SEC Spring Meetings…
+ SEC Commissioner Greg Sankey talked on the Paul Finebaum Show about how far ahead into the future he’s looking and explained: “Some of that is really filed in how you look at things. The easy thing to do is build a timeline of contracts that tie into sports, whether it's college sports and professional sports, and think about what that means for our positioning in the future. … I was asked yesterday about expansion. That really becomes a back burner issue – although the last time I said that like two months later we were expanding – but in all reality I think there's been so much movement and there's so much tension in some other places that we're really focused on the 16.” Sankey also notes that soon after the pandemic he was the longest tenured commissioner in the Power 5, “and I take that responsibility seriously, but I also decline the nod that I’m somehow all powerful because we will solve these issues, and by ‘we’ I mean the presidents have said that to me in the meeting that ‘you know you're the leader you need to solve this’ and I’m like we will solve these issues, there's no just me. … Now I think there is a position of strength here, and I said to the presidents, you know, at times you expect me to be really strong from our perspective, but you also expect me to be a statesman. And if you want me to just demand, demand, demand here I can do that – and some people may accuse me of having done so – but I think there's also in each of the decisions we've made of late an element of compromise from our perspective.” More. + Leaders throughout the conference are still trying to determine how Title IX factors into the House settlement, according to ESPN’s Heather Dinich and Pete Thamel. Texas President Jay Hartzell weighs in: “As I understand it, the law was not written from the standpoint of this particular kind of payment. It's a new thing. What's been explained to us is the judge in the main case has not opined or ruled in a way that gives much direction about how Title IX fits into the settlement. We're having to chart the course we think is best. That's why we're talking so much about it." Meanwhile, Texas A&M AD Trev Alberts believes it shouldn’t be up to each individual school to interpret the law because that would be “wholly unfair in a sense.” He adds: “Like Texas A&M takes a very conservative view, X, Y, Z school takes a very liberal view and suddenly it's disparate. We can't do that. So I think it has to be a consistent application. … You think about proportionality, and you think about in my simple farmer mind, if the same number of female student-athletes are participating as male student-athletes in some form of remuneration for their name, image and likeness, however it gets to me, that's the key. Then should the market then from there dictate or have impact on what that percentage looks like? That would be my orientation, but I guess I could be corrected." More. (link)
+ Several ADs made their way to the Paul Finebaum Show set, including Oklahoma AD Joe Castiglione, who says as the Sooners have gone through the transition, “it really does seem like a natural fit. We have so much in common with virtually all of the institutions, many of which are flagship universities in their own state like we are. A lot of tradition and success and our institutional missions are very, very similar. And the other part that doesn't get talked about is there's a collegiality to work together to find how higher education in its competitive world can play off each other to be more successful in helping grow the economy or whatever it is we're trying to do in our own state. So it's really been special to see all that evolve in kind of an organic way.” Texas AD Chris Del Conte joins and explains one positive that came out of COVID was time to assess the landscape and how quickly things were changing. In that evaluation period, Del Conte says there came a time when “we knew we had to do what was right for Texas and OU. And when we galvanized on those thoughts…it was quick. It was really quick.” Castiglione adds: “The tectonic plates, as they say, were heating up well before then if you watched what was going on in the rest of the country…and, by the way, there were a lot of other conversations that were taking place with a lot of other people that they’ll never admit. Not so much by any one particular conference, but these two universities weren’t the only ones thinking about some type of conference realignment.” (link)
