The NCAA Baseball Tournament bracket is set. The national top 16 seeds are Tennessee, Kentucky, Texas A&M, North Carolina, Arkansas, Clemson, Georgia, Florida State, Oklahoma, NC State, Oklahoma State, Virginia, Arizona, UC Santa Barbara, Oregon State and ECU, respectively. Overall, the SEC got a record 11 teams in, followed by the ACC (8), Big 12 (6), Sun Belt (4), and Big Ten and Pac-12 (3). The AAC, Big East, Big West, Conference USA and Missouri Valley all have two teams in the field. With the final national postseason tournament set, FootballScoop’s Zach Barnett takes a look back to see which schools made the postseason in football, volleyball, basketball, baseball and softball. Barnett notes that 21 FBS schools made a bowl game and the NCAA men's basketball tournament, down from last year’s total of 28. Meanwhile, four FCS schools reached the postseason in football and the NCAA MBB Tournament. Adding in baseball lowers that total to 12, adding in women’s hoops lowers it to eight and adding in softball and volleyball lowers it to three: Tennessee, Texas and Texas A&M. Barnett goes on to note that seven schools reached the postseason in five of the six major sports: Alabama, Arizona, Auburn, Duke, Florida State, Kentucky and Oregon. More from Barnett. (link)

As athletic departments contend with how the House settlement will impact Title IX, Husch Blackwell explains in an AthleticDirectorU article, that, per the Office of Civil Rights, “nothing in Title IX requires the cutting or reduction of teams in order to demonstrate compliance with Title IX, and the elimination of teams is a disfavored practice. Because the elimination of teams diminishes the opportunities for students who are interested in participating in athletics instead of enhancing opportunities from discrimination, it is contrary to the spirit of Title IX.” That said, Husch Blackwell notes that “if schools may one day be required to share revenue or pay student-athletes minimum wage, it is hard to imagine a world where they can all maintain the 16-sport Division I sponsorship minimum.” With the first Title IX complaints now being filed concerning perceived institutional involvement in NIL, Husch Blackwell cautions that “this trend may continue or be amplified should a new employment model be adopted on an ad hoc basis. While some institutions are advocating to bring their NIL collective(s) in-house, the implications of doing so have not been fully evaluated, nor is it clear how institutions could comply with Title IX based on the current reported rate of spending on NIL in men’s basketball and football as compared to other sports.” As such, the firm advises that athletic departments should continue to “analyze these decisions through the gender equity lens. Failure to do so could result in significant risk to colleges and universities, even beyond the athletics department.” (link)

Oklahoma Executive Assoc. AD Leah Beasley joined AthleticDirectorU’s Tai M. Brown at the 2024 PACnet Conference to discuss the ripple effects great leadership has on department culture and the fan experience. Beasley also discusses the intangible ROI of unexpected, spur-of-the-moment marketing efforts on brand-building and comments on the value of “forced collaboration.” On the latter, Beasley explains: “There’s not going to be something where you’re going to feel stupid – we hope. That’s never the intent. We want you to share what your thoughts are. If you feel like you have an idea for marketing, say it. If you have an idea for SoonerVision, say it. I feel like our team does a great job of listening to those ideas. We can always be better, and I can always be better, but I do feel like there is that, at least that opportunity for transparency and opportunity for trust. We always want to build trust.” Beasley also explains her own value proposition is building, which manifests itself in improving the student-athlete and fan experiences. “We are in the customer service business. Whether our fan is a customer or whether our student-athlete is one of our customers. So, how are we serving them? And then also brand. … It’s brand equity, brand affinity. However, to be the husband and father I want to be, I need to step away from this lifestyle. … Throughout the past year, I have realized that even in the best of circumstances I cannot simultaneously do this job well and care for my family well. New on Connect: Minnesota Senior Assoc. AD for NIL/Policy and Risk Management Jeremiah Carter joins Connect/MB Sports’ Matt Banker. The two dive into how the Gophers handle NIL and transfers, and Carter outlines how the department is making preparations for travel initiatives with the addition of new Big Ten members. Carter explains he’d like to see the industry get to a place where it is less reactive. “If we’re going to go to open transfers, let’s go to open transfers. Let’s make the decision, put the parameters around it that we can defend, and put the parameters around it that we think are best for our student-athlete experience. And it’s not just the student-athlete transferring that we need to think about, it’s their teammates, their incoming teammates, their outgoing teammates. It impacts them as well. … We're looking as an industry to find some sort of level ground that we can stand on and then start to make decisions for what we want to do in the future from level standing. Western Carolina averaged a Southern Conference-leading 11,935 fans during the 2023 football season, good for 15th in FCS. The Catamounts enjoyed crowds of over 10K for all five home games and also set records in season ticket sales, number of season tickets sold, and overall ticket revenue generated. Meanwhile, the baseball team eclipsed its previous record for season ticket revenue during the 2024 home schedule, and the WCU softball team drew a record 732 fans for its home matchup against Tennessee. Overall ticket revenue in football, men's and women's basketball, and baseball was at an all-time high. (link)

