SBJ’s Ben Portnoy dives deeper into NIL & how it’s impacting the NFL Draft with a Big Ten “staffer” commenting: “There’s more security [as a returning college player]. You get drafted as a seventh-round pick, get cut in camp and you’re out on the streets. You come back your junior or senior year, or you’re a [Group of Five player] that has a really good year [and you transfer up], you’re much more secure making $500,000 in the [Power Five] in one year than you are taking the jump going to the NFL, hell yeah.” Blueprint Sports CEO Rob Sine adds context: “The number of football players that are making more than six figures has spiked. Knight Commission CEO Amy Privette Perko sat down with Connect/MB Sports’ Matt Banker to discuss the finances of college sports and the possibility of FBS football breaking away. Perko also highlights the commission’s C.A.R.E Model, which is designed to restructure the way college sports distributes more the $3.5B in annual revenues (projected to be more than $7B annually by 2032) with athletes’ education, health, safety, well-being, and gender equity. Perko notes that with upwards of $1B in new, uncommitted money entering the ecosystem via the College Football Playoff expansion, “that’s the best time to change revenue distribution – when it’s new and it’s uncommitted. And for that reason, We really applaud President Baker's proposal to try to put out there some different initiatives that would direct more of this new money coming in at the very top athletes. But we think it's also an opportunity to really overhaul a lot more than that and overhaul the NCAA revenue distribution system. We've also shared with the CFP it’s time for the CFP to restrict some of its new revenue [to] be directed and spent only on athlete education, health and safety.” Lots more on Connect. (link)

With campus subsidies removed from the arithmetic, Cal and Stanford combined for a $122.7M budget deficit over the past two years: $46.9M in FY22 and $75.8M in FY23, according to The Mercury News’ Jon Wilner, who wonders whether incoming Cal Chancellor Richard Lyons and new Stanford President Jonathan Levin will continue to offer the same level of support as their predecessors. A Cardinal spokesperson tells Wilner: “Stanford will join the ACC as a full member, initially contributing a portion of media revenues back to the conference until it ultimately receives a full share. Stanford is working through the financial dimensions of this arrangement and has developed a financial model leaning on new and increased revenue streams, philanthropy, and institutional support, which will ensure that our student-athletes have the support needed to continue competing for national excellence.” Meanwhile, Wilner notes the “Bears have yet to finalize their strategy as they await a decision from the University of California’s Board of Regents on the so-called ‘Berkeley tax,’ by which UCLA would be required to funnel some of its Big Ten revenue to Cal’s athletic department.” A Cal spokesperson says: “Intercollegiate athletics are an essential part of the university, and we have been clear in our commitment to sustain a broad-based program, and to enabling our student athletes to thrive. In order to have a program that is consistent with our values and budgetary reality, we are working to confront the financial challenges through the development of new and alternative forms of revenue streams while carefully controlling expenses.” (link)

Seattle police suggest members of Washington’s athletic department knew about and discussed a sexual assault allegation against football student-athlete Tybo Rogers before allowing him to continue playing in the fall, according to the Seattle Times’ Catalina Gaitan and Caitlyn Freeman. Seattle PD Detective Emily Akiyama writes in a report of the investigation: “The timeline of social media posts as well as [Rogers’] suspension led me to believe there is a connection between his suspension and [the alleged victim’s] disclosure of the assault, especially after the comments made by the coaching staff.” Gaitan & Freeman also note that “investigators pointed to text messages involving UW athletics staff referencing Rogers that were sent within two weeks of the woman’s Nov. 28 social media post and Title IX report. The messages were followed up with a phone call, so the responses weren’t documented. One screenshot shows a text message sent Dec. 6 to an unidentified UW football coach asking the coach to share contact information for a defense attorney with Rogers. Another screenshot showed Cameron Elisara, director of football player development, messaged then-UW head coach Kalen DeBoer the same day.” Elisara’s text read: “WTF did Tybo do? I got people blowing me up about it. I won’t say anything if you don’t want me to obviously but I was just on ESPN radio and somebody brought it up.” In the screenshot, DeBoer did not message back but instead FaceTimed Elisara. Spirit headliner Varsity has settled another lawsuit, this one an antitrust challenge “filed in December 2020, the class-action suit asked the court for treble damages, the disgorgement of ‘unjust enrichment’ and injunctive relief.” More from Sportico: “As of now, the terms of the settlement, and to what extent it is likely to impact the competitive cheer industry, are not known. [...] The disposition of this latest lawsuit could play a key role in whether Bain can offload Varsity at some point, either by taking it public or selling it.” (link)