+ Kentucky AD Mitch Barnhart also joined Finebaum and talked about the process of hiring Men’s Basketball HC Mark Pope. Barnhart explains one of the traits he was looking for was an understanding of what the job means to the fans and to the state, and as the captain of the 1996 national championship team, Pope “understood what it meant to play in Rupp Arena and what it meant to our fans and how special the place at Kentucky was. And our fans needed to hear that and needed to feel that again. There's different components to that – you've got to be able to understand the game and have an ability to coach the game and bring a roster together and all those things that come with the job. And he had done that at a place that's very, very difficult in some respects to do that at BYU. And he did a remarkable job in their first year in the Big 12.” Barnhart also acknowledged that after some initial pushback the fanbase rallied and filled Rupp Arena for Pope’s introductory presser: “It was fascinating to watch. I’ve never seen a battleship turn that quickly, and by Friday evening it had changed, and Sunday we had a revival back in Rupp Arena. Michigan State AD Alan Haller discussed the changes in college athletics during a Mackinac Policy Conference conversation with Michigan House Speaker Joe Tate (D-Detroit) and said: “I’m not an advocate of ‘this is the end of college athletics.’ I don’t believe that. I think this is a new era of college athletics. … There is a reset that is going to happen when it comes to a lot of the NIL activity that is happening, that is impacting the coaches ability to recruit, to retain.” More. Freshly minted Arizona State AD Graham Rossini talks with AZ Big Media about a number of topics, including his leadership style. “I like to lead by example. I like for my interest and passion and the things I represent to come through to others. I’m also very big on attention to detail. So, how do we win these little details while focusing on the big moments? And just showing an exhilaration and enthusiasm for the work. There’s a lot coming at us. It’s not easy in college athletics at this point. But it matters to a lot of people. So, we need to be the ones, as an athletics department, to project confidence and enthusiasm and excitement for the aspects of it we do control.” Rossini also acknowledges some have been critical of his hiring: “I get it; I’m not a known commodity. But, as I said, I’ve thought about ASU every day of my life since I was 11 years old. I feel very confident that no one else is as prepared to understand this university, at this moment in time, in this market, with this fan base, than I will be able to. My lived experience as a Sun Devil and somebody who’s been in the Valley for 25-plus years is what I believe gives me a great head start over anybody else who would have been selected for this responsibility.” More from Rossini. On Wednesday, a Dauphin County jury in Harrisburg awarded orthopedic surgeon/former Penn State team physician Dr. Scott Lynch $5.25M in punitive and compensatory damages in his case against Penn State Health's Milton S. Hershey Medical Center and Dr. Kevin Black, the supervisor who announced his removal. Lynch, who filed the suit in August 2019 six months after he was removed from his position, claimed to be retaliated against for complaining about Nittany Lions Football HC James Franklin interfering with medical treatment and return-to-play decisions. Of note, both Penn State and Franklin were dismissed as defendants in 2020 due to the statute of limitations. Lynch hopes the verdict will prompt schools to pay more attention to the issue: “There's not yet been one school punished for violating medical autonomy issues. This is bigger than just Penn State. It's really a national crisis and things have to change.” (link)

From in front of the Law360 paywall: “A West Virginia federal judge will not allow the NCAA to escape the bulk of an antitrust lawsuit filed by a 22-year-old, ruling he sufficiently supported his claims accusing the organization of contract interference when it deemed him ineligible to play basketball after a midseason transfer.” The student-athlete involved is former Manhattan-to-West Virginia-to-Arizona State Men’s Basketball transfer Jose Perez. The Inside Zone’s Matt Fortuna catches up with Southern Utah Football HC DeLane Fitzgerald who received a one-game suspension for, per Fortuna, “seemingly minor tampering violations.” More Fitzgerald: “I made a mistake by not looking up that they weren’t in it (the Transfer Portal). This is my 29th year of college football, my 16th year as a head coach. It’s the first time there’s ever been an investigation of myself or of any of our staff members. I would’ve thought that the negotiation and everything would have been a lot more realistic and reasonable than it was. I got a year’s jail time for a jaywalking ticket, is what it amounts to.” More behind the paywall. (link)

ESPN’s Dave Wilson profiles Texas A&M Baseball HC Jim Schlossnagle’s vision for the program. Schlossnagle: "Traditions are awesome, but traditional thinking is not awesome. We've worked hard to try and find that blend of honoring A&M and everything that it is and its core traditions. But at the same time, we're making our game and our program attractive to a 15-year-old because that's who we're recruiting." One change he’s made has been to invite the Aggie Dance Team to perform at games. "They don't get to dance at football games, which I think is idiotic. That's just old Aggie thinking. ... The first year, with some people you would have thought I changed the school colors to burnt orange." For his part, Aggies AD Trev Alberts is on board with Schlossnagle’s philosophy. "Do you want somebody