Big 12 Commissioner Brett Yormark weighs in on private equity’s involvement in college athletics: “Private equity has been out there in the news and people are thinking about it. In some respects, private equity is a validation of where this industry is going and the growth. I don’t look at it as a bad thing. … I’ve said from Day 1, we are open for business. I guess you could say that we are open for business more than ever." Yormark clarifies that he’s not searching for new expansion members. The Big 12 will distribute a record $470M to its schools this year, according to Yormark, who acknowledges there will be "some dilution" of member distribution because of the four-team expansion. SEC Spring Meetings…
+ SEC Commissioner Greg Sankey closed out the SEC Spring Meetings by covering several topics, including the genesis of the joint advisory partnership with the Big Ten: “I picked up the phone on a Saturday night [in January] and called [Big Ten Commissioner] Tony Petitti because I had spent a Monday in Houston in a [College Football Playoff] meeting where we failed to accomplish much, in my opinion. I stayed for the first half of the national championship game, first time I ever left at halftime, you can understand why [the SEC had no team in the final game]. I had an early, early flight the next morning to go to Phoenix. I then spent the better part of two days in NCAA meetings where we accomplished little. We have some really big problems. It didn’t seem like we were solving the medium problems, and we’re not even talking about the really big issues. And I had thought for a long period of time that, if we agree, the two conferences could fulfill a leadership responsibility.” Sankey added that he came to a “realization that you’re not going to solve the big problems in big rooms filled with people. Because the realities are so different across Division I. … There’s times in the job when you’re a bully and times when you try to be a statesman. And I try not to be a bully. But that day was enormously frustrating. … The opportunity was offered for questions, and I decided to just wait and see what people have to say. And nobody said a word. I jumped in and said, ‘You have to be kidding me.’ So I was a jerk. I try not to be a jerk all of the time, or most of the time, but sometimes you have to be a jerk. That informed that January thought [to call Petitti].” (link)
+ Sankey also reiterated his position that March Madness expansion should be considered: "We've allowed Division I to grow. We have conferences solving their membership problem by inviting non-Division I members in, but we haven't modified the bracket size. I think common sense says you have to dig into that. There are competitive issues, there are calendar issues, there are economic issues. But I do think that March can be kept together. That doesn't mean it stays exactly the same. We also have to recognize the differences that do exist within the group that pursue that brass ring of the tournament access opportunity." Texas President Jay Hartzell says the “next move” will be to see a longer form filing of the House settlement. “We'll get to see what their plans are. Not that we'll shape it, but the public will start to learn what's going to happen. It will be interesting to see what the reactions are based on how they plan to spend the money. We'll all be watching that." Oklahoma President Joe Harroz agrees and adds that questions about the settlement are the “whole universe right now. … When you look at it, with the settlement it changes so much. It really is this idea of making sure you're in line with the settlement and that we continue to be the conference that leads the country." Looking to the future, Sankey says SEC leaders are leaving Destin “understanding that we're heading to a new chapter, we're going to have to manage transition, but fully prepared and committed across the board at the athletic director, president and chancellor level to take a leadership role in that change.” Sankey on working with the Big Ten: We're going to have to make independent decisions on a number of key things. We can't solve every problem together, otherwise you reintroduce antitrust concerns. ... We also have to draw people in, so it's not like two votes change the world. Certainly two conferences agreeing on things and in the right sort of way have influence." (link)
+ Georgia President/DI Board of Directors Chair Jere Morehead on the issues still to be ironed out in the House settlement: “One of the questions will be: Do you allocate these funds going forward the way they’re going to allocate them going back the last six years? I will be interested in learning what the plaintiff’s counsel proposes on backward damages as the settlement advances.” Texas President Jay Hartzell adds: “They’re going to come out with their plan first. I think we’ll learn how they think about it. How does the public react? How do the politicians react?” Yahoo’s Ross Dellenger notes that if reports are accurate, roughly $2B of the $2.8B agreed to in the settlement will be set aside for male student-athletes, and Hartzell notes: “That will be interesting to see. It will be a way for us to understand the public reaction.” Morehead says of the possibility that plaintiffs’ attorneys’ fees will exceed $100M: “That is outrageous. Simply outrageous.” As opinions continue to vary on how Title IX applies, headlining Title IX attorney Arthur Bryant asserts that “Title IX is not based on the market. If the market discriminates, the schools cannot.” (link)
+ More from Sankey on private equity’s foray into college sports: “I’ve been interested in some of these league ideas that are generated out of Manhattan, as I see it, never mention academics in their pitch deck. It’s fascinating to me. Never once say anything about a young person’s education. Not a lot of evaluation from who benefits from this participation. About the level of control that’s ceded by public universities to private equity.” While no concrete decisions were made, football coaches around the league were receptive to the idea of issuing injury reports, and Texas HC Steve Sarkisian noted: “I’m a big believer in this: The NFL has figured out a lot of this stuff already. They’ve already had to live through these things that have occurred. So we don’t have to recreate the wheel so much. If I try to game the system and I don’t report a guy (who is injured), fine us. We all like the money that we make. So that’s a really simple way to get us to adhere to the rules.” Meanwhile, South Carolina AD Ray Tanner is optimistic about the possibility of increasing scholarship limits: “When you think about baseball, and it was 11.7 forever, I never thought it would change. There’s now an opportunity now that it will change. And you don’t have to go to 30 or 24 (scholarships). But you get off 11.7. It could enhance the opportunity for student-athletes who play baseball, but other sports as well. This settlement has so many positives, but it’s also very challenging financially. Clemson has filed a motion for partial summary judgment to see who owns the TV rights to Tigers games after the school leaves the ACC. In the latest filing in the ongoing legal dispute between the school and the conference, attorneys for Clemson contend that the “plain, unambiguous language” of the ACC’s TV contracts with ESPN and the GOR make it clear that they’d belong to the school, not the conference. The ACC disagrees. Hundreds of millions of TV dollars and (practically speaking) the Tigers’ attractiveness to other conferences hinge on this interpretation. The Tampa Bay Times’ Matt Baker notes that “Clemson’s argument is nearly impossible to follow in Thursday’s filing because of heavy redactions to protect the confidentiality of the ESPN contract. One paragraph starts with, ‘In the plainest terms possible’ and is followed by 13 blacked-out lines.” Clemson is seeking a hearing on the issue before July 12. (link)

