New Arizona State AD Graham Rossini points to upgrades for Desert Financial Arena as a key initiative for his early tenure: “I’m the first one to say there’s a way for us to present our basketball product in a more modern fashion. It’s got great bones, there are some attributes that we can bring out of it but we are very much mindful of the expectation of the fan in today’s day and age and what they want to see from a venue. [...] It needs to be comfortable, it needs to be easy to navigate, it needs to be entertaining. The sound system, the scoreboard, etc. are all areas that we’re looking at. How do we make those improvements that are fan-focused in their mind?” (link)

The ACC paid $7.23M to attorneys in FY23, the most of all the Power 5 leagues during the year. Former Big Ten outside counsel Jon Barrett received $888,588 from the ACC before his retirement in February. The league also paid $1.76M to firm Fox Rothschild, which has defended the conference on a number of litigation matters, including House v. NCAA. (link)

SEC Commissioner Greg Sankey commented yesterday on the timeline of decisions as next steps in the NCAA-House settlement: “As I understand – so, I’m not in charge of everything, despite what some people will say - not in the next couple of months. The next couple of months will be that process – the ability to walk through the legal system, the court system, a longer-form agreement. Decisions that can be made, then, at the conference level about certain structural issues, some national policy changes that need to take place. And then, it goes through the legal process that takes months upon months. I look out, probably a year from now when we’ll have – we have a level of clarity now. But we’ll have more clarity as we walk through these next 12 months.” More from Sankey: “There is no better time to be a student-athlete than right now. Period. And we have to protect those opportunities, and we have to also acknowledge there are limits. We’re going to have some hard decisions to make over the next few years as we transition to this new model. But we’ve got an opportunity, I think, to control elements of our future and keep these broad-based programs intact.” (link)

MAAC Commissioner Travis Tellitocci: “I would say the most disheartening thing for me is that we now have to make difficult decisions as to what budget items will be cut that obviously will negatively impact the student-athlete experience over the next 10 years. [...] I’m not in favor of the MAAC being held liable for damages that primarily benefits athletes from the autonomy (power) conferences.” Siena AD John D’Argenio chimes in: “The devil is in the details, but certainly it impacts the services we can deliver to the athletes, right, because we’re going to lose a percentage of our revenue distribution, some of which is earmarked for things like academic enhancement services. We’ll have to make some changes, so unfortunately, it could impact the experience we give our athletes.” (link)

Opendorse Co-Founder/CEO Blake Lawrence on the future of collectives in light of the NCAA-House outcome: “One of the key functions of a collective is properly managing payroll for a sport. And that skill set that’s been developed is now going to be required for every single (power conference) school. Will schools hire key members of their collective, the ones responsible for managing and moving money, negotiating with parents and players, and move that internally? Or would schools hire the collective as their NIL agency, and shift some of their risk away from the school into the third-party to manage the distribution of those NIL payments?” (link)

On the Title IX debate surrounding House, Title IX specialist Dan Cohen tells Forbes’ Kristi Dosh: “There may be a viable theory where conferences distribute payments directly to student-athletes under a fair market valuation approach, which might avoid some Title IX implications if the shared revenue does not actually pass through the schools. However, conferences may be wary to do so. The NLRB is already advancing a ‘joint employer’ theory against Southern Cal and the Pac-12, and conferences may be cautious about their own potential liabilities. We’ll have to see the final settlement structure, but gate receipts and sponsorship dollars likely could not be addressed in this manner. Title IX undoubtedly will come into play in numerous ways as schools implement the final revenue sharing structure as well as the new scholarship/roster cap structure.” Parker Poe attorney Lexi Trumble adds: “I can’t conceive of a world in which the landmark House settlement doesn’t implicate Title IX. [...] The U.S. Department of Education’s Office for Civil Rights has explained in guidance documents that, ‘Athletic financial assistance includes any financial assistance expenditures through the institution's athletics program and any other aid that is connected to a student's athletic participation.’ If these House payments are routed through a school’s athletics department—if they bring the compensation on-campus—the school’s involvement in those transactions, in my opinion, likely triggers Title IX.” (link)

