A new rule finalized by the U.S. Department of Labor will require colleges and universities to provide either a pay raise or overtime benefits to thousands of admissions officers, student affairs professionals and athletics staffers. Previously, universities were exempt from clocking work hours and providing overtime pay to any employee salaried at or above $35,568. The new rule raises that bar nearly 65% to $58,656, effective January 1, 2025. The change is expected to impact roughly 4M employees nationwide, and the Biden administration has tried to address concerns about the timeline by breaking the shift into two parts—first a smaller increase to $43,888 by July 1, and then a larger jump to $58,656 in the new year. American Council on Education President Ted Mitchell: “We are disappointed that DOL failed to fully address the concerns raised by the entire higher education community. Ultimately, students will be harmed if institutions are forced to cut services, reduce financial aid, reduce staffing, and raise tuition to address the rapid growth in costs this rule would produce.” (link)

Oregon President Karl Scholz sits down for a wide-ranging interview with JohnCanzano.com’s eponymous proprietor, who asks what it was like in the room during the latest round of conference realignment, in which UO joined the Big Ten. Scholz: “So the world of big-time intercollegiate athletics is getting turned on its head. As I said I was at the University of Wisconsin-Madison when USC and UCLA came to the Big Ten. That’s, off the top, 40% of the media market. … I feel deep sadness about the Pac-12, Pac-10, Pac-8, but the world was changing and the University of Oregon needed to find stability and we took advantage of an opportunity that provides that stability.” Scholz acknowledges the money played a part in the decision, as did the visibility of playing in the Big Ten, but there were also a number of academic considerations. “The Big Ten library shares resources in something called the ‘Big Collection.’ So we can draw on the East Asia collection at the University of Michigan and the Latin American collection at UCLA as we share resources. … We share the teaching of almost-never-taken languages and things like Swahili or Urdu where tens of millions and sometimes hundreds of millions of people speak these languages. So they’re vital for the connected global environment but there’s not enough demand on any of our campuses to do a four-semester sequence in Swahili. So we can partner with other institutions.” Asked by Canzano to walk through the logic in the 11th hour before leaving for the Big Ten, Scholz says: “Yeah, I’d rather not. It’s a complicated, difficult, difficult process. So I think it’s best to look forward.” Scholz recognizes the impact leaving the Pac-12 has had on Oregon State and says: “We ended up spending a non-trivial amount of money to tweak our schedule and buy out a couple of other teams so that we’re able to do [schedule OSU in football]. That’s one example of us trying to put a foot forward and be good partners.” Full Q&A. (link)

In a letter to NCAA President Charlie Baker, the Knight Commission Co-Chairs Len Elmore and Pam Bernard offer several recommendations in response to Project DI, specifically in the areas of enhanced educational benefits, redirecting revenues to college athletes, correcting inequities and weaknesses in the current DI incentive structures, changing the DI structure to provide expanded autonomy and NIL. Elmore and Bernard credit Baker for “forthrightly” addressing the differences between DI institutions: “Project DI advances some essential and potentially groundbreaking proposals to promote and protect college athlete well-being. At the same time, the Knight Commission believes that some promising Project DI proposals may have unintended consequences that could limit athletic opportunities and that Project DI does not address several major problems in Division I. In particular, the Project DI proposal fails to address the fundamental issue of the large gap between authority and accountability for FBS football and the related need for FBS football conferences and the College Football Playoff (CFP) to earmark billions of new CFP football revenue for college athlete education, health, safety, and well-being. In much the same vein, Project DI’s proposals fall short of creating a different financial framework that will constrain runaway spending on FBS football coaches’ salaries and severance payouts—expenses that have grown two to three times as fast as spending on college athletes since the CFP began.” Full, in-depth recommendations. Former USC star RB Reggie Bush has won the 2005 Heisman Trophy again. The Heisman Trophy Trust has reinstated the award and President Michael Comerford says: “We are thrilled to welcome Reggie Bush back to the Heisman family in recognition of his collegiate accomplishments. We considered the enormous changes in college athletics over the last several years in deciding that now is the right time to reinstate the Trophy for Reggie. We are so happy to welcome him back.” The trust has returned the trophy to Bush and the replica to USC. (link)