New Missouri AD Laird Veatch was introduced in Columbia yesterday afternoon: “While I recognize the responsibility and honor that naturally comes with a leadership position like this, I will tell you being the first member of 'Alden's Army' who was actually promoted to this post, provided an extra layer of honor and responsibility that I will take very, very seriously. [...] I may come across as a nice guy, but I was a linebacker at one point in my day, that is inside me somewhere. … I want to be part of winning it all. I want to win SEC championships, national championships, and I really believe there's something special going on here. … I just love the fact that you expect to win championships, that that is the vision, that is the desire, top to bottom. I feel it. I talked to leadership, and you can tell that there is a real commitment to climbing to the top. [...] This is where we want to be. We are ready for our forever home. To be clear, there is no transfer portal for the Veatch family. We are committed.” Tigers President Mun Choi was also asked what changes to the university’s governance structure will ensure Veatch won’t be another AD to exit after a short tenure: “Having four members of the Board of Curators serve on the search committee demonstrates from the beginning we're going to be aligned in our message about what we are looking for in a new AD. The group of four Curators also constitute the IAC (Intercollegiate Athletics Committee). So they'll be working closely with me as well as Laird to ensure that alignment is there. Maine AD Jude Killy on the value of using a dossier: “It really helped me consolidate some research. I don’t know how many hours, or days, of research it saved me from finding information to the right links, but it was hours at a minimum and probably a day or two in total.” (link)

On3’s Eric Prisbell cites sources who say the Group of 5 football playoff idea “entails only Group of Five schools right now” and could potentially expand. “As conference realignment continues to take hold – and super conferences look to congeal – the industry’s so-called second tier could ultimately also include some Big 12 and ACC schools left on the outside of the two super leagues once the music stops.” One source tells Prisbell: “The second tier is so fragmented. Everyone is vying for the adult table. That second tier/G5 is truly ‘Game of Thrones.’” Prisbell goes on to note that “if efforts to join the two super conferences fail, a second-tier end game would be the fallback option for Big 12 schools like Texas Tech, Iowa State and Oklahoma State and ACC schools lacking big brand recognition. They could be second-tier members to complement the Group of Five schools already at that table. That scenario would make Dooley’s concept more appealing to a variety of stakeholders.” Even if the concept remains G5-only, Prisbell reports it could still provide “sustainable, reliable cash flows,” which is attractive for private equity. From a source: “They [PE firms] don’t care whether this is a good football team or not. What they care about is – will there be economic viability? I think there will be for this second-tier league.” (link)

In exploring the FTC’s new restriction on noncompetes, Extra Points publisher Matt Brown points out that “explicit noncompetes are not super common in coaching or senior college administrator gigs, although they do sometimes exist. The mechanism that is meant to prevent coaches from leaving for direct competitors at the drop of the hat is the buyout, a tool that would still be legal under this FTC ruling.” However, “for personnel that work in industries that serve and support college athletics, like athletic apparel, NIL education and software, multimedia rights, gambling education and more, noncompetes are common, even among junior employees. … If all of those restrictive covenants are suddenly unenforceable, I’d imagine you’ll see pressure to improve wages/working conditions, as well as new contractual ‘sticks’ to prevent employees (and institutional knowledge) from walking out the door to competitors.” While the final rule is already headed for legal challenges, Brown notes that in the “short term, I can absolutely see the ruling giving major college sports business-adjacent firms a reason to maaaaaybe not depend on that non-compete being ironclad. Good news if you’re a reporter, college sports SaaS developer or sales manager. Probably bad news if you’re an executive.” (link)

