With Tulsa AD Rick Dickson set to retire at the end of June, the Tulsa World’s Bill Haisten doubles down on the university needing to consider Oral Roberts AD Tim Johnson: “Having rallied ORU donors for an extensive renovation of the Golden Eagles’ baseball stadium, Johnson is blessed with the people-skill talent required in the fund-raising business. At Clemson, he raised a lot of money for Tiger football, and he was a difference-maker in that school’s campaign to raise $1 billion for various projects. ORU would be sickened to lose Johnson to its crosstown rival, but Johnson should be Candidate No. 1 for the University of Tulsa’s athletic director position.” Haisten also mentions Oklahoma state senator Dave Rader as a possible candidate. Outgoing Ohio State AD Gene Smith on the possibility of football separating from the school: “I’d hate it. I think whatever model exists has to be tethered to education. All the blessings I’ve had thinking back, not just football players, athletes over the years, we’ve changed so many people’s lives. … We have them come to us and they’re very mature and focused and get things done and we’re facilitating their time here and helping them develop. … Some come to us at a very immature level and we do a great job of getting them maturity and a great job of helping the light bulb come on for them. I just think in higher education we have to keep it tethered to education. If not, if it’s not a part of that, then make it semi-pro and take it outside the institution and you pay the institution a contract to use the stadium. But that model would bother me, because I would know that those student-athletes who, regardless of the fact they might be getting some level of money, they’re not being taught how to live the next part of their lives. That’s probably old-school in me, but I’m just passionate about giving these young people the opportunity to be educated.” (link)

Vermont AD Jeff Schulman, Hockey East Commissioner Steve Metcalf, Minnesota-Duluth Men’s Hockey HC Scott Sandelin and North Dakota Deputy AD Erik Martinson participated in a State of the Game press conference during last week’s Frozen Four. Asked about the relative lack of diversity within college hockey, Metcalf noted: “I guess it was three years ago now, a group of folks across the college hockey space came together in a group or committee College Hockey for DEI. … A lot of it is, it's a long game that this is to play. So it's hard to say you can see a direct, tangible result that's happened year over year. The intent is to try to grow some awareness and bring the game to maybe places it hasn't been, trying to work with the NHL folks in communities where the NHL and college hockey both exist. There is some work being done there. We all know that hockey has never been as diverse as perhaps we would all like it to be. There's certainly conversations going on to try to make improvements there.” Sandelin says the possibility of allowing CHL players to participate in college hockey will be a topic when coaches meet in a couple weeks but probably won’t be solved at that time. “I don't want to sit up here and say I'm for it or against it. I want to have a good discussion about it, but certainly probably two years ago I was fine with saying, ‘Hey, I like where our game is at.’ I still do, but I think we have to have some discussion and look at that, for sure.” On the possibility of the growing number of independent programs finding homes in a conference, Metcalf explains: “Some of these programs -- let's see the best way to put this. They started their program and they knew they didn't have a home right away. That was the chance they took. Now I guess there's a few more that have grown. I hear scuttlebutt all the time about maybe some of them banding together or jumping onto another league, perhaps a little movement within the conferences, which might make sense as well.” Lots more. Christopher Deubert, senior counsel with Constangy, Brooks, Smith & Prophete LLP, which is representing the NCAA in the Johnson case, outlines the following list of “practical considerations” should student-athletes become employees: compensation, taxes, collective bargaining, NIL rights, health insurance, workers’ compensation and employer rights. While certain star athletes may be able to negotiate compensation in the hundreds of thousands and into the millions, Deubert posits “the vast majority would be in line for the minimum wage or something just above it, amounts that might easily be satisfied by a scholarship and the benefits already provided.” Deubert also warns that student-athletes’ scholarships and other in-kind benefits “would seemingly be considered taxable income. Student athletes would thus be in the position of owing a considerable amount in taxes, even though they did not actually receive any cash income.” Also from Deubert: “Employers have the right to terminate employees so long as doing so doesn’t violate law or contract. Student athletes could theoretically be terminated from the team – and perhaps even the school – for poor athletic performance. Schools could also exert even greater control over student athletes, including practice schedules and related obligations, further straining their academic pursuits.” Full op-ed in SBJ. (link)