Colorado football student-athlete Shilo Sanders filed for bankruptcy in October with $11M+ in debt. Per USA Today’s Brent Schrotenboer: “The debt stems primarily from what a court in Texas says he owes to a security guard at his former school − a man who claimed Sanders assaulted him in 2015 and gave him severe and permanent injuries, including ‘neurological injuries and damage to his cervical spine.’ The security guard, John Darjean, sued Sanders for damages from this incident and won a $12 million judgment against him after Sanders failed to show up for trial in 2022.” Darjean is still trying to collect and has raised questions about Sanders’ earnings from NIL deals, specifically alleging that Sanders transferred said deals to his company, Big 21, LLC, as a way to keep the earnings protected from Darjean. Sanders legal team says he has done nothing wrong and in February noted: “Shilo is the honest but unfortunate debtor looking to get his fresh start in life, free from the oppressive burden of his debts, including the default judgement to the Plaintiff.” More. RealResponse Founder/CEO David Chadwick joins Connect’s Stephanie Garcia Cichosz to highlight some ways the organization is supporting student-athletes and administrators and the company’s ability to measure culture in order to increase retention and fans. Chadwick on the latter: “We talked about the student-athletes, we've talked about the staff, but the group that sometimes gets overlooked in the traditional sense of the area that we're talking about is the fan. It’s the person that's paying usually hard-earned money to be able to come and cheer on their team and we have developed products recently that are being used globally now for easy texting, easy messaging, easy email etc. We had several of our partner schools ask us why couldn't this be replicated in a similar way with the attendees that are coming to our events because we want to be able to prioritize their experiences. We might not know who they are per se to be able to upload them in the system like we are with their student-athletes, but if they have a concern, if they have a question, if they have general feedback, if there's something really serious going on – and there's a scale [from, for instance] there's no toilet paper in the bathroom to, ‘Hey, I'm a fan at this game and someone nearby me is yelling obscenities to the opposing team.’ A lot of the very large Power 5 football teams have had a reporting line or texting line in place, but sometimes the issues are happening in the smaller environment.” Full Q&A on Connect. Crakes Media Principal Patrick Crakes joins the Canzano & Wilner podcast to discuss the sports media environment and notes that for all the talk about streaming, only Amazon has stepped forward in a significant way, “but the real truth is they’re supplemental” rather than a “replacement for” because “80% of the content remains in the old, established system. … and now these deals are six to 10 years, don’t look for them to replace anytime soon.” Crakes also notes the College Football Playoff media deal with ESPN wasn’t the auction many thought it would be, but that doesn’t mean both sides didn’t receive value. On Fox sitting out the bidding process: “Fox is fine. At some point in the current era, you have what you need to optimize your business. You don’t need everything, certainly not in this era.” On the SEC and Big Ten: “If it came down to it, guys, those two conferences don’t need anybody else. They could do their own postseason and just invite people. If you come, great; if you don’t, super. Now, it’s not optimal. I don’t think they want that, but knowing that’s your fallback position, that’s not the end of the world.” Crakes advises those in big leagues to “get your deals done. Stop screwing around. Don’t wait for an auction. Get locked down, get through this so we can figure out what the landscape looks like. And in the end I feel like there’s bundling, guys, and it's got to be a bundle that doesn't look like the old pay TV bundle but still has the same concepts of bundling, which are universal. It allows you to scale, you can offer people a bunch of stuff at wholesale prices, you can get some commitment from them. You’re building a business that sustains these ever-growing, more expensive media rights, which, by the way, for college football, they might not double but they're not going to go backwards.” Full podcast. A number of ADs around the nation released statements related to the House settlement. Georgia AD Josh Brooks points to a $49M reserve fund as one pool of cash that the Bulldogs could use to help offset the annual revenue share with student-athletes: “The draw off of that helps our operating budget. In some degrees, it’s always raining. But we’re ready for it. Ready, like I said yesterday, to focus on growing revenues and being more efficient in the way we operate. [...] I think there are a ton of issues we have to work through and that’s going to be something that gets worked out over the next few months. We’re going to try to take this and make the best of it. We know where we are at with this piece and now the details of what’s moving forward is what we are going to spend a lot of time working.” (link)

