Puck’s John Ourand argues the NCAA’s new media rights partnership with ESPN remains a good deal despite some who question otherwise. Ourand notes the “question is whether the NCAA would have brought in more money by pulling out women’s basketball and then selling the other NCAA championships á la carte. But I’m told by executives who study this market that, economically, the difference was negligible. Other networks—Warner Bros. Discovery, NBC, et al.—were interested in various parts of the package, but the money wasn’t big enough to justify splitting it up.” Sports media, Ourand continues, is a “relationships business, and the NCAA was probably wise not to get too cute with ESPN. The network, after all, has extraordinary leverage to elevate women’s sports and has already proven itself to be a great collaborator. ESPN provided a ton of promotion for this year’s tournament; produced its studio show from the Final Four; and it carried the championship game on broadcast television—all things the NCAA has pushed the network on.” (link)

Sports law experts at the American Bar Association's spring antitrust meeting this week suggested the NCAA will have to weather the current wave of antitrust litigation. In fact, Morrison Foerster LLP Megan Gerking, whose experience includes time as a trial attorney with the DOJ Antitrust Division, believes the “NCAA as we know it is probably dead. Through the litigation that's pending in the courts, we'll see a different system." Meanwhile, current DOJ antitrust attorney Jack Congdon says a super league for football and basketball that sets its own compensation rules could still fail to pass antitrust muster. "It depends on market realities. In the future, you could imagine a world in which a conference does have market power, and you can imagine a world in which it doesn't." Baker Botts LLP partner/former Penn State football student-athlete Christopher Wilson explained that at one point he earned a $5K academic scholarship as part of an honors program but was told that his athletic scholarship would need to be lowered by the same amount, pursuant to NCAA rules. “I’m like, I need food. This makes no sense.” While that policy was struck down in Alston, Wilson noted: “We're now seeing that the NCAA and the conferences are…purely market entities [despite still being set up as a not-for-profit]. And the Supreme Court hasn't said [in Alston] that, if you are focused on these market realities, then you can exclusively restrict the athlete flow in a manner that doesn't affect the outcome." Viewership for the NCAA Men’s Hockey Tournament regional semifinals averaged 77K viewers across six games on ESPN platforms, up 20% YoY. Meanwhile, the regional finals averaged 243K viewers, a 39% uptick over last year. The Michigan-Michigan State regional final was the most-watched pre-Frozen Four game ever on ESPN networks, averaging 569K viewers. Overall, ESPN+ viewership for the tournament is up 25% YoY. (link)

UMass Boston professor Allison Smith pens an article in AthleticDirectorU about the increasing popularity of women’s college hoops and notes the “Sport Innovation Lab found that the highest percentage of fluid fans are in the women’s sports market. Fluid fans are marked by attitudes that are ‘open to change, empowered to choose, and continuously evolving—moving from one form of entertainment to another.’ Particularly, women’s sports fans have engaged on digital and social platforms as historically they have had less options to watch women’s sports in traditional linear models and on widely available platforms (i.e., ABC, CBS, ESPN). Until 2022, women’s sports only made up 4% of sport media coverage but saw a jump to 15% in 2023, with a prediction of 20% of sport media coverage by 2025. Further research by the Sport Innovation Lab found that members of the women’s sports community are retained at a higher rate than general sports fans and they also reward brands that invest in women’s sports with their purchasing patterns.” As such, Smith posits it would “behoove the NCAA, member institutions, and media conglomerates to continue to identify fan behaviors that create opportunities to develop new revenue streams through highlighting women’s college basketball’s unique storytelling and fans' continued desire to attend high-caliber games.” (link)

NBA Commissioner Adam Silver believes the WNBA and NBA are better off selling their media rights together, citing the year-round nature of their combined schedules, the NBA’s expertise in promoting basketball, and the two leagues’ shared investment in technology to improve fan engagement. Silver’s remarks come amid speculation that, with the sport’s growth and the anticipated debut of Caitlin Clark, it may make sense for the WNBA to negotiate a separate deal. Silver acknowledges the “interest is heightened from where it used to be and that’s wonderful to see” and notes there could be “unique channels,” like a network dedicated specifically to women’s sports, that could make sense for a piece of the WNBA’s rights. “At the end of the day it’s the [same] game. To the extent that we come up with ways to better present the game…in a way that makes it even that much more enticing to fans, there’s real opportunities to scale there when you put the NBA and the WNBA together.” (link)