The Competition Oversight Committee addressed several topics at last week’s meeting, including championship licensing and NIL for student-athletes. Member institutions can participate at their discretion. The system is predicated on the use being lawful; the use complying with the NCAA’s NIL policy (e.g., no inducements); the NCAA does not provide consideration or value to the student‐athletes; and the member institution affiliated with the student‐athlete has no objections. These four precautions were central to the NCAA’s decision to allow its corporate champions and partners to use student-athlete NIL in their promotional campaigns surrounding NCAA championships. The committee supported a proposal by the Committee on Women’s Athletics to introduce legislation to add women’s wrestling as a National Collegiate championship and establish a women’s wrestling committee. In fall of 2023, 41 NCAA member institutions met minimum sports-sponsorship requirements, putting the sport above the legislatively required threshold of 40 varsity programs to be considered for National Collegiate championship status. If adopted, and pending budget approval, the women’s wrestling committee would begin its work in January 2025 to prepare for the first National Collegiate championship in winter 2026. The COC also considered but did not support the women’s lacrosse committee’s request to allow video review to be used during its national championship tournament, including at preliminary-round host sites that have the capability of doing so. The Athletic’s Max Olson breaks down college football programs into five categories vis-a-vis their approach to the transfer portal: the NIL barons, the portal enthusiasts, the desperate portalers, the need-based portalers, and the portal deniers. While it’s not a hard and fast rule, NIL barons tend to get what they want, but Olson notes it’s not necessarily about having the most money overall. “Georgia and Alabama continue to be in a class of their own. They usually don’t take many transfers, but the few they add will be legit.” Ole Miss’ expertise in portal recruiting has helped the Rebels catch up to those two SEC powers, but HC Lane Kiffin acknowledged that’s always a moving target. “It closes the gap, but then at times it doesn’t.” Olson describes the “desperate portalers” as programs in their first or second year under a new HC who don’t really have a choice because “rosters get raided during coaching transitions.” The portal deniers category, meanwhile, is led by Clemson, who is “the only Power 5 program that has signed zero transfers this offseason. Iowa has typically been very selective with transfers in recent years and only took one this offseason (who later returned to Alabama). … The list of programs on the low end of transfer commitments so far includes Michigan (two), Stanford (two), Northwestern (three) and Virginia Tech (four). … We’ll see whether the spring window changes the calculus for a few of these teams.” (link)

Dallas Stars Business Strategy and Analytics Senior Analyst Jed Buchholz talks with SBJ’s Rob Schaefer about how a neural network machine learning model he helped build to serve as a ticket pricing analyst for the team achieved fast results. Across the 2023-24 season, the Stars have generated more than $300K in incremental revenue from single-game ticket price adjustments made using Buchholz’s AI model. Buchholz explains he trained the first version of his model against a “smooth moving average” of Ticketmaster’s ticket price adjustment tool’s recommendations and the average ticket price on the Stars’ resale market. Buchholz and Stars VP for Ticket Sales and Service Daniel Venegas emphasize that the model’s automated price adjustments are meant to augment the team’s existing sales staff, not replace it. Venegas: “[Buchholz] is using that to be able to put in recommendations to me, and I’m going through those and implementing the ones that I think make a lot of sense. We still have a little manual oversight over it. It’s not straight AI to the pricing model and then straight to the web.” Still, the Stars’ success using AI has led the team to investigate more use cases, such as predictive modeling for attendance, membership renewal and new business projections. Venegas: “Most of this stuff isn’t crazy as far as huge investments that we need to make. We’ve used a couple vendors, we do some stuff internally, and that allows us to spread the costs of what it would be to try to take everything on.” (link)

MEAC Commissioner Sonja Stills testified this week before an NLRB judge that classifying student-athletes as employees would have a “severe impact” on HBCUs. Stills: “We can't afford paying our students [because of] the tax implications of what we think scholarships would be if it turned into a salary.” Further, she points out, the students receiving the scholarships or aid often "can't afford to go to school, how would they afford to pay the taxes on the salary?" Stills predicts that at least some of the Olympic sports or the “non-revenue sports” would be eliminated. More details behind the Law360 paywall. (link)

