even top guards are making roughly half a million a year. Speaking with sources over the last week, On3's learned of a conference player of the year transfer earning $500K. Another guard is set to make $450K. … To put those dollars in perspective, quarterbacks are typically the highest-paid position in football.” Nebraska Football HC Matt Rhule in December noted that good QB in the portal costs $1M to $2M. However, shelling out that kind of money for a QB without also investing in the offensive line and other weapons around him is likely counterproductive, whereas in basketball one collective operator tells Nakos it “just doesn't take as many players…and one guy can truly change the game by himself, unlike football." Another collective exec says: “Supply and demand and the impact one player can have in their sport versus football. The price per player on average is close to double the football average.” (link)

Army West Point on April 15 will begin construction on the Michie Stadium Preservation Project. During the renovation period, the stadium’s capacity is expected to be capped at 30K, with plans to return to 36K once the East Stands open in 2026. Additionally, the Corps of Cadets will be seated temporarily in the north-end sections of Michie Stadium. When completed, the Michie Stadium Preservation Project will include a dedicated seating section for the Corps of Cadets in the East Stands spanning from end zone to end zone which will underscore the central role of cadets. Princeton’s Clarke Field (baseball) and Strubing Field (softball) will be replaced by the university’s new Quantum Institute for Quantum Science and Engineering. The Tigers’ new softball stadium is nearly complete, but plans for a new baseball stadium have yet to be released. Both teams will finish out their 2024 seasons at their current fields and begin preparations to move after the season concludes. (link)

Miami (FL) announces a partnership with OnBalance, a platform for measuring, managing and improving athletes’ mental healthcare. The Hurricanes will utilize OnBalance for “actionable intelligence and measurable progression metrics to help improve student-athletes’ mental health outcomes.” (link)

Silver Lake is likely to sell off certain segments of Endeavor’s business after it takes the company private. SBJ’s Chris Smith explains part of Endeavor President/COO Mark Shapiro’s contract “details a bonus structure related to the sale of Endeavor assets not considered vital to talent agency WME or TKO Group Holdings, the parent company of UFC and WWE. Shapiro will receive $20M for each of the first three tranches of $1B worth of Endeavor assets sold. He stands to make up to $100M in total asset sale bonuses.” As for which parts of the company could be sold, Smith notes that outside of WME and TKO, which appear to be off the table, the company’s events segment, which includes the operation of some ATP and WTA events, is its largest by revenue but least profitable by margin (10.5%), followed by the data and technology sector, which includes OpenBet and IMG Arena (13.3%). Following the game, Gamecocks HC Dawn Staley congratulated Iowa on its season and added: “I want to personally thank Caitlin Clark for lifting up our sport. She carried a heavy load for our sport, and it just is not going to stop here on the collegiate tour, but when she’s the No. 1 pick in the WNBA, she’s going to lift that league up as well. NCAA President Charlie Baker tells Howard Megdal of The Next that “our goal is to get [NCAA Women’s Basketball Tournament units] up for the next fiscal year, which would be 2024-25.” An NCAA spokesperson tells Sportico’s Dylan Manfre that Baker’s remarks were an expression of his confidence that the matter would be approved in a vote by the DI membership rather than a declaration that women’s basketball units are coming. (link); USA Today’s Lindsay Schnell asks Baker whether he envisions a future in which student-athletes would be compensated for March Madness, whether by the NCAA or their schools. Baker: “I’ve said since I got to the NCAA that we ought to make some changes to how support for student athletes works in Division I and we’ve done a number of things already to deal with that. But I’m not going to get ahead of the membership on this. I’m sure it’s a conversation we’ll be having going forward.” Baker also discusses the state of officiating and tells Schnell: “We’re chasing a big initiative around officiating generally. … One of the biggest is the treatment they receive from everywhere – from people at attendance at events, from people after attendance at events, on social media. That’s no secret to anybody, one of the great challenges everyone has in sports these days at the collegiate level is the beatdown that gets delivered on officials when they perform. That has a pretty big impact on whether people want to be in and stay in it. We have a lot of work to do there, but some of that work needs to come from a lot of the people around the game, which is unfortunate.” Full interview. (link)

