Moats will owe Missouri State $185K for terminating his contract before June 30, 2025, to seek other employment. The Springfield News-Leader’s Wyatt Wheeler outlines what the Bears’ next AD can expect walking in the door: “It will be up to [incoming President Richard ‘Biff’] Williams and his new athletics director to lead Missouri State into a new era of athletics, which will immediately entail the need to upgrade football facilities and keep the athletics department's financials stable when the outgoing administration promised the move to be budget-neutral. A new athletics director will take over a men’s basketball program that recently hired Cuonzo Martin to a five-year guaranteed deal worth nearly $3.2M. Missouri State is entering its second year under football coach Ryan Beard and third under women’s basketball coach Beth Cunningham. The DI-AAA ADA and FCS ADA have collaborated with The Pictor Group to draft a position paper on the distinguishing factors of both subdivisions’ financial models and operational philosophies. The goal is to create specific actionable strategies to help the subdivisions chart a course forward to play a distinctive role and actualize the important value within Division I athletics. The Chronicle of Higher Education’s Nell Gluckman: “Broadly, it seeks to de-professionalize athletics on their campuses, so that sports look more like extracurricular activities and less like jobs. … One piece of the plan is a tool for determining when a coach or athletic department is exerting too much control over athletes. A chart that will be presented to member institutions lists appropriate expectations a coach can impose and inappropriate ones that should be avoided because they verge on something more like an employer-employee relationship.” Another component of the plan involves giving student-athletes more of a voice in governance at the school, conference and NCAA levels. UNC Asheville AD Janet Cone: “The thing that is really driving this model is that student-athlete voice is going to be intimately involved going forward with everything we’re doing.” Kansas City AD Brandon Martin adds: “This is a test of how committed we truly are to the college athletic enterprise. Unfortunately there’s going to be some institutions who won’t be in the game.” The paper was unveiled yesterday at the NACDA Convention. (link)

The Tampa Bay Times’ Matt Baker has obtained a document that shows which ACC schools approved filing a lawsuit against Florida State and which ones didn’t participate. In short, Clemson and North Carolina missed the ACC Board of Directors vote, and Cal, a non-voting incoming member, was also absent. All three were listed as “invited but unable to attend,” according to Baker. Virginia President/Board Chair James Ryan stated in an affidavit that the members “present voted unanimously” to approve the complaint. The affidavit did not elaborate on who was present. Baker goes on to point out that UNC’s absence from the Zoom call has an extenuating circumstance in that it was Interim Chancellor Lee Roberts’ first day on the job. “The Zoom call is a key point in the nine-figure litigation over FSU’s future in the ACC. ACC schools did not vote before the conference sued FSU on Dec. 21 (a day before FSU trustees authorized a suit against the ACC). Instead, ACC members approved the updated complaint on Jan. 12. The conference filed it five days later. FSU has questioned whether the ACC’s after-the-fact vote violated league protocols. Here’s why the debate matters: Who sued whom first is a pivotal factor in determining where the litigation will proceed. FSU and the ACC are both seeking a literal home-court advantage for where their arguments will be heard.” More from Baker. (link)

South Dakota State AD Justin Sell sits down with Sioux Falls Live's Matt Zimmer for the first of a two-part interview in which he discusses the state of Jackrabbits athletics. Sell says winning the FCS national championship has had positive impacts across the board: “You can pick every category — branding, university applications, interest from students and a passion for their school. If you want to talk ticket sales, fundraising, corporate sponsorships and the auction. The new (basketball) arena and creating scarcity impact — people are worried they're not gonna get in and get their tickets, and part of that comes from not being able to get into four (football) games last year. So from all of those measurables it's crazy. We're all trained as mid-major ADs to be men's basketball-centric, at least from a business sense. … But being able to step back and get out of that thinking and understand the value of football — and for us wrestling and women's basketball, too, those four are all revenue drivers for us — but football has been way bigger than I ever thought, and I thought it could be big.” As far as a potential move to FBS, Sell notes it’s a university-wide decision, not just an athletic department or football program decision. “Nobody wants to be asleep at the wheel, so you get kind of pushed into — there's a panic that happens around not wanting to be the last one there. So some of the choices of the last 10 years are people jumping to things where they aren't really sure what they're jumping into. Is (moving to FBS) really the better of two options or the lesser of a bad one? You can't quite tell and everyone is in their own situation and how they're reading the tea leaves.” More. (link)

