Duke AD Nina King and North Carolina AD Bubba Cunningham join the Beyond the Curve podcast with former U.S. Senator Richard Burr (R-NC) to discuss the future of NIL. Asked where the industry started to lose its grasp on the direction of NIL, King remarks: “I'm not quite sure you can pinpoint exactly, but I would say we didn't move forward fast enough…and we've been so reactive for so long that trying to play catchup and then really innovate and move forward has been a challenge.” Cunningham agrees and adds: “It’s not necessarily the growth of the commercial activity that's the problem, it’s the use of the money – the skyrocketing salaries and the great facilities that we've built. It really has created a big disproportion between the educational value that the students are receiving and the salaries associated with coaching the same position. I do think that the commercial activity has grown exponentially in the last 10 to 15 years and the disparity between the value of a scholarship for students and the salary for the coach has just gotten so extraordinary that it drove us to this position.” Both King and Cunningham caution that revenue-sharing could put women’s sports and Olympic sports at risk, but Cunningham acknowledges that “I also feel like crying wolf that we said for 50 years we can't afford to do this and the money continues to rise. So, I think we are at a point now where if we are truly revenue-sharing like pro sports do, I think we're going to be challenged. … This is the gray area that we're going to need either guidance from the federal government, guidance from the Department of Education, tax advice – we're not sure where NIL’s going to fit into an educational environment.” Lots more in the full podcast. Kennyhertz Perry attorney Mit Winter says the vast majority of power conference schools have at least engaged in internal discussions about how they will operate their athletic programs under an employment model, and Winter asserts that preparing for such a paradigm shift is not only wise, it’s necessary. He tells On3’s Eric Prisbell: "It would be akin to athletic director/president malpractice to not at least be doing this. With respect to actually spending time seriously modeling it out, that number is not as large. I'd say less than half. But I think it would be smart to start spending time on this as well. … If a school is not ready when that time likely comes, it could take a long time to catch up." (link)

Iowa AD Beth Goetz explains her vision for the Hawkeyes’ open Deputy AD position, noting it will be more externally focused than it was before. “They won’t be as focused on running sort of the day-to-day in the department although they’ll play a role in that to be sure.” Goetz points out the refocus is a result of “evaluating what the landscape is and then also what are the strengths on our staff. … From a skill set standpoint, you’re looking at people who have backgrounds in either fundraising, ticketing, marketing, sponsorship, those type of things.” Goetz adds: “Wanted to make sure we had some additional hands and additional expertise to really partner with [Deputy AD for Revenue and External Relations] Matt [Henderson] in that space to make sure we’re positioning ourselves well for the future.” (link) The D1.dossier for the opening is available. Arkansas AD Hunter Yurachek talks about the process of hiring Men’s Basketball John Calipari: “He was very thoughtful throughout the process. He disclosed taking his hour-long walk and walking out thinking he’s the Arkansas coach and coming back in an hour thinking he's the Kentucky coach. … I mean he's leaving a really good program and a really good situation. And him and his family were really comfortable in Lexington, Kentucky, so it was not an easy decision for him. But I had to keep pushing gingerly. I didn’t want to push him too much because I didn’t want to push him away, and so I was trying to be respectful of his time. It's like you're waiting for a girl to call you back and keep looking at the phone and looking at the phone. Did I miss a call from him? The Athletic’s Richard Deitsch explores how women’s college basketball can carry forward its momentum post-Caitlin Clark and notes the first step is to continue increasing visibility. To that end, ESPN SVP of Programming and Acquisitions Nick Dawson says: “What I am focused on with my team is over the next couple of years, can we get it to a better place where we have more consistency in our offering of regular-season women’s college basketball on premier platforms throughout the season. We’ve made small strides there over the past four or five years, but it’s still a little bit spotty throughout the regular season in terms of when the opportunity exists. How do we build a better momentum-building and recurring and consistent platform for the sport, especially through the months of January, February, early March as it leads into the tournament?” Asked whether there are plans to move all Final Four matchups to ABC, Dawson says: “As of right now, our intention is to continue with what we did — the championship game on ABC in that kind of late afternoon Sunday slot, which from a potential viewership perspective our research team has proven to us that there’s not much difference in terms of potential upside between that window and in a prime-time window.” As for the semifinal games, “nothing is off the table long-term. We’ll continue to have those conversations year after year to assess how the distribution world is changing.” (link)