ESPN’s Jeff Borzello reports that “tucked away in last week’s NCAA transfer legislation was a significant change to the men’s basketball calendar: ALL transfers need to be in the portal by May 1, including graduate transfers. Previously, grad transfers didn’t have to abide by the date the portal closed. The NCAA confirmed to ESPN that the DI Board of Directors approved this change on Monday and it’s indeed effective immediately.” The Athletic’s Nicole Auerbach adds: "I’d checked on this last night as well. Applies to all sports. Every grad transfer who wants to play next season has to be in the portal by the end of the sport’s final portal window:” (link)

The Mercury News’ Jon Wilner observes that it “sure looks like [Arizona State] agreed to a separation deal with [former Football HC Herm] Edwards when it could have fired him with cause,” given Edwards’ admission of recruiting violations. “It certainly seems like ASU shelled out millions to a rule-breaking employee when it could have paid nothing. Worst of all, it appears campus leadership abdicated all financial responsibility to students and staff, not to mention millions of state taxpayers. … Either [President Michael Crow and former AD Ray Anderson] allowed Edwards to pocket more than $4M when they could have fired him for nothing, or they agreed to the separation deal without knowing the facts of the case. No matter how you slice it, they are guilty of fiscal mismanagement. Did Anderson’s longtime friendship with Edwards influence the decision to cut a separation deal with favorable terms? Why did Crow tell 98.7-FM, the school’s flagship radio station, in Feb. 2022 that Edwards was innocent?” Crow at the time asserted that “these are things he did not ask them to do. These are not things he was a part of.” Wilner reached out to ASU and Arizona Board of Regents Chair Cecilia Mata to see if regents would pursue the matter and ask Crow and Anderson to defend their handling of Edwards. Colorado, Nike and Buffs Football HC Deion Sanders are “getting close” to signing a special licensing agreement that has been in negotiations for the better part of six months, according to Sportico’s Eben Novy-Williams and Daniel Libit. The formal authorization to sell co-branded apparel would replace the “handshake deal” under which the sides are currently operating and which includes the IP of both CU and Coach Prime. According to a draft of the revenue-sharing agreement from January, CU is negotiating a “special license type agreement” that includes an 18% royalty for Nike “Prime 21” merchandise that includes university marks. Novy-Williams and Libit note the “document includes blank spaces to clarify how those proceeds will be split between Sanders’ company, Prime Time Enterprises, and Colorado’s athletic department. According to the draft agreement, Sanders would seek approval from the university—and specifically CU’s athletic director—for anything that appeared on co-branded merchandise, prior to it being submitted to Nike. The agreement would be in place as long as Sanders is employed as Colorado’s head football coach. In the event he no longer is, the draft agreement stated, the university would have six months to liquidate any remaining merchandise and distribute the revenue in accordance to the revenue share terms.” (link)

Marquette has received a $1.5M gift from alumni Bob and Kim Eck through the Eck Family Foundation, part of which will support a new men’s basketball practice facility in a future expansion of the Athletic and Human Performance Research Center. (link)

ECU has received a $1M gift from the Derek Dunn family to support the proposed 101K-sq-ft Isley Indoor Performance Center, which will include a 120-yard synthetic turf football practice field, LED lighting, scoreboards, clocks, sound system and graphics. Construction will begin when funding is complete, and the Pirates report they now have more than $21M of the needed $24M raised. (link)

Saint Joseph’s announces a new approach to its NIL programming “in direct response to new NCAA rules that allow Division I institutions to assist student-athletes with facilitation of NIL activities.” In collaboration with Van Wagner, Student Athlete NIL (SANIL) and Brandr, Saint Joseph’s is “creating a comprehensive framework that empowers our athletes to thrive in the evolving landscape of collegiate sports,” according to Hawks AD Jill Bodensteiner. The collaboration kicks off with the Hawk Hill NIL Fair, which will allow representatives from all four partners to educate existing University sponsors, prospective sponsors, alumni-led businesses, local businesses and more on how they can contribute to NIL efforts. “The most innovative aspect of the Hawk Hill NIL Fair will be the introduction of several Hawk student-athletes, allowing the attendees to imagine the possibilities with these outstanding young men and women as brand ambassadors and partners.” (link)