News of the morning has multiple reports indicating Arkansas will hire Kentucky Men’s Basketball HC John Calipari for the same role in Fayetteville. Compensation for Calipari is expected to be in the $8M range with another $5M for NIL purposes. As of last night UK AD Mitch Barnhart had not heard from Calipari. No buyout would be due to the Wildcats. (link, link)

In another headlining hoops move, Tennessee selects Marshall Women’s Basketball HC Kim Caldwell for the same role in Knoxville. An introduction is slated for Tuesday. Vols AD Danny White: “Kim has a winning formula that she has successfully implemented everywhere she has coached, with a fast-paced, high-octane offense and pressure defense that has led to remarkable results. In this new era of college sports, it was vital that we found an innovative head coach with a strong track record of winning titles. We are eager to return the Lady Vols to a championship level, and we're confident that Kim Caldwell is the coach who can lead us back to the top." (link)

In the third and final installment of a sit-down with InsideNDSports, Notre Dame AD Pete Bevacqua says keeping the Fighting Irish relevant amid the changing landscape of the industry is among the top priorities: “And full credit, [former AD] Jack [Swarbrick] did a wonderful job with that. And that shows the relevance and the value and the unique power of Notre Dame. To maintain that independence in football, to be a key part of the ACC in all of our other sports with the exception of hockey. But to have that voice in intercollegiate sports — whether you’re interacting with the NCAA or colleagues at the ACC or have a seat at that very important table at the CFP, to have that voice in Washington when you’re talking to Congress about NIL and the importance of the student-athlete experience. If I look back over the course of the eight months – and Jack and I have such a great partnership and such a great friendship and he’s impressed me in so many ways – I’d say where he’s impressed me the most is in his dealing with Washington.” Bevacqua says that “without sounding naive or Pollyanna, I believe in my heart that most of the people that are involved in college sports, most of the people that are going to be involved in making decisions that impact college sports — whether that’s the NCAA or Congress, conferences, conference commissioners, university presidents — understand that there’s something really important about being a student-athlete. And we have to maintain that term. … The main goal of Notre Dame is that we are going to absolutely do everything we can to maintain the student-athlete experience on our campus and simultaneously compete at the highest level and compete to win national championships. And we firmly believe we can do both.” (link)

Former Montana/Oregon/Washington State/Nebraska AD Bill Moos says if college athletics existed in 1982 as it did today, “I wouldn’t have gotten into it.” Moos asserts that conference realignment, paying players and other issues facing the industry are “against everything I believe college athletics should be about.” Moos also notes he “loved [former WSU President] Elson Floyd because he was a big thinker. If you wanted to get on his bad side, say you can’t do something. He never made me feel like I worked for him.” But he recalls telling Floyd: “We have some challenges – big, costly challenges. And, you have to have my back. We have to do it now.” The Spokesman-Review’s Thomas Clouse notes “by 2012, WSU moved forward on $165M worth of upgrades to football-only facilities. More spending upgraded the baseball clubhouse, training facilities, practice facilities for men’s and women’s basketball, and a new soccer complex.” Moos: “That arms race of it, I was in the middle of it. I’m probably the poster boy.” The Cougars have been grappling with revenue problems since then, and Moos admits: “There was debt service that I will take full responsibility there. But, it was money well spent. To get our facilities up to par and to hire a coach like Mike Leach. Look what came of it.” Moos tells Clouse that he sat down with a group of ADs 15 years ago and assigned values for all the benefits student-athletes received, including room and board, books, tuition, three meals a day, personal trainers and access to facilities. “In the Pac-12 that year, it was about $200K a year. That’s pretty good for a 19-year-old.” (link)

