The DI Board of Directors affirmed last week’s DI Council decision to allow schools to provide student-athletes with access to additional assistance with NIL activities and more flexibility to transfer, effective immediately. Specifically, schools can identify NIL opportunities and facilitate deals between student-athletes and third parties as long as student-athletes disclose their NIL arrangement. Student-athletes are not obligated to accept assistance from the school and must maintain authority over the terms in their NIL agreements. Also effective immediately, student-athletes who meet certain academic eligibility requirements will be immediately eligible at their next school, regardless of whether they transferred previously. To be eligible for an immediate transfer, undergraduate student-athletes must have left their previous school while academically eligible and in good standing (not subject to disciplinary suspension or dismissal) and meet progress-toward-degree requirements at their new school before competing. For graduate transfer student-athletes to be eligible, they must earn a degree from their previous school, leave while academically eligible and be enrolled as a full-time postgraduate student while satisfying minimum academic standards. Meanwhile, the Board of Directors Finance Committee will seek membership feedback on the targeted distribution amount, structure and source of funding for the women's basketball fund. Based on initial feedback, the committee is targeting an initial payout in FY26 based on performance in the 2025 NCAA Tournament. The board also moved the Pac-12 from an autonomy FBS conference to a non autonomy FBS conference, effective August 2. Wisconsin Chancellor Jennifer Mnookin discussed the state of college sports with the UW Athletic Board and said: "I think some of the challenges are that, across the country, NIL is not necessarily operating in the way that it was initially envisioned. The relationship between name, image and likeness – narrowly perceived – and some of the NIL deals that you read about is not always totally linked. I think that's a meaningful challenge. … While I am a very strong advocate of athletes' ability to receive compensation for name, image and likeness, I do think that parts of how NIL is operating in the broader landscape are messier than that. And the combination of the way that's playing out and the transfer portal is a challenge." For UW, Mnookin emphasizes the importance of staying true to the university’s values and adds: "We have to be looking ahead. There's a lot of uncertainty right now in many dimensions of the structures surrounding college athletics. Goodness knows I don't have all the answers; neither do any of you. If you think you do, whatever you think will probably turn out to be partly wrong, right? So being able to be both thoughtful about opportunities and to have the ability to change and chart new directions but also to have some of the values that I was just describing feels like it's going to be important in years to come." New York State Gaming Commission Chairman Brian O’Dwyer last week sent a letter to NCAA President Charlie Baker in which he endorsed a nationwide ban on prop bets on college athletes. O’Dwyer: “With the commencement of legal sports wagering in our state, the New York State Gaming Commission made a policy determination to prohibit individual athletic-based proposition betting within any collegiate event, as we shared the same desire to insulate student-athletes from potential harassment regarding their performance. We are pleased that many states have followed our lead and have since adopted such a similar restriction. As regulators of the largest sports betting market in the United States, we continue to believe the prohibition of college proposition betting on student-athletes is appropriate. New York State appreciates your efforts to help implement this important protective measure nationwide.” (link)

Ahead of its move to the ACC, SMU has selected Anthony James Partners to build out a new SMPTE 2110 broadcast production facility. Slated for completion in the fall, the facility features four control rooms (two full linear control rooms, and two full digital control rooms) centered around a SMPTE 2110-compliant core and 1080p HDR base resolution, capable of up to 8K. The facility includes several editing suites, an independent shading and engineering room, small cut-in studio, technical operations center, and production staff offices. (link)

Executives throughout the sports industry reflect on outgoing CBS Sports Chair Sean McManus’ 28-year tenure, including NCAA SVP of Basketball Dan Gavitt, who tells SBJ’s Mollie Cahillane: “He’s a very trusted confidant on top of being just a great partner. I’ve learned quite a bit from just watching how he operates as an executive who develops and maintains relationships at the highest level in the business. His leadership has certainly been transformational for the NCAA Division I men’s basketball championship over 27 years.” Gavitt adds that CBS’ partnership with Turner to broadcast March Madness “may have been the most impactful media development in the history of the men’s basketball championship. To have two rival sports media companies partner, share resources around production, talent, sales, programming, and put on this incredible American iconic event was very unique, borne out to be highly successful, but there was some risk involved with that.” Meanwhile, McManus tells Cahillane he still believes in the importance of broadcast and linear television: “Most of the top-tier events in sports are going to remain on broadcast or linear cable. I’ll include ESPN in that. … Sports will remain and become increasingly more important — it’s really what’s holding the traditional pay-TV bundle together, and I think it’s going to be even more valuable a year from now and five years from now.” (link)