The Athletic’s Scott Dochterman unwinds the gambling investigation that impacted over two dozen student-athletes at Iowa and Iowa State, and former Hawkeyes student-athlete Noah Shannon, who wasn’t charged criminally but still lost his final year of eligibility, says: “I’ve been explaining just what I went through and everything has been consistent, not switching up my story trying to say like, ‘Oh, I got screwed over. They did an illegal search on us.’ At the end of the day, I broke a rule. So, no matter how you look at it, I should have been in trouble.” However, Sarah Real, Shannon’s mother, contends the “crime didn’t fit the punishment. The entire season or his entire career seemed to be a little harsh for us.” Attorney Van Plumb, who represents 26 student-athletes, including Shannon, says his firm plans to file a federal lawsuit this week against the state of Iowa for violating the players’ civil rights. Plumb asserts the search was not legal because the Iowa Division of Criminal Investigation did not have a warrant to use geofencing. Plumb also expects the athletes to sue in state court by early next week. A DCI spokesperson maintains the evidence was obtained “in a constitutionally permissible manner,” adding: “Ultimately it is up to the courts to decide.” More from Dochterman. (link)

Memphis AD Laird Veatch explains his decision to leave for the same role at Missouri, telling SBJ’s Ben Portnoy: “First of all, it's an SEC school with tremendous momentum. They're doing great things, so to have an opportunity to be there and be a part of it, particularly right now, is just an awesome opportunity in our space. There's only so many programs and places in America that have that kind of opportunity. On top of it, it's close to home for us.” Veatch also acknowledges he will be tasked with maintaining the Tigers’ financial momentum: “I've always been on the fundraising, revenue-generation side. That's been kind of my heart and soul, and that's where I will definitely lean into, particularly early on. Of course, [I] want to establish relationships with coaches and staff. [Missouri has] an exciting project in the north end zone of their football stadium that they also just announced, so jumping into that right away and going out and seeing a lot of donors, some old friends and hopefully some new ones, that's going to be the primary focus.” Veatch on Memphis: “There's a lot of work ahead, but it really is in a pretty special place. Obviously, we've been highly competitive and winning as well, but probably the thing I'm most proud of is the internal operations and culture of the department. It’s really become a very professional, very hard-working, proud staff, and they really care and do things right.” (link)

The Commercial Appeal’s Mark Giannotto argues the “next Memphis athletic director should be the first Black one,” taking the view that it’s “well past time given the demographics of the city, the university and the athletes that represent the school. It’s hard to look at the leadership of the university administration and the athletic department administration and argue it’s adequately representative of a student body that’s 58% minority in the largest majority Black city in the country. But beyond that, the timing of Veatch’s exit coincides with a moment in which there are several sitting or former Black athletic directors with connections to Memphis or [President Bill] Hardgrave who are worthy candidates regardless of their race.” Specifically, Giannotto points to Buffalo AD Mark Alnutt, New Orleans AD Tim Duncan, Tennessee Senior Deputy AD/COO Allen Greene and Tennessee State AD Mikki Allen. “There are likely others who fit the bill, although it can be harder to identify them because not enough have been given the chance to prove themselves. … There’s a lot at stake with this hire, and there’s also a chance to make a statement about the core mission of this university. Memphis shouldn’t let the moment pass by, not when there’s a straightforward path to making history.” (link)

CBS’ Dennis Dodd and The Athletic’s Chris Vannini report former Louisiana Tech/Tennessee Football HC Derek Dooley has, as Vannini puts it, “been the salesman on behalf of private equity firms, making contact with schools” about a Group of 5 football playoff. G5 administrators who spoke with Vannini emphasize that “nothing is imminent and they haven’t been presented with any numbers yet. But conversations are more real than they’ve ever been.” Dooley did not respond to a request for comment.” One G5 AD tells Vannini: “We’re taking some leadership here to control our own destiny so that Tony Petitti and Greg Sankey don’t make that decision for us.” Details have yet to be worked out, as Vannini reports that “some administrators like a smaller-scale idea of creating their own postseason to replace bowl games. Others believe the entire Group of 5 – especially the American, Conference USA and Sun Belt – should reorganize geographically under one banner with multiple divisions and share all revenue equally like a pro sports league.” Outgoing AAC Commissioner Mike Aresco yesterday dismissed the idea, saying: “It would separate us from the big guys in the CFP, and that would be bad. It’s what I’ve always feared, that we’d be in a different division.” Dodd adds: “While Dooley's idea is in the development stages, sources stressed that financial involvement would be more than just funding a playoff. In one iteration of the proposal…eight division champions would play at the end of the regular season for the Group of Five's guaranteed CFP berth. ‘Significant dollars’ would be at stake, according to one source with knowledge of the pitch.” (link, link)

