A number of ADs around the nation released statements related to the House settlement. Georgia AD Josh Brooks points to a $49M reserve fund as one pool of cash that the Bulldogs could use to help offset the annual revenue share with student-athletes: “The draw off of that helps our operating budget. In some degrees, it’s always raining. But we’re ready for it. Ready, like I said yesterday, to focus on growing revenues and being more efficient in the way we operate. [...] I think there are a ton of issues we have to work through and that’s going to be something that gets worked out over the next few months. We’re going to try to take this and make the best of it. We know where we are at with this piece and now the details of what’s moving forward is what we are going to spend a lot of time working.” (link)

Georgia State AD Charlie Cobb: “We’ve been working off a model for several years that when the playoffs that our partition of the growth in the television dollars in the playoff dollars was going to change our payout to the Sun Belt Conference or Group of Five conference. With the new agreement we’ll effectively get a zero change. [...] I think a lot of school presidents, boards, significant donors, athletic directors on down the line who are going to be asking, ‘Who are we and what are we going to be about?’ And trying to answer that with a smaller, more constrict revenue pool to pay for all the things that are going to come out of whatever this new modern world of NCAA athletics looks like.” (link)

North Dakota State AD Matt Larsen: “I think the part that is hard to swallow for I would say the majority of Division I defendants in the lawsuit are the (Power) five conferences in the NCAA and the bulk of the certified class are football and men’s and women’s basketball players. So you’re essentially asking the majority of Division I to pay back damages to Power Five football and men’s and women’s basketball players. Our student-athletes at NDSU are going to have to do with less so we can pay back FBS football and men’s and women’s basketball players. [...] Anytime we’ve had a cut, we’ve always charged our staff that we don’t want it to impact our student-athlete experience and we don’t want it to impact our opportunity to compete for championships. So a lot of that sometimes becomes administrative. [...] I’ve been saying for years that in all of Division I you go from a $10 million budget to a $200 million-plus budget and all operating under the same rules is past due for some changes.” (link)

SEIU Local 560 President Chris Peck, whose union represents the Dartmouth men’s basketball players as well as about 500 other workers across Dartmouth’s campus, argues the NCAA’s antitrust settlement is not a solution to labor inequities in college sports and is not a substitute for rules created through a union-management relationship. Peck on Friday: “The attempt at a revenue-sharing workaround only supports our case that the NCAA and Dartmouth continue to perpetrate a form of disguised employment,” adding that he expects the NCAA will continue to “do everything it can to avoid free market competition. … The solution is not a special exemption or more congressional regulation that further undermines labor standards. Instead, NCAA member universities must follow the same antitrust and labor laws as everyone else. Only through collective bargaining should NCAA members get the antitrust exemption they seek.” Context from Sportico’s Michael McCann: “The absence of collective bargaining means the economic rules negotiated in a settlement between the NCAA and attorneys for the players aren’t immunized from potential antitrust challenges. The non-statutory labor exemption, which reflects a series of U.S. Supreme Court decisions, grants an immunity to workplace rules that primarily impact wages, hours and other working conditions when they are borne through bargaining. Rules created through a litigation settlement or unilaterally imposed by management are not immune. That means an athlete can argue that a salary cap is a violation of antitrust law. The player would contend the cap is a restraint on competition among competing businesses (colleges and conferences) and that some colleges would pay more than the cap if they had the discretion.” (link)