ESPN and Warner Bros. Discovery appear to be in “good positions to claim two of the NBA’s rights packages,” according to Puck’s John Ourand, who notes even though a contract has yet to be signed, the league can now determine whether it wants to offer third and fourth packages, “which would certainly include meaningful playoff games.” For those packages, Ourand notes NBA Commissioner Adam Silver is “enamored by these big streaming companies” for their international reach, among other reasons. “Instead of selling rights packages country by country, the NBA could use Amazon Prime or Netflix to go international in an instant. In particular, Netflix presents a wild card.” Ourand cites Moffett Nathanson Senior Research Analyst Michael Nathanson, who explained last week: “Netflix seems poised to further invest into the world of sports. We aren’t overly concerned about the potential of high sports rights costs weighing on margins, as long as Netflix stays away from acquiring a major sports package. We also believe that, despite its higher upfront costs, sports could actually be a better use of money for Netflix than some of its current original programming thanks to the dependability of the eyeballs sports delivers.” (link)

Netflix brass said on a recent earnings call that it’s “not anti-sports but pro profitable growth,” per CNBC’s Alex Sherman. (link); Meanwhile, Netflix will no longer provide its quarterly reporting of subscriber totals, “a move that could blunt its growing sports ambitions,” according to Front Office Sports’ Eric Fisher, who observes: “Much of the sports industry, and the advertising that helps support it, relies on clear and publicly available audience metrics for media content. Nearly every other major streaming entity—including ones controlled by Disney, Comcast, and Warner Bros. Discovery—regularly reports its streaming subscriber figures. On television, Nielsen audience totals have been a benchmark for decades. Even Amazon, another entity that historically had been more opaque about its streaming metrics, has worked with Nielsen for the past two years to help give a clearer view of its audience for Thursday Night Football.” Guggenheim analyst Michael Morris adds: “Eliminating regular reporting of membership data raises questions around management’s confidence to further grow the base, though it is not implausible that the change is intended to reduce quarterly sentiment volatility around relatively small changes in true economic drivers.” (link)

Nike is walking back its strategy of selling products directly to customers, according to the Wall Street Journal’s Inti Pacheco, who notes in an in-depth chronicle of CEO John Donahoe’s tenure that “Nike veterans said cutting off wholesale clients was one of the biggest mistakes the company has ever made. After digital sales hit the 30% of the total mark early in the pandemic, they dropped back, and haven’t reached that level since—let alone the 50% target Donahoe had foreseen.” Pacheco notes that “as part of its accelerated focus on digital sales, Nike hired about 3,500 people to join what the company calls its global technology group, which includes consumer insights and data analytics. Executives at the time said they were investing in ‘demand sensing,’ ‘insight gathering’ and a new inventory system. Former Nike employees with knowledge of the consumer insights strategy said executives misinterpreted the data in ways that overestimated demand for retro franchises.” Now, as Nike increasingly returns to retail chains, Donahoe says: “I don’t see it as a reversal of the strategy. I see it as an adjustment.” Looking toward the future, current and former Nike executives believe the future of the company is in its app ecosystem and the data it can harness to help design and sell products. Yahoo’s Ross Dellenger examines the impact of commissioners’ inability to decide on a College Football Playoff format in 2022, and MAC Commissioner Jon Steinbrecher tells him: “Our inability to conclude a deal two-plus years ago had a pretty significant impact on where the financials ended up. What was on the table in 2022 was simply different. The delay opened the door for continuing changes to where we ended up.” Dellenger notes the SEC and Big Ten did, in fact, negotiate a “one-sided deal, in part, by using a lingering belief that they would abandon all others to form their own postseason.” But would the SEC have really left the CFP? Commissioner Greg Sankey says: “Absolutely. When we ended that set of meetings in January 2022 without a decision, I was clear: If you are going to walk away from this opportunity, we are going to reevaluate our position on format, revenue sharing and governance. People called me (after the latest deal) and said, ‘Why did you take a hard line? Why did you put us in this position?’ I said, ‘You guys walked away from the deal.’” This year’s negotiations were, at times, “heated,” according to ACC Commissioner Jim Phillips, who tells Dellenger: “I don’t think anybody loved all of it, but everybody tried to message what they felt was important for their conference. You bargain and push as hard as you can.” Big 12 Commissioner Brett Yormark acknowledges he isn’t “thrilled” with the revenue distribution, but says it’s “the best deal we could get.” Pac-12 Commissioner Teresa Gould adds: “College athletics is one of the most inefficient economic models that probably exists. From a business perspective, it’s not particularly logical. I’m concerned that everything that is happening — financial disparities and litigation — is going to put people out of business.” Lots more. (link)

