MEAC Commissioner Sonja Stills testified this week before an NLRB judge that classifying student-athletes as employees would have a “severe impact” on HBCUs. Stills: “We can't afford paying our students [because of] the tax implications of what we think scholarships would be if it turned into a salary.” Further, she points out, the students receiving the scholarships or aid often "can't afford to go to school, how would they afford to pay the taxes on the salary?" More NLRB testimony as Stanford track student-athlete Liam Anderson argued that some student-athletes should be considered employees due to the control programs exerted over them. Anderson cited a time he encountered a hotel curfew guard for a DI basketball team as an example of how tight that control can be. Anderson, who is also the former co-president of Stanford’s SAAC, said his time leading the committee led him to believe that student-athletes in the Power 5 conferences playing in "top tier" sports like football and men's and women's basketball should be considered employees, while athletes in other sports, such as track and field, may also qualify depending on the situation. Anderson explained the difference between the tiers, as he saw it, had to do with the level of control programs exert over athletes' everyday lives, as well as the level of "commercialization and professionalization" of those sports. Anderson also asserted that many individuals, including pundits on TV, "fearmonger" that if athletes in top-tier sports are recognized as employees, it could lead to the non-revenue generating sports being cut. What's more likely, Anderson said, is that universities will start exerting less control over the lives of athletes in the lower tiers. (link)

[...] Have also heard a few funny stories where decent high-major starters are now asking double or triple in NIL $$$ vs. what top-10 guys in the portal were getting 2 yrs ago. Some thought NIL collective money might dwindle a tad. Instead, there are more people in NIL space than ever. To wit: There are legitimate professional agents repping NBA players on big contracts who've waded into the NIL space as a side gig b/c the COMMISSION on players landing in certain spots can be worth six figures. The Athletic’s Scott Dochterman points out that just 58 underclassmen declared for the 2024 NFL Draft, the lowest number in more than a decade, and cites a number of Iowa players returning who in past years might not have as an example of how “NIL has helped college football teams compete with NFL opportunities. Players can return to school as starters, continue developing and earn more compensation from NIL rather than risk their football future as a late-round pick or undrafted free agent. That option also has ramifications for NFL teams,” as Denver Broncos GM George Paton says there are concerns the draft’s later rounds aren’t as deep as in previous years. Detroit Lions GM Brad Holmes adds: “I wouldn’t be surprised if those numbers drop even more next year. Obviously, traditionally the underclassmen have been the meat of the first two rounds of the draft, so we’ll just kind of see how that changes in the very end.” Dochterman notes that according to Spotrac, the top seventh-round pick will receive a $118K bonus in this year’s draft, below what many Power 5 starters can earn in the NIL market. The NCAA is asking a federal judge in West Virginia to dismiss a lawsuit brought by Montana State-to-West Virginia men’s basketball student-athlete, RaeQuan Battle, who claims the organization sought to prevent him from being eligible after a midseason transfer. The NCAA argues the suit is too vague to pass legal muster, saying “The hodgepodge of contract-related claims [Battle] alleges fail for a multitude of reasons. The simplest — and most recurring of these — is that [Battle's] allegations require the NCAA and the court to guess what his claims are." John Gianola, legal counsel for Battle, thinks it is unfortunate that it takes federal litigation for the NCAA to understand there are issues with its enforcement rules: "It is equally unfortunate that they do not seem to appreciate the consequences that the disregard of their own policies and procedures can have on young athletes. I find it incredibly telling that just yesterday— the same day the motion was filed — the NCAA's Division I Council unanimously passed a resolution that would allow the type of transfer for which RaeQuan's waiver was denied." For the fifth consecutive year, North Florida set a new record for total dollars raised ($595,143.08) and donors that contributed (1,844) on UNF Giving Day. Former Department of Homeland Security Policy Advisor Matthew Wein advocates for the formation of a sports gambling integrity commission. In an op-ed for SBJ, Wein explains the NCAA and professional leagues should take steps form such a commission to “take stock of the vulnerabilities that exist and propose steps that promote integrity in a transparent manner. The commission should consist of representatives from each league in addition to at least five additional independent commissioners. The leagues should work with gambling platforms to gather the necessary data to understand the trends the leagues face and inform deliberations and potential recommendations. The commission should produce a report that outlines in a transparent way the vulnerabilities that threaten the integrity of the games in addition to actionable recommendations to address those vulnerabilities. The report is an opportunity for leagues and teams to ensure that they not fall victim to the error of failing to imagine the non-conventional steps that fans or others might take to distort a level playing field. … Athletes and spectators alike see the threat over the near horizon – the question that remains is which sport will move first to place the integrity of their game near the top of their priorities and act in concert with their fellow leagues.” (link)

