West Virginia State elevates AD Nate Burton to VP for Athletics. President Ericke Cage: "Over the past eight years, Nate has done a tremendous job growing our Yellow Jackets athletic programs, including increasing fundraising, upgrading athletic facilities, improving the academic performance of our student-athletes, increasing the competitiveness of our teams, and growing our sport offerings." Allen AD Jasher Cox sits down with D2.ticker/Connect’s Anthony Grassi at the 2024 NCAA Convention to discuss finalizing its membership process to join DII, major facility plans, strategic planning and more. With a new athletic facility on the horizon, Cox says the ability to play the 2024 Football stadium there is unknown adding: “It's taken quite some time to get to this place. The one thing you don't want to do is rush it. […] What this does for us is when we bring kids on visits now, there's something that they can now put their hands on, even if it's just a hard head in a shovel. You can put your hands on it and say, ‘Hey this is truly coming to fruition for Allen University,’ and I think that's what's important.” As the Yellow Jackets await the final call to conclude their membership process, Cox notes how the move to DII has improved systems across the university and pushed AU to be “fully buttoned down in everything that we do.” One of those facets is customer service, with Cox stating: “It's a little awkward to think about customer service with higher education because the first thing you probably think about is Best Buy or Target, but I'm a firm believer that we have to be exceptional in what we do from a customer service standpoint, and I think as a result of us making this transition, it's put the spotlight on us even more, so it forces you to be cleaner in your approach, what you do and how you approach our consumers, which are mom and dad and any prospect that is having an exploratory conversation about being a part of the institution.” Check out the full conversation only on Connect. Notable from DI: UAB (DI) Football has become the first team to sign with a players association in Athletes.org, per ESPN's Dan Murphy. Athletes.org Founder Jim Cavale: "We're not in there to get them to boycott, but we do understand the power they can have. When it is time to negotiate, we'll be prepared to have UAB be a part of that negotiation. We're building the pipes for the negotiation of the new deal for college athletics - the pipes for the athletes to be in that conversation." With this move, AO reports its current membership is 2,945 athletes, 2,026 of whom compete in power conferences. (link, link)

Husch Blackwell has released its 2024 Compliance Report and observes that in post-Alston world, “there is little to no deference to any concept of NCAA amateurism. It is equally true that the [U.S. Supreme Court] Justices went out of their way in Alston to indicate that their decision was not intended to address ‘pay for play’ or athlete employment, which would fundamentally alter the pre-professional collegiate sports model in the United States.” On the topic of student-athlete employment, Husch Blackwell addresses the issue of control in recent NLRB cases and posits: “This ‘employment debate’ is based on a belief that there is an economic fairness issue because of the money derived from media deals in the sports of football and men’s basketball. The belief is underscored, not only by the fact that the complaint involves only three sports, but also by the reliance on the NCAA and its conferences earning millions of dollars in profit as a rationale for employment categorization. Never mind that the money from Division I football and men’s basketball is used to fund all other sports, including those in Division II and Division III, as well as the pre-professional league and Olympic training models; or that college athletes generally have a competition window of approximately four to five years. The economic fairness concerns disregard the institutional brand’s role in generating value to support broad-based opportunities, the limited and transitory nature of college athletes, and the educational value of sport within the larger context of higher education. Pending employment status decisions could also lead to athletes who perfect the exact same ‘job’ for the same ‘employer’ being classified differently (e.g., softball athletes and men’s basketball athletes).” Lots more. Private regional colleges with small student bodies and high acceptance rates will face increasingly stiff competition from public institutions amid widespread demographic challenges, according to a new report from Moody’s that indicates these issues will be particularly pronounced in the Midwest and Northeast, where analysts predict higher education enrollment will plummet in the coming years. Small private colleges have increased spending on employee salaries and student wellness services since the start of the pandemic, and analysts note  that “maintaining small class sizes has become more expensive.” From the report: “Exacerbating the race for enrollment are the many strong state institutions that also compete for students in these regions, often with much lower tuition costs than what the private universities can offer.” (link)
