Virginia Governor Glenn Youngkin has signed the state’s NIL bill into law. Effective July 1, the bill allows colleges and universities to directly pay student-athletes for their NIL. Virginia AD Carla Williams is in favor of the bill and says: "If this law gets us closer to a federal or a national solution for college athletics then it will be more than worthwhile. Until then, we have an obligation to ensure we maintain an elite athletics program at UVA." The law states explicitly that student-athletes are not employees and does not permit pay-for-play. Williams says this was "maybe a distinction without a difference, but there's a distinction there.” Virginia Tech AD Whit Babcock also weighs in: "There is a better model and a better compromise. This is absolutely a step in the right direction for the commonwealth of Virginia and the country in my opinion." Babcock also acknowledges that whether schools will have to provide male and female student-athletes an equal number of endorsement dollars is “still an open question, and it's a huge question.” (link)

A Stanford track student-athlete this week gave testimony to the NLRB stating that some student-athletes should be considered employees due to the amount of control their programs have over them. Ohio State AD Gene Smith reflects on his tenure in Columbus and explains he was influenced by author/consultant Peter Drucker’s thoughts about “management by roaming around. And early in my career at Ohio State I used to roam around more. I’d drop in on coaches, I’d see their practices and spend time with them. But it's more about some of these other platforms like meetings and things of that nature where I connect with them, or different events or going to their contests. But I want to know our coaches. I want to know them as people and what they're all about. I want to know their character, so I try my best to get to know them. That’s [also true for] a lot of the staff. It’s just not the coaches, it’s other people as well. You’ve got to make the effort to get out to meet them and spend time with them. I appreciate and understand what they do, and they may report to somebody else structurally, but behaviorally we have to have a relationship.” When it comes to the difficult decision of letting coaches go, Smith says the process is collaborative, and once it’s in his mind that it’s time for a change, he brings in others to share their perspective and “help me see what I don’t see. … We talk about it. You know, should we give this individual another year? What haven't we done to help this individual be successful? What do we know about the student-athletes and how do they feel? So, you go through a process to make sure that you're ready to make that move, and that’s not easy.” Lots more. (link)

The Missouri Board of Curators has approved a $250M project to renovate Memorial Stadium’s north concourse. The upgrades, which will be designed by DLR Group, are expected to include additional premium seating, concessions, retail space, a recruiting room and multiple open-air observation decks. In all, the project could add up to 51 new suites, including 28 cabanas featuring large social spaces in covered settings. New premium spaces will also include loge seating options and mezzanine club luxury outdoor seats. Of the $250M price tag, half is expected to come from fundraising, including a $50M contribution from an anonymous donor earlier this year. Another $50M will come from unspecified internal sources, and $75M will come from debt. (link, link)

Charlotte receives the green light from the North Carolina Board of Governors to proceed with the $60M Phase 1 expansion of Jerry Richardson Stadium. The project includes seven luxury suites, club seats, loge boxes, ledge seats and additional general seating. Additionally, the club level will serve as a dedicated team dining area, meeting facility, and conference space, enabling year-round utilization. With this initial phase, the stadium's capacity will increase to 18,170, with plans for further expansion to 21,000 already in motion for Phase 2. (link)

UTSA has launched two ESPN+ broadcast control rooms inside the Roadrunner Athletics Center of Excellence. The $5M project allows UTSA to produce top-quality live productions that meet the standards set forth by the [AAC] and ESPN.” Roadrunners AD Lisa Campos: “We have invested significant resources in building these control rooms that put us on the cutting edge of college athletics live broadcasting. We talk all the time about how athletics really is the front porch of the university. These broadcasts on ESPN+ help expand the visibility of the UTSA brand and tell the stories of our student-athletes. That reach also helps increase enrollment and enhances the value of the UTSA degree.” (link)