Texas A&M is laying off at least a dozen staffers and high-level administrators, including Executive Deputy AD/COO Justin Moore, Deputy AD for External Relations and Business Development Chris Park, Deputy AD for Administration & Leadership/SWA Kristen Brown, Assoc. AD for Branding, Creative and Communications Tyler Pigg. Aggies AD Trev Alberts explains the downsizing is a “reorganization related to existing and emerging threats to our business model” and adds: “We are on the cusp of unprecedented change in the world of intercollegiate athletics. As a department, we have to adapt and become more efficient and effective so that we are best positioned for the changes to come. However, what will not change is this: student-athletes are our priority and making sure their experience at Texas A&M is second to none is our goal. … These changes are difficult and let me state emphatically these people have done nothing wrong. These are good, hard-working members of the Aggie family and their service is greatly appreciated. I can assure you, this was not personal, it was a business decision, and a very difficult one at that.” (link, link)

The Federal Trade Commission’s new rule banning noncompetes will impact sports executives, coaches and NIL deals, according to Sportico’s Michael McCann, who points out that “DraftKings and Fanatics have recently been embroiled in a battle over an executive who left the betting company for the sportswear manufacturer. Noncompetes are also seen in endorsement deals that restrict contracts an athlete might pursue with other brands. Coaches’ contracts sometimes contain noncompetes that limit their ability to join rivals, such as when Bobby Petrino was blocked from leaving one SEC school for another.” McCann adds: “Expect to see attempts by businesses and other parties to challenge the rule as unauthorized under the language of the FTC Act and beyond the intent of Congress. One possible argument is that the ban violates Article I, Section 8 of the U.S. Constitution. … A legal challenge might also assert that the ban would raise due process problems since it alters existing arrangements without the parties’ consent. Litigants could seek restraining orders and injunctions that delay the ban from taking effect.” (link); Headlining attorney Tom Mars points out the ban exempts senior executives with an existing noncompete who make at least $151,164 a year and who are “in a policy making position.” For college sports fans, that raises the question whether the ban applies to head coaches. I think so. Virtually every head coach contract requires the HC to comply with university and athletics department policies. That would seem to undermine any argument that the HC sets policy.” (link)

Connecticut paid a $2.83M premium to insure all performance bonuses and associated costs it would owe men’s and women’s basketball HCs and their staffs this season, and CT Insider’s Mike Anthony notes that “with the women’s team reaching the Final Four and the men’s team winning the national championship, almost every possible performance incentive bonus was triggered and the total payout was $5.6M.” Huskies AD David Benedict: “We obviously believed we were going to have a successful season and there were people on this campus who questioned what we were doing. I was confident that was the right thing to do, financially and fiscally, for our university and convinced the right people that we should do it. We did it, and obviously that's having a significant impact on our fiscal situation because we saved $2.8M.” The policy, secured through Game Point Capital, had a total coverage limit of $6.25M, and Benedict notes that “was insuring basically all of your exposure from a bonus standpoint in men’s and women’s basketball in addition to covering things you don't budget for. Like, you don't budget for championship rings or Final Four rings.” Benedict says the idea for insuring bonuses came to him while negotiating MBB HC Dan Hurley’s contract last summer: “I was having the conversation to try to utilize this in the way we compensated Dan. It was, how can we do better for him if he's successful? Let's reward success. We don't have the money that these other conferences do from a media standpoint, so it's harder for us to get guaranteed money. But how can we stretch our dollar? One way to do that was to leverage higher bonuses for winning at the highest level. And that's what we did.” (link)

