Fontenot v. NCAA plaintiffs’ attorney Garrett Broshuis joins the Sports Wise podcast with Tulane Sports Law Director Gabe Feldman and points out that U.S. District Court Judge Claudia Wilken has a duty to scrutinize the House settlement, “and I’m sure she is going to scrutinize the settlement. And nobody has a crystal ball. Nobody knows exactly what's going to happen with this House settlement and if it's going to go through exactly as written or if changes are going to need to be made or if it just doesn't get approval at all. And the other thing is, too, you know as we are starting to litigate our case we're going to be keeping a close eye on that proposed settlement. Obviously, we haven't seen the exact details like everybody else. We’re waiting to see the fine print on this. And so we'll wait to completely judge this settlement until we do see that fine print. We wouldn't be doing our job as attorneys if we didn't take a close look at that proposed settlement to make sure that it was fair for class members, both past and future.” Broshuis does acknowledge that based on what is being reported, “we do have some preliminary concerns about not only about what is being released on the back end – because you're using essentially another case to try to release broader claims – but also what's being reported about the forward-looking aspect of it and the attempt to bind future athletes. In a Q&A with WDRB’s Eric Crawford, Louisville AD Josh Heird says the hardest part of the House settlement is trying to solve equations without knowing multiple variables. “Like, take Title IX, for example. If we have to do a 50-50 split (of payments), from a revenue standpoint, that changes the equation dramatically. So there are a lot of questions, and there’s just not enough concrete information to say, ‘All right, we can take this path now.’ Roster limits are another question. What does that look like, when you start trying to have those conversations on the ideal roster size for 23 sports? And, obviously, we’re essentially adding a $20M expense to every Power 5 athletic budget. And you’re taking away some of the revenue, call it $1M or $1.5M that is going to be deducted from NCAA disbursements every year.” As far as collectives go, Heird says: “I think collectives become more of cherry on top, I kind of term it.” Heird notes the revenue-sharing payments offered to players will likely be similar from school to school, “but then does a collective have the ability to come in and say, hey, we can also provide you a car and a place to live and some different things like that. Maybe classify it more as a fringe benefit opportunity – and I want to be really careful not to compare this to an employment offer, or a job offer.” Heird goes on to posit that the House settlement “provides the first step in an opportunity to provide stability. Standalone, I'm not sure that it does. … To me, it's almost a foundational piece as far as how we move forward. If you took it, this isn't the problem solver. This isn't the answer to all of our questions. But it allows us to begin to answer more of our questions. And if we wouldn't have done this, then we wouldn't have the ability to really move forward at all. I think that's the benefit of it.” More from Heird. (link)

The FCS Oversight Committee has put forth recommendations for two new recruiting models: a three-period signing model and a two-period signing model. The first would increase recruiting person days in the spring contact period from 140 to 168, selected at the discretion of the institution. Additionally, after January 1 of a recruit’s junior year of high school, an institution may engage in up to two recruiting opportunities per contact period. The committee explains its rationale: “An increase to 168 recruiting person days during the spring contact period allows off-campus recruiters additional opportunities to engage in off-campus recruiting opportunities with prospective student-athletes before the June signing period. Further, allowing recruiting opportunities during the spring contact period at the educational institution and any other location provides more opportunities for prospective student-athletes, their family members and off-campus recruiters to evaluate academic and athletic preparedness.” Under the second format, the Monday immediately following the last Saturday in November through December 31 shall be a dead period except for a 14-calendar day contact period beginning the Friday following the early National Letter of Intent Signing Date and a three-calendar day quiet period following that contact period. “The changes to the recruiting opportunities and recruiting calendar are necessary to accommodate the first opportunity to sign a National Letter of Intent in December. Additional recruiting opportunities during the spring contact period at the educational institution and any other location provides more opportunities for prospective student-athletes, their family members and off-campus recruiters to evaluate academic and athletic preparedness.” (link)

The Collective Association has added Purdue’s Boilermaker Alliance, Nebraska’s 1890 Initiative and San Diego State’s MESA Foundation, bringing the organization’s total membership to 40 with an annual combined payroll pushing $250M. The MESA Foundation is one of the first Group of 5 collectives to join, and TCA Executive Director Russell White tells On3’s Pete Nakos: “One thing with the [House] settlement is the role of collectives at the Group of 5 level is now more important than ever. That’s why we’re expanding and inviting them in because most of those schools aren’t going to be able to participate in revenue sharing, at least up to the [$22M] point. And so the way they’re going to attract and retain talent and be competitive is through a strong collective.” White also says TCA will not slow down its lobbying efforts on Capitol Hill and says of the NCAA’s view of collectives: “They’re not giving us the time because just the overall arrogance of the NCAA is they can do whatever they want, and nobody else really matters. In their eyes, it doesn’t matter how many collectives we have. They are singularly focused on trying to get this exemption and protections so that they can continue to run their racket the way they do. They don’t care to discuss things with us.” (link)