Learfield will revamp its Compass platform designed to help brands and athletes execute on NIL deals at a higher rate. Student-athletes using the new Compass app will receive access to a list of brands Learfield has worked with over the last three years. As part of the process, local Learfield staffers will help connect athletes with brands who match their individual profiles and interests. The platform will also include a list of outstanding deliverables for all NIL deals an athlete might have signed, and athletes will be able to be paid directly through the system. CEO Cole Gahagan tells SBJ’s Ben Portnoy: “[This] represents Compass’ biggest stage of evolution. Things are moving pretty quickly. More than ever, schools and student-athletes alike are going to be focused on how to create more NIL revenue opportunities, and the faster we can put the Compass platform in the hands of our property sellers, the faster we can accelerate NIL dealmaking.” Portnoy notes brands working with student-athletes through Compass will pay Learfield a 2% fulfillment fee, while individual student-athletes will not pay any fees and school partners won’t be charged software as a service (SaaS) fees. The advent of NIL has enabled car dealerships, which had “long been conduits for the whispered inducements coaches or boosters promised talented players,” to now conduct deals in the daylight, according to The Athletic’s Christopher Kamrani and Brian Hamilton, who observe: “Car dealers nationwide quickly exchanged leases and keys for players boasting about their new ride on social media or even starring in commercials. The scheming, overzealous outsider morphed into the connective tissue for landing a star.” Ricart Automotive Group of Columbus CEO Mike Ricart: “All of a sudden, it was like, ‘What are the rules here?’ There are no rules anymore.” Fred Caldwell Chevrolet GM Martin McKinley, a Clemson alumnus, says he saw Ohio State players posing in front of cars and has since struck a deal with Tigers QB Cade Klubnik. “I just went with the most recognizable person on Clemson campus because it’s always going to be quarterback. Legal Matters…
+ Members of NC State's 1983 men’s basketball national championship team are suing the NCAA, which they claim has "systematically and intentionally misappropriated the Cardiac Pack's publicity rights…without the players' consent and while paying them nothing." According to the News & Observer’s Andrew Carter, the lawsuit is being brought by Stacy Miller of the Miller Law Group. Raleigh attorney Elliot Abrams of Cheshire Parker Schneider firm is also involved. Abrams represented North Carolina’s Tez Walker in his eligibility case last season. (link)
+ Dapper Labs, creator of the NBA Top Shot Moments NFT collection, has settled a class-action lawsuit alleging the company violated securities laws by improperly selling the digital collectibles. The company agreed to pay $4M as part of the settlement and says in a statement: “The settlement in the Friel vs. Dapper Labs case further asserts Dapper Labs’ conviction that NBA Top Shot Moments are not securities under federal law.” (link)

Washington AD Pat Chun caught up with Fox Sports’/D1.ticker’s Bryan Fischer at the opening day of the 2024 NACDA Convention covering a number of items, including getting acclimated in Seattle: “Already having familiarity with some of the staff has been a huge help. Their willingness to give me trust right away. I acknowledge that knowing our athletic department had some whiplash. Three athletic directors, two football coaches, two men’s basketball coaches in an academic year is a lot for any athletic department, let alone a storied one like Washington. For them to be willing to be so trusting of me right away, for them to welcome our family right away, plus the hire of Kurt Svoboda, he fits us in really unique, extraordinary ways.” Chun on key initiatives for the next six months: “It always starts with people. I need to get to know our staff better. I’ve told our team my mindset is that I need to earn the right to be on this team. We can’t do anything unless we have the right people involved. Big West Commissioner Dan Butterly also stopped by the Collegiate Sports Connect at the 2024 NACDA Convention interview set for a conversation with Kristen Eargle. Notably from Butterly on the House settlement: “Part of it is shock on how we got put into the overall settlement. [...] There are 27 conferences who didn’t learn anything about this settlement until early May and this would be our taxation as part of that. [...] Every week that we’ve gotten updates the money continues to increase in terms of what each conference and each institution owes. [...] Now you’re looking at not only the costs of it, but the impact of it.” Butterly goes on to say that potentially cutting sport programs “is going to have to be on the docket. No athletic director, no conference, no institution wants to think about cutting sports or scholarships, but these are real dollars and real world scenarios. Cost of a college education isn’t going down, it continues to go up. If you look at a Cal State or University of California school, tuition costs go up 6% per year. Those are costs athletic departments have to fund. [...] Conferences such as the Big West are already on slim margins on their operating budgets.” More from Butterly on Connect. (link)