Illinois AD Josh Whitman: “On our campus, we must determine what we can afford, who will receive these new scholarship or revenue sharing benefits, and in what amounts. This analysis will inevitably lead to an important discussion with others at the University regarding institutional expectations for competitive excellence and how those expectations intersect with student-athlete opportunity, experience, and equity. As the model of intercollegiate athletics modernizes, our approach to the business of Illinois Athletics must modernize as well. Your expectations, on the scoreboard and in the stands, have never been higher. And with the changes now on the horizon, our ability to meet those expectations – to drive your active participation and support – has never been more important. For nearly a year, we have been studying our strategy around fan engagement, including ticket sales, donor activation, parking, and more. Georgia State AD Charlie Cobb: “We’ve been working off a model for several years that when the playoffs that our partition of the growth in the television dollars in the playoff dollars was going to change our payout to the Sun Belt Conference or Group of Five conference. With the new agreement we’ll effectively get a zero change. [...] I think a lot of school presidents, boards, significant donors, athletic directors on down the line who are going to be asking, ‘Who are we and what are we going to be about?’ And trying to answer that with a smaller, more constrict revenue pool to pay for all the things that are going to come out of whatever this new modern world of NCAA athletics looks like.” (link)

North Dakota State AD Matt Larsen: “I think the part that is hard to swallow for I would say the majority of Division I defendants in the lawsuit are the (Power) five conferences in the NCAA and the bulk of the certified class are football and men’s and women’s basketball players. So you’re essentially asking the majority of Division I to pay back damages to Power Five football and men’s and women’s basketball players. Our student-athletes at NDSU are going to have to do with less so we can pay back FBS football and men’s and women’s basketball players. [...] Anytime we’ve had a cut, we’ve always charged our staff that we don’t want it to impact our student-athlete experience and we don’t want it to impact our opportunity to compete for championships. So a lot of that sometimes becomes administrative. [...] I’ve been saying for years that in all of Division I you go from a $10 million budget to a $200 million-plus budget and all operating under the same rules is past due for some changes.” (link)

SEIU Local 560 President Chris Peck, whose union represents the Dartmouth men’s basketball players as well as about 500 other workers across Dartmouth’s campus, argues the NCAA’s antitrust settlement is not a solution to labor inequities in college sports and is not a substitute for rules created through a union-management relationship. Peck on Friday: “The attempt at a revenue-sharing workaround only supports our case that the NCAA and Dartmouth continue to perpetrate a form of disguised employment,” adding that he expects the NCAA will continue to “do everything it can to avoid free market competition. … The solution is not a special exemption or more congressional regulation that further undermines labor standards. Instead, NCAA member universities must follow the same antitrust and labor laws as everyone else. Only through collective bargaining should NCAA members get the antitrust exemption they seek.” Context from Sportico’s Michael McCann: “The absence of collective bargaining means the economic rules negotiated in a settlement between the NCAA and attorneys for the players aren’t immunized from potential antitrust challenges. The non-statutory labor exemption, which reflects a series of U.S. Supreme Court decisions, grants an immunity to workplace rules that primarily impact wages, hours and other working conditions when they are borne through bargaining. Rules created through a litigation settlement or unilaterally imposed by management are not immune. That means an athlete can argue that a salary cap is a violation of antitrust law. The player would contend the cap is a restraint on competition among competing businesses (colleges and conferences) and that some colleges would pay more than the cap if they had the discretion.” (link)

Sportico’s Eben Novy-Williams and Scott Soshnick discuss private equity’s foray into college sports, and Novy-Williams reports the newly formed Collegiate Athletic Solutions has been in contact with “multiple dozens” of athletic departments and adds: “We are, I think, on the precipice, and probably by the end of the summer going to have the first number of deals between institutional capital of some sort and athletic departments or schools.” Regarding the potential for PE firms themselves, Novy-Williams says several in the space have echoed RedBird Capital Founder/Managing Partner Gerry Cardinale’s assertion that this is the best opportunity to invest in sports he’s seen in 30 years. “There’s bigger fan affinity in college sports than there is in pro sports. Geographically it's not only a wider net, but it touches in parts of the country like Alabama, like Arkansas that don't have pro teams anywhere near them. … And if you look at the drivers for valuation increase, rapid valuation increase, in pro sports in the U.S., you see scarcity value. College sports has that. We’re not really minting too many new Power 5 schools. … And then it's the non-correlated-to-other-assets appeal. One of the things that has driven private equity to pro sports is that it's a very uncorrelated asset to pretty much any other industry that you might be in, and there's certainly worlds in which you can have a portfolio that spreads across technology and healthcare and, let's say, consumer goods but but there's correlation, there’s overlap. If one goes down because of something, there’s a chance others are going to go down. People…look at sports as one of those areas that is largely uncorrelated from everything else.” Lots more in the full podcast. (link)