Desser Sports President Ed Desser and Kosner Media President John Kosner make an extended case for combining the men’s and women’s Final Fours rather than expanding the field size. They argue that to “increase the value of their two basketball crown jewels, the NCAA and its schools should focus on strategically improving what they already have — not diluting it further. While beautifully constructed, the men’s and women’s tournaments, as media properties, have barely changed in decades.” As such, they propose opening the MBB tournament on Saturday/Sunday rather than Thursday/Friday. “Then use Monday/Tuesday late afternoons and evenings for the second round. We also suggest using home arenas for both tournaments for the first weekend — cutting down on travel, ensuring a great atmosphere for TV and rewarding the excellent play of higher seeds during the regular season.” They also suggest updating the TV schedule. “The Duke-NC State regional final drew 15.1M on CBS Sunday at 5:05 p.m. ET. What would it have done at 8 p.m. ET? The South Carolina-Iowa rematch on ESPN drew 18.7M and ended just after 5 p.m. ET. How about if it started on ABC at 8:30 p.m.? All games should be elevated into the best, not best-available, time slots.” Desser and Kosner go on to suggest that for the Final Fours themselves, the “women play Friday/Sunday and the men Saturday/Monday. But the NCAA could also create a Super Saturday with all four semifinals and a Monday night championship doubleheader with prime-time slots for both. Lots more. (link)

Furman officially breaks ground on its $40M Timmons Arena renovation. President Elizabeth Davis: “A renovated Timmons Arena will not only honor and celebrate the Paladins’ storied past but will also create a tremendous home-court advantage for our teams. Timmons will be a jewel on campus for all of our students, faculty, and staff, and it will continue to be a place for the Upstate and Furman communities to gather for basketball, Furman Engaged, graduation, and other events.” During renovations, the Paladins men’s basketball program will play in the Bon Secours Wellness Arena in downtown Greenville, and the women’s team will play most home games at North Greenville University (DII). Temple will install new FieldTurf playing surfaces at the Edberg Olson Football Complex and the Temple Sports Complex. A new FieldTurf Prestige Vertex system will be installed on Chodoff Field at Edberg-Olson Hall, while the Owls will install a FieldTurf Hockey Gold surface at the Temple Sports Complex’s Howarth Field. In response to a recent Washington Post article calling for increased regulation in the gaming industry, Orrick, Herrington & Sutcliffe Partner Behnam Dayanim explains that the current regulatory environment around sports betting is antiquated because it “stems from an era when the principal concern was keeping organized crime out of the casino business. But that is really not a concern in this age of gaming respectability, with public companies and shareholder reports. Instead, the focus should be on those issues that are important: responsible gaming, responsible advertising and the like. Railing against gambling is like raging against the weather. It will be with us whether we like it or not. Before legal sports betting, there was illegal sports betting (and there still is – see Shohei Ohtani). What states should do is take a hard look at how they can streamline those regulations that no longer are fit for purpose and examine where new rules may be appropriate.” Dayanim asserts that “adding more regulatory overhead without any relief will…make the licensed industry less competitive – driving more activity to unregulated, offshore actors. … Several states – including my own – have banned college prop bets on the theory that, particularly with amateur athletes, they can lead to abuse. So what happened this past NCAA tournament? Unlicensed offshore books advertised that they were accepting those prop wagers. I would be willing to, ahem, wager that their volume increased substantially as a result.” (link)

Legal Matters…
+ Michigan Football Asst. Director of Player Personnel Denard Robinson has been suspended indefinitely after being arrested for OWI following a single-vehicle crash in Ann Arbor. Wolverines HC Sherrone Moore: “We will continue to monitor the situation and will have no further comment at this time.” (link)
+ Kansas City Chiefs wide receiver Rashee Rice and SMU student-athlete Teddy Knox are being sued for over $1M in actual damages and $10M in punitive damages by Edvard Petrovskiy and Irina Gromova, who allege Rice and Knox deliberately raced their vehicles at speeds well beyond the posted limits and caused a six-vehicle crash that led to their injuries. The incident occurred in Dallas on March 30, and Rice and Knox are each facing one count of aggravated assault, one count of collision involving serious bodily injury and six counts of collision involving injury. Knox has been suspended by SMU, which indicated in a statement last week it "takes these allegations seriously." Both vehicles were leased in Rice’s name. (link)

American introduced new AD JM Caparro today, and during his remarks, Caparro said: “To be able to serve student-athletes at such a prestigious university, with a prioritized focus on high-end academics and athletics in a united conference like the Patriot League, was the reason I got into college athletics in the first place. I promise to lead this department through the values that have helped define who I am today: family, integrity, trust, humility and communication. I will work tirelessly to help provide the necessary resources for our student-athletes and our coaches to be able to compete at their highest levels, and I promise to be a valuable ambassador and a key partner to the university. Together, the vision for our department will be simple. We're going to put the student-athletes at the forefront of every decision that we make. We're going to compete in the classroom and on the playing field, and we're going to be extremely active in the community. If we do these things consistently, we will develop future leaders that the university will be proud of and provide the best possible experience for our student-athletes. (link)