Virginia will pay $9M in total settlements in connection to the 2022 on-campus incident that led to the death of three football student-athletes. Details: $2M to each of the families who lost a son & “$3 million total to the two students who were wounded.” (link)

Missouri Football HC Eli Drinkwitz believes the state’s eight Fortune 500 companies could play a major role in supporting the Tigers’ NIL ambitions: “That’s got to be an asset for us. We need those Fortune 500 companies to look into the investment of the University of Missouri. Obviously, they’re utilizing our graduates, hopefully, in some of the ways that they’re hiring players, hiring students. But now the ask is: ‘Would you look into investing into our athletes for marketing?’ There are some really big brands in St. Louis and Kansas City and Columbia. We could use any possible help.” To that end, freshly minted Tigers AD Laird Veatch has some experience, having recently courted FedEx to support Memphis’ NIL efforts, and MU President Mun Choi remarks: “That’s where he’s going to bring a lot of his strengths. We’re going to be seeking out all those…Fortune 500 companies in Missouri, and then some.” Veatch: “I believe that major corporate NIL support has got to be part of the solution to the future of college athletics. We are in such a time of transition, the way that NIL in particular has evolved. The necessity of (NIL) collectives is very real, but in my mind, you have to find a way to get back to what NIL was originally intended — which was more of a traditional endorsement or sponsorship directly to the student-athletes.” (link)

Draper will be joined by a to-be-named Director of Football this Summer. VP of Women’s Basketball and Competition Dayna Scherf has been promoted to the newly created role of VP of Women’s Basketball. Pac-12 Senior Assoc. Commissioner of Sports Management and Championships Lisa Peterson will take over as VP of Olympic Sports. On the communications side, Assoc. VP for Communications & Special Projects Clark Williams takes over as VP of Communications & Strategy. Additionally, the Media Services department will be rebranded as the Communications department, which Williams will oversee. Arkansas AD Hunter Yurachek covers a bunch of ground with WholeHogSports’ Christina Long. On the House settlement: “It will transform how we operate. It will transform the opportunities for young men and women, both positively and negatively. Student-athletes that are able to participate will have many more benefits that will be great, but there'll be less that will have the ability to participate because the opportunities are going to diminish in some of those areas to pay for those that will be on rosters. [...] It’s going to be inherent on all of us on our campuses to really look hard at where those expenses are. What are the things that are truly fat that we can do without?” What does Yurachek think the future holds for collectives? “Too early to tell, I think, where collectives go from here, and I think a lot of that has to do with what happens with the Title IX application of this. If you follow the spirit of the law and it's 50/50 [between men and women], then there will probably be a need for collectives and all of our campus communities to supplement additionally what football and basketball players may be receiving.” Also of note: “We're not going to increase our debt service model right now. Until we can raise the money to really pay cash for those facilities, we're not going to add more debt to our bottom line until we really figure this out.” (link)

AAC leaders also provide perspectives on the House settlement. Outgoing Commissioner Mike Aresco: “We don't know what we bought. What kind of antitrust protection do you have when there's a cap? Is Congress going to help us? I don't know that they necessarily will. The other issue is that we didn't collectively bargain with anyone, so if someone attacks the cap, can we defend? I hope we can.” Outgoing Tulsa AD Rick Dickson: “It squarely puts the light on the group that's driving the bus at the [Autonomy 4] level, and really, you could probably refer to them as the A2. As a guy that's going out the door in 30 days, that's a lot of the root of what the majority of us are dealing with in conferences like this. It's all being tilted overwhelmingly towards two entities in a way that's hard to argue is a benefit for all.” North Texas AD Jared Mosley: “I do think the one thing that we have to do is draw a line in the sand and continue to fight for access. Having opportunities in the CFP, having opportunities for our teams to compete in March Madness and other championships. As long as we have that, we can figure out within our world that we live in how to best do that and put people in the best possible position to have success.” (link)

