Yahoo’s Ross Dellenger examines the impact of commissioners’ inability to decide on a College Football Playoff format in 2022, and MAC Commissioner Jon Steinbrecher tells him: “Our inability to conclude a deal two-plus years ago had a pretty significant impact on where the financials ended up. What was on the table in 2022 was simply different. The delay opened the door for continuing changes to where we ended up.” Dellenger notes the SEC and Big Ten did, in fact, negotiate a “one-sided deal, in part, by using a lingering belief that they would abandon all others to form their own postseason.” But would the SEC have really left the CFP? Commissioner Greg Sankey says: “Absolutely. When we ended that set of meetings in January 2022 without a decision, I was clear: If you are going to walk away from this opportunity, we are going to reevaluate our position on format, revenue sharing and governance. People called me (after the latest deal) and said, ‘Why did you take a hard line? Why did you put us in this position?’ I said, ‘You guys walked away from the deal.’” This year’s negotiations were, at times, “heated,” according to ACC Commissioner Jim Phillips, who tells Dellenger: “I don’t think anybody loved all of it, but everybody tried to message what they felt was important for their conference. You bargain and push as hard as you can.” Big 12 Commissioner Brett Yormark acknowledges he isn’t “thrilled” with the revenue distribution, but says it’s “the best deal we could get.” Pac-12 Commissioner Teresa Gould adds: “College athletics is one of the most inefficient economic models that probably exists. From a business perspective, it’s not particularly logical. I’m concerned that everything that is happening — financial disparities and litigation — is going to put people out of business.” Lots more. (link)

Leon County (FL) Judge John C. Cooper has ruled in favor of the ACC’s motion to dismiss Florida State’s lawsuit while allowing FSU to amend its complaint and says: “The case is not over. The case will continue. … I send every case to mediation except mortgage foreclosures. This is not being done any differently.” The Tampa Bay Times’ Matt Baker reports Cooper has called for both sides to meet for mediation within 120 days. FSU will have seven days to amend its complaint. During the hearing, an attorney for FSU “held up copies of three contracts in dispute here, including the ACC-ESPN contract. It turns out pages 1-160 are blank. FSU has been trying to get a physical copy of the contract for weeks, because the contract is kept secret at the ACC’s headquarters in North Carolina.” Additionally, “FSU’s counsel said he’s confident the conference and Seminoles could negotiate a settlement on the $130M exit fee in ‘fairly short order.’ But that part leaves out the dispute over the grant of rights and who holds the rights (and TV money) for FSU home games from 2024-36.” More from Leon County. Arizona, Arizona State, Colorado and Utah combined to record a $34.1M operating shortfall in 2023, but The Mercury News’ Jon Wilner observes that “in total, the Four Corners schools received $74.5M in direct support. Remove that amount from the countable revenue, and that substantial operating shortfall of $34.1M becomes a $108.6M crater. Add the $31.6M loan Arizona’s athletic department received from central campus and the all-too-real shortfall zooms to $140.2M — or more than half of the Pac-12’s total for the 2023 fiscal year.” Now that the schools are moving to the Big 12, Wilner anticipates the situation will improve but “not nearly enough” to cover the shortfall. Some back-of-the-napkin math shows the Four Corners schools will bring in $45M each in their first year in the Big 12, roughly $10M more than they received in the Pac-12. “Even if the estimate is low by a few million dollars per school, it won’t fully offset the need for campus support next year. Without that support, the operating shortfalls for Arizona, ASU and Colorado were in excess of $35M in 2023, while Utah’s deficit was $14.4M. In theory, the Utes will get close to break-even with their Big 12 distributions in 2025. The other three athletic departments probably won’t. … From our vantage point, the outlook is fairly clear and somewhat bleak: Arizona, ASU and Colorado will continue to rely heavily on university subsidies in their new home.” (link)

East Tennessee State AD Richard Sander believes ETSU will need to secure at least $200K in NIL funding for its 2024-25 men's basketball team to be competitive in the Southern Conference. Sander believes a couple players will receive $40-50K each, maybe three or four more will have packages of $25-40K and a few other players could get upwards of $15K. “Pretty much that’s what we’re trying to shoot for.” Most SoCon all-conference players have hit the portal for bigger paydays at bigger schools, and Sander observes: “That’s the reality of where it is. When the transfer portal and NIL came in at the same time, you couldn’t have had a (more impactful) combination, two different programs just creating unbelievable turmoil. … It just changes the core of what we’ve always tried to do, use sport as a way to build a lot of social value through teamwork, through resiliency, through working together, through working hard. Now it’s all come down to ‘What am I going to get paid?’ I think a lot of values that we try to teach through sport have pretty much been eliminated.” (link)