More NLRB testimony as Stanford track student-athlete Liam Anderson argued that some student-athletes should be considered employees due to the control programs exerted over them. Anderson cited a time he encountered a hotel curfew guard for a DI basketball team as an example of how tight that control can be. Anderson, who is also the former co-president of Stanford’s SAAC, said his time leading the committee led him to believe that student-athletes in the Power 5 conferences playing in "top tier" sports like football and men's and women's basketball should be considered employees, while athletes in other sports, such as track and field, may also qualify depending on the situation. Anderson explained the difference between the tiers, as he saw it, had to do with the level of control programs exert over athletes' everyday lives, as well as the level of "commercialization and professionalization" of those sports. Anderson also asserted that many individuals, including pundits on TV, "fearmonger" that if athletes in top-tier sports are recognized as employees, it could lead to the non-revenue generating sports being cut. What's more likely, Anderson said, is that universities will start exerting less control over the lives of athletes in the lower tiers. (link)

CBS Sports’ Matt Norlander: “In talking to people across CBB this week there's an unrelenting, overwhelming sentiment that portal recruiting—while new/crazy the past few years—is at an entirely different level of insanity + untrustworthiness in 2024 due to the NCAA being forced to back off all NIL oversight. [...] Have also heard a few funny stories where decent high-major starters are now asking double or triple in NIL $$$ vs. what top-10 guys in the portal were getting 2 yrs ago. Some thought NIL collective money might dwindle a tad. Instead, there are more people in NIL space than ever. To wit: There are legitimate professional agents repping NBA players on big contracts who've waded into the NIL space as a side gig b/c the COMMISSION on players landing in certain spots can be worth six figures. Toss in the bonus COVID year forthcoming and it's a big ol' stew.” (link)

The Athletic’s Scott Dochterman points out that just 58 underclassmen declared for the 2024 NFL Draft, the lowest number in more than a decade, and cites a number of Iowa players returning who in past years might not have as an example of how “NIL has helped college football teams compete with NFL opportunities. Players can return to school as starters, continue developing and earn more compensation from NIL rather than risk their football future as a late-round pick or undrafted free agent. That option also has ramifications for NFL teams,” as Denver Broncos GM George Paton says there are concerns the draft’s later rounds aren’t as deep as in previous years. Detroit Lions GM Brad Holmes adds: “I wouldn’t be surprised if those numbers drop even more next year. Obviously, traditionally the underclassmen have been the meat of the first two rounds of the draft, so we’ll just kind of see how that changes in the very end.” Dochterman notes that according to Spotrac, the top seventh-round pick will receive a $118K bonus in this year’s draft, below what many Power 5 starters can earn in the NIL market. More from Dochterman. (link)

The NCAA is asking a federal judge in West Virginia to dismiss a lawsuit brought by Montana State-to-West Virginia men’s basketball student-athlete, RaeQuan Battle, who claims the organization sought to prevent him from being eligible after a midseason transfer. The NCAA argues the suit is too vague to pass legal muster, saying “The hodgepodge of contract-related claims [Battle] alleges fail for a multitude of reasons. The simplest — and most recurring of these — is that [Battle's] allegations require the NCAA and the court to guess what his claims are." John Gianola, legal counsel for Battle, thinks it is unfortunate that it takes federal litigation for the NCAA to understand there are issues with its enforcement rules: "It is equally unfortunate that they do not seem to appreciate the consequences that the disregard of their own policies and procedures can have on young athletes. I find it incredibly telling that just yesterday— the same day the motion was filed — the NCAA's Division I Council unanimously passed a resolution that would allow the type of transfer for which RaeQuan's waiver was denied." Former Department of Homeland Security Policy Advisor Matthew Wein advocates for the formation of a sports gambling integrity commission. In an op-ed for SBJ, Wein explains the NCAA and professional leagues should take steps form such a commission to “take stock of the vulnerabilities that exist and propose steps that promote integrity in a transparent manner. The commission should consist of representatives from each league in addition to at least five additional independent commissioners. The leagues should work with gambling platforms to gather the necessary data to understand the trends the leagues face and inform deliberations and potential recommendations. The commission should produce a report that outlines in a transparent way the vulnerabilities that threaten the integrity of the games in addition to actionable recommendations to address those vulnerabilities. The report is an opportunity for leagues and teams to ensure that they not fall victim to the error of failing to imagine the non-conventional steps that fans or others might take to distort a level playing field. … Athletes and spectators alike see the threat over the near horizon – the question that remains is which sport will move first to place the integrity of their game near the top of their priorities and act in concert with their fellow leagues.” (link)