Arizona AD Desireé Reed-Francois, incoming Ohio State AD Ross Bjork, Extra Points publisher Matt Brown and Illinois Asst. AD for Strategic Initiatives Kamron Cox participated in a panel discussion on revenue sharing as the 2024 NACDA Convention got underway in Las Vegas. Bjork noted that “if we want to keep 36 sports, it’ll have to be funded differently” as the financial relationship between student-athletes and athletic departments changes. He pointed out that questions still surround roster limits, scholarship limits, and conference-wide sport sponsorship. Further, Bjork said no matter the plan, it’ll be under legal threat and that the House settlement still needs U.S. District Court Judge Claudia Wilken’s approval. Also, conferences or the NCAA need to define third-party involvement, and colleges need experts connecting athletes with NIL opportunities, but he’s not sure that should be handled inside athletics. Reed-Francois believes athletic departments will figure it out, noting everyone figured out how to adapt during COVID. She also emphasized the need for financial education for athletes and said want vs. need will need to be evaluated going forward. No more “this is how we’ve always done it.” Cox emphasized the need for athletic departments to carefully consider the pros and cons of private equity, and Bjork asked: “What are they actually buying? What’s the rate of return? What’s the management inclusion in the process? If we needed money, we’d go to the university and they’d tap into private banking or bond issues.” More from Business of College Sports’ Kristi Dosh. (link)

Former Colorado State AD/new Iowa Deputy AD Joe Parker comments on how the Rams may approach the changing marketplace structure: “I’d imagine they’re going to be able to compete. It’s just going to get harder. But it’ll stabilize. And I think, for everyone, just knowing what the rules of the game were (is) going to be key in building whatever strategy you feel comfortable with. If the settlement is approved and it sticks, it gives everyone a chance to kind of build (within) the model.” Parker also points to the facilities “arms race” as one area of spending that may get impacted: “I think it does (slow down). I think you saw Iowa State had to make a decision relative to a project where they had to put a pause on it. I got the feeling probably 14-16 months ago that once that train had left the station and you’re on this path, where it’s going to be different. I think for me, and for a lot of people, you just want to know what the rules of the game are.” (link)