who cares so much that they're into every single detail to make the program great? Or somebody who doesn't care? We've got a guy leading our baseball program that understands the importance of the details and is a high-level executor. And quite frankly, that's why we've got a top-five baseball team in the country." Schlossnagle explains he’d like TAMU to build a new ballpark twice the size of the current stadium, which opened in 2012. “What Camden Yards did to Major League Baseball, I think Texas A&M should strive to do that for college baseball.” Alberts: "That's why I was attracted to Texas A&M. This is a place where you can dream like that. ... I don't want to have to push coaches. I want coaches who push me and our administrative team and this place is filled with them. ConocoPhillips has agreed to acquire Marathon Oil Corp. in an all-stock deal valued at $17.1B. Under the terms of the agreement, “Marathon Oil stockholders will exchange each share for 0.255 shares of ConocoPhillips, representing a nearly 15% premium based on Marathon Oil’s closing share price on Tuesday,” according to the Wall Street Journal’s Dean Seal and Benoit Morenne, who add the deal “allows ConocoPhillips to expand its presence in several key U.S. shale basins including in Texas and North Dakota.” (link)

Stephen F. Austin has officially accepted an invitation to rejoin the Southland Conference beginning July 1, 2024. Lumberjacks AD Michael McBroom: “We are in a dynamic, new era of college athletics. We need stability, but also bold and strategic thinking to ensure a bright future for SFA. The SLC is a conference on the rise, with visionary leadership and a strategic plan that aligns with our own goals for our athletics program and the university. Florida AD Scott Stricklin comments on the potential of Florida State joining the SEC: “We have a good relationship with our friends in Tallahassee. No school has a veto in this league. If you get three-fourths of league to support expansion, we're going to expand. Anybody who made our league better, we'd be supportive of joining the SEC. Whenever we've expanded in the past, the leadership of the league was able to lay out this is why it makes sense to bring in Arkansas and South Carolina, A&M & Missouri, why Texas & OU make sense. We all saw financial projections, competitive rationale and three-fourths of the league said, ‘Let's do this.' If there were ever opportunities out there - & again no one has had any conversations - that is the scenario where somebody walks in & says 'here's a school, here's what they bring to the table, here's how it makes us all better.' North Texas AD Jared Mosley says the timeline for expanding its athletic center has been changed due to the changing financial realities in college sports. “When you look at the complexities we face, we have adjusted our timeline. We are also exploring if we can do this in a couple of phases. Can we generate enough to start a phase one and do it when construction is going to be cheaper than it will be in 18 months to two years when we could realistically be ready for the whole thing?” Mosley estimates the project, originally set to break ground by the end of 2024, will cost around $40M. “Until we figure out what a revenue share model looks like, and when that’s going to be implemented at our level, it’s really hard to plan. We just don’t have the details yet to start to roll out how we’re going to move forward. … We’re hopeful that we can do this in a couple of phases and hit $10M [in fundraising] in the next year. Once we get there, we have a couple of other pieces we are working on that could move the number fairly quickly. A lot of these gifts will take a year or two, whether it’s a personal donor or a corporate entity. We’re going to keep plugging away and hope to make progress sooner rather than later.” UNT needs to raise $20M for the project and the university will cover the other half. (link)

Montana AD Kent Haslam says the House settlement will cost the Grizzlies roughly $200K in distribution reductions each year and adds: "I couldn't even answer and tell you how it all happened because none of us knows how it happened. We weren't consulted. We weren't asked, and I understand that, I guess. The line in big-time college athletics is clearly drawn. … I will add to that: We've got to get some resolution. We've got to get some direction. We've got to have some federal help. We've got to have things where the student-athletes are declared as students where they're not employees. We've got to get some antitrust safe harbor where we can set some guardrails and some boundaries and if this House settlement leads towards that, then I'm all for that. It's just unfortunate that the pain to get there impacts those who really don't benefit at all from it." Haslam goes on to remark that it’s “worrisome for me that we run faster than we've got strength. And we're in a business where you mix competition and you mix money and you mix egos, and it makes kind of a funny milkshake. And so navigating that already is difficult. So it's worrisome that we start to do things that are out of character, out of what our core mission is, and we lose sight of really what we are, what we represent.” (link)

