UConn Men’s Basketball goes back-to-back in convincing fashion as its second half surge over Purdue led to another double-digit victory, its 12th in as many games over the last two tourneys. Huskies HC Dan Hurley: “Obviously it's a special run. Yeah, I mean, s***, we're going to try to replicate it again. We're going to maintain a championship culture. We're bringing in some very talented high school freshmen. Our returning players, through player development, will take a big jump. We'll strategically add through the portal. NCAA President Charlie Baker in a meeting with media members ahead of last night’s men’s hoops national championship again brought up the danger of prop bets: “Did any of you notice how much time was spent on cable TV about Caitlin Clark’s prop performance (after the) first (national semifinals) game leading into the second game? Was that really what we should be talking about in the middle of a women’s Final Four? I think the answer for that for most people is no. … The prop-betting piece is enormously problematic for student-athletes and I’ve had a lot of them say that to me.” Baker also noted the NCAA continues to work on a consumer protection package to help student-athletes and their families better understand the NIL market. Part of that package includes a deal database, which Baker explains isn’t meant to be used for individualized data on specific deals as much as a general income scale. The NCAA is also creating a platform that Baker said is similar to Yelp that will give families a way to discuss NIL third parties and their trustworthiness. “I think this is the first step on our part to try and make sure that all the players in this space get held accountable and we do more to provide more transparency.” (link, link)

The Athletic’s Nicole Auerbach reports the DI Council can “adopt emergency legislation for a new transfer eligibility rule at its April 17-18 meeting. Proposed legislation would allow all undergraduate athletes to transfer and play immediately as long as they meet specific academic requirements.” The legislation states there is no limit on the number of times a student-athlete can transfer, and Auerbach notes transfer windows would still exist in the new system. “You still can’t transfer mid-year and play for a second school in the same athletic season. This new NCAA transfer rule proposal comes four months after a West Virginia judge issued a TRO that was converted into a preliminary injunction to stop the NCAA from enforcing its rule barring athletes from transferring multiple times and playing right away.” (link); Yahoo’s Ross Dellenger adds: “As a result of litigation around transfers, the Council can adopt legislation to permit athletes to transfer and play immediately if they meet academic requirements. This was expected. Within the transfer agenda item, the Council is also expected to review creating a separate concept to APR called ‘Transfer APR’ that tracks transfer academic progress as well as a ‘Graduation Passport.’” (link)

Sunday’s women’s hoops South Carolina-Iowa national championship delivered an average of 18.7M viewers to ABC. The game peaked at 24.7M and represents an 89% YoY increase and a 285% increase over 2022. The Athletic’s Richard Deitsch shares some perspective, noting the game topped every World Series game since Game 7 of the 2019 World Series, every NBA Finals game since Game 5 of the 2017 NBA Finals, every Daytona 500 since 2006, every Masters final round viewership since 2001, and all but four college football games in 2023. (link, link); According to Front Office Sports, the game drew a larger audience than any of last year’s non-NFL sporting events except Michigan’s football victory over Ohio State, which averaged 19M. Women’s Sports Network President Carol Stiff, who previously served as VP of Programming and Acquisitions at ESPN, tells Puck’s John Ourand that continued advertiser support is needed to maintain the momentum of women’s hoops. “We need investors to come in and demand better windows for exposure. Until that happens, I fear that it could fall back. But I think the pressure is on now.” Ourand notes that advertisers are spending more on women’s sports this year, “yet Stiff told me about meetings where clients admitted that they didn’t have any sort of tangible strategy, even if they felt aligned with a sport centered on the notion of scholar athletes—female basketball players, after all, don’t usually leave school early for the pros, seldom employ the transfer portal, and haven’t fully exploited the opportunities afforded by NIL.” Stiff: “I kept hearing that this season was just a blip, and the women’s game is going to go south, back to where it was. I don’t think it is. You could feel the momentum.” (link)