The debate over student-athlete employment is leading some federal lawmakers to seek compromise, according to Bloomberg Law’s Diego Areas Munhoz and Parker Purifoy, who note: “Even in the Democratic-controlled Senate, lawmakers are trying to balance their support for unions with concerns over the fallout of designating college athletes as employees under various federal labor and employment laws.” For example, Senator Richard Blumenthal (D-CT) recently explained: “What I’m considering is the possibility that athletes could choose representatives to bargain for them without becoming employees. It could be a union representative. They could unionize but without being employees. … I’m hearing from coaches and athletic departments; they think it’s a terrible idea. A college president regarded it as an anathema.” Additionally, Blumenthal says student-athletes have told him that they oppose being considered employees. Meanwhile, congressional intervention is increasingly likely, according to Munhoz and Purifoy, who explain: “The easiest path forward for the hybrid model advocated by Blumenthal would be to classify the players as employees under the National Labor Relations Act but not the Fair Labor Standards Act.” West Virginia professor/former NLRB attorney Anne Marie Lofaso believes that approach still fails student-athletes. “If you don’t want them to get minimum wage, overtime, and workers compensation, then fine. But at least be open about it. This middle ground is still just hurting the players. It’s not a middle ground. It’s a concession to big business.” (link)

SBJ’s Ben Portnoy takes a look at whether combining the men’s and women’s Final Fours is in the offing, and Big East Commissioner Val Ackerman voices her support: “Take Grand Slam tennis — Wimbledon, the U.S. Open, the Australian Open, the French Open — think about how ludicrous it would be at this stage to separate out any of those events [between] men and women. They’re made better together. Basketball would be made better together…if we were all in the same place, and not having sponsors and fans and NCAA brass and dignitaries having to choose. But that’s what we’re doing, we’re asking people to choose.” Kosner Media President John Kosner agrees: “What happens [now] is you have double the time and resources to have a smaller event. Those things fit beautifully together. [The NCAA has] chosen not to do it at this time. We think that’s a mistake.” Still, there are logistical challenges, as Portnoy points out that “cities that could handle the influx of fans for both events are few and far between.” Additionally, there’s the question of venue. The men have played in an NFL stadium each year since 1997, and Portnoy suggests that “it’s conceivable the men’s event could continue in a football stadium, with the women’s game held in a local NBA arena, though the optics of such a decision would likely not be well received by the general public.” To that end, ESPN analyst Jay Bilas remarks: “Women’s basketball does not need the men’s Final Four to elevate it. It’s already elevated to that level. … To me, if you put them together, does it elevate everybody? Or does it diminish one versus the other? It’s an unnecessary comparison if you do it that way.” Meanwhile, NCAA SVP of Basketball Dan Gavitt points out that “any consideration now would have to be early in the next decade, but we’re always going to continue to think creatively and consider all alternatives.” (link)

The Athletic’s Chris Vannini explains the main reason for not holding a Group of 5 football playoff is that it wouldn’t be as valuable as the College Football Playoff, and G5 schools don’t want to give up the money they receive through the CFP. Also, “nobody wants to voluntarily declare themselves as second-class, which is what a G5-only playoff would look like right now. Schools want to sell the dream of making the big CFP. Remember, the 12-team CFP this year will be the first time in college football history a G5 team truly has a guaranteed seat at the table and a chance to play for it all.” That said, Vannini acknowledges incoming AAC Commissioner Tim Pernetti last week talked about “maverick postseason ideas” and seemed open to a G5 playoff. “Pernetti doesn’t take over until June, and conferences’ agreements with bowl games would be an obstacle. Opt-outs and transfers have also decimated the available rosters for postseason games outside the CFP, so it might be a pipe dream to set up another tournament taking place during that chaotic few weeks. But with Fox’s new NIT-rival basketball tournament now official, these could be the kinds of things that get discussed.” (link)