Sportico’s Eben Novy-Williams and Scott Soshnick discuss private equity’s foray into college sports, and Novy-Williams reports the newly formed Collegiate Athletic Solutions has been in contact with “multiple dozens” of athletic departments and adds: “We are, I think, on the precipice, and probably by the end of the summer going to have the first number of deals between institutional capital of some sort and athletic departments or schools.” Regarding the potential for PE firms themselves, Novy-Williams says several in the space have echoed RedBird Capital Founder/Managing Partner Gerry Cardinale’s assertion that this is the best opportunity to invest in sports he’s seen in 30 years. “There’s bigger fan affinity in college sports than there is in pro sports. Geographically it's not only a wider net, but it touches in parts of the country like Alabama, like Arkansas that don't have pro teams anywhere near them. … And if you look at the drivers for valuation increase, rapid valuation increase, in pro sports in the U.S., you see scarcity value. College sports has that. We’re not really minting too many new Power 5 schools. … And then it's the non-correlated-to-other-assets appeal. One of the things that has driven private equity to pro sports is that it's a very uncorrelated asset to pretty much any other industry that you might be in, and there's certainly worlds in which you can have a portfolio that spreads across technology and healthcare and, let's say, consumer goods but but there's correlation, there’s overlap. If one goes down because of something, there’s a chance others are going to go down. People…look at sports as one of those areas that is largely uncorrelated from everything else.” Lots more in the full podcast. (link)

East Carolina Baseball HC Cliff Godwin (two games) and student-athlete Dixon Williams (one game) have been suspended by the AAC for their role in the Wichita State game incident on Thursday. Both served a game of the penalty yesterday, sitting out for the Pirates win against Rice. Godwin will also miss today’s tilt against the Shockers. Godwin was ejected and assessed the additional two-game suspension for violating NCAA Rule 2-26-h, which states that “no team personnel may continue to argue or to continue to excessively express themselves with prolonged action or offensive language after an ejection.” Williams was given the one-game suspension for violating NCAA Rule 8-7, which prohibits “unnecessary and violent collisions with the catcher at home plate, and with infielders at all bases.” (link, link)

JohnCanzano.com’s eponymous publisher reports from the Pac-12 Baseball Tournament in Scottsdale, the last athletic event in the conference’s 108-year history and writes: “This tournament shouldn’t be all sad. It’s a celebration, too. You don’t blow out the candles on a 108-year-old conference without remembering so many of the wonderful birthdays that came before. But I’ll tell you that my heart sank when I came upon the merchandising set up on the concourse. The Pac-12 emptied the storage facilities and is holding a blowout sale. There were hats, keychains, lanyards, golf balls, hair ties, stickers, and felt pennants featuring the conference’s logo alongside the logos of its 12 members. T-shirts hung on discount racks from old conference events (i.e. softball and golf, football games, the conference basketball tournaments, etc.). ‘Buy one for $10, get one free,’ a sign read.” Yesterday’s semifinal games marked the last two broadcasts for the Pac-12 Networks, and Roxy Bernstein, one of the networks’ first hires, handled play-by-play duties for the first matchup. Ahead of the broadcast, Bernstein told Canzano: “It’s going to be emotional. We’re talking about how we’re going to handle it. We’re planning for it and throwing a lot at it.” Canzano: “I’m in Scottsdale this week. I promised you I’d go where the stories are. An important one is coming to a close. EA Sports President Cam Weber explains how the company used AI in the development of College Football 25: “We've used a machine learning and inspired tool set to create over 134 schools, stadiums, mascots and traditions and over 13,000 players that have opted in from our NIL program. And we couldn't have built those likenesses and executed on that without machine learning technology that we built into the toolsets that we're using to execute on all of it.” Weber goes on to note that “we’ve been investing for a number of years now in building our capabilities. We’ve built new studios, new teams, we've acquired new studios, we brought in new franchises like Formula 1. We actually just launched eight new AAA-caliber sports games on HD consoles this past year which is an all-time record for EA Sports.” (link)