Leon County (FL) Judge John C. Cooper has ruled in favor of the ACC’s motion to dismiss Florida State’s lawsuit while allowing FSU to amend its complaint and says: “The case is not over. The case will continue. … I send every case to mediation except mortgage foreclosures. This is not being done any differently.” The Tampa Bay Times’ Matt Baker reports Cooper has called for both sides to meet for mediation within 120 days. FSU will have seven days to amend its complaint. During the hearing, an attorney for FSU “held up copies of three contracts in dispute here, including the ACC-ESPN contract. It turns out pages 1-160 are blank. FSU has been trying to get a physical copy of the contract for weeks, because the contract is kept secret at the ACC’s headquarters in North Carolina.” Additionally, “FSU’s counsel said he’s confident the conference and Seminoles could negotiate a settlement on the $130M exit fee in ‘fairly short order.’ But that part leaves out the dispute over the grant of rights and who holds the rights (and TV money) for FSU home games from 2024-36.” More from Leon County. Arizona, Arizona State, Colorado and Utah combined to record a $34.1M operating shortfall in 2023, but The Mercury News’ Jon Wilner observes that “in total, the Four Corners schools received $74.5M in direct support. Remove that amount from the countable revenue, and that substantial operating shortfall of $34.1M becomes a $108.6M crater. Add the $31.6M loan Arizona’s athletic department received from central campus and the all-too-real shortfall zooms to $140.2M — or more than half of the Pac-12’s total for the 2023 fiscal year.” Now that the schools are moving to the Big 12, Wilner anticipates the situation will improve but “not nearly enough” to cover the shortfall. Some back-of-the-napkin math shows the Four Corners schools will bring in $45M each in their first year in the Big 12, roughly $10M more than they received in the Pac-12. “Even if the estimate is low by a few million dollars per school, it won’t fully offset the need for campus support next year. Without that support, the operating shortfalls for Arizona, ASU and Colorado were in excess of $35M in 2023, while Utah’s deficit was $14.4M. In theory, the Utes will get close to break-even with their Big 12 distributions in 2025. The other three athletic departments probably won’t. … From our vantage point, the outlook is fairly clear and somewhat bleak: Arizona, ASU and Colorado will continue to rely heavily on university subsidies in their new home.” (link)

East Tennessee State AD Richard Sander believes ETSU will need to secure at least $200K in NIL funding for its 2024-25 men's basketball team to be competitive in the Southern Conference. Sander believes a couple players will receive $40-50K each, maybe three or four more will have packages of $25-40K and a few other players could get upwards of $15K. “Pretty much that’s what we’re trying to shoot for.” Most SoCon all-conference players have hit the portal for bigger paydays at bigger schools, and Sander observes: “That’s the reality of where it is. When the transfer portal and NIL came in at the same time, you couldn’t have had a (more impactful) combination, two different programs just creating unbelievable turmoil. … It just changes the core of what we’ve always tried to do, use sport as a way to build a lot of social value through teamwork, through resiliency, through working together, through working hard. Now it’s all come down to ‘What am I going to get paid?’ I think a lot of values that we try to teach through sport have pretty much been eliminated.” (link)

