Pretty interesting clause in the contract of new Missouri AD Laird Veatch as the institution included a force majeure provision “related to potential changes to the financial model for collegiate athletics given pending litigation and legislation.” If such changes impact the athletic department’s “exigency,” then Veatch’s deal can be renegotiated “with such changes not being known or negotiated until such time as the occurrence of the aforementioned force majeure event or litigation/legislative changes.” Wonder if we’ll also start seeing similar language in coaching contracts. Key updates from the NCAA Board of Governors: “$1.7 million in Association-wide funding — $200,000 in fiscal year 2025 and $1.5 million in fiscal year 2026 — for establishing a National Collegiate women's wrestling championship, with the first championship occurring in the 2025-26 academic year.” Additionally, a $5K penalty for any school that doesn’t submit its annual sexual violence attestation form, plus a public listing on the NCAA website. Also of note: “The Board of Governors discussed transgender student-athlete participation. The current policy remains under review. College sports are the premier stage for women's sports in America and the NCAA will continue to promote Title IX, make unprecedented investments in women's sports and ensure fair competition for all student-athletes in all NCAA championships.” (link)

An NCAA spokesperson declined to confirm who else was under consideration for its NIL services and registry agreement with Teamworks; however, Sportico’s Eben Novy-Williams and Daniel Libit report Opendorse and CLC’s COMPASS platform were both finalists. Opendorse CEO Blake Lawrence confirmed his company’s candidacy but declined to comment further, and Learfield President of Brand Management and Marketing Cory Moss: “The COMPASS platform will continue to serve a critical role in facilitating NIL opportunities at scale for student-athletes and provide an important tracking solution for our university and business partners.” (link)

Digital Sport by Hot Paper Lantern SVP of Communications Mike Adorno highlights the importance of strategic communications when raising NIL funds. In a recent study of media members who cover NIL conducted by the firm, 92% of participants said collectives provide “inconsistent communications relating to their goals, missions, wins, partnerships and benefits to the community.” Meanwhile, more than half indicated they don’t understand how funds are distributed or allocated to different sports or athletes, and three out of four reporters said fans and donors have a below-average understanding of NIL. Adorno notes that a marketing email he received from a collective “took two landing pages, plenty of reading and scrolling and four separate clicks to finally get to a donation page. … This is entirely too much effort to assume the average person will [put forth]. It takes much more effort to research and segment audiences, create customized messages and content for each audience and build a consistent external pipeline of spokesperson commentary and news for external media, than just sending out a blast video or email to your donor list. But fundraising should be treated like e-commerce. The more targeted the communication, the greater the chance the audience reacts in the way you need them to.” (link)

The Athletic’s Pete Sampson examines the “hidden impact” of kickers entering the football portal, noting Alabama, Georgia and Notre Dame have all taken kickers this cycle and the Irish have brought in a new kicker for the second year in a row via the portal. Buffalo HC Pete Lembo: “If you’re a school that’s a ‘have’ and a school that’s got the ability to use NIL to augment their recruiting, there’s a lot of good reasons to just sit back and watch. Allow a guy to grow and develop somewhere else and then hopefully be able to attract him at a later point in his career when he’s already well-established as a high-end college player.” To illustrate Lembo’s point, Mitch Jeter, who recently transferred to Notre Dame from South Carolina (where he was coached by Lembo) tells Sampson: “I really just felt like I wanted a little bit of a change of scenery. And Notre Dame kind of really stood out to me with the opportunity that I’m able to build through this brand and this network, as well as get on the field and compete for a national championship.” The increased movement among kickers in the portal is having a trickle-down effect, as high school kicker Nikola Dugandzic explains: “A kicker getting a scholarship out of high school to a Power 5 school is very rare nowadays. … Those schools taking portal guys, that just really is gonna hurt high school kids.” In fact, Sampson notes that scholarship offers for high school prospects have “fallen off a cliff since the transfer portal became standard operating procedure and specialist trainer Chris Sailer adds: “Before, 40 to 50 guys were getting scholarships across FBS. Now it’s 10 to 20. I’m trying to talk parents off the ledge every day because it feels like there’s just nothing out there.” Lots more. (link)