The Mercury News’ Jon Wilner puts Arizona’s budget deficit into context, noting that “eight of the other 10 schools that made their financial data available experienced far steeper budget shortfalls when direct campus support was removed from the revenue total.” The “complicating factor” in Arizona’s case is the $31.6M bridge loan from campus. “Remove the loan, the direct transfers to athletics and the student fees allocated to athletics, and Arizona booked $99.3M in organically generated revenue against operating expenses of $142.8M – for a shortfall of $43.5M. That’s approximately $5M more than the deficits incurred by UCLA, which produces a massive shortfall on an annual basis.” Without campus support, Wilner notes Colorado experienced a $38.5M shortfall, while Stanford and Cal faced deficits of $33.3M and $31.1M, respectively. Further, Arizona’s deficit was not the largest in the Pac-12, as Wilner notes Arizona State “reported an operating shortfall of $27.1M, but the amount included $16.6M in direct campus support. Remove that figure, and ASU’s athletic department booked $98M in revenue and $141.7M in expenses. That’s a $43.7M hole — or $200K more than Arizona.” (link)

North Dakota State establishes the Graduating Champions program to begin distributing Alston awards. This program is expected to award more than $1.5M in the first year. Bison AD Matt Larsen: "Graduating Champions will provide long-lasting financial support for our student-athletes. Our student-athletes have traditionally excelled in the classroom earning a four-year average, cumulative GPA of 3.4. This success was a primary motivating factor for our donors to not only support and reward the academic success of our student-athletes, but also incentivize both retention and graduation at NDSU.” (link)

A one-and-done rule in women’s college basketball would ruin the sport, according to Connecticut HC Geno Auriemma: "If you want to kill it, then let the kids leave after freshman year. On the men's side, it's become transactional. Everybody's a free agent. Everybody's a mercenary. It's not the kids' fault. ... To me, what helped the women's game grow is the people in Iowa got to grow up with Caitlin Clark. The people of Connecticut got to grow up with all of my great players. There's something to be said for that." The WNBA’s CBA, which states players are eligible to be drafted upon graduating from college, being within three months of doing so or in the calendar year that they turn 22, runs through 2027 but has an opt-out clause that could be exercised by November 1, 2024, and terminate the deal following the 2025 season. Auriemma: "I don't know that our game can continue to move forward if all of a sudden our guys are gone. So I like the rule, and the players decided the rule. So if they change the rule, God bless 'em, but I think it'll ruin the game." (link)

James Madison AD Jeff Bourne reflects on his career and acknowledges there were days he considered leaving: “It’s like any job, you have your days you go through it and go, ‘Boy, this is really, really tough.’ But then you look at it on the other side and say no matter where you would go or what you would do, those same types of days are going to follow you, and you have to look holistically at what's best I think for you as an individual [and as a family] ... You can chase other jobs and make a lot more money other places, but happiness across the board in that family element was huge for us.” On his advice for the incoming AD: “I’d first tell them they’re incredibly fortunate to have the job and to be a part of this incredible culture and institution. Secondly, I would say we’ve built something incredibly special here. We want to make sure the next person is capable, competent and has the energy to go beyond where we’ve ever been.” Also: “We need somebody who can step into this role and be a thought leader, someone who’s well-attuned to what’s happening on a national scale and then has the patience and the perseverance to do just what we’ve done: chart a course and then follow that plan through to its existence.” More from Bourne. Oregon State AD Scott Barnes joins the Bald Faced Truth Show with John Canzano and says of the recently announced home-and-home football series with Houston and Kansas State: “Absolutely any connection that we can have – consistent connection – whether it be in the room or in scheduling or other areas with Power 5 conferences, in particular the Big 12 and ACC, we want to do that. We want to continue to foster relationships there. … It’s much more intentional than it ever has been.” Barnes also says a football media rights deal is close to being finished and OSU and Washington State “leaned in very heavily on making sure we were in the most homes we could be in, the biggest reach we could make. Exposure was priority one in that regard, for sure.” Looking toward the next two years and beyond, Barnes notes OSU coaches “have to be really strong in articulating what the plan is to their student-athletes before the portal opens and be very clear that, ‘Here’s how we make this work.’ Our women’s basketball situation specifically, we are respected at a national level. … We can leverage a national schedule and play top 10 teams at home. And so as you think about – let’s just call it what it is, a step down competitively – in the WCC compared to what we've seen the Pac-12, particularly of late, how do you augment that and how do you do it on a national level? That’s where we've got it to be really clear with our student-athletes about how we're doing this and why we're excited about it as we position ourselves for the next opportunity.” (link)