Former Arizona State Football HC Herm Edwards has agreed to a five-year show-cause penalty for his role in ASU’s recruiting violations, which involved hosting over 30 prospects during the Covid-19 no-visit period. Sun Devil Source’s Chris Karpman notes this is “one of the longest show-cause penalties for a head football coach in NCAA history. It is one year fewer than Jeremy Pruitt received in 2023 for recruiting violations at Tennessee and equal to the length received by Jim Tressel at Ohio State in 2012 for lying to investigators about players being paid for selling memorabilia.” Karpman also reports six other former staffers – ACs Prentice Gill, Derek Hagan, Chris Hawkins, Zak Hill and Robert Rodriguez, and equipment employee Eric Bowman – were also hit with severe show-cause penalties of between three and 10 years. Gill, Hawkins and Hill agreed to their penalties in the negotiated resolution phase with the COI. Former AC Antonio Pierce, now the head coach of the NFL’s Las Vegas Raiders, will have his case heard separately by the COI, as Karpman notes Pierce is “believed to be contesting one or more of the extensive allegations made against him.” Also from Karpman: “While ASU agreed with a ‘failure to monitor’ determination, its efforts throughout the investigation were lauded as ‘exemplary’ by the NCAA, which significantly contributed to the successfully negotiated Level I-mitigated” penalty despite at least six former staffers being given Level I-aggravated punishments. After August 1, there will be no additional punishments impacting ASU football other than the one scholarship it won't be able to fill in 2024 and the four-year probation period. (link)

NCAA Managing Director of Enterprise Risk Management Clint Hangebrauck sits down with Connect/MB Sports’ Matt Banker to discuss all things sports gambling, including the importance of education, monitoring officiating for discrepancies, mitigation efforts to protect student athletes, resources and more. Regarding whether there should be a risk management committee within the NCAA governance structure, Hangebrauck says: “I certainly don’t think that’s a bad idea at all. I actually have a unique reporting line where I do report internally, but I report directly to the Board of Governors for a finance and audit committee. So, that tends to be the committee that focuses a little bit more on risk, but I certainly think it's just more of a prevalent topic that athletic departments to higher ed to us and the work that we do in the NCAA should really make it a priority, absolutely.” Full conversation on Connect. Deloitte in its report on 2024 higher ed trends calls for presidents to be more involved in the conversations around athletics: “Presidents and their leadership teams should be prepared with risk mitigation strategies and be ready to take decisive action in partnership with other university officials, the [NCAA], their conference leaders, and state legislators. … In evaluating the president’s role in athletics decisions, the following questions must be considered: When should the president be consulted? What relationships should the president have with the NCAA, their conference leaders, and state legislators? How and when should the president be the decision-maker? In conjunction with the governing board, in-house counsel, and strategic communications teams, presidents should define their roles and develop plans for decision-making, risk mitigation, and crisis management.” Deloitte also advises establishing institutional guidelines for the financial support of student-athletes; developing approaches to support student-athletes' mental and physical well-being; establishing processes and governance around Title IX implications; and developing long-term strategies for preserving the unique character of college athletics. “The distinct culture, traditions, and experiences of college sports differentiate them from professional leagues. Preserving these characteristics in an evolving landscape will require strategies to prevent damage to the institution’s connection with students, parents, alumni, donors, and community members.” Lots more in the full report. The NHL set an attendance record this season with 22,560,634 fans and games being played to 97% capacity. That figure does not include the eight games played on Monday, which will add to the record total. (link); Also, the NHL averaged 504K viewers across ABC, ESPN and TNT during its regular season, marking an 8% YoY increase and making it the most-watched season since the 2015-16 campaign averaged 505K on NBC and NBCSN. Sports Media Watch’s Jon Lewis observes that “ESPN was the driving force behind the increase, as its average viewership increased 25% to 486K. TNT was up 1% to 363K and ABC was actually down 8% to 934K. The cable average of 410K viewers is the highest for any NHL season in 30 years – since 1993-94 (474K) – surpassing the previous high of 392K for the lockout-shortened 2013 season on NBCSN.” (link)