The Athletic’s Stewart Mandel and Scott Dochterman attempt to predict the TV schedule for the first three weeks of the college football season ahead of Thursday’s reveal. They note the lineup will look different than in previous years because: “First: ESPN now owns all of the SEC’s rights and will begin showcasing the conference on ABC. The network gave a sneak peek earlier this month, when it announced SEC afternoon/prime-time double-headers in each of the first three weeks. Second: CBS will air its first full-season Big Ten schedule in the SEC’s former window. It will not, however, be the first pick most weeks, as those slots rotate among Fox (Noon ET most weeks), CBS (3:30 p.m. ET) and NBC (7:30 p.m. ET). Third: There is no more Pac-12. This will become most noticeable in ESPN’s ‘After Dark’ window, which might feature a lot of Arizona, Arizona State, Colorado and Utah — all now battling in the Big 12.” At least part of the schedule has already been announced after the Big Ten unveiled its slate of Friday games and Fox previously revealed Michigan-Texas as the Big Noon game for Week 2. Further, the SEC has already announced South Carolina-Kentucky for its 3:30 slot on ABC that week. For Week 3, they note that NBC for its night broadcast has a choice between Washington State–Washington in Seattle or Indiana at UCLA. The Apple Cup rivalry seems too strong to pass up, while the Bruins’ first Big Ten game seems fitting in prime time with FS1.” Check out their full slate of predictions. (link)

The NCAA’s Point of View: House Settlement…
+ Rakesh Kilaru, lead attorney for the NCAA in the House, Hubbard and Carter settlement, joins Tulane Sports Law Director Gabe Feldman’s SportsWise podcast to discuss the mechanics of the settlement, what it means in the big picture, how the NCAA believes it is protecting itself from future antitrust lawsuits and more. + Kilaru: “It’ll be a 10-year settlement where we're hoping and expecting that it'll get approved, and so the court will agree that the terms of the settlement are fair and reasonable for the class. And we'll get through that the ability to enforce rules on things that don't come within the four corners – for example, payments in addition to or above how the pool is going to operate. I think that 10-year stability period is important in that you’ll have essentially a court decree saying that this system is workable, saying that it's fair and saying that it's not an antitrust violation. So we think that will provide significant stability going forward.”
+ Kilaru notes student-athletes will have the chance to voice their concerns about the settlement, “but I would say I'm hopeful and think it is probably the case that there won't be many of those objections once people see how this is actually going to operate in practice. On the Fontenot case in particular…we do think that the settlement will make that case not a major event, to say the least. Certainly, I think people are going to have the right to come into the Northern District of California and raise concerns with the settlement if we have them. It may be that the Fontenot plaintiffs decide to do that, but I think you have to wait and see what they're going to get under the settlement and how it's going to operate for them and make an informed decision about that.”
+ Current student-athletes will have three options regarding their participation in the settlement: they can opt in and accept the terms, they can opt out of the backward-looking damages piece and choose to pursue claims on their own, and/or they can opt out of the forward-looking agreement regarding the revenue structure. Kilaru emphasizes he believes few student-athletes will choose the latter two options, “but that’s their right. And then there’ll be a hearing at some point – I would guess maybe early next year, but it'll depend on the schedule – that the court sets a date where anyone who's objecting can come in and say, ‘Judge, you shouldn't approve the settlement. I don't like this aspect, I don't like that aspect of it.’ And our hope is at the end of that hearing the judge will say, ‘I understand the objections, I understand the concerns, but I'm approving the settlement.’ And with that kind of bang of the gavel, the injunction will be approved.” Moving forward, incoming student-athletes will have the same opportunity to raise objections.
+ Kilaru believes the NCAA is in agreement with the plaintiffs’ attorneys that “it would be appropriate for Congress to act to essentially enshrine the settlement, and I think what that means concretely is [to] ensure that there is an antitrust liability for complying with it and then also preempt state laws that exist today that are inconsistent with it. So, that's something that I think is just part and parcel of and related to the desire to create something durable that we think we've done.”

