It’s not a given U.S. District Court Judge Claudia Wilken approves the House settlement, according to Sportico’s Michael McCann, who explains one potential obstacle is “whether the settlement would too extensively restructure college sports. As some courts have held, a settlement shouldn’t reshape an entire industry.” McCann cites U.S. District Judge Denny Chin’s 2011 rejection of the “Google Book Settlement” which envisioned Google paying for books it had already scanned and for books it would scan but allowing authors and publishers to opt out of scanning. Chin worried such an arrangement would “give Google a significant advantage over competitors” and “reward” Google “for engaging in wholesale copying of copyrighted works without permission.” Chin also “found problematic that approximately 6,800 individuals (mainly authors and writers) opted out of the agreement, and a comment period yielded hundreds of critical comments about the deal. These were large numbers of naysayers and suggested those who would be governed by a so-called resolution regarded it as problematic.” Furthermore, the Department of Justice called the settlement “an attempt to use the class action mechanism to implement forward-looking business arrangements that go far beyond the dispute before the court in this litigation.” Similarly, McCann believes Wilken will ask how the settlement is supposed to bind DI schools who aren’t named in the complaint, and he notes that “she could further wonder whether attorneys negotiating what is tantamount to a CBA on behalf of college athletes is problematic from a labor law perspective.” More from McCann. The Big Ten and SEC have put their calls for securing the top two College Football Playoff spots along with three AQs on hold, according to CBS’ Dennis Dodd, who observes the “10 FBS conferences plus Notre Dame have seemingly agreed to let this season play out under the 12-team format before making any further decisions about structure for 2026 and beyond. Beyond 2026, virtually everything is on the table including possible expansion of the field to 14 and beyond.” Dodd notes that uncertainty around the House settlement, potential further conference realignment, and the formation of collective bargaining units are among the many factors contributing to the delay. On conference realignment: “Why address CFP structure and format when college football as a whole may not be done with realignment. Florida State's dogged effort to get out of the ACC threatens to trigger the next round of consolidation. FSU's departure would diminish, if not cripple, the league. We've already seen the Pac-12 dissolve.” (link)

More from Louisville AD Josh Heird’s sit-down with WDRB’s Eric Crawford in which Heird says he remains optimistic about UL’s place in the ACC: "I'm bullish on the ACC and you may say, ‘Well, don’t you have to be?’ And yeah, maybe this is born out of necessity a little bit. But I don’t think I’m being naïve. I think the ACC is in a really strong position. And I just continually say, if Louisville can continue to be in the third-best conference in the country, we’re in a really good spot. … I think at times, we, fans, lose sight of where the ACC is really. There's a lot of athletic departments that would pay, I mean handsomely, to be in the ACC. As I always kind of refer to it, we live in a pretty good neighborhood. And I think sometimes we all get used to driving into our neighborhood, right? And then we go to another neighborhood that isn't as nice and we realize, ‘We live in a really nice neighborhood.’ And that's what I don't want us, our fans, other members of the ACC, to forget.” With the fund for House settlement damages being calculated based on NCAA Men’s Basketball Tournament units, Heird acknowledges that he “kind of caught myself getting upset. And all the smaller school Group of 5 teams are complaining about the amount that they're paying, and saying their percentage is not what they think it should be. But it's like, guys, you wouldn't have any of this basketball revenue, if it wasn't for the NCAA Tournament that, for all intents and purposes, is created by all the schools in the Power 5.” Heird adds that he remains focused on looking ahead: “How do we create stability within this industry and stop getting sued six ways to Sunday? The USF Board of Trustees has approved the construction contract with Manhattan Construction Company, moving the Bulls one step closer to building an on-campus football stadium. Board Chair Will Weatherford says USF is targeting October 18 as the break-ground date. According to the term sheet approved by trustees, the builders will receive 2.25% of the cost of construction of the guaranteed maximum price. That figure has yet to be decided. The Bulls have allocated up to $340M for the stadium. (link)