NCAA Office of the Committee on Infractions Managing Director Matt Mikrut joins Husch Blackwell attorneys Kristina Minor, Jason Montgomery and TaRonda Randall for a webinar titled “Behind the Scenes of the NCAA Committee on Infractions (Divisions I, II & III).” Topics covered include the NCAA infractions process, high-profile DI cases, current trends in infractions, meaningful penalties, exemplary cooperation, and risk mitigation and proactive measures. Recruiting visits were the most frequent Level I and II violations in 2022-23, accounting for 27%, followed by recruiting offers/inducements (26%), impermissible recruiting contact (24%) and the use of an impermissible recruiter (16%). Mikrut explains that sports wagering cases can be difficult to navigate because they involve more “individualized behavior” and don’t always fit into the level structure from an institutional standpoint. Therefore, “some of the conversations that are taking place right now are, given the shared accountability for the conduct, where is it appropriate and how is it appropriate to penalize or address that conduct with involved individual behavior and institutional behavior? So, I look for that to be another evolution over the next year. We’ll probably see a lot of cases – most of those have gone through the negotiated resolution process – but how people in institutions or entities are held accountable for it remains kind of an open discussion.” Lots more in the full webinar. LSU AD Scott Woodward sat down with AthleticDirectorU’s Tai M. Brown to consider the overlapping definitions of “consumer” versus “customer” in college athletics and how the industry creates value for the broader academic mission of an institution. Woodward also discusses the transformational impact of higher education, especially for football student-athletes, his experience working on campus and how it instilled in him a love for academics, and how his philosophy on staff development is centered on the concept of “doing the right thing.” Woodward on emphasizing the value of academics to student-athletes: “It’s nebulous to them because they want it immediately, and they want to see it, but the statistics don't lie. It’s life-changing. It’s generational changing when you get that higher education degree, especially when you're first generation into it. It’s not going to guarantee anything, but it is in the long run going to make your life better [not only] as a person, [but] also better economically. The statistics bear out that you're going to have 70% more money with a bachelor's degree.” On developing staff members to become better leaders, Woodward advises: “Better yourself broadly. Read, write, pay attention to what's going on in the world. Just don't focus on real finite, narrow athletic things. Anyone can get information…but the way you manage and the way you endure and the way you deal with people, that’s so much more important. And staying broad in that sense and staying involved in your mind on other things, to me, is the most important thing you could do.” (link)

Among the long-tail impacts are shifts in strategic thinking around marketing and promotion efforts to both hometown audiences and new demographics across the ACC footprint; reevaluating revenue models; and implementing changes to the premium fan experience. Everett also shares insight into her creative process, how she evaluates career opportunities, and the importance of communication and vulnerability for leaders. Everett explains of Cal’s recent fan demographic study. “We didn’t just study who our fans are, we also studied, ‘Hey, here's what the potential for your fan base is,’ and not just when it comes to selling tickets, but if you're looking for donations, here's the right pool of people that might be interested in that. Accelerate Equity Founder/Executive Director Pamela Seidenman has created the Gender Equity Dashboard using the publicly available data that athletic departments report to the Department of Education. Seidenman explains the dashboard is designed to increase transparency by offering a more user-friendly way to analyze Title IX data. “Are women getting a fair share of spots on teams and athletic scholarships? How does spending on recruiting and overall spending on men’s and women’s sports compare? The Dashboard lets you quickly find the answers for any college. It also explains how Title IX works and what actions anyone can take to help women athletes get the equality they deserve.” Seidenman asserts that this information is now more important than ever as “pressures on athletic budgets due to revenue sharing further threaten women’s sports and the chance to play college sports. … The alternative? Turning our backs on hundreds of thousands of young women and letting 50-plus years of sex discrimination continue unchecked. I’m betting that we have reached the moment when enough sports fans are willing to speak up and insist that colleges treat women athletes fairly.” (link)

Sportico’s Jacob Feldman observes that AI presents a looming challenge for sports properties: “The biggest concern is that these tools will be used to misrepresent athletes or team brands—posting them appearing to support a cause or brand they otherwise wouldn’t, or just outright slandering them via pixels. It’s unlikely we’ll see real-life Shohei Ohtani promoting a sportsbook or [LeBron] James hawking Adidas. With AI however, anything is possible. Then there’s the economic issue of ensuring players are properly compensated for their NIL.” OneTeam Managing Director and Chief Legal Officer Tim Slavin: “We have avoided formal conflict. I don’t know how long that’ll last. There have been some difficult conversations.” At the same time, Slavin says OneTeam has held “a series of presentations” with player associations and others about ways to capitalize on the new technology, and Feldman notes that “rightsholders are looking into building custom, brand-safe models that would give licensees or fans the ability to create new content using player/team marks within defined parameters.” Moving forward, Slavin notes: “This is certainly an area of significant opportunity. We’re excited for the fan and the athlete to have better and more chances to interact. But as we make our way into this space, we know we need to remain vigilant.” (link)