Collegiate Sports Associates President/CEO Drew Turner and CSA Partner Consultant for Baseball Jason Penry join CSA's Steph Garcia Cichosz to examine turnover in the Baseball HC ranks and trends to track at this stage of the season. Turner also discusses the addition of Penry to the CSA team to support the firm's growth in Baseball HC searches, how Baseball HC turnover compares to football and basketball and lots more. Turner on how increased search firm involvement will increase salaries and/or contract lengths: “I”m not sure yet. But what I think we can do as a search firm and where we can be an asset is there is so much happening in college athletics, and college baseball is one of several things that is currently going on. Yet hiring the right people, the right leaders for your program is still critically important and so to try and manage a high-profile search in a tight time frame has made the need to move more efficiently than ever. Trying to manage that search, do it effectively, be thorough in a tight time frame, and doing that by yourself is probably more challenging than ever with all that's happening in college athletics, yet it's just as important as ever.” More on Connect. East Carolina Baseball HC Cliff Godwin (two games) and student-athlete Dixon Williams (one game) have been suspended by the AAC for their role in the Wichita State game incident on Thursday. Both served a game of the penalty yesterday, sitting out for the Pirates win against Rice. Godwin will also miss today’s tilt against the Shockers. Godwin was ejected and assessed the additional two-game suspension for violating NCAA Rule 2-26-h, which states that “no team personnel may continue to argue or to continue to excessively express themselves with prolonged action or offensive language after an ejection.” Williams was given the one-game suspension for violating NCAA Rule 8-7, which prohibits “unnecessary and violent collisions with the catcher at home plate, and with infielders at all bases.” (link, link)

JohnCanzano.com’s eponymous publisher reports from the Pac-12 Baseball Tournament in Scottsdale, the last athletic event in the conference’s 108-year history and writes: “This tournament shouldn’t be all sad. It’s a celebration, too. You don’t blow out the candles on a 108-year-old conference without remembering so many of the wonderful birthdays that came before. But I’ll tell you that my heart sank when I came upon the merchandising set up on the concourse. The Pac-12 emptied the storage facilities and is holding a blowout sale. There were hats, keychains, lanyards, golf balls, hair ties, stickers, and felt pennants featuring the conference’s logo alongside the logos of its 12 members. T-shirts hung on discount racks from old conference events (i.e. softball and golf, football games, the conference basketball tournaments, etc.). ‘Buy one for $10, get one free,’ a sign read.” Yesterday’s semifinal games marked the last two broadcasts for the Pac-12 Networks, and Roxy Bernstein, one of the networks’ first hires, handled play-by-play duties for the first matchup. Ahead of the broadcast, Bernstein told Canzano: “It’s going to be emotional. We’re talking about how we’re going to handle it. We’re planning for it and throwing a lot at it.” Canzano: “I’m in Scottsdale this week. I promised you I’d go where the stories are. An important one is coming to a close. EA Sports President Cam Weber explains how the company used AI in the development of College Football 25: “We've used a machine learning and inspired tool set to create over 134 schools, stadiums, mascots and traditions and over 13,000 players that have opted in from our NIL program. And we couldn't have built those likenesses and executed on that without machine learning technology that we built into the toolsets that we're using to execute on all of it.” Weber goes on to note that “we’ve been investing for a number of years now in building our capabilities. We’ve built new studios, new teams, we've acquired new studios, we brought in new franchises like Formula 1. We actually just launched eight new AAA-caliber sports games on HD consoles this past year which is an all-time record for EA Sports.” (link)