Rhode Island AD Thorr Bjorn joins Playfly’s On the Fly podcast and credits the three presidents for whom he’s worked with contributing to his longevity in the role. “You’re really at the mercy a lot of times with presidents you’re working for…and I’ve been very lucky to receive the support I’ve had from all three. And I certainly hope that I can finish my career here at the University of Rhode Island.” Bjorn acknowledges that NIL is “not going away” and says URI will continue to embrace it. While he was always on board with student-athletes earning money via their NIL, Bjorn admits he struggled with it morphing into a collective-driven model rather than the “types of entrepreneurial stuff” but adds: “When I think about where NIL is or what it needs to be if we're going to do all those things that I mentioned earlier in our conversation about making sure that the basketball coach, the basketball players, the team, feel supported and want to be here, we have to make sure that we do that. We've made this a priority and we’ve really put our best foot forward in terms of our NIL opportunities.” Looking at the future from a conference perspective, Bjorn explains no one is asking fellow Atlantic 10 members to invest in certain sports across the board, but “what we are all telling each other is we need to be really good at basketball. … There’s been a lot of schools within that league, and as we look to ever expand, if we lose a team and ask who are we going to tap to take a spot, it's always done very strategically. You look at Loyola Chicago, our most recent addition, certainly coming off of two great basketball runs. They’re basketball-centric.” Full pod. (link)

The recently adopted College Football Playoff revenue distribution model has “cast the Big 12 and the ACC as necessary partners, the strangest of bedfellows,” according to The Mercury News’ Jon Wilner, who cites numerous differences between the two leagues, including: “Were the SEC and Big Ten to hold an expansion draft, the top four picks would come from the ACC: North Carolina would be the first off the board…followed by some combination of Virginia, Florida State and Clemson. Heck, Miami might even give the ACC a clean sweep of the top five selections. In that regard, the revenue distribution within the CFP’s new contract doesn’t reflect the competitive stature of the two leagues.” Wilner notes that based on new conference configurations, the ACC has had seven teams reach the CFP compared to the Big 12’s two (the SEC and Big Ten had 17 and 12, respectively). That said, Wilner points out this could all change, as “multiple sources with knowledge of the CFP’s agreement with ESPN” tell him there is a series of “openers” that allow for changes in the early years of the contract cycle. One of those openers shifts the revenue shares if a particular conference outperforms its baseline participation figure. Additionally, if the “most valuable football brands depart the ACC, a new playoff structure could arise. And it’s not difficult to envision several schools seeking refuge in the Big 12, prompting the strangest of bedfellows to join together in unholy matrimony.” (link)

Dan Furman, president of the Louisville-focused 502Circle, tells WDRB’s Eric Crawford 850 people have contributed to the collective in the past seven days. “And as NIL continues to grow, I think that’s the future, the sustainability of this. I’m a fundraiser. After my time in the Cardinal Athletic Fund and my time here in Louisville, spending a lot of that time as a fundraiser, you see those challenges and how hard it is to get donors and individuals to be able to support year in and year out. That's a major challenge across the country. So, for us to be able to step up in this way and provide as many new memberships as we have, so many new independent one-time donations, I think it just gives us an incredible boost that we can try and create some sustainability.” Furman says the collective has received questions from other collectives around the country who would seek to duplicate 502Circle’s success and notes that’s part of a give-and-take effort within the space. “There’s a lot of really highly qualified, really talented people that are running collectives across the country. For us, that’s an unbelievable resource and we've been able to connect with those peers through The Collective Association and find ways to pick their brain on ways that we can get better. And they do the same with us. We love that camaraderie about it, and our coaches ask those questions. ‘Hey, what's that school doing?’ Or ‘Hey, how are they doing this?’ And I love that because that means our coaches are paying attention and understanding this ever-evolving landscape of NIL.” More from Furman. The SEC reversed several of the suspensions issued following Saturday’s Mississippi State-Georgia baseball imbroglio. Those who remained suspended for Sunday’s game included MSU’s Johnny Long and Logan Kohler and UGA’s Henry Hunter, Fernando Gonzalez and Daniel Padysak.