Athletes.org Founder Jim Cavale during an NABC panel in Phoenix talked about how little discussion there is about the potential end of amateurism: “It’s interesting how much liability is referenced by college athletics leaders when you bring up topics like employment or unemployment, and you bring up topics like revenue sharing, and you bring up topics like athletes organizing. There’s a lot of sensitivity in public forums, especially by college athletics leaders, because of the ‘risk’ they have in talking about these things and how even things they say in a private conversation could be used in a deposition.” Front Office Sports’ Amanda Christovich: “In other words, general counsels at universities have warned athletic departments against saying anything about enhanced athlete compensation, employment, or unionization, because those comments could be used against them in one of many ongoing legal battles threatening amateurism.” While that risk is real, Cavale asserts the bigger risk is “not figuring out the future.” (link)

More from Cavale as he hosts TCU women’s basketball student-athlete Sedona Prince on his Now It’s Legal podcast and talks about her role as a plaintiff in the House v. NCAA lawsuit. “When I transferred from the University of Texas (to Oregon), I got an injury and I transferred for health and safety reasons and just felt like there was a lot of malpractice at my university. And I didn't feel like I’d been treated as I should have been as a student-athlete. I felt very, very upset about it, and so as I said, transferred, I didn't get to play again – the NCAA ruled me ineligible – and so more of that anger, I was just like, ‘Man, all these adults around me, they're supposed to take care of me…and it's so unfair and this is not how it should be.’ And so my mom had the opportunity she reached out to one of the people in the College Players Association connected with us and he said, ‘Hey, would you like to be a plaintiff in this House v. NCAA lawsuit?’ I had no idea about what is NIL, what does it even mean? But I’ve already been taken advantage of so much that I'm upset at the NCAA, [so I said] absolutely, sign me up.” Prince says she “constantly get[s] documents seized and I’m giving them my own information into NIL and what my deals look like. … And then I had a deposition with the NCAA, sat in front of them for seven hours straight, in front of four NCAA lawyers and was deposed and asked about NIL and my thoughts and everything, which was a crazy experience.” Full podcast. Harvard AD Erin McDermott acknowledges the lack of an NIL collective may have a negative impact on recruiting but says she is willing to accept that rather than “compromise” athletics and academics. “If it means we end up with, I don’t know, a couple less recruits over a period of time that might have come but now they won’t, I’m willing to take that risk.” Overall, McDermott hasn’t observed NIL playing a major role in the Ivy League so far: “I think it’s kind of early to call it doomsday, for sure.” McDermott also addresses the possibility of a team forming a union and says: “If a team were to come forward with that interest, I think we would certainly allow for it.” However, she hopes players view their involvement in athletics at Harvard as something they “love to do” and adds: “I would hope that they don’t view it like a job.” (link)

Illinois State Interim AD Jeri Beggs encourages fans to donate to the Empower the Nest collective: “If our athletic programs want to remain competitive, we need support for NIL funds. The days of a school's name being enough to land a recruit are long gone. I know NIL may be new and different to many of you, but it isn't going away and we need to attack this head on! I know you want to see the Redbirds compete for championships and showcase Illinois State University on a national stage. … We are determined to adapt to changes in the collegiate landscape and NIL must be a priority for us to be competitive.” (link)

Following the NAIA’s announcement “effectively banning transgender athletes for all women’s sports other than for two co-ed sports, competitive cheer and competitive dance,” Sportico’s Michael McCann and Daniel Libit note that “an athlete at an NAIA school whose eligibility to play a sport—and potentially their eligibility for an athletic scholarship—has been lost on account of the new rule could sue the NAIA. The athlete would likely seek a restraining order that would permit them to play and argue their exclusion violates constitutional safeguards for equal protection and due process.” While the U.S. Supreme Court has yet to weigh in on transgender athletes’ eligibility, “in Bostock v. Clayton County (2021), the Court interpreted Title VII of the Civil Rights Act of 1964 to prohibit employment-related discrimination based on sexual orientation and sexual identity.” An NAIA spokesperson tells Sportico: “The NAIA understands that legal action being taken to challenge the policy is a possibility. [B]ut this policy is one our membership and board felt like was the right decision.” (link)