South Carolina Women’s Basketball HC Dawn Staley remains devoted to local South Carolina reporters despite becoming a “celebrity coach,” according to Front Office Sports’ Margaret Fleming. The Post and Courier’s David Cloninger, who began covering Staley in her first season 16 years ago, tells Fleming: “She will always make time for whoever’s asking for a piece of her time. Even though these days, there are more and more people who are asking. She’s never refused me an interview, even when you have to talk about difficult subjects.” For her part, Staley says she prefers talking with local media rather than national media, particularly later in the season because “they know the type of questions they need to ask because they know the inner workings of our team.” She adds: “They’ve watched us, and they’ve followed us, and they know what our standard is, and when we don’t play to our standard, they recognize it. So it’s not like the national media who sees you once or twice or three times, and that’s their opinion. Or they’ll speak from a historical standpoint, not knowing real-time what our team is all about. But the local media, they know. I’d rather spend my time with the people that really know our team, that’s going to report back to our fan base and give them the real.” More. (link)

Ohio professor David Ridpath voices his support for College Sports’ Tomorrow’s super league model on the grounds that it’s “better for schools to play at levels they can afford and sustain while being able to win championships. Models like this can lead to more sport-by-sport and division-by-division membership, which can directly impact the institution with enrollment benefits, Title IX compliance, finances and even competitive equity. Why not explore letting a school commit to certain teams that will compete at the highest level in the top division, while having others at the DII, DIII or even an enhanced college club sport model, all which can lead to more students? Why not have sports governed by sport? This is a way to keep March Madness intact for men’s and women’s Division I basketball without worrying about divisional sport minimums or what level the other sports are competing at.” The financial aspect of college sports, Ridpath continues, is important but needs to be reframed. “There is no reason to require a college athlete to be in a minimum full-time program of studies while developing as an elite athlete for Olympic, national and professional teams while we are being entertained. There is only a finite time for an elite athlete to succeed. Tailor the education around the athletic enterprise either before, during or after the life cycle of the elite athletic performer. Trying to continue the myth of education-first has mostly generated scandal and an expensive industry of focusing on eligibility and not access to a real education, because winning is simply first priority.” More in a guest column for Sportico. Genius Sports Chairman/Horizon Sports and Experiences Co-CEO David Levy offers some thoughts on the future of the sports industry, noting some “exciting trends and opportunities are emerging around women’s sports, data implementation and AI integration.” Levy points out that “larger audiences and fans hungry for engagement want a deeper dive into what’s happening on and off the field” in women’s sports, “and as more women’s programming hours are scheduled, engagement opportunities for these elite female athletes will grow, just as we have seen for men. Brands have responded and are shifting more media and sponsorship dollars into women’s sports than ever before. This will ultimately bring down the costs of data tech and visualizations as scale creates efficiencies.” Meanwhile, the “toolbox for AI integration” is only getting bigger, particularly in the areas of content creation, AI-driven camera systems and virtual graphics and AR. “Brands will be able to sponsor new visual creations in the telecast without disrupting the game or the viewer experience. So whether it’s betting, stats overlays or brand-sponsored activation, the multicast will allow fans to become their own personal director by choosing the feed they want.” While technology fads come and go, Levy posits the “key is to cut through the noise and listen to what fans want, see what is scalable and know what is sellable.” (link)

A “prominent sports investor” tells JohnWallStreet that cord-cutting could be the best thing that ever happened to professional leagues, and JWS explains that’s because it is “forcing rights owners to make the transition to a digital world where they should learn more about their fans and what they value.” Still, streaming needs to solve its fragmentation problem, as cord-cutters increasingly decide to spend their money elsewhere, and the investor notes the easiest way to tap into fans’ other discretionary spending wallets is by adding more value. “Rights owners must now work to develop packaged offerings that appeal to the balance of the fan base. Industry stakeholders view succeeding on that initiative as the business’ ‘holy grail.’ … One can imagine a subscription offering that includes season-long access to the teams’ DTC RSN platform, tickets to a pair of regular season games, a couple of collectibles, a discount code for merchandise, and a personally relevant fan experience. Suddenly, the same individual who had balked at paying $30/mo. for another streaming service may be eager to pay twice as much because he/she feels valued by organization and is pulling funds from different discretionary spending wallets.” More from JWS.