The Alamo Bowl’s effort to be able to choose Texas or Oklahoma for its bowl games in 2024 and 2025 has been denied, according to Action Network’s Brett McMurphy, who notes the bowl wanted to be able to select the Sooners or Longhorns as a replacement for a Pac-12 school. “Ultimately, though, that was squashed last week after pushback from Texas and Oklahoma, current SEC bowls and the SEC.” One source tells McMurphy: “Allowing the Alamo to take OU or Texas instead of a Pac-12 legacy team would have caused a lot of issues with the SEC bowls. And we don’t like issues.” (link)

An internal review by Penn State in 2019 found evidence of “friction” between Football HC James Franklin and former team physician Scott Lynch, but it “could not determine whether Franklin violated NCAA bylaws or Big Ten standards by interfering with medical decisions,” according to the AP’s Ralph Russo. The report supports Penn State’s claims that no medical treatments were ever altered under pressure from Franklin or other Penn State coaches and adds that there was “limited demonstrated evidence” that Lynch’s removal was made with a “retaliatory motive.” Lynch tells Russo: “My goal is not to target anybody in particular. My overarching goal is to try to get policies and procedures in place to stop this from happening. So what happens to him is not really my concern. My concern is way above that. Not just at Penn State. I’m hoping that this can be a catalyst so other people come forward now and we can effect change.” (link)

Creighton will rename its men’s basketball practice facility the McDermott Center in honor of MBB HC Greg McDermott and his family. Formerly known as the Championship Center, the $13M facility first opened in 2014 with a lead gift from Bill and Ruth Scott, who recently requested the facility be named after McDermott. McDermott: "I could not be more grateful to the Scotts for their generosity and recognition of our family. Creighton is a special place and home to so many fond memories. Robert Morris has received a $450K gift from alumnus Welling W. Fruehauf to continue supporting the men’s and women’s hockey programs. Fruehauf previously donated $250K to boost the newly reinstated programs. Colonials AD Chris King: "The continued commitment and generosity of Welling Fruehauf is a major reason why the best days of RMU Hockey are ahead of us. Welling's contribution positions RMU Hockey to continue to elevate our programs to recruit the highest caliber students and student-athletes, and this gift/sponsorship will have a direct impact on every student-athlete in our hockey programs.” (link)

Indiana will expand the student section footprint at Memorial Stadium. The Indianapolis Star’s Zach Osterman: “Where in the past overflow kicked students to the other end of the bowl, that section will now sweep all the way across the North End Zone facility, washing one entire end zone in student noise. … Snaking the section all the way around the north end zone also puts students more fully on top of not just the opposing sideline, but also an area of the field that could see key snaps in close games late.” IU will offer season ticket holders displaced by the changes more premium seating options at reduced rates, and Osterman notes the “reseated fans will be placed in more coveted areas of the bowl, many of them with lower sightlines to the field. Some could move as close to midfield as the 30-yard line, and all will receive seatbacks placed on the stadium’s bleachers.” (link)

Paramount Global and Skydance have agreed to terms of a merger, according to CNBC's David Faber, who reports a “deal could be announced in the coming days.” The deal currently calls for National Amusements owner Shari Redstone to receive $2B for National Amusements. Skydance, backed by private equity firms RedBird Capital and KKR, would buy out nearly 50% of class B Paramount shares at $15 apiece, or $4.5B, leaving the holders with equity in the new company. Skydance and RedBird would also contribute $1.5B in cash to Paramount’s balance sheet to help reduce debt. Once the deal is closed, Skydance and RedBird would own two-thirds of Paramount, while class B shareholders would own the remaining third of the company. Overall, the deal is valued at $8B, an increase from the $5B offer previously on the table. (link)

Sports Business Journal’s Ben Portnoy gets more viewpoints from industry leaders on what the House settlement could mean for the future of college athletics. Texas AD Chris Del Conte: “The House settlement [affects] the NCAA and what they do and we’re looking at, ‘what are the ramifications moving forward?’ Because, to me, House is taken care of through [the NCAA]. What does it look like? We don’t know. There’s so many unknowns. It’s one of those things, it’s hard to speculate until the details have been ironed out.” Interesting comment from an unnamed source: “People had a really good excuse during COVID to [cut sports] because you’re $30-$40 million short, and [people] got sued and had to reinstitute programs. I don’t think you’re going to see that. What I think you’re going to see is the amount of food that we were giving to athletes, because they didn’t have money to eat, well, now they do. We’re cutting that. … The student-athlete feel-good stuff that we did for recruiting advantage, yeah, we’re not doing that anymore.” More. (link)