Central Michigan launches the Maroon & Gold BOLD campaign, which seeks to raise $25M over five years. Funds will be focused on supporting three areas: student-athlete experience, fan experience and being performance leaders in the MAC. Chippewas AD Amy Folan: "This campaign pulls us together to fuel a future that serves today's student-athletes, while positioning the university to continue its history of excellence in the MAC. It will create an energy that unifies us all in support of our teams and Central Michigan University as a whole. … We must continuously improve the quality of academic and athletic opportunities for our student-athletes, increase fan engagement to serve our 245,000 alumni worldwide and to expand the resources that promote athletic excellence within the MAC.” (link)

Richmond city officials want to issue general obligation bonds backed by the city to fund a new MiLB stadium and future home of VCU baseball at the Diamond District. Doing so would cut costs by $200M; however, if the project fails to generate the expected revenue, the city would have to pay off the debt. Richmond Chief Administrative Officer Lincoln Saunders: "We think the risk is low because of the strength of the market and the strength of the Squirrels.” With a lower interest rate on the general obligation bonds, the cost of the stadium will total roughly $280M, compared to about $500M under the old plan. The NAIA Council of Presidents unanimously approved a policy to require student-athletes to compete according to their assigned gender at birth. NAIA President/CEO Jim Carr says of the measure, which passed in a 20-0 vote: "We know there are a lot of different opinions out there. For us, we believed our first responsibility was to create fairness and competition in the NAIA. ... We also think it aligns with the reasons Title IX was created. You're allowed to have separate but equal opportunities for women to compete." Carr also tells CBS’ Dennis Dodd that student-athletes who are no longer eligible for women's competition could still participate in men's sports. “It's important to know that the male sports are open to anyone.” The policy doesn't apply to team activities like practices, exhibition games and scrimmages. St. Ambrose President/Council of Presidents Chair Amy Novak: “The task force spent nearly two years reviewing research, meeting with experts to better understand potential policy challenges, and obtaining feedback from multiple membership groups. With this policy, the NAIA has made its best effort to allow for the inclusion of transgender athletes in any way which does not impact the competitive fairness of women's sports. Our priority is to protect the integrity of women's athletics and allow them equal opportunity to succeed." (link)

Tulane Sports Law Director Gabe Feldman and Altius Sports Partners CEO Casey Schwab discuss private equity’s potential foray into college sports, and Schwab explains that “when you think about the collision of outside capital coming into a distressed industry that overspends because of what I just talked about – misaligned interests – and under commercializes, then it seems to me like there's going to come a breakpoint. And I think the breakpoint is going to come if and when – and I think it's a when…there is this rush to the super conference of football. And we know the SEC is there, we know the Big Ten for the most part is there, and then there's questions around the other conferences in terms of what do the broadcasters, the TV networks, what teams do they want to see on Saturday? If there is a consolidation of 40 or 50 teams, that means there’s going to be 50+ teams vying for, call it 20 seats, and at that moment in time there’s going to be desperation in a distressed industry.” Schwab goes on to posit that schools who are “at the adult table” when it comes to football will be less inclined to engage with PE “because you’re not going to be desperate.” But for those trying to get one of those seats, Schwab notes there are large financial hurdles facing them, including stadium upgrades, conference exit fees and player costs. “Those three are just three examples of where money is going to be needed to get to the adult table if you're any of the schools in the Big 12, any of the schools in the ACC and potentially some of the lower performers in the Big Ten and the SEC. … And if they look to private equity, there’s going to come a moment of, ‘We need to be okay with changing our north star a couple degrees towards for-profit interests.’” Lots more. Sportico’s Michael McCann explains how direct NIL payments would likely be the final nail in amateurism’s coffin, noting the “fundamental risk” is the “moment one of those payments is exposed as compensation to attend, or not later transfer from, a school. Such a payment wouldn’t be NIL, but instead pay-for-play—a payment the NCAA has long insisted is an anathema to the student-athlete model and a threat to amateurism. … Should the NCAA permit colleges to make direct NIL payments, the association better take compliance and enforcement seriously. If any so-called ‘NIL’ payments turn out to be pay-for-play and the NCAA is shown to have acquiesced, a court would be inclined to conclude the NCAA permits pay-for-play.” By itself, NIL “shouldn’t trigger employment recognition if the payments are really about the right of publicity. An athlete who signs an endorsement deal with a company doesn’t automatically become an employee of that company. … A college could adopt the same approach in paying to use an athlete’s NIL. While that structure would be different from the NCAA’s past practices, it would be consistent with the right of publicity.” (link)