Sun Devil Source’s Chris Karpman reports from Arizona State AD Graham Rossini’s introductory press conferences and notes that ASU President Michael Crow explained ASU has “eliminated” the “debt owed to it by its athletic department—listed by Sportico at more than $300M—as a key element of its restructuring. Not entirely clear whether the debt was entirely forgiven or dealt with in another manner.” Crow: “What's happened in the past was athletics was considered a separate thing, called an auxiliary enterprise. It's not an auxiliary enterprise anymore. It's in the core of the enterprise of ASU itself. We've changed the financial model that's going to allow our athletic department to focus on victory and success of our student-athletes academically and athletically. The rest of our university is going to worry about the rest of our financial issues. We're going to have an opportunity for the athletic department to not be burdened by trying to carry the totality of all of its fixed costs." Rossini noted that the new financial model has “raised the stakes for athletics,” explaining that “the expectation, and Dr. Crow has been very clear to us, is that he wants athletics and the leadership of ASU wants athletics to operate commensurate with the rest of the university. I don't think anybody would argue with the quality of our degree programs, the quality of our research output, the quality of how we're impacting society. … I like the challenge, I like the high expectations." Crow on the duration of the AD search process: "Six months in the scheme of things—we're trying to build a multi-decadal trajectory here, something for the next 20 or 30 or 40 years. So taking a few months to reconstruct ourselves financially, to build our NIL presence, to change the financial model for the institution, to complete the NCAA process, all of that needed to be done before we could take the next step. NCAA President Charlie Baker sent a letter to members outlining the points in the House, Hubbard and Carter settlement, noting that plaintiffs were seeking $3B in the House case alone, which could’ve been $9B in trebled damages had the NCAA lost in court. Of the 58% being covered by DI conferences, Baker notes that FBS leagues will contribute $95M annually (33%), FCS will contribute $37M annually (13%) and non-football conferences will cover $34M annually (2%.). Baker also asserts the settlement “replaces potentially crippling lawsuits with a negotiated settlement and a 10-year injunction” and “ends decades of antitrust litigation, stabilizing college sports while permitting conferences and the NCAA to enforce rules that set a level playing field and emphasize the educational mission of college athletics.” Baker goes on to acknowledge that “there are still pending legal issues, such as those related to employment with the NLRB and the Johnson case.” (link)

Yahoo’s Ross Dellenger talks with House plaintiffs’ attorneys Jeffrey Kessler and Steve Berman about some of the finer points of the settlement and confirms the revenue sharing will consist of 22% of the average Power 5 athletic department’s revenue. Dellenger explains: “That figure, once set, will fluctuate as it includes an escalator. While the 22% will remain the same through the 10-year agreement, the money figure will change. Over the first three years of the deal, the money figure will automatically increase by 4% each year. In Year 4, the figure is likely to undergo a further reevaluation, especially if significant new monies flow into departments through new television deals, for instance. There are exceptions that can be counted toward the cap, including as much as $2.5M in Alston-related money already going to athletes and $2.5M in additional scholarships.” Berman: “We are going to be monitoring it every year to make sure revenues are adequately distributed. We are going to be auditing. We’ll be watching.” The application of Title IX remains nebulous, with one P5 AD telling Dellenger: “Campuses must weigh their risk [tolerance].” One source tells Dellenger that many within the sport believe schools will keep their collective around for two reasons: (1) circumvent the revenue-sharing cap by using the third-party entity to offer ‘bonuses’ and (2) bend Title IX rules as collectives aren’t under the umbrella of the university.” Will the settlement give the NCAA and/or a third-party enforcement entity “real teeth” when it comes to policing NIL? Berman: “I don’t know and, frankly, I don’t care.” More. (link)

On3’s Pete Nakos is told by multiple sources that the House settlement’s compensation cap “will only necessitate organizations to strike side NIL deals to provide a competitive advantage,” and Altius Sports Partners President Andrew Donovan explains: “That cap is a very important piece because as we know the competitive nature of the collegiate athletics landscape, particularly in the Power Four, it’s going to necessitate additional dollars in order to recruit and retain the best athletes. If we’ve learned anything over the past three years, it is that schools are incredibly competitive. They’re going to do everything they can and their supporters are going to do everything they can to try to gain an advantage. And so, I think to expect that collectives are going to go away entirely would be a bit of a fool’s errand.” Blueprint Sports CEO Rob Sine adds: “The high-functioning [collectives] will be involved in the arms race and to provide that competitive advantage. Revenue sharing will be the baseline toward NIL. Now the question will be how much does a collective need to raise for a new football roster.” As far as strategy if/when the settlement is implemented, The Grove Collective (Ole Miss) Executive Director Walker Jones tells Nakos: “The schools and collectives that work in conjunction together, that can be most efficient and most creative, can develop true brand partnerships through corporate entities that can add a lot of opportunities for their student-athletes and can be very efficient with compensation. Those will be the schools and the collectives that will create the competitive advantage through their operation and their efficiency.” (link)