In partnership with Legends and Conventions, Sports & Leisure International (CSL), Mississippi State enters the final stages of developing a comprehensive long-term master plan for all athletics facilities. Currently, the Bulldogs are assessing feasibility for improvements to Davis Wade Stadium and will send a survey via email to key stakeholders in the next 24 hours. AD Zac Selmon: “The comprehensive plan developed for Davis Wade will provide a complete road map to follow into the future, and while we think you'll be pleased with the immediate updates to improving the sound for 2024 in advance of the permanent sound and lighting upgrades scheduled for the 2025 season, there is even more to do as we approach the goal line on our master plan process.” (link)

ESPN and the NBA have “essentially come to terms” on a media rights package, according to Puck’s John Ourand, who notes that while nothing has been signed, “I’m told that the two sides agreed to the broad framework of a deal that would keep the league’s ‘A package’ with ESPN, which would include exclusive rights to the NBA Finals on ABC. This was a key point for ESPN, which did not want to share the NBA Finals with another media co. As part of its deal, ESPN will have less game inventory, which the league will use to create a third package.” While the NBA’s talks with Warner Bros. Discovery are not as far along, “they have been described as productive,” and Ourand reports WBD’s potential deal would also likely include fewer games with excess inventory going to a third package. Meanwhile, NBC has “aggressively pursued” a deal for its broadcast network and Peacock, “but WBD has backend rights that allow it to match competing offers.” Amazon Prime still has a ways to go to work out a deal, but all signs suggest that it’s likely to land one, and “NBA’s lines to Netflix and Apple are still open, but talks with others have advanced further. Google remains interested in carrying the league’s out-of-market package, NBA League Pass.” No word yet on the financial details. (link)

Following a report that Apple is close to signing a deal with FIFA that would grant Apple global rights for a planned month-long tournament, Puck’s John Ourand observes: “You could make the case that there are some synergies between this FIFA deal and Apple’s MLS deal, which would likely help retain these new subscribers. But it’s hard to shake the idea that the world’s largest company is bottom-feeding. This isn’t the World Cup, after all – it’s a club tournament, scheduled for the middle of summer, which players have already criticized. News of this potential FIFA deal comes as the NBA is entertaining bids for its worldwide rights, and by all accounts, under Eddy Cue, its SVP and resident sports emissary, Apple is not a serious bidder. This FIFA deal confirms what we already know: Apple is still a dabbler in sports rights, at least for now.” (link)

Stephen F. Austin announces West Texas A&M (DII) AD Michael McBroom as its next AD, effective May 15. SFA Interim President Gina Oglesbee: "We are excited about the future of Lumberjack athletics under McBroom's leadership. His proven ability to build championship-worthy programs – both on the playing surfaces and in the classroom – aptly matches the goals of SFA Athletics and the university." McBroom: "This is a dynamic time in college athletics, and our job is to set the stage so that we can achieve an unprecedented level of success across the board. SFA is going to carve out a niche that results in record numbers of championships, graduates and support for all teams and all student-athletes. My family and I can't wait to get to Nacogdoches and start this exciting new chapter." (link)

The NCAA selects Teamworks to provide NIL services to student-athletes and member institutions. Per the agreement, Teamworks will “develop a process to collect disclosures of NIL activities and create and provide educational materials to all NIL stakeholders. It also will build and maintain a registration process for agents and other professional service providers offering NIL services and make that registry available to student-athletes.” As stated previously, the registry will be voluntary and serve as a central repository for those interested in providing services to enrolled and prospective student-athletes. It will also include both a ratings and a dispute resolution system, as well as background information about the third parties. Also from the NCAA: “The educational materials must reach a large number of stakeholders and facilitate national consistency in both electronic and in-person formats. Included topics will be NCAA legislation, tax implications, intellectual property, selecting professional service providers, responsible social media engagement and business startup strategies.” (link)

