SEC Commissioner Greg Sankey covered several topics at the league’s annual meeting in Destin, including the proposed House settlement. While many caution the settlement would not be a panacea, Sankey noted: "I think Congress has still an opportunity to use the structure of this settlement to enact legislation to strengthen the future of college sports.” To that end, Sankey says the NCAA and conferences need to continue educating lawmakers on the topic. “I would welcome action between now and the election. Most people with whom I converse say that's unlikely, and so your educational process will continue post-election, and it will depend on who's in leadership of each party within the House and Senate, where the majorities lie and who occupies the White House. Those realities guide conversations. So, as much as it's been unpredictable, I think it will still be unpredictable." Sankey went on to comment that he’s yet to meet a student-athlete who has said he or she wants to be “[taxed] like a lawyer,” yet “there are those who advocate for that reality. That takes me back to a fundamental statement, which is there's no better time to be a student-athlete than right now in the history of college sports. No better time. And again, they're not calling me saying, 'I want to be an employee.'" The conference will have to “wrestle” with the Title IX component of the House settlement, as Sankey explains: “Our trends have been to provide some equity. This is a very different world. I expect we'll elicit opinions, perspectives, and we've got time to learn those perspectives – and then we're going to have to work through what that means from a decision-making standpoint." (link)

More from Destin, where SEC Commissioner Greg Sankey pushed back on the narrative that he and his colleagues are seeking antitrust protections. “You have not seen me talk about antitrust exemptions. And I want to be clear on that. I have talked about safe harbors, about the ability for us to implement, with legal protections, whatever law might be enacted to provide support to student-athletes, so we can get out of this cycle of constant litigation.” Sankey went on to say the House settlement “doesn’t embed employment automatically,” adding: “As people write about collective bargaining in college sports versus professional sports, that played out over 30, 40, 50 years, with lockouts, antitrust lawsuits. There can be a better way. There’s an opportunity here. But in life nothing is certain. … You assume — you assume — that some kind of bargaining mechanism would resolve [transfer rules, recruiting caps and other issues]. But understand the professional leagues started at the opposite end of the spectrum, which was complete restriction. You go back and read stories of people who said they’d rather sell insurance than go back and play in a fill-in-the-blank city. That’s not where we are. So what I think [has not] been made clear is the comparative realities with historic professional sports bargaining and where we are.” In response to a question about whether schools could sign student-athletes to contracts under the new model, Sankey answered: “We’ll see.” (link)

Arkansas AD Hunter Yurachek earlier this month said he initially wasn’t a fan of collectives after seeing how they were being used. “As we often do in college athletics we are our own worst enemy and somebody finds the loophole in something good. These things called collectives were born, and collectives are groups of donors that came together to pool their resources to induce players to either come to their school or remain at their school. For very little work.” Yurachek also says if the Razorbacks could raise $12M for its collective they’d be in an “incredible spot,” but still in the middle to lower tier of SEC collectives. (link)

NCAA Committees Notes…
+ The DI Council adopted expedited legislation stating the Women’s Basketball Committee “shall consist of 12 members, including one member from each of the conferences named in Bylaw 9.2.2.1.1 that is eligible for automatic qualification, four members selected from the seven highest ranked other conferences based on basketball success and the remaining members from the remaining conferences.” The council noted that “with the change to the number of autonomy conferences, there is a need to determine how the composition of the Women’s Basketball Committee should be adjusted.” (link)
+ The Committee for Legislative Relief “established information standards, guidelines and directives to consider waiver requests for a student-athlete to enter the NCAA Transfer Portal outside of student-athlete’s sport-specific transfer window. The changes specify that legislative relief to permit a student-athlete to enter the NCAA Transfer Portal outside of sport-specific window may only be considered through the waiver process for exigent events outside of the student-athlete’s control, unrelated to athletics participation and demands the student-athlete’s immediate departure from the institution. Further, legislative relief to enter the NCAA Transfer Portal outside of a designated sport-specific transfer window are reserved for extreme, nonathletically related events that transpire after the student-athlete’s sports-specific transfer window. Athletics and academic reasons to enter the NCAA Transfer Portal outside of a designated window are not circumstances that should be considered by the NCAA staff and will be denied. Further, lack of institutional knowledge of the legislation does not warrant relief of the legislation.” (link)