Towson AD Steve Eigenbrot joins Citybiz to discuss all things Tigers Athletics, including the plans to add 10 additional scholarships next year in baseball, field hockey, track, both golf programs and gymnastics. “It was something, when I came in, that I saw from the outside that there's an opportunity for us to do this a little bit better, making sure that we can be competitive in some of those sports. … I don't know that competitive excellence will be instantaneous once you get those scholarships. It’s all about kind of catching up to some of our CAA peers. So, just having the scholarships in and of themselves, it may take another minute there after that to make sure we have the right people in the scholarships and some of the underclassmen can develop and mature. But that's something I'm really excited about, and I think a great commentary on institutional alignment and support for the department.” Eigenbrot also notes that “from a capital perspective, some of the more obvious things we're really excited about are that we have $3.5M of state funding to finish out our academic center which is in the fieldhouse of the building that's connected to the United Stadium. There’s going to be another renovation to that building. The $3.5M we contribute to probably somewhere between a $10M and $14M dollar renovation, I’m hoping to break ground on that next spring.” More from Eigenbrot. (link)

Minnesota and Visit St. Paul plan to “put in bids for future Frozen Fours,” according to Gophers Senior Assoc. AD Tom McGinnis, who expects the next bid cycle to cover 2029 to possibly 2031. There has been talk of changing the NCAA regional format to move games from campuses to neutral sites, but if that changes, McGinnis says that Minnesota would be interested. (link)

Oregon reports a football season ticket renewal rate of 95.2% so far along with a 99% renewal rate for season parking passes. The Ducks have also sold 10,524 new season tickets. (link)

Fordham unveils its newly renovated basketball film room. The chairs from the room's original construction in 2011 were replaced with 20 brand new seats complete with logos and in-seat desks from DreamSeats. In addition, the room received new flooring and lighting while the walls and graphics were updated to reflect more modern Fordham branding. (link)

+ Kentucky Men’s Basketball HC Mark Pope’s five-year deal starts with a salary of $5M and increases by $250K each year. Additionally, Pope can earn one-year extensions with every Sweet 16 appearance as long as there are no more than five years remaining on the contract. Those extensions will also trigger $500K raises. Pope will also earn $100K for an SEC regular season championship, $50K for an SEC Tournament title, $25K for a team GPA of 3.0 or greater and $25K for a team APR score of at least 975. He can also secure a $500K bonus with a national championship, $250K for a Final Four, $100K for an Elite Eight and $50K for making the Sweet 16. Overall, Pope can earn a maximum bonus of $700K each year. Should UK let Pope go without cause, the school would owe him 75% of his remaining salary. Should Pope leave for another opportunity, he would owe the Wildcats 33% of his remaining salary. That number drops to 20% if Wildcats AD Mitch Barnhart is no longer the AD. (link)

The numbers being reported concerning Kansas’ NIL war chest for men’s hoops have been exaggerated, according to Jayhawks AD Bill Self, who says: “It’s a different world. What you read in NIL and stuff like that is so full of crap. People actually believe that we have $7.1M in NIL. That was reported the other day. If we had had $7.1M in NIL we would have (Kevin) Durant and LeBron (James) suiting up for us. I read something the other day that people said we had $4.1 or $4.2, whatever it was, million dollars in NIL. I wish. If we had that we would have the exact same thing as what I said with LeBron and Durant. … We have a good (NIL) program. We have so many generous people that have bent over backwards to make sure we’re competitive. But guys, cut those numbers in half.” Speaking to the crowd at the season-ending KU hoops banquet, Self went on to remark: “NIL in theory is good. It’s also the way (of) the world that’s not so good too, just be very candid with you. If we want to play with the big boys, then we’ve got to play the game and we have to participate. We need your help to do so and it is appreciated. But that is a key component in our success moving forward.” (link)

Ole Miss’ spring football game featured Joey Chestnut scarfing down hot dogs, sororities competing in a tug-of-war competition, and a dunk contest between players and CBS’ John Talty observes: “On a beautiful, 80-degree day inside Vaught-Hemingway Stadium, this looked like the future of spring games: Show very little actual football, focus on the fun and try to escape without any injuries. There would be no opportunity to over-analyze how well the Ole Miss backup quarterback looked, as many fanbases will surely do following other spring games.” Rebels HC Lane Kiffin acknowledges as much: "Really, the value of spring games, in my opinion, is overrated because you don't show many plays on offense or defense. Most people don't unless they are trying to win the fans over or TV over with the game. You really don't get a whole lot out of it." While Ole Miss didn’t release the game’s official attendance, the “feeling was that it easily exceeded anything experienced during recent spring games,” per Talty, who adds: “It didn't hurt that Ole Miss allowed students 21-years-and-older to bring in alcohol and sit behind one of the end zones to try to recreate the environment of right field at a baseball game in Swayze Field.” Meanwhile, Kiffin says he hopes other schools don’t copy the Rebels’ format. “I would like people to keep playing the spring game so we can watch all their players play in spring.” (link)