Winston & Strawn Co-Executive Chair Jeffrey Kessler, during a discussion hosted by the Drake Group this week, said he believes college sports finds itself in its predicament because of surging salaries for coaches and administrators. He also insisted the power conference schools should be treated differently than the others: “Here’s what people have to get in their heads: The Power [4] schools are not like everybody else. … You really have to think about [Power 4] as different. The reason we get tied in knots is because we conflate those schools who have developed these gigantic independent commercial businesses with the schools who are still just educational institutions with extracurricular activities. When you try to come up with one rule for all, you go crazy. You have to look at the schools differently. For the ones with the money, there is plenty of money to compensate the athletes and share it with the women’s sports. Once you divide it all up, this is not hard. It is only hard if you’re saying, ‘Well, how will Lehigh be able to afford all this?!’ They won’t and they won’t pay [athletes]. If their concern is that Lehigh then won’t be able to compete with Alabama in football… OK, that’s your concern? That’s your concern?!” Kessler also dismisses the “scare tactics” from college leaders who say paying players will result in the elimination of sports. “If you are paying your athletic director $3.5M because you have the money and you [report] that you have a $100K loss, you’re making money!” Also from Kessler: “Right now, President Baker agrees that schools should pay directly NIL. FedEx is pledging $5M per year over the next five years to support Memphis’ football, men’s and women’s basketball and other women’s sports’ NIL efforts. Tigers AD Laird Veatch: "This is a massive example of what NIL was intended to be and can be, but it’s done the right way with the right kind of infrastructure from a Fortune 50 (500) company to hometown student-athletes. Really, I don’t think there’s another deal that we’re aware of that is this size or the scope across multiple programs and across multiple years." The deal also includes a 50% match clause, and Veatch says the university will start a campaign to raise an additional $2.5M per year. FedEx will work with Altius Sports Partners to determine how the money is allocated among sports and student-athletes. (link)

The NCAA Playing Rules Oversight Panel approved new optional technology rules in football beginning with the 2024 season. In FBS games, each school will have the option to use coach-to-player communications through the helmet to one player on the field. That player will be identified by having a green dot on the back midline of the player's helmet. The communication will be turned off with 15 seconds remaining on the play clock or when the ball is snapped, whichever comes first. Additionally, teams can have up to 18 active tablets for use in the coaching booth, sideline and locker room. Tablets cannot be connected to other devices to project larger additional images and cannot include analytics, data or data access capability or other communication access. All team personnel will be allowed to view the tablets during the game. The panel also approved a two-minute timeout in the second and fourth quarters, allowing conferences the option of using a collaborative replay review system and penalizing horse-collar tackles within the tackle box. The panel did not support a uniform rule proposal made by the Football Rules Committee. Panel members were not comfortable with on-field officials having to enforce the recommended rule. (link)

More form The Athletic’s Chris Vannini on the helmet communications that will be allowed starting next football season. He notes a team “can use the helmet tech even if the opponent chooses not to use it. Conferences will select their vendor of choice, according to the policy, keeping everyone in a conference with the same company. GSC (which supplies the NFL helmet tech) and CoachComm (which handles coach headsets for most teams) are expected to be the main vendors.” Vannini also points out this “technology rule change was not a response to Michigan’s sign-stealing scandal, which was revealed after the Big Ten first proposed this rule last summer. This is also not expected to end sideline signals or sign-stealing, especially for up-tempo teams that need to feed a play into wide receivers quickly, but it is a step toward an easier process.” Meanwhile, Big Ten VP of Football A.J. Edds says the new two-minute warning “is not a new or additional timeout. This is a known position that will hopefully alleviate the impression early in the quarters where media partners have taken breaks in consecutive opportunities. This will give them a larger runway over the second and fourth quarters.” (link)