Tennessee AD Danny White talks about the continued importance of fans & the fan experience in Knoxville: “They’re more important than ever. The passion of fans is what makes college sports special. The connection to the university and in our case, the state-wide pride is a big deal. Professional sports don’t have that strong community that we’re seeing here. It’s our job to find ways to build an awesome experience for our fans to interact with our teams and coaches in different ways. Ultimately, you have to generate revenue because there has never been a time in the history of college sports where revenue has such an impact.” (link)

TCU AD Jeremiah Donati shoots down reports that the Horned Frogs have inked a deal with Amazon for the ecommerce giant to appear on all TCU jerseys. Per the report: “The deal was spearheaded by the brother of Amazon founder and TCU alumni, Mark Bezos.” (link)

USA Today’s Blake Toppmeyer reads between the lines on SEC Commissioner Greg Sankey’s comments regarding expansion, which were: “We respect that there are agreements and situations that prevent a lot of movement, so our focus has been on our 16, but, I pay attention.” Toppmeyer: “He didn’t say the SEC will stand firm at 16 in perpetuity or that the conference is disinterested in further expansion. That’s notable. If brands the SEC might privately desire become available, I expect the conference to pounce – just as the SEC did with Oklahoma and Texas. […] Houses are divided between Florida and FSU, too. And Clemson and South Carolina. For now, those houses are split between the SEC and ACC. But, what school wouldn’t prefer to be in the SEC (or the Big Ten)? And, if presented with another tempting expansion opportunity, couldn’t the SEC find room for a couple more school pennants on its pinwheel?” (link)

More details on Kansas AD Travis Goff’s new deal, which includes an additional car at his disposal and comes with up to $50K a year in private jet flights for his personal use via a Wheels Up membership. Jayhawks Men’s Basketball HC Bill Self and Football HC Lance Leipold are the only other employees on campus to have the same air travel benefit. The new contract also calls for eight retention bonuses, the first of which, for $100K, is owed to him tomorrow. Additional ticket packages and steeper exit fees are now in the mix. If Goff is fired in either 2025 or 2026 he would be owed $5M. The amount falls to $4M in 2027 and to $2M in 2030. Should he depart on his own, his exit fees follow the same schedule. (link)

According to court documents, on May 22 the Pac-12 reached a settlement with former Pac-12 Networks President Mark Shuken and former CFO Brent Willman who were dismissed in January 2023 for failing to properly report millions of dollars in overpayments by Comcast to the Pac-12 Networks over a 10-year span. The two former staffers, who claim they told former league boss Larry Scott of the issue but were told to keep quiet, brought a wrongful termination lawsuit against the conference in the aftermath of their termination. The original lawsuit described damages “in amounts to be established at trial and believed to be in excess of $2 million.” Binding agreement has not been formalized and a case management conference is scheduled for June 26. New on Connect: UT Arlington AD Jon Fagg sits down with Connect/Fox Sports’ Bryan Fischer to dive into his approach to NIL at UTA while competing in a crowded marketplace. Fagg also talks about how now more than ever it’s beneficial for an AD to have a background in compliance and how he administers compliance education to coaches, staff and student-athletes. Fagg asserts those with compliance backgrounds make the best possible AD candidates and explains: “Development people, they have metrics that can be measured, it's really straightforward to figure out what their impact is. But they make their living saying yes. That’s what they do, they say yes to people for a living. Being an AD is about saying no. You say no for a living. Compliance people, we say no for a living and do it in a manner that makes people want to come back and get another one. … We're very relational even though people often say and think of it as being transactional because it's a rule, it's a yes or no. It’s not yes or no. It’s gray, it's nuanced, and so I love my background. It’s useful. I use it every day, every second. I'm super proud of my background.” (link)

St. John's athletics, in conjunction with the Peter J. Tobin College of Business and the Lesley H. and William L. Collins College of Professional Studies, unveiled a new academic minor entitled Name, Image, and Likeness in Sport. Formerly named Sports Leadership & Branding, the minor was initially launched in January 2021 with the St. John's UNLIMITED program to offer students a core curriculum in NIL, finance, marketing, social media and law. The 15-credit minor is available to both student-athletes and the general student undergrad population. (link)

While the new terms have not been made public, Skydance Media has submitted a “sweetened offer” for a merger with Paramount, per the Wall Street Journal’s Jessica Toonkel and Lauren Thomas. Paramount’s directors are expected to review the new offer, which is “more favorable to both Paramount’s voting and nonvoting shareholders,” shortly. If Paramount’s committee of directors recommends the deal, it will be up to controlling shareholder Shari Redstone to decide if she wants to pursue the merger. Lest we forget the $26B nonbinding offer submitted by PE firm Apollo Global Management and Sony Pictures earlier this month. (link)