D1Baseball’s Mark Etheridge points out that 10 universities were represented on the Baseball Selection Committee, seven of whom had teams in contention for the postseason. Army West Point had an AQ for winning the Patriot League. “Florida State received the final top-eight spot. [ECU] received the final host. Florida, Kansas State, Coastal Carolina, and Indiana were among the final teams in the field. Six opportunities were on the cutline, and all six fell on the side of committee member representation. Evaluated alone, each barely causes a stir. Together, the circumstantial evidence points toward tit-for-tat, horse-trading, or whatever ugly term you prefer. Even if one assumes positive intent, there’s little question this is a bad look. None of the choices were egregious. All are defensible. Still, no one is surprised.” Outgoing Coastal Carolina AD/Selection Committee Chair Matt Hogue points out that ‘it is important to remember those decisions don’t happen in a vacuum. These (decisions) are happening at different stages throughout the weekend. You are taking each situation as it comes.” TCU HC Kirk Saarloos remains skeptical after the Horned Frogs were left out with an RPI of 39: “We didn’t have a person on the selection committee. That’s what it came down to. There were four bubble teams that have athletic directors on the committee and they were all selected.” Etheridge consequently posits that “if coaches feel that way, it’s a problem. On CSC’s goals for the year, Christianson explains: “We’re really in growth mode right now. We really want to continue to grow our membership. The Star Tribune’s Marcus Fuller profiles the role Learfield’s Gophers Sports Properties Senior Manager for Business Development–NIL Brett Schreiner is playing in Minnesota’s NIL outreach. Schreiner explains: "We're trying to kind of be on the cutting edge with this role. We're trying to work with a lot of companies to make NIL more important to them." To get these companies on board, Schreiner notes that a crucial step is getting them to see the value of influencer marketing. "I don't think this path has gotten as much press. This basically gives student-athletes a chance to be influencer marketers for companies. … How can we pair a company with student-athletes and the Gophers' brand to touch the hearts of fans across the state and the nation? We can humanize the companies with athletes from the University of Minnesota and not just from the local pro sports teams." Schreiner adds that these partnerships “can also teach athletes about developing their entrepreneurship and what they want their brand to be.” (link)

Puck’s John Ourand and Julia Alexander dissect Netflix’s future with sports rights, and Ourand notes the streamer’s recent NFL deal makes sense for the league, which can reach a global audience with one deal rather than 100; however, Alexander points out that while Netflix helps the NFL’s global reach, the NFL doesn’t necessarily move the international needle for Netflix. “Netflix is a global company, and there is no real proof…that there is a huge market for the NFL outside of the United States. Stadium figures from London and Germany games are great, but how many of those fans are expats, traveling Americans, and die-hard sports fans compared to born-and-bred Londoners or Berliners who are interested in American football? … Netflix’s sports strategy makes more sense to me as a combination of marquee events that it can sell to an international audience while playing to a specific market.” Doing so, she continues, “helps score big advertisers, creates ‘event’ programming, and allows Netflix to experiment with subscriber reaction in specific markets. In fact, I think Netflix’s bread and butter is going to be in sports like cycling, gymnastics, sailing, etcetera. These are sports with low buy-in, global interest, and they allow Netflix to participate in the event side as well as programming.” As far as Amazon’s continued involvement in sports rights, Alexander posits that the company’s strategy is no different than it is with other verticals. The company’s acquisitions of Twitch, Audible and other companies “represent its attempt to present in every facet of people’s lives. Sports is just another line on that checklist, and it’s why the FTC is watching every move.” More. (link)

Netflix Co-CEO Ted Sarandos sits down for a wide-ranging Q&A with the New York Times’ Lulu Garcia-Navarro, who asks Sarandos who the company’s competitors are now. Sarandos: “We compete for screen time. Social media, including YouTube, other streaming apps, gaming.” Sarandos acknowledges that “free” is “super-popular” and is something YouTube offers that Netflix doesn’t. As such, Sarandos asserts that “you’ve got to be worth paying for all the time. Be better all the time, at the programming, at the choosing of it, at driving the conversation around the world of it, which drives the kind of must-seen-ness.” Sarandos says of the company’s increasing involvement with live events that “it’s really incredible, the conversation that gets driven around the world around a big live event. You know, in a world of on-demand and total control, the novelty of a big live event, if it’s a Super Bowl or the Tom Brady roast, is that people get very excited that they’re all watching it at the same time. And what we saw with the Tom Brady roast was it was driving so much conversation around the world that the audience kept coming back. The NCAA Baseball Tournament bracket is set. The national top 16 seeds are Tennessee, Kentucky, Texas A&M, North Carolina, Arkansas, Clemson, Georgia, Florida State, Oklahoma, NC State, Oklahoma State, Virginia, Arizona, UC Santa Barbara, Oregon State and ECU, respectively. Overall, the SEC got a record 11 teams in, followed by the ACC (8), Big 12 (6), Sun Belt (4), and Big Ten and Pac-12 (3). The AAC, Big East, Big West, Conference USA and Missouri Valley all have two teams in the field. With the final national postseason tournament set, FootballScoop’s Zach Barnett takes a look back to see which schools made the postseason in football, volleyball, basketball, baseball and softball. Barnett notes that 21 FBS schools made a bowl game and the NCAA men's basketball tournament, down from last year’s total of 28. Meanwhile, four FCS schools reached the postseason in football and the NCAA MBB Tournament. Adding in baseball lowers that total to 12, adding in women’s hoops lowers it to eight and adding in softball and volleyball lowers it to three: Tennessee, Texas and Texas A&M. As athletic departments contend with how the House settlement will impact Title IX, Husch Blackwell explains in an AthleticDirectorU article, that, per the Office of Civil Rights, “nothing in Title IX requires the cutting or reduction of teams in order to demonstrate compliance with Title IX, and the elimination of teams is a disfavored practice. Because the elimination of teams diminishes the opportunities for students who are interested in participating in athletics instead of enhancing opportunities from discrimination, it is contrary to the spirit of Title IX.” That said, Husch Blackwell notes that “if schools may one day be required to share revenue or pay student-athletes minimum wage, it is hard to imagine a world where they can all maintain the 16-sport Division I sponsorship minimum.” With the first Title IX complaints now being filed concerning perceived institutional involvement in NIL, Husch Blackwell cautions that “this trend may continue or be amplified should a new employment model be adopted on an ad hoc basis. While some institutions are advocating to bring their NIL collective(s) in-house, the implications of doing so have not been fully evaluated, nor is it clear how institutions could comply with Title IX based on the current reported rate of spending on NIL in men’s basketball and football as compared to other sports.” As such, the firm advises that athletic departments should continue to “analyze these decisions through the gender equity lens. Failure to do so could result in significant risk to colleges and universities, even beyond the athletics department.” (link)