Miami (FL) will begin settling on plans to expand its indoor practice facility and add a new weight room, according to Hurricanes AD Dan Radakovich. "As we flip over on June 1 to the new fiscal year, it looks like we have the funding available to begin to move forward with the expansion of the Carol Sofer indoor practice facility and a brand new weight room. That was always going to be a part of the entire football development. So we were just looking to see if we're going to do that first, because that's a little bit more player centric and helps with the development of our football team. We're still moving forward and looking at funding opportunities and other items associated with the bigger building, the football operations center. We haven't forgotten about that at all. It's just that this one, the expansion of the indoor, the 100-yards indoor, 100 yards outdoor, plus a new weight room is something we were able to get done a little quicker to be able to give Mario (Cristobal) and his staff and his student athletes a really good spot to continue to train and get better as a program." Radakovich also notes he doesn’t foresee the ACC expanding in the near future. "I think the television contract with the Big Ten, SEC, Big 12 and ACC, have some time to run right now. The big college football playoff expansion television contract is complete at this point in time. So I think that there's going to be, for at least maybe the end of this decade, there will be some peace, if you can say it that way, as it relates to conference expansion. And probably we'll look to come up again as we flip from 2030-31 when some of the other conference TV contracts come forward again." (link)

On3’s Eric Prisbell explores how schools will seek to supplement the revenue-sharing cap established in the House settlement, and Altius Sports Partners COO Tommy Gray posits the “commercial NIL ecosystem is going to be an arms race. Providing athletes with an infrastructure and real tangible dollars that they can count on, on top of the cap, outside of the cap, is going to be very important to remain competitive at the highest levels of sports." As has been oft-reported, the settlement will seek to have an enforcement mechanism to police collectives, but Kennyhertz Perry attorney Mit Winter is among those who are skeptical, telling Prisbell: "The NCAA and conferences think this new enforcement arm structure will be able to stop [collectives]. But I don't see how. It's going to be interesting to see how schools try to circumvent the cap. Because that will definitely happen – whether it's through collectives or some other way." Gray adds: “When there is a cap in place, and if there are more robust enforcement mechanisms in and around synthetic NIL [collective dollars], commercial NIL dollars for athletes are going to be really important. Temple alumni Lou Parisi and Jackie Dansak have launched the Owl Elite Fund to support student-athletes' NIL endeavors. The collective has also signed a one-year deal with strategic marketing firm Innovative New Media to develop monetization strategies. Southern Utah agrees that tampering violations occurred in its football program when HC DeLane Fitzgerald impermissibly contacted two student-athletes from other schools who were not in the transfer portal, according to an agreement released by the Committee on Infractions. As a result of the impermissible recruiting contacts and Fitzgerald's personal involvement in the violations, the parties agreed that Fitzgerald violated head coach responsibility rules. The school also agreed that it failed to monitor its football program. Prescribed penalties include a two-year show-cause for Fitzgerald, a two-week prohibition of all recruiting activities during a permissible 2024 recruiting period, and a two-week off-campus recruiting ban for Fitzgerald, among others. + Kentucky Men’s Basketball HC Mark Pope has officially agreed to a five-year deal worth $27.5M. If Kentucky advances to the Sweet 16, the contract will be automatically extended by an additional season, with $250K added to his salary for each extra year as long as there are no more than five seasons remaining on the contract at that time. Pope will also receive $100K for winning the SEC regular season crown and $50K for winning the SEC Tournament. NCAA Tournament bonuses are non-cumulative and include $50K for making the Sweet 16, $100K for making the Elite Eight, $250K for the Final Four and $500K for winning the national championship. If Pope is terminated without cause before the end of his contract, he will be owed 75% of the remaining compensation on the deal. If Wildcats AD Mitch Barnhart is still on the job, Pope would owe 33% of his remaining contract for leaving without cause. If Barnhart is no longer the university’s athletics director, Pope would owe just 20% of his remaining contract. Wildcats AC Cody Fueger will earn $500K and $525K in his two-year deal, and Assoc. Coach Mark Fox has signed a one-year deal worth $200K. (link)