As Altius Sports Partners promised to “create business plans to ‘Future-Proof’” Michigan’s athletic department against the industry’s looming challenges, Sportico’s Daniel Libit notes: “Left unwritten is that Altius’ own future appears no more certain than any of the schools it is advising. Indeed, one could surmise that the NIL concerns of Altius and its clients are inversely related—the more stable, or predictable, the space becomes, the less schools may need to rely on the expertise, or the onus, of outside companies. … One of its main points of leverage is that the NCAA has so far restricted schools from directly soliciting deals on behalf of their athletes. Yet that may not be the case for much longer.” However, Libit points out that Altius’ staying power could lie in its ability to allow athletic departments to outsource risk. “For public universities, which are generally subject to state transparency laws, Altius also provides a mechanism to engage in the NIL process in a way that is shielded from public scrutiny.” Libit also breaks down some of Altius’ financial arrangements with universities. Michigan is paying the firm $1.64M over four years – $5K per month as a standard consulting fee plus annual payments of between $255K and $309K for the in-house GM. Altius’ deal with Oklahoma, which runs through 2028, includes OU paying consulting fees of $15K per month for the first half year, then $5K per month for the remainder of the term. The Sooners’ on-campus package includes both a GM position, which starts at an annual salary of $225K, then increases 5% each year, as well as a $75K-per-year “revenue analyst,” who can earn discretionary bonuses of up to 20%. Lots more on how Altius has positioned itself moving forward. (link)

Sportico’s Michael McCann observes the Biden administration’s new Title IX regulations could make it “harder for students accused of misconduct to rebut allegations,” as schools will “no longer be required to hold live hearings that include opportunities for cross-examination. Schools can instead hold separate meetings with the accuser and the accused, with a school-appointed official asking questions. The school must then provide the parties with recordings or transcripts. Even when live hearings are held, a student must be able to participate remotely instead of in-person. One argument in favor of holding separate hearings is survivors may be more likely to report incidents if they don’t have to face their attacker again. When Title IX live hearings were mandated by the Trump administration, survivors’ rights advocates criticized the move as undermining Title IX’s goals. On the other hand, the ability to confront one’s accuser is a hallmark of the American legal system. The Sixth Amendment contains the Confrontation Clause, which guarantees the right to confront witnesses in criminal trials.” Title IX, however, is not a criminal law. As far as how the new regulations impact player compensation, McCann contends Title IX still applies. Schools “who pay football and/or men’s basketball players but not pay other athletes would undoubtedly face Title IX litigation. They might also face claims under the Equal Pay Act and Title IX of the Civil Rights Act.” More. (link)

Former Nebraska Women’s Basketball AC Chuck Love denies ever having a sexual relationship with former student-athlete Ashley Scoggin but admits he did meet her late at night in a Lincoln parking lot. Scroggin earlier this year filed a lawsuit describing how Love allegedly took a special interest in her and that the relationship allegedly turned sexual. Scoggin said she feared retaliation if she refused to engage in it. Scroggin accuses former AD Trev Alberts and WBB HC Amy Williams of not setting rules, training or policies prohibiting staff members from having sexual relationships with athletes. In his response to the suit, Love acknowledged he met Scoggin at a parking lot, saying she was "emotionally distraught and urgently insisted that she needed to see (him) immediately, so they agreed to meet at a parking lot, a place where Scoggin felt she could speak without fear of being heard by others, in particular other players on the team." According to the AP, Scoggin was “discovered in Love's hotel room during a trip to Penn State in February 2022. Teammates engaged in a ruse to obtain a key to Love's room. When they entered, they discovered Scoggin on the bed fully clothed. Love said Scoggin had been in his room at her request to discuss a personal problem.” The NU Board of Regents, Williams and Alberts said in their joint response that they didn't have "sufficient information and belief to either admit or deny the allegations" of a sexual relationship between Scoggin and Love. Nebraska AD Troy Dannen says he’s still “listening and learning” about the full scope of the $450M renovation to Memorial Stadium. “There’s a lot to balance as you look at this. Not just as a project in isolation but how does it relate to the entire department interacting with the future of what college athletics is going to be here?” Dannen acknowledges there are things that need be done inside the stadium: “Chairbacks, upgrading the club facilities, some ADA work. There’s restrooms and concessions, wireless, there’s a lot of things that I think everybody’s known, but it’s already very obvious to me that that needs to be done. A lot of those things monetize themselves. I think if you look at any project, its ability to pay for itself, whether it’s through donor gifts upfront or whether it’s through monetizing those improvements to pay for whatever debt you have to take on. You have to look at it in that context.” Dannen also says selling beer for baseball and softball games at the Haymarket complex is “big for us. I think just having a month of the season gives us a chance to make sure operationally we’re doing it in the right way. Then go back to the drawing board next season, do it the right way for the full season. It’s a great amenity, and it’s going to help the park because we will be a beneficiary.” (link)

