Pacific Lutheran AD Mike Snyder chats with BOSCA Founder Jim Abbott about key issues in DIII, his path to the chair, professional development on committees, advice for those looking to sit in the chair and more. Snyder’s path to PLU involved evaluating all DIII AD jobs based on endowment, enrollment, championships to try to “figure out mathematically what the right schools that I could really be a part of.” On the enrollment cliff: “Right now, budgets are tight and they have to be at least for the next few years. Now the outlook down the road for some of us looks better. I mean we can see the light at the end of the tunnel and for those of us who are able to make it through these next few years, I think we will see some better days ahead. But right now, there's no no doubt talking with colleagues here on campus, in the conference, across the country, you just keep hearing, ‘Oh, man, I had to take this percentage cut,’ and we can't do this or that anymore. I have to cut back on these things and you struggle because you have a level of expectation, a level of operating, that you just kind of say that this is how it should be. This is the student-athlete experience that we're providing and when you're invested in this work, it almost feels like a personal cut. … I think that that's kind of the biggest thing is we're all trying to figure out how we continue to provide a great student-athlete experience in a changing budgetary world.” Lots more. Christopher Deubert, senior counsel with Constangy, Brooks, Smith & Prophete LLP, which is representing the NCAA in the Johnson case, outlines the following list of “practical considerations” should student-athletes become employees: compensation, taxes, collective bargaining, NIL rights, health insurance, workers’ compensation and employer rights. While certain star athletes may be able to negotiate compensation in the hundreds of thousands and into the millions, Deubert posits “the vast majority would be in line for the minimum wage or something just above it, amounts that might easily be satisfied by a scholarship and the benefits already provided.” Deubert also warns that student-athletes’ scholarships and other in-kind benefits “would seemingly be considered taxable income. Student athletes would thus be in the position of owing a considerable amount in taxes, even though they did not actually receive any cash income.” Also from Deubert: “Employers have the right to terminate employees so long as doing so doesn’t violate law or contract. Student athletes could theoretically be terminated from the team – and perhaps even the school – for poor athletic performance. Schools could also exert even greater control over student athletes, including practice schedules and related obligations, further straining their academic pursuits.” Full op-ed in SBJ. (link)

The entire Brandeis Women’s Basketball team has sent a letter to HC Carol Simon stating they will depart if she does not resign, according to the Boston Globe’s Michael Silverman, who reports the call for Simon’s resignation follows the conclusion of a yearlong investigation that found no violations of institutional policies and reinstated Simon. A week after the investigation concluded, members of the WBB squad read impact statements they filed with the Office of Equal Opportunity during a meeting with athletic department staff and fellow student-athletes. Lone senior Selena Gonzalez writing: “I am exhausted from the numerous attempts at recounting my trauma, which continue to be disregarded and ignored. From the second I’ve stepped foot on this campus, I’ve developed and expressed concerns regarding women’s basketball players, especially those of color, quitting under Carol Simon. […] my heart is with the players that still have one or two years left of having to navigate all of this, so just even having to recount my trauma and my story, it’s for them.” Junior student-athlete Lulu Ohm adding of the situation and incoming AD Jessica Chapin, who played for Simon while at Brandeis: “The team is in shambles. People are stressed out of their minds because there’s a pressure on us to make things right because, unfortunately, the university has not really been hearing us until we started showing them how much we need to be heard. […] It’s not [Chapin], it’s the name that she’s attached to and the history and the timing — it’s very icky. Who will we talk to if we have issues about Carol?” (link)

Sportico’s Michael McCann observes the Biden administration’s new Title IX regulations could make it “harder for students accused of misconduct to rebut allegations,” as schools will “no longer be required to hold live hearings that include opportunities for cross-examination. Schools can instead hold separate meetings with the accuser and the accused, with a school-appointed official asking questions. The school must then provide the parties with recordings or transcripts. Even when live hearings are held, a student must be able to participate remotely instead of in-person. One argument in favor of holding separate hearings is survivors may be more likely to report incidents if they don’t have to face their attacker again. When Title IX live hearings were mandated by the Trump administration, survivors’ rights advocates criticized the move as undermining Title IX’s goals. On the other hand, the ability to confront one’s accuser is a hallmark of the American legal system. The Sixth Amendment contains the Confrontation Clause, which guarantees the right to confront witnesses in criminal trials.” Title IX, however, is not a criminal law. As far as how the new regulations impact player compensation, McCann contends Title IX still applies. Schools “who pay football and/or men’s basketball players but not pay other athletes would undoubtedly face Title IX litigation. They might also face claims under the Equal Pay Act and Title IX of the Civil Rights Act.” More. (link)

Albertus Magnus announces the addition of Women’s Golf as its 18th DIII sport with play scheduled to begin in the 2024-25 academic year. Current Men’s Golf HC Rick Malafronte will take over the helm of both programs. (link, link)

Wisconsin-Superior will host a formal groundbreaking ceremony for Superior Choice Credit Union Stadium on April 25. The facility, which will serve as the on-campus home of Yellowjacket men’s & women’s soccer and track & field, is slated for completion in August 2024. (link)

A new study in Research in Higher Education by researchers at Georgia (DI) examined the impact of adding football on enrollment and tuition revenue. From the study: “In summary, a difference-in-difference analysis suggests that colleges adding football programs see an immediate increase in applications and enrollment, particularly male enrollment, when they launch football teams. This methodology allows us to compare foot-ball-starting colleges with others that never added the sport to better assess the effects of football on institutional metrics. The analysis suggests more muted effects on diversifying enrollment, and found no impact on tuition and fee revenue. […] Our findings do not necessarily imply that football-adopting colleges return to baseline enrollments or shrink from prior levels. Instead, it may well be that a football-adopting school begins drawing from larger pools of potential students than before, thus diversi-fying its key sources of students.” Lead author Welch Suggs tells Sportico: “This is the closest we can come to saying, what would have happened to a college if it never added football. It’s often said that sports is the front porch of the university. But what we’re seeing is that colleges that didn’t build that front porch are likely getting the same number of students and tuition dollars as those that recently did.” More.(link, link)