Florida State AD Michael Alford spoke to WESH’s Daren Stoltzfus before yesterday’s NCAA Baseball Regional action in Tallahassee on the Seminoles’ marketplace positioning: “We’ve evaluated this coming. You’ve seen some of the changes we’ve made and some of the questions we’ve asked over the last few years because we saw the collegiate landscape changing. We’re forecasting it continuing to change. So, it’s really about preparing ourselves so we can contend for those national championships, so we can provide the resources necessary to have the best student-athlete experience possible and give them the resources to play for conference and national championships. That’s what Florida State is about, that’s our standard.” Alford goes on to reiterate that his relationship with ACC Commissioner Jim Phillips is “wonderful,” describes the interaction with other league ADs as “very professional.” (link)

More from Washington State interim AD Anne McCoy, including a potential timeline for the hire of a new permanent leader in Pullman: “I think President Schulz has talked about maybe by the fall, having the next steps in place or a decision. I think right now, my focus has been only on being the interim athletic director and not being a candidate for the athletic director position, if that makes sense.” On a number of afternoon football kickoff times for the upcoming season: “That, I think, is going to be absolutely huge. I think (there are) two pieces to that. I think the ability to have as many of our home games times set in advance is really important for our fans to be able to plan and travel and know what to expect. I think the fact that many of them are going to be earlier day games will be really beneficial, because that works in every time zone. And I think it’s, to some degree, people’s vision of a more traditional college football Saturday. I think Friday night games are fun and Saturday evening games are fun. Temple AD Arthur Johnson sat down with AthleticDirectorU’s Tai M. Brown as the pair cover ground on a number of management & leadership topics. Johnson on surprises as a first-time AD: “Unfortunately, in my two-plus years, I’m on my third president. So handling the transition of leadership. The sudden and tragic passing of late president JoAnne Epps, but making sure we kept moving, which is something that she would have wanted having been a Faculty Athletic Rep for 12 years during her time on campus. [...] We had to keep moving. But, it’s a reminder, life is like a river, it keeps flowing. A year ago, Learfield announced the launch of an intercollegiate rodeo division, anchored by the programs at Wyoming, Cal Poly and Montana State. Noting the hit TV series Yellowstone and 1883, Learfield College Rodeo VP/GM Brad Poe: “Rodeo is as popular as ever. There is a romance to this space (and a) lot of elements, culturally, that have increased the popularity of the sport. Our end is driven in a few ways: One is to grow upon and be supportive of our partner institutions, serving our sponsors and schools. We have those relationships, we have all that in place, we have resources at Learfield—a professional sales team—to elevate the sport and increase revenue while providing championship experience.” Most of the deals are structured as their own distinct contract, or as an addendum to an existing Learfield MMR agreement. Montana State and Idaho State, for example, will each get $35K from Learfield next year plus half of any sales above $70K. Sportico’s Daniel Libit adds context, “Montana State is among the few programs that exist under the umbrella of an athletic department. In the fiscal year, the team brought in $965,092 of revenue, while spending a little bit more, $968,262.” To date, Learfield has signed rodeo-specific sales representation agreements with 10 of its existing school partners, in addition to one region, with the hopes of securing another eight to 10 schools by the end of year. The goal, Poe says, is 40 teams, “and then we’ll see what the landscape looks like.” More from Libit. (link)

The Inside Zone’s Matt Fortuna praises the advanced scheduling by Conference USA, noting three of the schools in the league (FIU, Jacksonville State and Sam Houston) have confirmed kick times for all 12 of their football games already, and every school knows at least 10 start times. Comparatively, the 134 FBS schools have an average of 5.28 game times confirmed for the fall. Fortuna: “They might not make Big Ten money in that part of the country. Retiring Coastal Carolina Baseball HC Gary Gilmore sounded off on the current state of college athletics after the Chants were eliminated from the NCAA Tournament by Clemson: “There’s not a level playing field. It’s ridiculous. As much as I’m gonna miss the kids, and I’m gonna miss the heck out of them, dealing with that mess [NIL], I’m telling you right now, the fact that there are teams in college baseball giving $2M+ of NIL money away, I mean c’mon man. A real system would be one where they get a little bit of money, but then they put money in trusts so you don’t have the horror stories you see in the NFL and different places. … There has to be a better way.