Florida Attorney General Ashley Moody has filed a lawsuit against the ACC demanding the league turnover its ESPN contract via a public records request. Moody: “The ACC is asking a state entity – Florida State University – to potentially pay and lose more than a half a billion dollars but is refusing to produce the documents related to that outrageous price tag. We sent a public records request to the ACC in January, but they failed to fully comply. We are taking legal action against the ACC for wrongfully withholding these important public records.” In denying Moody’s January request, ACC General Counsel Pearlynn Houck wrote: “These agreements contain commercially sensitive and proprietary information which, if publicly disclosed, would irreparably harm the Conference’s and ESPN’s ability to negotiate future rights agreements. The Conference has an obligation to ESPN, as a party to the agreements, to protect its fundamental business interests as reflected in the agreements. Courts across the country have protected these types of agreements, including the present agreements between the Conference and ESPN, in a variety of lawsuits.” If successful, other TV deals involving conferences with public universities in Florida could also become public records, including the SEC, Big 12, AAC and others. In an pending amicus brief filed Wednesday, the Ivy League urged the NLRB to grant Dartmouth’s request for review of Regional Director Laura Sacks’ February 5 decision to recognize the men’s basketball players as employees. In its brief, the Ivy League argues the employment of Dartmouth’s basketball players would undermine the conference’s academic goals and open the door for “students who participate in club sports, play in a school band or participate in any other of many college extracurricular activities” to also seek employment status. The league also contends the benefits and compensation players receive do not constitute employment and notes that the “only form of financial assistance” given to Ivy League athletes “is based solely on need” and not participation in athletics. Additionally, the conference also suggests Sacks’ ruling lacks a limiting principle. Sportico’s Michael McCann: “If basketball players receiving non-monetary support counts as compensation, then, the conference argues, a school supplying transportation to students in club sports or school band could pave the way for their employment recognition. On the other hand, those students might not receive the same level of benefits, including priority admissions, and they’re likely not under the same degree of institutional control as are varsity athletes. McCann also points out the Ivy League is not a party to Dartmouth’s dispute and needs the NLRB’s permission to submit its brief. (link)

George Mason unveils a new logo to cap its three-year rebrand effort. President Gregory Washington: “Higher education in America is at an inflection point, with families having a harder time finding a top-quality, affordable college education at a university that will actually admit them. George Mason has always offered these things, but few families know of this value because our brand and message have not been adequately heard. This new look is our reintroduction to the community, and a symbol of our commitment to the fundamentals: outstanding and rigorous academics, pragmatic career preparation and internships, flexibility and value, and an atmosphere of belonging for everyone.” Having the entire university represented by a single logo also “fixes several operational challenges with the existing logo system, and visuals that were difficult to maintain consistently across the university’s complex academic environment.” Have a look. Wisconsin Men’s Basketball HC Greg Gard explains he holds no animosity for players who enter the transfer portal: “This isn’t a surprise to anybody. I’m not mad at anybody, specifically Chucky and AJ. If anybody in their right mind told any of you guys or gals that you could go triple your income by taking a different job, you’d do it in a heartbeat, no questions asked. Did we all not want to see him go? Yeah, of course. Love those two kids, they were great for us, but I understand the landscape we’re in. I would tell my kid probably to do the same thing if I was in that position because the earning power window is really small, and when they have those type of opportunities in front of them, that's hard to say no to. So, I don't begrudge them at all for that.” (link)

The Inside Zone’s Matt Fortuna profiles Indiana Football HC Curt Cignetti, who says unabashedly: “I’m 62 years old, so there's some old school in me. My dad was a coach, I learned a lot from Nick (Saban). I don't buy that ‘You’ve got to treat them great, pat them on the ass,’ all that s—, you know what I mean? You’ve got to have NIL money. You’ve got to, or you're not going to compete. Period. But when guys are making big bucks, then they’ve got a responsibility, too. It’s the same thing (Dan) Hurley said about Connecticut, right? There's a responsibility that comes with that. Because let's face it: You get to a certain point In NIL where these guys really are employees more than student-athletes, you know what I mean?” Lots more. (link)

James Moore’s Shane Metzler highlights some of the key points in the NCAA’s 2024 Agreed-Upon Procedures Guide. First, definition wording for contributions has been updated to note that contributions “provided and used by athletics” in the reporting year should be reported. Additionally, the “room & board” wording in the definition was updated to instead reflect “living expenses.” Athletic Student Aid Procedure 20(a) has been “reformatted and reworded to add clarity to the difference in sample size requirement for schools that use Compliance Assistant vs. schools that do not.” Meanwhile, Procedure 20(b) has been “reworded to provide clarity that independent auditors should be ‘reconciling’ the total aid received by each student-athlete in the sample to the amount in the report that ties to the NCAA FRS (rather than just ‘comparing’ as it was listed previously).” (link)