Washington is “evaluating options” for refinancing the debt on the Husky Stadium renovation, a “move that potentially could free up valuable cash for operations as the Huskies transition into the Big Ten,” according to The Mercury News’ Jon Wilner, who notes UW paid $12.3M in debt service in FY22. That figure dropped to $3M in FY23 after regents approved a restructuring plan that allows UW to make interest-only payments through FY25. With Washington and Oregon receiving half-shares for the first six years as Big Ten members, Wilner notes the two schools will receive around $180M less than their peers during that period, and “every dollar UW saves on debt service could help offset the revenue disparity.” He adds: “The savings from a restructured payment plan are not publicly known. But if, for example, the new rate lowered UW’s annual debt service by the same amount as the temporary shift to interest-only payments ($3.1M annually) — and if that process played out for the entirety of the Big Ten’s media rights deal — the Huskies would save about $19M.” (link)

Wake Forest is offering a new annual seat rights option for men's basketball season ticket holders beginning with the 2024-25 season. Fans who participate can lock in their seating location on an annual basis rather than having their seats reassigned ahead of each season. Those who join the program will have an annual seat rights payment added on to their season ticket cost. Fans who choose not to participate will select from available seats following the conclusion of the seating period for program participants. South Carolina plans to purchase the 2024 Final Four center court circle and additional panels on which the Gamecocks won this year’s women’s hoops title. The school will purchase the hardwood from Connor Sports and plans to display it in the lobby of Colonial Life Arena. While the price has yet to be determined, Gamecocks Executive Assoc. AD/SWA/Chief Diversity Officer Maria Hickman says acquiring the 2022 center court panels cost around $60K. (link)

The Biden administration has released new Title IX regulations which will prevent colleges and coaches from suspending athletes accused of sexual misconduct while school officials investigate complaints against them. The new rules do not include provisions regarding the eligibility of transgender athletes, which had been included in an earlier Department of Education proposal. ESPN’s Paula Lavigne notes that “officials separated that issue from the broader Title IX rules, and those regulations are not expected until after November's presidential election. Asked during a call with reporters Thursday whether the delay was politically motivated, a senior administration official said those rules have a separate process, which is several months behind. The regulations also address what to do when schools are trying to investigate a complaint of sexual assault at the same time as law enforcement, especially when police or prosecutors ask them to hold off. A federal official says the rule emphasizes the need for a "prompt" process even while a criminal justice process is pending. The official added that while some aspects of the case may need to be paused, not all of them should be put on hold and not indefinitely. Schools are also instructed to return to the "preponderance of evidence" standard – also known as the 51% threshold – to determine whether evidence supports a finding of misconduct. (link)

Arizona State and four individuals who previously worked for the school's football program have reached an agreement with the NCAA enforcement staff on recruiting violations that occurred within the program and the appropriate penalties for those violations. Two individuals are contesting portions of their respective cases via written record hearing. After the written record hearing, the committee will release its full decision. The agreed-upon violations include impermissible in-person recruiting contacts during the COVID-19 dead period, recruiting inducements, impermissible tryouts and tampering. The negotiated resolution also involved the parties' agreement that the underlying violations demonstrated unethical conduct by involved individuals and a head coach responsibility violation. Several involved individuals also failed to meet their legislated responsibility to cooperate throughout the investigative phase of this case. The school also agreed that it failed to monitor its football program. Penalties for the case include four years of probation for ASU, a fine, a self-imposed postseason ban for the 2023 football season, show-causes of three to 10 years, vacation of records for contests in which ineligible student-athletes competed, scholarship reductions and recruiting restrictions in alignment with the Level I-mitigated classification for the school. Additionally, the school disassociated an involved booster for a period of five years. The COI will not discuss further details in the case to “protect the integrity of the ongoing process.” (link)

Arkansas State has agreed that it failed to monitor its women's soccer program, which impermissibly provided travel expenses for families of recruits during official visits, according to a negotiated resolution released by a Committee on Infractions panel. An additional tampering violation occurred in the football program when former football staff member Nick Montgomery and former AC Jon Shalala contacted a DII student-athlete who had not entered the transfer portal. The parties also agreed that Women’s Soccer HC Brian Dooley and Football HC Butch Jones violated head coach responsibility rules as a result of the violations in their respective programs. Prescribed penalties include a four-week reduction in off-campus recruiting contacts and evaluations in the women's soccer program, a reduction of official visits in the football program by three during the 2023-24 academic year, and a two-week ban on unofficial visits for the football program during the 2024-25 academic year, among others.