Georgetown has received a $4M gift from alumnus David Welch and his wife, Gretchen, to establish an endowed fund in support of the athletic director's priorities and a current use fund for new initiatives led by Men's Basketball Head Coach Ed Cooley. Sports Illustrated’s Pat Forde contends there are two problems with football coaches pushing back on trimming roster sizes and putting walk-on spots at risk: “It presumes football walk-ons are somehow more special than those in other sports, where they tend to make up a far larger percentage of the actual contributors to a team; and it ignores the numerical reality of football, wherein most walk-ons rarely and barely play. Check the participation numbers.” SEC teams averaged 121 players on the roster in 2023 while playing just 58 per game. Forde: “Point being, coaches aren’t overly interested in having a flotilla of walk-ons who actually impact the depth chart and take playing time—they want the flotilla for practice fodder. They want two sets of live drills going at all times, known as ‘two-spotting.’ That means starters on one field and second-stringers on another, both of them getting reps against the ‘meat squad’ guys who don’t see the field on Saturdays. That’s all well and good in an era of limitless resources. Now? Not so much. Outfitting, feeding and providing medical care to 120 players is expensive, even if scholarships are capped at 85. … The days of operating the way football programs always have are coming to an end. It’s time to stop throwing out half a ham while joining the unfamiliar world of (some) fiscal restraint.” (link)

The ACC has signed an agreement with IC360 that will provide each member institution access to IC360’s integrity monitoring technology and data insights. The agreement also gives each ACC member institution the option to opt in to receive IC360’s educational services and access to its ProhiBet platform. On Location and Blueprint Sports announce a partnership that will allow NIL collectives to monetize the resale of game tickets. Specifically, fans across the country will be able to donate game tickets for resale to their school’s collective to help fund NIL opportunities for student-athletes. The program will kick off with football and basketball, with plans to expand into more sports in the future. On Location EVP of Ticketing Greg Nortman: “NIL collectives play a key role in supporting student-athletes and we are excited to utilize our best-in-class expertise and software to help them generate important new revenue through a seamless, first-of its-kind ticket resale program. A bill that would compel North Carolina and NC State to play other in-state FBS teams routinely in football and basketball passed committee in less than two minutes, per WRAL’s Brian Murphy. Specifically, the bill would require institutions in the state to play at least one of East Carolina, Appalachian State and Charlotte every year in football and men’s and women’s basketball. (link)

Dayton AD Neil Sullivan calls the House settlement the “the most fundamental, transformative change in college sports history. I’m not naive. I recognize that the federal lawsuits and government inquiries have said, ‘The model must radically change and the system we have now is broken. The status quo is not an option.’ I think this settlement is indicative of that.” Sullivan also acknowledges the settlement comes with several question marks: “We’ve not been given yet the formal settlement agreement, the actual document where we can assess all the risks and opportunities. We have enough information to look at the big picture. … It’s one thing to settle on paper or in a mediation room, but it’s another to execute it on campus. Execution is the scoreboard, not the term sheet, not the mediation room. Execution is the responsibility that will make or break us as a business. So I think a lot of details still have to be worked out.” In the meantime, Sullivan asserts that “we cannot take our foot off the gas on anything related to [the] Dayton 6th [collective] yet. I do think it will evolve with revenue sharing and direct payments from schools. I see schools still having agencies and collectives to deal with what was intended to be real NIL in the first place, whether that be car deals, commercials, just what you see in pro sports. You see pro players in markets and their team is paying them obviously, but then they are doing endorsements in the area.” (link)

Is it perfect? No, but there's a lot of good that takes place in the walls of our athletics department. All of us are funding football at a very high level. We're not going to stop investing in football. That will not happen because of the impact it makes on everything else. Dr. Witt was the first one to ever say it, but one of the best investments the University of Alabama ever made was Nick Saban. Michigan AD Warde Manuel talks about hiring a new Football HC and Men’s Basketball HC in the same season and notes that having seen Football HC Sherrone Moore in action made the process a little easier, “but he had to earn the job, and he talked through it and did an excellent job. Dusty [May] was different because it was a search where I didn’t have an internal candidate, and I knew I was going to make it broad. It worked out great because from the initial review he was a person that I wanted to target based on his success at FAU, the things that I've heard about him, having personal friends who have worked with him, and just knowing all of the things that I wanted in the next head coach for men's basketball. Again, every time we talked with him or with somebody about him, it just made it more and more clear that he was a person I was interested in and it worked out.” Manuel says what impressed him most about Moore’s three games as interim HC last season was “how calm he was and what a leader he was of the program – how he took the reins and really took it as a challenge. For what we went through with Jim and the football program, he really accepted it as something that he wanted to lead, and he wasn't reluctant about it, he wasn't scared, he did a great job with the team and the messages. … And then, lastly, Jim was really helpful in really giving me a sense of why he was prepared. Having known Jim since I was 18 and we played together in the football program, I took his advice.” Manuel on managing the unknown moving forward: “I think you just have to keep on thinking and sort of working through the process of what could be and how would we adjust. What are the necessary needs of the department to make the changes that we make? Because all of these changes are sort of flagged out there, you get a sense of where it's going and what it may be, and I think it's just facing that head-on.” (link)