LSU AD Scott Woodward weighs in on the new model proposed as part of the House settlement: “[The NFL] did change. But did it end it? Did it cause it to decline? Not really. I think this is kind of going to be similar, in my opinion. [College sports are] going to be different. Do I like the way it is? Do I prefer the way it was? Of course. But we’re going to thrive in the way it is and we’re going to make the best of it. … I'm most pleased with it because it's going to put some certainty back in what we do. Do I like it? Not necessarily. No one likes change. But I see this as a good opportunity for us because our athletic department had great success in this chaotic world that we're in right now with NIL and the (transfer) portal and all that stuff. I think that's a testament to LSU and the brand and how strong it is. I look forward to the future, frankly.” As for payment for the damages in the settlement, Woodward says the funding will come from several areas. “From growth in revenue, and everyone knows what that is. It's TV growth, it's admissions [ticket prices] growth, which we do very carefully. It's growth in our apparel contracts or multimedia rights contracts. And then a big part of this is us continuing to try to keep our expenses relatively sane and run it as efficiently as possible.” (link)

While Arizona’s Pac-12 Tournament victory in baseball marked the final conference competition in the league’s current form, Sportico’s Michael McCann notes the league endures as a defendant in multiple legal proceedings, most notably the House settlement. McCann notes that in addition to Title IX and other details still to be ironed out there actually is not a settlement at the moment. “The deal also hasn’t been negotiated with a players’ union, so the non-statutory labor exemption doesn’t apply and settlement terms are subject to potential antitrust challenge. Likewise, the settlement doesn’t resolve whether college athletes are employees and can unionize, a topic playing at the National Labor Relations Board and, through Johnson v. NCAA, at the U.S. Court of Appeals for the Third Circuit. … The settlement will also have to overcome potential objections and legal challenges by players and dissatisfied member schools. It will need approval by U.S. District Court Judge Claudia Wilken and, if Wilken’s approval is challenged, by the U.S. Court of Appeals for the Ninth Circuit and possibly the U.S. Supreme Court as well. There are many hurdles ahead. While the Pac-12 might not be playing games anymore, its attorneys will be busy at work.” (link)

USA Today’s Dan Wolken adds more context to his recent article opposing private equity’s involvement in college sports: “One thing that has been consistent in talking with some people who sat down with Weatherford and heard their pitch is that the revenue growth they are projecting is fantasyland. For most schools, the big revenue items are more or less locked in for several years. … The big revenue items for the top athletic departments are TV, CFP distribution and the media rights they’ve sold to Learfield. Those are basically set for a while. Ticket sales are more dynamic but how much growth can you generate there? That doesn’t leave much.” (link)

The Athletic’s Mitch Sherman reports the Big Ten has renewed its contract with Omaha to continue hosting the conference baseball tournament at Charles Schwab Field through 2027. (link)

While the Big Ten is on an upward trajectory as a baseball league, The Athletic’s Mitch Sherman observes that built-in obstacles remain, including the RPI. Iowa HC Rick Heller recalls winning two of three games at Nebraska and 2022 yet falling in the RPI. “It’s just stupid.” And Sherman notes that “it’s not changing unless leaders in the sport agree to an overhaul. It must include a later start to the season, Heller said, allowing Big Ten teams to safely schedule home games early in the season and build a base of victories while playing more conference games like the SEC. The SEC has opposed previous pushes by the Big Ten to delay the start of the season. … The imminent entry of USC, UCLA, Oregon and Washington figures to boost the Big Ten baseball profile in the long term. Full scholarships and a new roster limit are possibly on the way. Why not look at a system that evens the access to resources – like warm weather and home games in the first month of the season – largely needed to compete for championships?” Heller’s on board, telling Sherman: “I really believe the rest of the country knows it’s the best thing for the game.” Illinois, which won the regular season title, now has a “touch of concern” about making the NCAA Tournament, and Illini HC Dan Hartleb says: “It’s in the back of all of our minds. I tell our guys throughout the year, don’t leave anything in somebody else’s hands. And the only way you can assure yourselves to get in the tournament is to win and keep winning.” (link)