AFAAC (Air Force Academy Athletic Corporation) CEO Dr. Nancy Hixon sits down with AthleticDirectorU’s Tai M. Brown at PACnet 2024 to discuss the unique culture and challenges at Air Force, including the key differences between running a fundraising and development arm within a military institution versus leading an external operations unit at other Division I colleges and universities. Hixon reflects on the evolution of the AFAAC in terms of team-building, onboarding and talent acquisition and retention as well as the progress it has made in generating resources and momentum for the Academy. Despite the inherent differences between AFAAC and other collegiate athletic departments, Hixon says there is a lot of crossover. “At the end of the day, it’s the external side of the house. There are some uniquely different pieces of how we speak funding-wise with the government, and our left and right lanes of what is allowed and what is not allowed. So there's a big learning curve and I've been at Air Force for a good number of years now, and feel that I kind of think I know what I'm doing on a day-to-day basis. Illinois has closed its internal investigation into a sexual assault allegation against men’s basketball student-athlete Terrence Shannon Jr. According to UI Office for Student Conflict Resolution Director Robert Wilczynski, the school had insufficient evidence to find Shannon had violated the student code of conduct. Wilczynski noted that the school's investigator did not have "access to the complainant, the complainant's witness" and that "the complete Lawrence Police Department file was not available to the investigator.” Additionally, he noted the investigation may be reopened if substantial evidence is brought to the office’s attention. Shannon has consequently withdrawn his lawsuit against the university. (link)

Following reports that Washington football student-athlete Tybo Rogers was reinstated to the team after his initial suspension have led to questions about UW’s handling of the situation. Seattle police were first contacted on October 28 about an alleged attack that occurred five days earlier and, according to the Tuscaloosa News, “emails were sent within the University of Washington athletics department that Rogers should be taken off the travel roster for the conference championship game, the detective [investigating the case] wrote. The emails didn't specify why, though. The first victim reported the assault to the University of Washington Title IX office on Nov. 28, 2023, per the probable cause statement.” Rogers was however reinstated before the College Football Playoff and when asked about his status, former Huskies OC Ryan Grubb replied: “We're working through some things. Some challenges he had off the field. I can't comment on what it was exactly. … There are some things a little bit out of his control he is trying to work through, and we're trying to work with him." Meanwhile, Alabama HC Kalen DeBoer has since released the following statement: “While I am not able to comment specifically on the situation involving an individual at my former institution because of federal privacy laws and the ongoing criminal matters, I do want to make it clear that I take any allegation of sexual misconduct very seriously. I always have and always will follow established institutional policies and procedures to ensure prompt reporting and proper handling of allegations by the appropriate authorities.” (link)

The AAC held an introductory press conference for incoming Commissioner Tim Pernetti today, during which Pernetti said: “We're going to build on the foundation and the true mission and really the purity of collegiate athletics. We're going to elevate the enterprise – like, get ready, we're going to take some big swings – and we'll innovate and lead in the future. This conference has an opportunity to break new ground. We're going to be proactive. We're going to be disruptive. And we’ll maximize every opportunity that's in front of us, whether it be capitalizing on relationships in private equity, innovative naming rights, creative corporate partnerships, conference-wide NIL resources, maverick postseason models. We're going to turn the conference room at the office into a literal shark tank of fun. Nothing will be off the table. Pernetti also explains: “It’s accretive for our entire industry to move forward together instead of some at the cost of others, and I think that's where we're starting to move, which will be a huge challenge for our conference, but I think we're uniquely positioned in between all that's going on in the hierarchy. You won't hear ‘Power 5’ and ‘Group of 5,’ you're not going to hear those words out of my mouth because, just in general, I think that where we're headed as an industry should refocus itself on what we're actually trying to do rather than just the bottom line.” Full presser. All three games for this weekend’s Men’s Frozen Four in Minneapolis are sold out with resale tickets seeking tickets as much as $10,781, according to Sportico’s Brendan Coffey, who notes regular season attendance for the 64 DI schools eclipsed 3.95M this year, an increase of more than 400K from 2022-23. “More schools are filling more seats too, with attendance hitting 77% of capacity nationally, up from 71% last year.” The sport is experiencing higher TV viewership as well, as Coffey notes this year’s regional finals averaged 254K viewers across all games, up 50% from last year. Last year’s final between Quinnipiac and Minnesota drew 808K on ESPN, double the previous year’s viewership. Coffey: “The apparent uptick in attendance and ratings can probably be credited to the high level of hockey being played at the collegiate level today. Unlike the 1990s and earlier, when NHL prospects would usually go right to the junior leagues to develop their game, college hockey is now packed with NHL talent—at least at the elite levels the teams in this year’s Frozen Four play.” (link)