Kansas AD Travis Goff denies GoPowercat.com publisher Tim Fitzgerald’s assertion that KU’s Gateway project is on hold and that taxpayer money is being used to renovate Booth Memorial Stadium. Goff to Fitzgerald: “Every aspect of our detailed, transparent, strategic project is completely on track as planned/announced. Only change is increased momentum! I welcome you to come over to Lawrence for an interview if you’re interested in gathering accurate information and covering KU.” Fitzgerald subsequently remarks in a video: “They’re trying to say the stadium is part of the Gateway project, which doesn't make sense. The stadium's there, and they're just fixing up what needed to be fixed up, and we all agree on that. … if you look at their plan, which I have, Phase 1 has always been the stadium and elements of the conference center. … Okay, so when's Phase 2? Normally when you do a major project you have dates on the phases. Travis Goff has now admitted they don't have a date and they don't have the money and that statement tells me, yes the $50M went directly to the football stadium. And keep in mind also to secure the $50M they had to backstop that grant with $150M because it was a challenge grant. They were challenged to raise three times the amount of the grant, but they used money from the KU Foundation to backstop that, so money that people had given to academic concerns was used to prop up this grant given for Gateway project. Was that money actually used or did they fundraise over the top of that and return that $150M to the KU Foundation?” (link, link)

Idaho AD Terry Gawlik joined AthleticDirectorU’s Tai M. Brown to discuss building a culture via the hiring of head coaches and senior level staff members. Gawlik also reflects on the impact her coaching experience had on her leadership style, how the transfer complicates creating culture in the locker room, working with a search firm on a head coaching search and more. To illustrate the importance of developing staff members, Gawlik explains that when Senior Assoc. AD for External Operations Matt Martin left for the USC Upstate AD post, she chose not to backfill his role. “I am seeing what’s happening in the weeds, so to speak, and I had elevated our former head athletic trainer to our senior leadership team. And he's overseeing athletic training, but I saw some things in him that I thought were great leadership skills. So now he came to me and said I want to take over that department. He knows nothing about it. It’s been great. He runs our meetings, he supports the staff.” Gawlik goes on to note that when she first took over in Moscow, “I had to let go of some of the day-to-day. I like doing the things, so I had to say, ‘No, it's yours, you go run with it, if you need help come see me.’ And a lot of times people, they don't do it the way I do it – great. And if it doesn't work, then hope you learn from that, but I think you need to develop your staff and let them grow. So, we’re hoping to let all our marketing young people, maybe we’re going to give them more assignments of this whole changeover, so that way they get to grow. It’s all about empowering people to get better in whatever areas they want to do it or even sometimes in some areas they don't even know they want to do.” Full conversation on ADU. (link)