Oklahoma Executive Assoc. AD Leah Beasley joined AthleticDirectorU’s Tai M. Brown at the 2024 PACnet Conference to discuss the ripple effects great leadership has on department culture and the fan experience. Beasley also discusses the intangible ROI of unexpected, spur-of-the-moment marketing efforts on brand-building and comments on the value of “forced collaboration.” On the latter, Beasley explains: “There’s not going to be something where you’re going to feel stupid – we hope. That’s never the intent. We want you to share what your thoughts are. If you feel like you have an idea for marketing, say it. If you have an idea for SoonerVision, say it. I feel like our team does a great job of listening to those ideas. We can always be better, and I can always be better, but I do feel like there is that, at least that opportunity for transparency and opportunity for trust. We always want to build trust.” Beasley also explains her own value proposition is building, which manifests itself in improving the student-athlete and fan experiences. “We are in the customer service business. Whether our fan is a customer or whether our student-athlete is one of our customers. So, how are we serving them? And then also brand. … It’s brand equity, brand affinity. New on Connect: Minnesota Senior Assoc. AD for NIL/Policy and Risk Management Jeremiah Carter joins Connect/MB Sports’ Matt Banker. The two dive into how the Gophers handle NIL and transfers, and Carter outlines how the department is making preparations for travel initiatives with the addition of new Big Ten members. Carter explains he’d like to see the industry get to a place where it is less reactive. “If we’re going to go to open transfers, let’s go to open transfers. Let’s make the decision, put the parameters around it that we can defend, and put the parameters around it that we think are best for our student-athlete experience. And it’s not just the student-athlete transferring that we need to think about, it’s their teammates, their incoming teammates, their outgoing teammates. It impacts them as well. … We're looking as an industry to find some sort of level ground that we can stand on and then start to make decisions for what we want to do in the future from level standing. Western Carolina averaged a Southern Conference-leading 11,935 fans during the 2023 football season, good for 15th in FCS. The Catamounts enjoyed crowds of over 10K for all five home games and also set records in season ticket sales, number of season tickets sold, and overall ticket revenue generated. Meanwhile, the baseball team eclipsed its previous record for season ticket revenue during the 2024 home schedule, and the WCU softball team drew a record 732 fans for its home matchup against Tennessee. Overall ticket revenue in football, men's and women's basketball, and baseball was at an all-time high. (link)

The Athletic’s Stewart Mandel and Scott Dochterman attempt to predict the TV schedule for the first three weeks of the college football season ahead of Thursday’s reveal. They note the lineup will look different than in previous years because: “First: ESPN now owns all of the SEC’s rights and will begin showcasing the conference on ABC. The network gave a sneak peek earlier this month, when it announced SEC afternoon/prime-time double-headers in each of the first three weeks. Second: CBS will air its first full-season Big Ten schedule in the SEC’s former window. It will not, however, be the first pick most weeks, as those slots rotate among Fox (Noon ET most weeks), CBS (3:30 p.m. ET) and NBC (7:30 p.m. ET). Third: There is no more Pac-12. This will become most noticeable in ESPN’s ‘After Dark’ window, which might feature a lot of Arizona, Arizona State, Colorado and Utah — all now battling in the Big 12.” At least part of the schedule has already been announced after the Big Ten unveiled its slate of Friday games and Fox previously revealed Michigan-Texas as the Big Noon game for Week 2. Further, the SEC has already announced South Carolina-Kentucky for its 3:30 slot on ABC that week. For Week 3, they note that NBC for its night broadcast has a choice between Washington State–Washington in Seattle or Indiana at UCLA.