On this latest episode of The Career Hustle, D1.ticker/Connect’s Kristen Eargle sits down with TCU Deputy AD for External Affairs Ryan Peck to discuss his career path, which has included stops at some of the highest levels of fan engagement and revenue growth at multiple institutions. Peck reflects on what was key in fundraising efforts starting at Chattanooga, Denver and North Texas where the Mean Green obtained the best fundraising years while securing the top four gifts in school history. Peck shares how he proved he was ready for leadership and advice from mentors that has become his North Star. At Chattanooga under then-AD Rick Hart, Peck notes: “I asked for more. I would go into his office and pick his brain. We had a staff departure and I went into his office with a plan and said, ‘Maybe I can take over that area.’ I was 22 at the time and overseeing a couple of units. He gave me an opportunity. I made some mistakes and learned a lot from them, and made diligent notes on how to do it better.” Peck talks about his mindset of “Did I get 1% better today” and evaluating opportunities. WMT Digital Founder/CEO Andres Focil: “We started in 2012 as a tech consultancy and evolved into a tech integrator model, and then eventually a digital platform and a tech provider. The goal of the business was to think about ways that we can unlock storytelling through technology. Today platforms are going more modular, flexible and scalable and really shifting from traditional content into much more dynamic storytelling content and we spend a lot of time thinking about like finding product market fit and creating specific use cases for organizations that fit their particular market.” (link)

SBJ’s Austin Karp: “Oklahoma this afternoon lost to Florida in Game 1 of the semifinals, which was OU's first NCAA Tournament loss in 20 games. That sets up a winner-take-all game on Tuesday for college softball's most-popular team. What's on ESPN in prime time Tuesday? A couple of documentary features. One is the premiere of the 30 for 30’ titled I'm Just Here for the Riot, which looks back at June 15, 2011, when the Canucks’ Game 7 Stanley Cup Final loss to the Bruins sparked a massive riot in downtown Vancouver. ESPN also has an E:60 feature on the 1994 NY Rangers' Stanley Cup win. ESPN is waiting to decide the time for that Oklahoma-Florida game Tuesday, holding off until it knows the results of tonight's Texas-Stanford semifinal (another game that should do well in viewership). Game 1 of the WCWS finals is still slated for Wednesday (with little TV competition).” (link)

“College baseball is a sleeping giant” when it comes to pushing ESPN app alerts, ESPN Senior Director for Audience Engagement Nick Loucks tells SBJ’s Austin Karp, adding: “We have so many of the games on ESPN+, so you have to buy ESPN+ to watch the games, which means by definition you have to register with us. And we’ve seen some growth there.” Loucks also notes he’d like to see the app alert data his team is pulling to be part of what the rights acquisition teams are using in talks with properties. (link)

Tepper Sports & Entertainment's $800M Bank of America Stadium renovation plan includes a provision that would keep the Carolina Panthers and Charlotte FC there until 2045. SBJ’s Bret McCormick notes that at least six of Charlotte's 11 City Council members must approve the deal in a vote scheduled for June 24. If approved, renovation work would begin in 2025 and finish by 2029. Specifics of the renovation are still being finalized, but HOK Global Sports + Recreation + Entertainment Director Nate Appleman says substantial portions of the work will be focused on “making the building a modern building again,” with “many of the major systems coming to an end of their useful lifespan.” (link)

FAFSA’s beset rollout may result in a “dramatic enrollment decline this fall, leaving colleges already on the brink of financial failure at the risk of falling over the cliff,” according to Inside Higher Ed’s Charles Ambrose and Michael Nietzel, who assert that already the “FAFSA fiasco has caused hundreds of thousands of students either to not apply to college or face uncertainty about where they can afford to attend. … While estimates vary, tracking by the National College Attainment Network shows that as of May 24, 14.4% fewer high school seniors had completed a FAFSA than at the same time last year. That translates into almost 300K fewer high school graduates completing the form.” According to some industry professionals, this might translate to a 10-20% enrollment decline in the entering class. Oregon State Vice Provost for Enrollment Management Jon Boeckenstedt fears the problem “could be the straw that breaks the camel’s back for some schools,” adding that “it’s not a revelation that small, poorly endowed, tuition-dependent colleges with small regional draws in areas that are saturated with private colleges and declining high school graduates will be most vulnerable.” More, including a list of what institutions facing financial uncertainty can do at this time.