ACC Senior Assoc. Commissioner for Football Michael Strickland joins the On the Fly podcast with Gene DeFilippo to discuss the complexities of scheduling after conference expansion, including the mitigation of travel concerns, ensuring competitive equity, and catering to the needs of teams, student-athletes, fans, and broadcast partners. Strickland says one way the league is attempting to mitigate travel hardships is by using open dates strategically. “When teams on the East Coast do go west, as many times as possible you follow it up with an open date, particularly in the first couple years as we learn the true impact of the travel that we've got an open date in there for rest and recovery. And then doing the same for the new members. Obviously, they're making more trips to the East Coast three – times per year – and doing so in a creative fashion. We've got this year both Stanford and Cal playing on a Friday night, so they’ve got all day Saturday to get back home and rest and recover for the following week’s game. And then another one of their trips for each of them are followed by an open date, so two of the three East Coast trips mitigated it in that regard.” Strickland says the league will use historical data and other information to try and maximize balance across the league “not just for the eight teams that you do play in any given season, but the balance of home games versus road games from an on-the-field perspective. Then you've got, from the ticket office perspective, what's your home game inventory look like this year versus other years and making sure you've got nice balance there.” Full podcast. (link)

On3’s Eric Prisbell notes several elements of Project DI will not be discussed during this week’s DI Council meetings. As one source puts it: "All legislative action is stuck in neutral with all the judicial and legal action, including the AGs. Pass something in October, and if a school does not like the outcome or if it goes against them, they get the state AG involved. Brutal way to manage the NCAA and try to create positive change." Athletes.org Founder Jim Cavale tells Prisbell he’s not surprised by the pause, particularly since plaintiffs’ lawyers in the House case argue Project DI “establishes the existence of less restrictive alternatives.” Cavale also believes the proposal already has accomplished its purpose, which was to kickstart an industry-wide conversation. Former Kentucky women’s swimming team captain Briggs Alexander says he was “vigorously discouraged” from coming forward about former HC Lars Jorgensen’s alleged sexual abuse during his time as a swimmer and later an assistant coach with the team. He tells The Athletic’s Katie Strang and Jenna West: “I thought I could trust [the Title IX office]. I went to them and disclosed my abuse and thought it was going to be taken care of. … I was repeatedly discouraged and vigorously discouraged to not come forward.” Alexander also says: “Lars abused me in a lot of different ways. Emotionally, spiritually, physically, sexually. And he did so under the guise of he was doing what was best for me. And he, you know, basically put himself in this position where if I said anything, no one was going to believe me. My career was going to be over.” Strang and West also report UK was informed by former Toledo AC Mark Howard that Jorgensen was involved in a relationship with a student-athlete during Jorgensen’s time with the Rockets. Additionally, a San Jose State official reportedly alerted Kentucky about hearing allegations that Jorgensen had been in a relationship with one of his swimmers at an earlier coaching stop and that he had sexually assaulted a woman on the swim staff at Kentucky. Jorgensen maintains to The Athletic that none of the allegations against him are true. Note from The Athletic: “(Alexander swam on the women’s team at Kentucky but later transitioned while serving as an assistant coach. At Alexander’s request, The Athletic is using gender pronouns that correspond with his transition timeline because he wants the reader to understand ‘who I was in the moment when I was being abused.’)” (link)