Extra Points’ Matt Brown examines what the IRS’ recent denials of non-profit certification for new collectives means going forward and notes that the “letter of the law and the consensus interpretation of the law appear clear to me. Fundraising to give money to athletes, even if those athletes do charitable work, is not charity. College athletes are not a charitable class. If a collective wants to operate as a non-profit, then the majority of their money needs to directly benefit charitable organizations, not athletes. But a few large NIL collectives are making the bet that they can simply run out the clock on an overworked and unstaffed IRS. Worse case scenario, one or two collectives get sued, pay a modest penalty, and reclassify…years after the athletes they paid have completed their eligibility. Nobody is going to jail or anything for this. And the IRS can’t take away a championship trophy.” (link)

On3’s Pete Nakos notes the most valuable positions in the men’s basketball transfer portal are power forwards and centers. “For high-end talent at those positions, $1M deals are commonplace. Even top guards are making roughly half a million a year. Speaking with sources over the last week, On3's learned of a conference player of the year transfer earning $500K. Another guard is set to make $450K. … To put those dollars in perspective, quarterbacks are typically the highest-paid position in football.” Nebraska Football HC Matt Rhule in December noted that good QB in the portal costs $1M to $2M. However, shelling out that kind of money for a QB without also investing in the offensive line and other weapons around him is likely counterproductive, whereas in basketball one collective operator tells Nakos it “just doesn't take as many players…and one guy can truly change the game by himself, unlike football." Another collective exec says: “Supply and demand and the impact one player can have in their sport versus football. The price per player on average is close to double the football average.” (link)

Army West Point on April 15 will begin construction on the Michie Stadium Preservation Project. During the renovation period, the stadium’s capacity is expected to be capped at 30K, with plans to return to 36K once the East Stands open in 2026. Additionally, the Corps of Cadets will be seated temporarily in the north-end sections of Michie Stadium. When completed, the Michie Stadium Preservation Project will include a dedicated seating section for the Corps of Cadets in the East Stands spanning from end zone to end zone which will underscore the central role of cadets. Princeton’s Clarke Field (baseball) and Strubing Field (softball) will be replaced by the university’s new Quantum Institute for Quantum Science and Engineering. The Tigers’ new softball stadium is nearly complete, but plans for a new baseball stadium have yet to be released. Both teams will finish out their 2024 seasons at their current fields and begin preparations to move after the season concludes. (link)

Miami (FL) announces a partnership with OnBalance, a platform for measuring, managing and improving athletes’ mental healthcare. The Hurricanes will utilize OnBalance for “actionable intelligence and measurable progression metrics to help improve student-athletes’ mental health outcomes.” (link)

Silver Lake is likely to sell off certain segments of Endeavor’s business after it takes the company private. SBJ’s Chris Smith explains part of Endeavor President/COO Mark Shapiro’s contract “details a bonus structure related to the sale of Endeavor assets not considered vital to talent agency WME or TKO Group Holdings, the parent company of UFC and WWE. Shapiro will receive $20M for each of the first three tranches of $1B worth of Endeavor assets sold. He stands to make up to $100M in total asset sale bonuses.” As for which parts of the company could be sold, Smith notes that outside of WME and TKO, which appear to be off the table, the company’s events segment, which includes the operation of some ATP and WTA events, is its largest by revenue but least profitable by margin (10.5%), followed by the data and technology sector, which includes OpenBet and IMG Arena (13.3%).