CBS’ Matt Norlander points out the irony of the House settlement involves basketball, not football, saving the NCAA: “We all realize that the riches of college football, money already attained, but also the fortunes promised in billions of dollars in multimedia revenue expected over the next near-decade, rolled college sports to this point. But college football isn't solving anything. The only reason we have a settlement is because of college basketball. The men's NCAA Tournament made this possible. That's been lost in a lot of the discussion and reaction to this historic news.” One high-ranking industry source tells Norlander: “The men's basketball tournament is bailing everybody out. The NCAA lost out on the authority to manage college football money. Men's basketball is helping save, at least maybe has saved, all the other sports." Norlander explains the portion of the settlement being paid by non-Power 5 conferences is “largely being covered by past and future money made off the March Madness event. Without it, the NCAA has nothing. … The NCAA is only agreeing to settle because it has future NCAA Tournament media rights payments that will be withheld by the NCAA to member institutions – basically like garnished wages for everyone from Alabama and Ohio State to the low rungs of Division I.” For WCC Commissioner Stu Jackson, the situation is “analogous to being in a boat in the open ocean on a fairly clear day, and then all of the sudden just getting hit by one of the worst storms possible. USA Today’s Dan Wolken cites Red Lobster as an example of why college sports should avoid going the private equity route, noting that when the company found itself in financial distress it turned to private equity for help. “From there, private equity did what private equity does. It sold off the company’s land to a real estate conglomerate to make back the cash it used to buy Red Lobster in the first place, then saddled the restaurants sitting on that land with expensive rent deals they didn't have before. That left stores with little financial room for error, and when economic headwinds finally hit, it sent Red Lobster into a tailspin leading to bankruptcy.” Wolken on the recently announced Collegiate Athletic Solutions: “You can call this theoretical arrangement whatever you want. Some will call it ‘private equity investment.’ Some will call it ‘private credit,’ or, in layman’s terms, a loan. Drew Weatherford, the former Florida State quarterback-turned-private equity bro who cooked up this idea and has been pitching it to college administrators for months, even told Yahoo! Sports: ‘They are not mandated to pay us back the money we give them.’ Here’s what I call it: A garden-variety private equity scam that will benefit private equity and only private equity, because that’s all private equity truly cares about in the end.” Wolken cautions those considering PE to ask themselves some questions: “What do you think ‘right-sizing’ your operation actually means? If you need private equity to tell you how to unlock new revenue in an industry that already has a massive audience and widespread appeal, are you actually good at your job or just collecting a paycheck? And what evidence is there that these guys can actually help you do it?” More. (link)

Payouts to schools for EA Sports College Football 25 are based on a four-tier system, according to cllct, which explains the tiers are determined by each team's finish in the final AP Poll over the last 10 seasons. Just 13 of 134 teams reached Tier 1, including Michigan, Alabama, Ohio State, Clemson, Notre Dame, Oklahoma, Georgia, LSU, Oregon, Oklahoma State, Penn State, Iowa and Utah. Payouts are as follows: Tier 1: $99,875.16; Tier 2: $59,925.09; Tier 3: $39,950.06; Tier 4: $9,987.52. Schools will receive additional payments based on the success of the game, and “CLC is hopeful sales of the game will exceed the minimum guaranteed royalties, and increase revenue, but a breakdown of how that money would be distributed is not listed, other than to say schools will get a 10 percent royalty on sales,” per cllct’s Matt Lieberman, who adds: “It's not stipulated whether those sales are net sales or gross sales.” (link)

Louisiana Tech will install a 3,240-square-foot Daktronics end zone video display in Joe Aillet Stadium in time for the 2024 football season. Along with the 36’ x 90’ video board, the Bulldogs will install a custom Daktronics audio system that will “improve the game-day experience for our fans, players and alums,” according to AD Ryan Ivey.