Greg Anderson, an attorney for former Kentucky Swimming & Diving HC Lars Jorgensen, claims Jorgensen is being targeted for voicing his support of former UK swimming student-athlete Riley Gaines, who has called for the NCAA to change its stance on transgender student-athlete participation. “This has nothing to do with anything he has done in his private life. This all has to do with NCAA woke philosophy and his support of his swimmer, Ms. Gaines. The timing of it, in light of her statements publicly, is extremely suspicious. We will be exploring that.” Anderson also asserts: “He never assaulted anyone. He never battered anyone. He didn’t defame anyone. He never mistreated anyone. He drove his swimmers to be the best that they could. And the facts here do not add up in any way, shape or form.” In regards to yesterday’s report in The Athletic that the athletic department was warned about potentially abusive behavior on the part of Jorgensen, UK Executive Director of Public Relations/Deputy Chief Communications Officer Kristi Willett says: “We had no credible evidence of sexual harassment or misconduct by Lars Jorgensen at the University of Toledo at the time he was hired as a swim coach at the University of Kentucky.” (link)

The U.S. Justice Department has agreed to pay approximately $100M to 100 victims of former Michigan State/national women’s gymnastics team doctor Larry Nassar over the FBI’s failures to take seriously the reports brought to it of his potential abuse of star athletes. According to the Wall Street Journal’s Louise Radnofsky and Sadie Gurman, the deal “will resolve the last remaining legal claims against the constellation of institutions who botched their responses to Nassar—and bring the total price-tag of legal payouts over liability for his actions to almost $1B.” (link)

Capacity at Kansas’ revamped David Booth Kansas Memorial Stadium likely will shrink by at least 5K seats when the facility opens in 2025, according to Jayhawks AD Travis Goff, who expects it will accommodate fans in the low 40,000-seat range, down from a listed capacity of 47,233 currently. If KU decides to renovate the east side of the stadium, the capacity could increase back to the 47K range; however, Goff KU is not making any firm commitments for the east side, as that decision involves finding a private development partner interested in building amenities and mixed uses at the site. For non-football uses, Goff says concerts are “in the realm of possibility” but notes KU is thinking both big and small. “You can think about wedding receptions, you can think about the concert, music performance piece of things. Certainly anything would be done in partnership with the community and making sure it fits. But there is a space for just about anyone and anything in this development.” (link)

SMU’s football season-ticket sales are up more than 50% YoY, putting the Mustangs on pace to more than double the amount of season tickets sold for the upcoming year. The season ticket sales to date are already a record for Ford Stadium, and now SMU is inviting fans to become part of the Game Changer program by selling football season tickets within their personal networks. Those who sign up will be paired with a ticket sales rep to whom the fan will provide leads. Leads that turn into sales can earn fans “exclusive SMU x ACC merch.” (link)

DLA Piper Partner Peter White, who oversees the law firm’s sports practice, talks about the rising value of sports organization and interest from institutional investors, the power of live events and emotional connection at the SBJ CAA World Congress of Sports. "Sports are an asset class now. And people invest in asset classes...Think of it. From an investing perspective — you don't like surprises. In the US we have control of what you're paying players, for the most part; you don't have that in most parts of the world. You have these businesses now that become multimedia companies...you have new stadiums (and real estate developments). The technology spinoff opportunities are there. So it's no surprise that private equity is jumping in." (link)

Fanatics CEO Michael Rubin during the SBJ CAA World Congress of Sports noted the company will soon have geographic parity with gambling industry competitors FanDuel and DraftKings; however, those two companies account for 80% of the market compared with Fanatics’ 2.5%. But Rubin explains that “we will have spent, by the end of this year, $1.1B (on legal sports betting). That’s a fraction of what they spent. Ultimately, the question is whether we get more market share. … I am more convinced than ever we can. Our cross-sell is really working. But I’d be full of it if I told you today that I knew what the outcome was going to be.” Rubin also commented on the potential for Fanatics to enter the ticketing business: “We don’t want to be a ticketing operator; we want to offer ticketing to our fans, because it’s something our loyalty members want and something we want to reward customers with.” (link)

StubHub is planning an IPO “by late summer,” according to The Information’s Cory Weinberg, who notes the company, which has upwards of $2B of debt, will “test investors’ appetite for companies with strained balance sheets.” StubHub is hoping for a valuation in line with the $16.5B at which it raised money during late 2021 and may call off the IPO if it can’t get close to that number. Weinberg notes SeatGeek has also been “seeking a potential listing this year, which means similar companies might end up vying for investors’ attention at around the same time.” (link)