The Athletic’s Austin Meek, Seth Emerson and Mitch Sherman wonder whether the 85-person scholarship limit in college football still matters and point to Michigan student-athlete Cam Goode’s situation as an example of why it may matter less, at least. Asked to give up his scholarship to make room for another player, Goode chose to remain in Ann Arbor and pay for his scholarship with NIL money rather than transfer. He explains: “I was totally open to it. I’m not a selfish person at all – if anything, selfless. It was all for the better. I knew they were going to take care of me. I’m a good player, they love me, I’ve got a great personality. I knew they’d take care of me, for sure.” Meek, et al. note Goode is far from the only player in this situation. “At many programs, players are receiving NIL as a way of going above the NCAA scholarship limit of 85 per team. It’s a way to have a deeper roster and keep veteran players around.” Still other programs “prefer to focus on the top 50 or so players, rather than send NIL money to the 86th, 87th and 88th players on their rosters.” AFCA Executive Director/former Wyoming HC Craig Bohl says the topic came up at this year’s convention and opinions among coaches are varied. Some coaches like a tighter roster while others would “go up to 150 if they could.” Nebraska HC Matt Rhule favors a slightly larger roster but believes getting there by replacing scholarships with NIL money “feels like a workaround. … The way things are done, I’m recruiting someone here who’s dealing with a third party. And then I’m beholden to a third party. It’s definitely backwards. There’s no transparency to it.” More. (link)

Howard AD Kery Davis joins Connect/Fox Sports’ Bryan Fischer as the pair cover the overall landscape, the current state of HBCU football, what lessons Davis brings with him from his management experience at HBO and more. Davis explains that HBCU football’s uniqueness is one of its biggest selling points: “Before I got to Howard I had never been to an HBCU football game. And being a former HBO executive, I had been to almost everything. We went to the Super Bowl every year because we did Hard Knocks and Inside the NFL, etc. We did all-star games, we were involved in some big sporting events. But the first time I went to a Howard-Hampton game, I was like, ‘Oh, this is different.’ And it’s unique. And one of the things my background tells me is anytime you’re experiencing or selling something that’s unique, that makes it even more viable. I love the cultural impact of HBCU football, the pageantry of it, the bands, the cheerleaders, the fans of it. It’s a great afternoon and there's nothing like an HBCU homecoming. … We’re hopeful that the networks will see the value of what we bring to the table because it is unique.” Full Q&A on Connect. Extra Points publisher Matt Brown reports One Team Partners last week indicated that 12,300 football student-athletes have opted into EA Sports College Football 25. That figure includes scholarship and non-scholarship players who have opted in, but Brown points out that opting in does not guarantee NIL compensation. Only those who are included in the game will receive NIL compensation. Brown: “I’ve texted a few P4 and high level mid-major school officials about what their participation numbers are looking like, and every single official I’ve spoken to has told me their school has more than 100 players who have opted into the program (which would include walk-ons). … There is a confidence in the industry that north of 95% of scholarship athletes will sign the paperwork before April 30.” (link)

Adidas CEO Bjorn Gulden says the "sum reportedly paid by Nike to lure the German football team away" from Adidas was "inexplicable” and the company opted not to enter into a bidding war. Adidas, Gulden continues, says the company “would continue to go after major kit deals, including the franchise for France, but only if the price is right” and that international football “was not everything,” citing high-profile deals with Real Madrid and Bayern Munich. “We try always to invest where one gets the best advertising impact and can make the highest sales, and we'll continue to do that.” For its part, the German Football Association says that the decision to link up with Nike was “made in the interests of the domestic game and grassroots football.” (link)

DraftKings is facing a second class-action lawsuit with a new complaint filed in the Southern District of New York that alleges the company engaged in deceptive, misleading, fraudulent and unlawful activity by advertising a risk-free wager. The suit, filed by plaintiff Samantha Guery, argues that the way DraftKings awards its free bet resulted in compensation that failed to match the amount of money a person must wager in order to receive the offer. From the suit: “The promotion required that the customer place a bet with their own money. If a customer lost their bet, they were not returned to their original position. Instead, their accounts were credited with a ‘Free Bet’ that was worth less than its counterpart in U.S. dollars implied by the promotional materials. … Free Bets cannot be withdrawn and must be wagered to be converted to U.S. dollars. Furthermore, wagers made with Free Bets are not paid out like wagers made with U.S. dollars. A $100 winning bet made with U.S. dollars at even odds recovers the $100 stake plus the $100 winnings less the sportsbook’s cut (known as the ‘vig’ or ‘rake’) of 9%, which results in a payment of approximately $191. By contrast, a winning bet made with a $100 Free Bet converts only to $100 US dollars less vig, which results in a payment of approximately $91.” DraftKings declined to comment to SBC Americas on the story.