As Altius Sports Partners promised to “create business plans to ‘Future-Proof’” Michigan’s athletic department against the industry’s looming challenges, Sportico’s Daniel Libit notes: “Left unwritten is that Altius’ own future appears no more certain than any of the schools it is advising. Indeed, one could surmise that the NIL concerns of Altius and its clients are inversely related—the more stable, or predictable, the space becomes, the less schools may need to rely on the expertise, or the onus, of outside companies. … One of its main points of leverage is that the NCAA has so far restricted schools from directly soliciting deals on behalf of their athletes. Yet that may not be the case for much longer.” However, Libit points out that Altius’ staying power could lie in its ability to allow athletic departments to outsource risk. “For public universities, which are generally subject to state transparency laws, Altius also provides a mechanism to engage in the NIL process in a way that is shielded from public scrutiny.” Libit also breaks down some of Altius’ financial arrangements with universities. Michigan is paying the firm $1.64M over four years – $5K per month as a standard consulting fee plus annual payments of between $255K and $309K for the in-house GM. Altius’ deal with Oklahoma, which runs through 2028, includes OU paying consulting fees of $15K per month for the first half year, then $5K per month for the remainder of the term. The Sooners’ on-campus package includes both a GM position, which starts at an annual salary of $225K, then increases 5% each year, as well as a $75K-per-year “revenue analyst,” who can earn discretionary bonuses of up to 20%. Sportico’s Michael McCann observes the Biden administration’s new Title IX regulations could make it “harder for students accused of misconduct to rebut allegations,” as schools will “no longer be required to hold live hearings that include opportunities for cross-examination. Schools can instead hold separate meetings with the accuser and the accused, with a school-appointed official asking questions. The school must then provide the parties with recordings or transcripts. Even when live hearings are held, a student must be able to participate remotely instead of in-person. One argument in favor of holding separate hearings is survivors may be more likely to report incidents if they don’t have to face their attacker again. When Title IX live hearings were mandated by the Trump administration, survivors’ rights advocates criticized the move as undermining Title IX’s goals. On the other hand, the ability to confront one’s accuser is a hallmark of the American legal system. The Sixth Amendment contains the Confrontation Clause, which guarantees the right to confront witnesses in criminal trials.” Title IX, however, is not a criminal law. As far as how the new regulations impact player compensation, McCann contends Title IX still applies. Schools “who pay football and/or men’s basketball players but not pay other athletes would undoubtedly face Title IX litigation. They might also face claims under the Equal Pay Act and Title IX of the Civil Rights Act.” More. (link)

Former Nebraska Women’s Basketball AC Chuck Love denies ever having a sexual relationship with former student-athlete Ashley Scoggin but admits he did meet her late at night in a Lincoln parking lot. Scroggin earlier this year filed a lawsuit describing how Love allegedly took a special interest in her and that the relationship allegedly turned sexual. Scoggin said she feared retaliation if she refused to engage in it. Scroggin accuses former AD Trev Alberts and WBB HC Amy Williams of not setting rules, training or policies prohibiting staff members from having sexual relationships with athletes. In his response to the suit, Love acknowledged he met Scoggin at a parking lot, saying she was "emotionally distraught and urgently insisted that she needed to see (him) immediately, so they agreed to meet at a parking lot, a place where Scoggin felt she could speak without fear of being heard by others, in particular other players on the team." According to the AP, Scoggin was “discovered in Love's hotel room during a trip to Penn State in February 2022. Teammates engaged in a ruse to obtain a key to Love's room. When they entered, they discovered Scoggin on the bed fully clothed. Love said Scoggin had been in his room at her request to discuss a personal problem.” The NU Board of Regents, Williams and Alberts said in their joint response that they didn't have "sufficient information and belief to either admit or deny the allegations" of a sexual relationship between Scoggin and Love.