Iowa recently hosted a panel discussion on whether student-athletes should be considered employees, during which Pepperdine FAR Alicia Jessop asserted any talk of collateral damage with such a decision is “fear-mongering,” adding: “The NCAA continues to unsuccessfully and to the tune of millions of dollars in lobbying fees try to persuade Congress to grant it antitrust immunity. The likelihood of Congress passing such bills is as good as Caitlin Clark not being the No. 1 overall WNBA draft pick.” Husch Blackwell attorney Jason Montgomery disagreed: “It’s clear that the NCAA is on the worst losing streak in sports since the Bills’ four Super Bowl losses. They are terrible at litigating. But current and well-established law in this country says that college athletes are not employees. The Department of Labor says they’re not employees. No federal court has ever said they’re an employee.” To support her point, Jessop argued that any attempt to trim Olympic sports is an excuse, noting that most DI coaches averaged a 15.3% pay increase in 2021, even after the pandemic wreaked havoc on athletic department budgets. She also pointed out that Ohio State in FY23 spent more than $90.7M on coaches and staff salaries while paying $23.8M for athletic scholarships. “Don’t buy that there is no money in the system. This will require the reallocation of funds. Top college coaches will see pay reductions, strength trainers will no longer earn $1 million per year.” Meanwhile, Montgomery contended that college sports’ popularity is at an all-time high, so changing it “makes very little business sense and it makes very little practical sense.” (link)

Kansas has selected Oak View Group to operate the Gateway District, including the renovated David Booth Kansas Memorial Stadium, and serve as food and beverage provider for all KU athletic venues. OVG will oversee not only the football stadium, but also the attached conference center and will lead booking efforts for conferences, special events, and concerts, while operating a membership-only dining club within the stadium. The Athletic’s Antonio Morales unpacks the unique challenges associated with quarterbacks and the transfer portal and observes that “development often takes a back seat as coaches and players seek instant gratification, and mapping out the future for the position at a school — on both ends of the college football food chain — is nearly impossible.” USC HC Lincoln Riley says it’s “like this constant chess game with everybody trying to figure out what’s the next move and what’s going to be best for everyone.” He also says the state of QB development is “probably not as healthy in the last several years with all the recent developments,” but he acknowledges the blame is shared equally among coaches and players. “You’ve given both these coaches and players another tactic to use and both are. … Some of that comes from, at times, unrealistic expectations of those that aren’t within the walls where people feel like they just have to do something drastic to meet those expectations. But I understand the temptation behind it, especially with that position. There’s so many options and possibilities out there now, I think for everybody, sometimes it’s hard not to take a look across the fence and wonder if it’s better on the other side.” Arizona State HC Kenny Dillingham believes the portal is and will continue to lead to more talented QBs across the country than ever before, and private QB coach Danny Hernandez, whose clients have included Mac Jones and Bryce Young, explains that when Power 5 starting spots are spoken for, “guess what? These Group of 5 schools now are going to end up benefiting from that.” (link)

On3’s Eric Prisbell points out that NIL is creating a new cohort of young, wealthy individuals who may find it increasingly difficult to become insured. Burns & Wilcox SVP Bill Gatewood talks about a scenario in which a star QB, for instance, rear-ends another driver. “If you get rear-ended by the quarterback now, you think you won the lottery. You’re going to lawyer up. You’re going to sue that kid for everything you can. As opposed to some other senior who is driving a 12-year-old pickup truck rear-ending you – and you’re just kind of pissed off that you have the aggravation of it, you exchange numbers and everybody goes about their business. Athletes are always targets for lawsuits. It’s just being pushed even younger. It’s a fascinating thing to see what all this NIL money and exposure are going to do.” Gatewood, whose firm works with agents and brokers who work with college and pro athletes, goes on to note: “Go back three or four years ago, insurance carriers didn’t want to write rookie professional [athletes] because they’re really young and for the first time, they just got handed a mountain of money. Are they going to go down the road of getting into fights and car accidents? … Or are they going to turn out to be pretty decent human beings?” Burns & Wilcox VP Heather Posner adds: “I’m worried that the way folks are going to learn is going to be through example. Somebody’s going to have this really lucrative contract. They’re going to get into that car accident, and they’re not going to have the right amount of liability insurance. During its spring football game, UCF will wear helmet decals designed by pediatric patients at Orlando Health Arnold Palmer Hospital for Children. The decals were designed in collaboration with UCF student-athletes who visited the hospital, including DT Lee Hunter, who says: “I’ve never experienced anything like that. It touched my heart and made me get closer to my baby girl, my daughter. Giving back is important because many people are not as fortunate or able to make it on their own. It’s very important for me because you never know what someone’s gone through. Growing up, I had struggles so I know what it’s like. If someone offers you something, it means they care about you. It’s important for me to show that somebody cares.” Hunter’s defensive line will feature black helmets with a purple and yellow Knight head decal, and the other units will feature various multicolored decals, including a Citronaut with red, green and yellow, according to the Orlando Sentinel’s Matt Murschel.
